In May 2009, a court decision supported the US DOT requirement for transportation industry employers to implement the Direct Observation Rule for Return-to-Duty and Follow-up testing 73 Fed. Reg. 62,910, 62,918

• Employees who elect not to participate in drug & alcohol screening shall be treated as a positive test and required to demonstrate that they are drug free before returning to work.
