Request for De-accessioning of Items

Recommendation:

That the list of items to be de-accessioned dated December, 2017 be approved for de-accession from the Archival Collection.

Background:

De-accessioning is an important part of healthy collections management. It allows for analysis and honing of the collection and keeps the collection following the Archives collecting mandate and in conjunction with the collecting plan. Appropriate means of disposition are offering to other institutions, removing to the education/programming department, selling at a third party auction, or destruction. Attached, please find a list of items for de-accessioning. These items are currently in our archival collection and are in good to poor condition. They do not meet our collecting mandate, or have become redundant (updated materials have been donated).

Exhibit Rental and Deposit

Recommendation:

That the rental of “Kids Celebrate”, feature exhibit for the 2019 summer season be approved “and, that the Director, Museum & Cultural Services be authorized to sign the rental contract and process the deposit of $3,750 Canadian dollars to be forwarded to Canadian Museum of History, Gatineau, Quebec in order to secure this exhibit for the 2019 summer season; and, that the full amount of the rental will be included in the 2019 budget.

2019 Summer Exhibit

As part of our ongoing efforts to support operational recommendation #37 and our business plan goals we are continuously researching traveling exhibits that are educational, interesting and supportive of our goals.

Our proactive and long term approach to exhibition planning allows for adequate time for sponsorship, partner and programming development as well as maximizing promotional and marketing opportunities.

Kids Celebrate!

Eyes that sparkle at the sight of a Christmas tree, wooden dreidels spun at Hanukkah, brightly coloured costume parades to the sound of Caribbean music – there are so many ways to enjoy the spirit of various holidays.

The exhibition Kids Celebrate plunges young visitors into the midst of 12 celebrations throughout the seasons in Canada’s many cultural communities. This exhibition is a wonderful opportunity to highlight cultural diversity in Canada, as children learn more about the special occasions that punctuate their daily lives, while giving them a sense of belonging and caring for others.

GENERAL TERMS AND CONDITIONS

1) PURPOSE The Kids Celebrate! exhibition is loaned to the Borrower for the purposes stated in this Agreement only. The Borrower will obtain prior written approval from the CMH for any other use.

2) DEFINITIONS "This Agreement" means this Agreement and any other document(s) referred to in this Agreement as forming part of it.

"Exhibition" means exhibition objects such as artifacts, props, exhibit structures and audio materials, as listed in schedule “A” attached to this Agreement. For the purposes of this agreement, the “Exhibition” is Kids Celebrate!

3) CUSTODY OF THE EXHIBITION The Borrower will have custody of the exhibition from the time it leaves the previous venue until it leaves the Bruce County Museum & Cultural Centre.

4) GENERAL OBLIGATION OF THE BORROWER The exhibition must be shown in its entirety without deletions or additions unless written permission is obtained from the CMH.

The Borrower will be responsible for any damage to, or loss of, the exhibition while in the Borrower's custody.

5) INSURANCE The attached Schedule “A” indicates the values of all insurable components of the exhibition:

a) The Borrower will insure the exhibition for the full value established by the CMH (see Schedule “A”) for the term of the loan under an all-risk, wall-to-wall policy subject to the following standard exclusions: wear and tear, gradual deterioration, insects, vermin, or inherent vice; repairing, restoration, or retouching process; hostile or warlike action, insurrection, rebellion, or acts of the Queen's enemies; and nuclear reaction, nuclear radiation, or radioactive contamination.

b) The Borrower will provide the CMH with an evidence of Licencee’s insurance coverage no later than April 1, 2019 to be sent to the CMH c/o Malcah Sussman, Travelling Exhibitions Coordinator.

c) The CMH may from time to time, at its discretion, review and adjust the value of the exhibition. The adjusted value established by the CMH, upon written notice from the CMH to the Borrower, will be binding upon the Borrower for all purposes of this Agreement. The Borrower will ensure that the insurance policy will reflect the adjusted value of the exhibition.

d) Any inaction by the CMH regarding evidence of insurance coverage will not be interpreted as a waiver of the obligation of the Borrower to insure the exhibition.

e) If the Borrower fails to secure and maintain the insurance coverage, the Borrower will continue to be liable to the CMH in case of loss or damage to the exhibition.

6) PACKING AND TRANSPORTATION a) The CMH will send the exhibition to the Borrower fully packed with an installation manual and a

condition report binder. These manuals contain detailed packing instructions (for structures, audio-visual components, etc.) and information about the condition of the artifacts in the exhibition.

b) The CMH will make transportation arrangements for the incoming and ongoing shipment of the exhibition.

c) The Borrower will comply with any packing or transportation instructions provided by the CMH for the exhibition.

7) PACKING REQUIREMENTS a) The packed artifact crates, upon arrival at each venue, must be left unopened for 24 to 48 hours to

acclimatize to the Borrower’s environment.

b) Prior to repacking the artifact crates, the empty crates, with their lids removed, shall be stored in controlled conditions for at least 48 hours.

c) The exhibition shall be repacked exactly as received, or following the instructions provided by the CMH preparator.

8) STORAGE a) The Borrower will provide appropriate storage inside their facilities for the packing cases and packing

materials provided by the CMH, while the exhibition is in the custody of the Borrower.

b) Storage facilities should comply with standard museum requirements for adequate climate control and security, including insects and pest control.

c) The Borrower will notify the CMH of any arrangements for off-site storage in advance of signing this Agreement.

9) CARE AND PROTECTION a) To ensure protection against theft, loss, or damage to the exhibition, unless otherwise agreed in writing

by both parties, the Borrower will:

i) provide supervision in any exhibition area with a security guard or guide during opening hours or when the exhibition is open to employees, specials guests, events or special groups;

ii) provide guards or an electronic alarm system to protect the exhibition when it is not under such supervision as described in article 9 a) i) of this Agreement;

iii) monitor the exhibition area electronically or tour it regularly; iv) provide supervision during the loading and unloading, as well as for the full duration of the

installation and dismantling periods. v) a minimum of 1 trained animator/tour guide must be on site during public hours to enhance the

visitors’ experience, as well as to ensure proper handling of props & hands-on material in the exhibition. During peak visitor attendance hours, a minimum of 2 trained animators/tour guides must be on site. At all times, the Borrower is responsible for props and exhibition structures maintenance.

b) The exhibit area, and any other areas where the exhibition is housed, will be air-conditioned to a temperature of 21 to 24 degrees centigrade (70 to 75 degrees Fahrenheit). Temperature changes must be avoided. The relative humidity should be maintained between a maximum summer relative humidity of 50% and a minimum winter relative humidity of 43% with a daily fluctuation of no more than 3% and a monthly maximum fluctuation of 5%. The exhibition must be, at all times, protected from harmful exposure to, or contact with:

i) direct heat;

ii) direct sunlight or other sources of ultra-violet radiation; iii) any liquids or noxious substances; iv) dust, dirt, or polluted air having a high sulphide content; v) any shocks or jolts; vi) any wood-boring or fur-eating insects or fungus infestations; vii) food, drink, or other organic material potentially attractive to vermin.

c) The artifacts and other sensitive exhibition materials must be removed from any room in which painting, fumigation, or spraying is in progress.

d) The artifacts must not be subjected to any form of cleaning, polishing, fumigating, or protective coating, nor to any marking, treatment, or modification without prior written permission from the CMH unless specific instructions are included in this Agreement.

e) No work of art may be unframed, cleaned, repaired, transported in a damaged condition, nor may its hanging device be changed, without the express permission of the CMH. Any such approved work must be negotiated and approved in advance by a designate of the Conservation Division of the CMH.

f) All artifacts and sensitive exhibition materials must be handled by experienced personnel only.

g) More specific care and protection measures may be required for specific artifacts and/or exhibition components and will be provided in the installation manual.

10) CONDITION REPORT a) The Borrower will report to the CMH in writing, within seventy-two (72) hours of receiving the exhibition,

as to the condition of the contents, such as artifacts and art works. The Borrower will also report on the condition of exhibit display cases, audio-visual material, packing material and crates, after the full exhibition contents have been unpacked. The Borrower will report any discrepancy between the material listed and the material received. Please note that condition reporting of all the components must also be done at the dismantling of the exhibition. Both reports must be sent to CMH c/o Malcah Sussman, Travelling Exhibitions Coordinator.

b) The Borrower will notify the CMH immediately of loss, theft or damage to the exhibition while it is in the custody of the Borrower, and will submit a full written report to the CMH within forty-eight (48) hours of the discovery of the loss, theft or damage. The report will detail the incident which caused the loss, theft or damage (form is included in the Condition Report binder); the extent of the damage; and the steps taken to mitigate loss and prevent the recurrence of similar incidents.

c) If no such report is received by the CMH it will be assumed that the exhibition was received by the Borrower in the same condition as was sent by the CMH.

11) COPYRIGHT a) The CMH will ensure that owners of copyright to artifacts and other exhibition materials are paid the

appropriate fees.

b) Should the Borrower add anything to the exhibition, subject to the approval of CMH, the Borrower shall be responsible for copyright clearance and payment of all appropriate fees. The CMH reserves the right to request proof of suitable copyright clearance and fee payment.

c) For the production of promotional material, the Borrower agrees to use the images provided by the CMH.

12) DOCUMENTATION a) The CMH will provide the Borrower with an installation manual including information on the exhibition

(sample floor plan, installation instructions, crates list etc.) and education material.

b) The CMH will provide a Media Kit in electronic format (photos, press release template, logos and graphic files) for the Borrower’s use.

c) The CMH will provide Condition Report binder to the Borrower to report on the condition of the artifacts included in the exhibition.

d) The Borrower will submit a floor plan to CMH that will detail the layout of the exhibition no later than April 1, 2019. This floor plan will be reviewed by CMH preparators in collaboration with the Borrower to confirm the final layout. Floorplan to be sent to CMH c/o Malcah Sussman, Travelling Exhibitions Coordinator.

13) REPRODUCTION RIGHTS AND RESTRICTIONS a) Except as specifically provided in this Agreement, the Borrower will not make any reproduction, cast,

or copy of any kind, or scientific examination or photograph (other than for the purpose of a condition report or documentary record) of exhibition artifacts without the prior written consent of the CMH.

b) The Borrower retains the right to reproduce installation shots of the exhibition or portions of the exhibition in promotional material, publications or educational programs related to the presentation of the exhibition on the Borrower's premises. The Borrower may not cede this right to any third party without the CMH prior written permission. The same applies to all photographic or electronic reproductions. Should specific works in the exhibition be subject to copyright restrictions, these will be negotiated /approved by the CMH.

14) WITHDRAWAL AND RETURN OF OBJECTS The CMH reserves the right to withdraw any artifacts or other exhibition material and structures from the Borrower, if, in the opinion of the CMH:

a) the Borrower has been negligent in the care of a part of the exhibition;

b) the Borrower has not fulfilled any of the terms of this Agreement;

c) the Borrower has exposed the exhibition to an unreasonable risk of harm.

15) CREDITS a) The Borrower must give full credit to the Canadian Museum of History as the producer of the exhibition,

in all publicity, promotional products, related activities and programming as follows:

English: A travelling exhibition developed by the Canadian Museum of History.

French: Une exposition itinérante réalisée par le Musée canadien de l’histoire.

b) The CMH and the Canada Federal logos must be included on all publicity and promotional materials produced by the Borrower. The CMH to supply all logos which are not be altered or modified in any way by the Borrower. The Borrower must use the bilingual media kit provided by the CMH.

16) PROMOTION a) The Borrower must give full credit to the CMH and the federal government of Canada as stipulated

above, in all acknowledgements, press releases, media events, invitations, posters, publications, banners, title and credit panels, backgrounder, calendar of events, weekly on-site information sheets, on-site information outlets, tourism information sites, signage and other material relating to the exhibition. The Borrower agrees to send publicity materials to CMH for approval c/o (Malcah Sussman, Travelling Exhibitions Coordinator. The CMH agrees to respond within no more than 2 working days.

b) The Borrower agrees to send to the CMH a complete summary report within 30 days of the closing of the exhibition. The report will include an evaluation questionnaire, attendance figures, copies of press clippings, sample poster and invitation cards, exhibition reviews, exhibition photos, and other pertinent information collected as a result of the display of the exhibition at the Borrower's premises. The evaluation questionnaire will be provided by CMH and should be returned to CMH c/o Malcah Sussman, Travelling Exhibitions Coordinator.

17) MEDIA RELATIONS CAMPAIGN The Borrower may undertake a media relations campaign in advance of and including the opening of the exhibition. CMH representatives will be invited to participate in any planned media preview. Each representative will be invited to speak at the media preview.

18) OPENING a) The Borrower agrees to confirm with the CMH at least 6 weeks prior, whether an opening event will

take place at the hosting institution.

b) The Borrower agrees to collaborate with CMH on the opening event. The Borrower agrees to invite the members of the Board of Trustees and Executive Committee of the CMH as well as invitees identified by CMH. All related travel costs will be covered by CMH respectively, if applicable.

19) SPONSOR & CONTRA SUPPORT The Borrower may seek contra and/or cash support for the exhibition from media partners and local sponsors provided their contribution is recognised as secondary to that of the exhibition producers. The CMH reserve the right to pre-approve or refuse the participation and the positioning (e.g. crediting) of any other sponsors associated with the exhibition and related programming.

20) ADMISSION FEE The Borrower, at its own discretion, may charge a special admission fee for the exhibition.

21) TRANSFERENCE OF LOAN The Borrower will not transfer or loan any part of the exhibition to any other person or institution without the prior written permission of the CMH.

22) RETURN OF THE EXHIBITION The Borrower will pack the exhibition promptly after their closing date, with the assistance of CMH experienced staff, and ship it as directed by the CMH. Any costs arising from delays caused by the Borrower will be charged to the Borrower.

23) EXTENSION OF LOAN The CMH may grant an extension to the Loan of the exhibition, subject to certain changes to the terms and conditions set forth in the Agreement. The request for extension of the Loan must be provided to the CMH in writing sixty (60) days before the end of the Loan period.

24) OTHER RELATED COSTS a) The Borrower will assume all costs related to the presentation of the exhibition on its premises, such

as loading/unloading, promotion, unpacking, storage, condition reporting, security, lighting, training, installing/dismantling, repacking and making sure that all exhibition components are loaded for shipment to the next venue.

b) The Borrower will pay an exhibition rental fee of $15,000 plus applicable taxes, 25% ($3,750) upon signature of this contract and the remaining 75% ($11,250) payable within 30 days after the opening of the exhibition on it premises. CMH will forward both invoices.

c) The Borrower will need to have on site a pump-lift and some dollies to facilitate crate handling. A forklift is required for unloading/loading of stacked crates.

d) The Borrower will need to have one experienced exhibition curator for a maximum of 2 days to condition report the artifacts & the exhibition prior to installation and 2 days during dismantling the exhibition.

e) CMH will send one (1) preparator to assist in the installation for a period up to 5 working days and for the dismantling of the exhibition for a period up to 4 working days. Borrower to provide two (2) experienced exhibit preparator to help for the duration of the installation & the dismantling.

f) The Borrower will pay for full insurance coverage on the total value of $158,000 for the duration of the Loan period, and will provide the CMH with evidence of Licencee’s insurance coverage no later than April 1, 2019.

g) The CMH will not be responsible for expenses incurred by the Borrower in fulfilling the terms of this Agreement.

25) DAMAGES AND BREACH OF AGREEMENT

Borrower may cancel exhibition and terminate this agreement without cause by giving CMH written notice of such termination. In the event of such a cancellation, the Borrower will be required to pay the applicable Cancellation Fee.

B. Venue Substitution

If Lender can secure a substitute venue acceptable to CMH, in its sole discretion, and under terms similar to those set forth herein, this cancellation fee shall be waived, and all Rental Fee payments made by Borrower shall be refunded. The Borrower will be responsible for any shipping, storage, or other expenses resulting from the Exhibitor’s cancellation of this contract.

26) INDEMNITY

The Borrower will, at all times, indemnify and save harmless Her Majesty and the CMH from and against all claims, demands, losses, damages, costs, actions, and other proceedings made, sustained, brought, or prosecuted by any person in any manner based upon, occasioned by, or attributable to the loan of the exhibition under this Agreement.

27) INTERPRETATION a) This Agreement and its attachments constitute the entire understanding between the Organiser and

the Borrower with respect to the exhibition and is binding upon the parties and upon their respective successors. This Agreement supersedes and replaces any previous documents, correspondence, conversation and other written or oral understanding related to this Agreement.

b) This Agreement may not be amended or modified except by means of a written document, signed by both parties, and no waiver of the terms hereof shall be in effect unless in writing and signed by the party making such waiver.

28) LANGUAGE OF THIS AGREEMENT This Agreement will be drawn up in English or in French, depending on the language requested by all parties hereto.

29) GOVERNING LAW Unless otherwise specified, this Agreement shall be governed by and construed in accordance with the law of the province of Québec.

30) MEMBERS OF THE HOUSE OF COMMONS No member of the House of Commons will be admitted to any share or any part of this Agreement or to any benefit arising from it.

31) BINDING EFFECT This Agreement is binding upon the parties and upon their respective successors and assigns.

Recommendation:

That the revised Facility Rentals Policy/Serving & Consumption of Alcohol Procedure for the Bruce County Museum & Cultural Centre be approved.

Background:

The Museum is governed by standards outlined by the Ministry of Tourism, Culture and Sport. The 10 standards for community museums represent the minimum requirements for the operation of a good community museum and are necessary in order to qualify for the CMOG (Community Museum Operating Grant).

While this particular policy and procedure are not part of the CMOG standards they are necessary in order to guide our practice for the visitor experience. As part of our ongoing efforts to ensure our policies are relevant and up to date, all policies will be reviewed and updated if necessary on a three-year cycle.

Policy: Facility Rentals Policy

1. Coverage

All Bruce County Museum & Cultural Centre (BCM&CC) employees, volunteers, BCM&CCmembers and anyone entering the Facility.

2. Policy Statement

This policy shall be known as the “Facility Rentals Policy”. The purpose of the FacilityRentals Policy is to establish procedures and authorization for use of the BCM&CC facilitiesby individuals or groups and to preserve the facility for future use.

3. Procedure

The Museum reserves the right to refuse or cancel rentals on the basis of availability,safety or inappropriateness of the proposed event as it pertains to the Museum’s overallMission and/or Core Values.

Use Regulations

The BCM&CC is foremost a Museum & Cultural Centre, and all policies are guided by theneed to ensure the safety of our collection, exhibits, care for the building itself, andmaintain the reputation of the Museum. Therefore, the Museum’s facilities will be madeavailable on a case-by-case basis.

Types of Events The Museum may be used for a variety of events such as presentations, lectures, theatre productions, concerts, receptions, dinners, meetings, funeral/memorial services, small wedding receptions and other corporate and special events.

Confirmation / Cancellations / Payments

Rental Agreement (see attached)

The Renter is responsible for the conduct and supervision of all persons admitted to the facility and is responsible for ensuring the agreement and policy is observed.

A Rental Agreement is required for any large events, theatre and/or wedding rental.

Upon confirmation of facility rental, a Rental Agreement must be signed, dated and returned to Museum Staff at the time of making deposit.

Approval

Each Facility Rental event will be reviewed on an individual basis for classification and acceptance.

Any Facility Rental inquiries deemed “high risk” will be reviewed by the Business Manager and/or the Director. The applicant will be advised of the reasons for the decision.

Confirmation

For large events, theatre and/or wedding rentals a signed Facilities Rental Agreement and a deposit will be required at least sixty (60) days in advance to secure the venue. The Deposit is a non-refundable deposit equal to fifty percent (50%) of the room(s) rental fee and will be deducted from the Renter’s final invoice.

A booking is confirmed upon receipt of both agreement and deposit.

Damage/Cleaning Deposit

Damage/Cleaning Deposits may apply to certain events.

At the Museum’s discretion a refundable Damage/Cleaning Deposit in the amount of $300.00 may be requested and is required a minimum of fourteen (14) days prior to the event or the date will be released. This deposit will be returned to the Renter after it has been determined that no damage has been incurred by the BCM&CC.

In regards to large events, theatre and/or weddings rentals written cancellation is required by the Renter within sixty (60) days or the non-refundable deposit of fifty percent (50%) of the room(s) rental fee will be forfeit. The Damage/Cleaning Deposit will be returned to the Renter with no penalty.

All other events will require written cancellation by the Renter within fourteen (14) days prior to the event otherwise the Renter will forfeiture the entire deposit.

Payments may be made by cash, cheque, VISA or MasterCard.

Arrangements

Setup

Previously discussed basic room setup such as tables, chairs, A/V and bar (if requested) will be organized and completed by the BCM&CC staff as per the Facility Rental Booking.

Any further setup requirements must be discussed a minimum of fourteen (14) days in advance with Museum Staff and the Maintenance Department. A meeting is required in advance to discuss layout, special requirements, lighting, electrical needs, caterer needs, etc.

Additional costs may be applied for staff time in the event of special requests during event set-up and/or tear down.

Any additional equipment brought into the facility by the Renter must be removed immediately following the rental unless arrangements have been previously made with Museum Staff.

Access Times

Access for an event will begin at the reserved time as stated in the Facility Rental Agreement. Entry will not be permitted prior to this time. All use of the facilities shall terminate and facilities be vacated no later than the time and dates stated as per the agreement. In the event all persons are not vacated at such time, an additional hourly fee will apply as per the fee schedule.

Renters will be permitted to setup for weddings and other events one (1) day prior to the event date pending room availability. If Renters would like to ensure availability the room must be booked in advance.

Arrangements will be made in advance for Renters to be permitted to return the morning following their event to complete removal of any decorations or supplies however, anything deemed of value to the Renter must be removed from the premises at the time of event completion. The BCM&CC will not be held responsible for any items that have not been removed from the premises at the time of event completion.

Parking

BCM&CC has ample free parking, but does not guarantee or reserve parking spaces of Renters and/or their guest and patrons. Parking is not available at G.C. Huston Public School located next to the Museum unless prior arrangements have been made with the Bluewater District School Board. If such arrangements have been made the BCM&CC should be notified.

Decorations

All plans for décor are subject to approval and are limited to the designated event spaces. Nothing may be affixed to any interior or exterior surface of the Museum.

** As per the Ontario Fire Code no candles, sparklers or open flames are permitted.

No confetti, rice, glitter, loose petals, bales of straw/haw or live animals are permitted. All rented equipment, decorations and flowers must be removed from the premises within one hour after the end of the event.

Marketing

Renters hosting events at the Museum which are open to the public may have their event posted on the Community Events page of the Museum’s website and are encouraged to provide event details to Visitor Services for coordinating the posting of that information.

The Renter is not to promote their event as a Museum sponsored event.

Safety and Security

Conduct

The Renter shall conduct the event in an orderly manner in full compliance with all applicable laws, ordinances, and regulations, and in accordance with all policies and procedures established by the Museum. The Museum reserves the right to terminate any event at any time due to inappropriate or undesirable behavior by the Renter or Renter’s guests as determined by the Museum staff. Such termination will result in the forfeiture of all monies paid to the Museum by the Renter. A final invoice will still be issued to the Renter with any additional costs that were not covered in the deposit.

Capacity

The maximum number of people allowed in the BCM&CC rental facilities will be determined and discussed with the Renter prior to an event, taking into account building integrity, and applicable fire, safety and liquor control legislations. The Renter is responsible for ensuring that this number is not exceeded.

Staffing

The BCM&CC reserves the right to designate additional staff to attend any function to ensure that all regulations are being observed and respected. This will be an additional charge to the Renter on the final invoice as per the fee schedule.

Security

If it is deemed necessary, Security will be contracted by the BCM&CC at the Renters expense. Any costs incurred will be included on the Renters final invoice.

All “High Risk” facility rentals will have Security Personnel on the premises for the full duration of the event. Security Personnel will be required to have a valid Ontario Security Guard License and it must be available to view upon request

In the event a person becomes intoxicated or is acting dangerously, Security will carefully and politely deal with that person and if necessary seek outside assistance from the Police.

Safety

All halls, aisles and exits are to be kept completely unobstructed in keeping with the Fire Regulations.

Security of Personal Property

Rental equipment and any other items brought onto the site for the event is the responsibility of the Renter. The BCM&CC assumes no responsibility for items left on the premises by the Renter.

Smoking

In compliance with the Smoke Free Ontario Act, smoking is not permitted inside the Museum building.

Hospitality

Catering The Museum does have a certified kitchen therefore food may be prepared on site. All food coming onto the premises is presumed to be supplied by a reputable caterer with a licensed kitchen. The Renter may provide wedding and birthday cakes. A list of caterer’s will be provided by the BCM&CC upon request from the Renter. The Renter is to ensure that the Caterer is responsible for the bussing and cleanup during and/or after an event. BCM&CC Facility Staff will not be responsible for bussing and cleanup unless arranged in advanced and additional charges discussed. If Caterers fail to comply, an additional fee for clean-up will be the responsibility of the Renter and will be included on the final invoice.

Any equipment or serving dishes brought into the Facility must be picked up by the Caterer within 24 hours.

Alcohol

The Museum retains a liquor license and must provide any liquor, beer and/or wine used at any function held at the Museum. A Renter or guest may never furnish his or her own alcohol. Any ‘in-kind’ donation of alcohol is also not permitted.

All servers in Ontario must be trained and certified by a recognized alcohol server training course i.e. Smart Serve or S.I.P (Server Intervention Program prior to May 1995). All servers will be hired by the BCM&CC and will abide by the certified training courses guidelines as well as the Serving & Consumption of Alcohol Procedure enforced by the BCM&CC.

Refer to the Serving & Consumption of Alcohol Policy.

Entertainment

The Renter is responsible for all music licensing fees pertaining to live or recorded music (SOCAN/ReSound). These fees will be invoiced directly to the Renter on the final invoice.

Subcontracted bands or DJ’s are required to contact the BCM&CC Staff at least two (2) weeks prior to the event to consult on set-up guidelines within the Museum. All entertainment is subject to approval by the Museum.

Review of Policy and Procedures:

This policy will be reviewed every three years by Management or when deemed necessary for amendments. Policy changes must be approved by the BCM&CC’s governing body, Bruce County Council.

BCM&CC has ample free parking, but does not guarantee or reserve parking spaces of Renters and/or their guest and patrons. Parking is not available at G.C. Huston Public School located next to the Museum unless prior arrangements have been made with the Bluewater District School Board. If such arrangements have been made the BCM&CC should be notified.

3.4 Decorations

All plans for décor are subject to approval and are limited to the designated event spaces. Nothing may be affixed to any interior or exterior surface of the Museum.

** As per the Ontario Fire Code no candles, sparklers or open flames are permitted.

No confetti, rice, glitter, loose petals, bales of straw/haw or live animals are permitted. All rented equipment, decorations and flowers must be removed from the premises within one hour after the end of the event.

3.5 Marketing

Renters hosting events at the Museum which are open to the public may have their event posted on the Community Events page of the Museum’s website and are encouraged to provide event details to Visitor Services for coordinating the posting of that information.

The Renter is not to promote their event as a Museum sponsored event.

4.0 Safety and Security

4.1 Conduct

The Renter shall conduct the event in an orderly manner in full compliance with all applicable laws, ordinances, and regulations, and in accordance with all policies and procedures established by the Museum. The Museum reserves the right to terminate any event at any time due to inappropriate or undesirable behavior by the Renter or Renter’s guests as determined by the Museum staff. Such termination will result in the forfeiture of all monies paid to the Museum by the Renter. A final invoice will still be issued to the Renter with any additional costs that were not covered in the deposit.

4.2 Capacity

The maximum number of people allowed in the BCM&CC rental facilities will be determined and discussed with the Renter prior to an event, taking into account building integrity, and applicable fire, safety and liquor control legislations. The Renter is responsible for ensuring that this number is not exceeded.

4.3 Staffing

The BCM&CC reserves the right to designate additional staff to attend any function to ensure that all regulations are being observed and respected. This will be an additional charge to the Renter on the final invoice as per the fee schedule.

4.4 Security

If it is deemed necessary, Security will be contracted by the BCM&CC at the Renters expense. Any costs incurred will be included on the Renters final invoice.

All “High Risk” facility rentals will have Security Personnel on the premises for the full duration of the event. Security Personnel will be required to have a valid Ontario Security Guard License and it must be available to view upon request.

In the event a person becomes intoxicated or is acting dangerously, Security will carefully and politely deal with that person and if necessary seek outside assistance from the Police.

4.5 Safety

All halls, aisles and exits are to be kept completely unobstructed in keeping with the Fire Regulations.

4.6 Security of Personal Property

Rental equipment and any other items brought onto the site for the event is the responsibility of the Renter. The BCM&CC assumes no responsibility for items left on the premises by the Renter.

4.7 Smoking

In compliance with the Smoke Free Ontario Act, smoking is not permitted inside the Museum building.

5.0 Hospitality 5.1 Catering The Museum does have a certified kitchen therefore food may be prepared on site. All food coming onto the premises is presumed to be supplied by a reputable caterer with a licensed kitchen. The Renter may provide wedding and birthday cakes. A list of caterer’s will be provided by the BCM&CC upon request from the Renter.

The Renter is to ensure that the Caterer is responsible for the bussing and cleanup during and/or after an event. BCM&CC Facility Staff will not be responsible for bussing and cleanup unless arranged in advanced and additional charges discussed. If Caterers fail to comply, an additional fee for clean-up will be the responsibility of the Renter and will be included on the final invoice. Any equipment or serving dishes brought into the Facility must be picked up by the Caterer within 24 hours. Catering Company: Requirements:

5.2 Alcohol The Museum retains a liquor license and must provide any liquor, beer and/or wine used at any function held at the Museum. A Renter or guest may never furnish his or her own alcohol. Any ‘in-kind’ donation of alcohol is also not permitted.

All servers in Ontario must be trained and certified by a recognized alcohol server training course i.e. Smart Serve or S.I.P (Server Intervention Program prior to May 1995). All servers will be hired by the BCM&CC and will abide by the certified training courses guidelines as well as the Serving & Consumption of Alcohol Procedure enforced by the BCM&CC.

Policy: Serving & Consumption of Alcohol Procedure

1. Coverage

All Bruce County Museum & Cultural Centre (BCM&CC) regular full-time, regular part-time, temporary/seasonal, contract employees, volunteers and security personal.Exemptions will not be tolerated.

2. Procedure Statement

The Bruce County Museum & Cultural Centre (BCM&CC) is dedicated to ensuring safe andpositive experiences for our visitors, guests and clients. The Serving and Consumption ofAlcohol Procedure provides the legal procedures pertaining to this service for the purpose ofreducing alcohol related problems during functions where liquor is available forconsumption. It also provides procedures for the provision of a safe and healthy environmentfor our servers and our clients and protects them from any dangers of intoxication, includingbodily harm and property damage.

This Serving and Consumption of Alcohol Procedure will be a reference for scope ofresponsibilities and course of action.

3. Procedure

Inspections of Facility:

• Access will be allowed to police officers or AGCO inspectors in the course of their dutiesor after hours of operation and will be given unobstructed access to the facility.

• Compliance to evacuate the premises will occur if required.

• Capacity limits and permitted locations will be strictly followed as outlined in the Liquor Sales License establishment number 812567.

• Alcohol use is prohibited in all other areas, within and outside the facility.

High Risk Security Events:

• All agreements deemed “high risk” will be reviewed by the Business Manager and/or the Director. The applicant will be advised of the reasons for the decision.

• Examples of facility rental events that may be classified as “High Risk” include, but not limited to, stag and doe and wedding parties. Each Facility Rental event will be reviewed on an individual basis for classification and acceptance.

• All “High Risk” facility rentals will have Security Personnel on the premises for the full duration of the event. Security Personnel will be required to have a valid Ontario Security Guard License and it must be available to view upon request.

Acceptable and valid identification includes:

Persons must be 19 years of age or older to be served alcohol. If there is any doubt of a person’s age, an acceptable form of valid and current identification (please refer to list below) which includes a person’s photograph and birth date must be produced.

• Ontario Driver’s License • LCBO BYID Card • Canadian Passport or a Canadian Citizenship Card • Canadian Armed Forces Card • Photo ID can also be requested • Expired ID will not be accepted • Underage and Age of Majority Admittance to Events • A secure Indian Status card • A permanent resident card issued by Government of Canada • A photo card issued under the Photo Card Act 2008 • By law no one should be required to produce Ontario Health Card but if offered

voluntarily it may be accepted

Underage Participants (18 or under)

• Will not be provided or served alcohol directly or indirectly at any event. • Parents or age of majority escorts are prohibited from purchasing, giving or sharing

alcoholic drinks with underage guests. • Youths under the age of 19 must be accompanied and monitored by an adult 25 years of

age or older.

Alcohol Servers and Monitors:

• Person’s 18 years old may serve alcohol as long as they have Smart Serve Certification.

• Servers will not consume alcohol while on duty. • Servers will not serve anyone to the point of intoxication. • Servers will not serve anyone who appears to be intoxicated, and will proceed to offer

non-alcoholic drinks. • There will be no “last” call for alcoholic beverages. • If tickets are being used a maximum of 5 tickets may be bought at one time • A maximum of 2 drinks may be served at a time (1 drink per hand rule)

Food and Non-Alcoholic Drinks:

• Non-alcoholic beverages must be made readily available throughout the duration of the event by the Renter or available to be purchased at a cost significantly lower than alcoholic drinks at the bar.

• Patrons will be encouraged to eat food when drinking alcohol. • Food must be provided at any event that includes the serving and consumption of

alcohol. The BCM&CC will provide food for any Museum Events and/or Programs however, any events that are related to a Facility Rental will be the responsibility of the Renter.

Controlling Consumption:

• The serving of a ‘1 oz. standard drink’ will be used as a measure to gauge alcohol consumption by individuals. There will be a supply of food sufficient to serve the persons throughout the event.

• Snacks such as chips, pretzels, and peanuts are not considered food and due to salt intake increase the rate of consumption.

Managing the Intoxicated:

• Loud, aggressive, rude, riotous, quarrelsome, violent, harassing or disorderly behavior will not be tolerated. This may result in the local police service being called to ensure that the person is taken off the premises.

• A log of incidents is to be maintained in order to have an accurate record if something does happen.

Alcohol and the Law:

• In the event a person becomes intoxicated or is acting dangerously, Security will carefully and politely deal with that person and if necessary seek outside assistance from the Police.

• Visitors and Clients are forbidden from bringing their own alcohol on to the premises.

Transportation:

• Serving anyone to the point of intoxication is illegal however, anyone deemed intoxicated will not be permitted to drive. Security will provide assistance to anyone showing signs of intoxication by providing telephone numbers for taxi cabs or introducing them to a designated driver. Police assistance will be requested if the patron does not co-operate with Security.

• A list of cab companies and contact numbers will be made accessible with servers as well as Visitor Services Reception.

Hours for the Sale and Consumption of Alcohol:

• The Museum will not serve alcohol before 11:00 a.m. or later than 12:30 a.m. • Outdoor licensed event hours will be as follows in accordance with the Town of Saugeen

Shores Noise By-Law. • Friday and Saturday 11 a.m. to 12 a.m. • Sunday to Thursday 11 a.m. to 10 p.m. • In addition, music for outdoor events must be shut down in accordance with the Noise By-

law and hours stated above

• Sandy’s Law Poster • It’s the Law: Servers are prohibited from serving alcohol to participants less than 19

years of age or intoxicated persons or anyone who appears to be at the point of intoxication.

• Ask Your Server about Safe Transportation Options: The BCM&CC will post a list of taxi services for safe transportation.

Other Responsibilities:

• It is the responsibility of the employees, paid bartenders, volunteers, volunteer bartenders and security personnel to familiarize themselves with the BCM&CC Serving and Consumption of Alcohol Procedure and Workplace Harassment and Workplace Violence Prevention Policy as a point of reference for scope of responsibilities and course of action.

• These Policies and Procedures will be available for reference when dealing with under-age, intoxicated or troublesome patrons.

• Museum Staff will be accessible for assistance and support. • Patrons or guests should not be allowed to drive away from the Museum premises if they

are deemed unsafe to drive. If the patrons do not participate, the local Police detachment will be called for assistance.

• Security will ensure that under no circumstances may the intoxicated patron walk away from the Museum on his/her own or the local Police detachment will be called.

• Parking lots and the building exterior will be monitored by Security from time to time to ensure guests are not consuming alcohol outside of the facility and if any person appears to be intoxicated they will be politely informed that for his/her own safety and the safety of others, he/she will not be permitted to drive.

• Security will assist patrons in finding a safe ride home e.g. call a taxi cab or arrange alternate transportation (e.g. designated driver).

• If assistance from Security or a designated driver is refused, Security will report the license number to the local Police Service.

• All incidents and actions will be recorded in a log book including the date, time of the incidents, names of persons, witnesses and the response to the incident by Security.

Review of Procedures:

This Procedure will be reviewed every three years by Management or when deemed necessary for amendments. Policy changes must be approved by the BCM&CC’s governing body, Bruce County Council.

Request for Transfer of Reserve Funds

Recommendation:

That the transfer of $16,888 from the General Donations reserve account be authorized to offset costs associated with the Riding the Rails Permanent Exhibition, in the 2017 budget.

Background:

Now in the second year of construction the Riding the Rails permanent exhibition is on schedule and expected to open June 2018. With the opening of this exhibition the lower level gallery spaces will have all been transformed into sustainable programming structures.

Funding for this exhibition was anticipated as follows: Year 1 – 2016 Private Donor $15,000, Year 2 – 2017 Sponsorship and Year 3 – 2018 Grant and Reserve Funds. In 2017 a total of eight applications for funding where submitted (Canadian National, Canadian Pacific, Lionel LLC, North American Railway Foundation, VIA, Railway Association of Canada, CNR Historical Association, Bruce County Rotary Clubs). While many of these applicants were able to support us with in-kind and promotional opportunities several have not been able to support us financially. The request from the Rotary Clubs is still pending. We have received an individual donation of $200 to put towards the project. With the individual donation we still have a budget shortfall of $16,888 for 2017. Drawing from the General Donation reserve to cover this shortfall will allow us to stay on course for the project.

In the 2018 budget we have budgeted for the final funds to come from a combination of grant and or sponsorship revenue with accommodation of any shortfall to be covered by the General Donation reserve account.

Collections Report

Background:

Exhibits

Throughout the autumn, Collections has been focused on a variety of projects including the installation of three temporary exhibits and two smaller installations. The first was Bert Henderson: A Living Legacy, which opened September 11, in the Bruce Gallery. Created in partnership with the Saugeen Arts Centre, this show consisted of 64 juried works and a sampling of pieces created by Bert Henderson. Next was Field of Dreams, located in the OPG Feature Gallery. Through photographs, the show explored the lives of migrant workers within Saugeen Shores, and was photographed and written by Guest Curator Sandy Lindsay. The show was on display from September 18 until November 18. The end of October saw the arrival of the travelling show My Story, My Tattoo, created by the Wellington Museum & Archives. This show features 32 photographs of people from all walks of life and their tattoos. Accompanying are the peoples’ stories. These are told through audio stations, video and written labels. My Story, My Tattoo will be on display until January 31, 2018.

The first of the two smaller installations included Home in a Distant Land: Chinese Community in Grey and Bruce. This installation, consisting of two pop-up banners depicted the history of the Chinese Community within Grey and Bruce and explored the reasons they came to the area to settle in the late 19th Century and early 20th Century. The second display was of a Pride flag flown during the first Pride Parade in Bruce County. Partnering with the Bruce County Library and the Bruce County Museum, the flag travelled throughout the Library system gaining signatures in support for Pride and the LGBTQ community. The flag is now on display at the Museum and will become part of the Museum’s Collection.

Education/Outreach Report

Background:

Educational Advisory Group (EAG)

Furthering the Museum’s strategic pillar #1 “Forge partnerships & relationships”, the Museum is continuing the work of the Educational Advisory Group (EAG). This group was created in 2016 so that we could learn more about the needs of the students and teachers in the local school boards and homeschool associations and enhance the educational programming that we offer.

The EAG met on November 1 to regroup, review accomplishments and discuss methods for moving forward. In addition to improving and strengthening our relationships with community partners, our objective for 2018 will be to work with this group to review and enhance our educational programming as a direct result of input from the community partners involved in the EAG (education professionals).

Education & Outreach Programs, Fall 2017

Between September and the end of November the Museum delivered 9 education programs to school groups from the BWDSB, BGCDSB and homeschool associations. Programs were delivered both in-house (5) and at schools with our Museum Mobile (4). In total, 212 students and 54 supervising adults had unforgettable hands-on learning experiences as they interacted with Museum artifacts, completed STEM building challenges, made and sampled special treats, created pieces of art to take home, and much more. In December we will be running 6 more programs that will reach 220 students and 31 adults.

In addition to our school programs we visited 3 seniors’ residences to deliver outreach programs to 57 seniors. In one program participants were invited to view an archival film from Ripley and help identify those present in the film. In the other two programs participants were invited to handle artifacts related to WWI and talk about Bruce County’s Military contributions.

Christmas Cards from Then and Now On November 24, children ages 5-10 came to the Museum to get into the holiday spirit and experience a bit of how people celebrated this time years ago with crafts and games. After getting to view real historic Christmas cards in the archives, participants had the chance to make their own to take home to family and friends. PA Day Movie Children and families joined us on November 24th PA day for a screening of the classic film Mary Poppins with popcorn in our Bruce Power Theatre. Upcoming Events December 6 & 13 - Preschool Holiday Fun! - Caregivers and their children are invited to come to the museum for holiday memory making. Activities include decorating gingerbread and making pioneer ornaments. December 16 – Below Zero Creations – Children ages 5-10 will get to embrace their inner artist as they make beautiful winter-inspired art.

The Museum is holding a membership drive to encourage the purchase of Museum Memberships for gift giving. This year over 70 people attended the lecture and concert honouring the 100th anniversary of the largest non-nuclear explosion in history and the 100th birthday of the famous WW2 songstress Vera Lynn. A diorama was created by Mat Johnson which showed the destruction caused by this Halifax explosion and the lecture informed the audience about the strange events leading up to this disaster. A beautiful concert was performed by Sandy Lindsay who was accompainied by pianist Christina Edwards.

Museum Mixer: Under the Big Top This year’s Adult Only After Hours Museum Mixer had a Circus theme. The event featured catering by the Flying Chestnut and Stilt walking and an Aerial Silks Performance in the Lobby by Lookup Theatre. 120 guests enjoyed this event and were able to participate in: hands-on circus skill workshops; carnival games in the exhibit hall; a scavenger hunt; glow-in the-dark-puppet construction and a story telling circle.

Angola Murdoch of Lookup Theatre performs an Aerial Silks Act in the Lobby of the BCM&CC Museum and Library Joint Programming Project: Pride Flag and LBGTQ literature display The first ever Bruce County Pride Parade took place in Kincardine this spring, organized by many partners and spear headed by Fort Papalia. Bruce County Staff marched with the Pride Flag which had extra fabric attached for signatures of people who support the LBGTQ community. The flag and a selection of LBGTQ literature toured several Library branches throughout the summer and is now on display at the BCM&CC.

Visits with Santa 1-3pm December 2, 9 and 16 the Jolly Old Man himself will be at the Museum to meet with young visitors. Dec 7, 1-3pm Victorian Christmas Tea Tea and Treats served by Harrigan’s 100 mile Grocery and Loose Leaf Teas, with special guests: a Harpist and the Celtic Academy of Canada Dance group. Dec 9, 1-4pm Memories of Christmas and Holiday Traditions Activities designed to celebrate the holiday season for families. Dec 27-30 and Jan 2-6, 10-5pm Winter Family Fun Days Various crafts, activities and programming during the winter break from school.

Strategic Plan Report – Museum/Library Partnership

Recommendation:

The Strategic Plan Report, is for information.

Background:

The following report is an update on the Museum Explorer Pass pilot program to date. As per the December 1, 2016 committee report the Museum and Library were preparing to launch a pilot program to improve accessibility of services to the residents of Bruce County. This program included a Museum Explorer Pass in all branches of the County libraries for patrons to take out and receive free admission to the Museum.

Since launch the program in January of this year a total of 142 passes have been taken out from the library and used for 246 visits to the Museum. The highest rate of return was seen over the summer months. The Museum saw the card used from all branches with the exception of Lions Head with a least 2 visits. The highest usage was the following branches with 10 visits or higher: Cargill 14, Chesley 21, Kincardine 20, Port Elgin 55, Sauble Beach 13, Southampton 47, Tara 12, Teeswater 12 and Wiarton 8.

The program is simple to administer for staff and easy to use for patrons. Through the usage we see this is off value to our patrons and will continue to work with the Library to provide this service to our mutual patrons. In 2018 we will continue to track the results and encourage more usage through multiple marketing channels.

The Library Director will present the findings of the pilot program at the Library Board Meeting on December 15, 2017.
