The Annexation Process
• Governed by the Local Agency Formation Commission (LAFCO) for Los Angeles County
• Established by California State law (Cortese-Knox-Hertzberg Act of 2000)
• LAFCO is responsible for coordinating logical and timely changes in local governmental boundaries

The Annexation Process
• Annexations are Initiated by Petition or by Resolution:– Petition must be signed by 5% or more of registered
voters within the area, or– Via a Resolution adopted by the City Council
• The Calabasas City Council will consider a resolution of application to initiate annexation proceedings at their meeting of August 12, 2009

The Annexation Process
• LAFCO Activities– Receive Application and Determine Completeness– Negotiate a Revenue Agreement with LA County– Conduct 1st Hearing: Decide on Sphere of
Influence Amendments and Annexation– Conduct 2nd Hearing: “Protest Hearing”

Protest Hearing Outcomes
– Three possible outcomes from the Protest hearing:1) If fewer than 25% of registered voters, or fewer than
25% of affected landowners (weighted by proportional share of overall assessed valuation) file written protests, then LAFCO orders the boundary change;
2) If at least 25% but not more than 50% of the registered voters or landowners protest, then LAFCO orders an election; and,
3) If more than 50% of the registered voters or landowners protest, LAFCO terminates the proceedings.

Who Can Vote?
• At the LAFCO Protest Hearing…– Registered Voters and Property Owners
• In a LAFCO Ordered Election…– Registered Voters Only– Results are determined by simple majority

How long will the process take?
• After Council Action to Initiate Annexation…– Three to four months to prepare and officially file
the application with LAFCO– Approximately six months to a protest hearing– Approximately three months following the protest
hearing to an election (if one is required)

What Could Change?
• If MVE became part of the City of Calabasas, there would be no change to:– Your School District– Utility services and providers– Tax rates– Your HOA Board– Your HOA’s open spaces
