3. There was submitted a report (docketed) dated 31 March 2004 by the Director of Planning and Environment on applications submitted for planning permission.

With regard to planning application C/03/01873/FUL by Southburn Property Company Limited for the extension and alteration to a public house including the change of use of a shop to a public house, extension to the rear, provision of a rear access ramp, alterations to the shopfront and the installation of a roof mounted ventilation duct at the Cellar Bar, 79 Stirling Street, Airdrie, the Development Control Manager advised the Committee of late representations from the Club Secretary, Airdrie Bowling Club, 2 Manse Place, Airdrie.

With regard to planning application S1031014941FUL by Global Fireworks for the erection of one block of steel containers to store fireworks at Costain, Main Street, Newmains, Wishaw, the Development Control Manager advised the Committee of the receipt of late representations in the form of a petition from the Tollpark Residents’ Association.

With regard to planning application S1041002241FUL for the creation of hardstanding and front garden, in retrospect at 19 Glenelm Place, Bellshill, the Development Control Manager advised the Committee of late representations from Mr. and Mrs. W. Boyle, 18 Glenelm Place, Bellshill.

Decided:

PRE INQUIRY CHANGES TO THE FINALISED DRAFT SOUTHERN AREA LOCAL PLAN 1998 (MODIFIED JUNE 2001)

4. Under reference to paragraph 4 of the Minute of meeting of this Committee held on 22 October 2003 there was submitted a report (docketed) dated 11 March 2004 by the Director of Planning and Environment (1) seeking approval to a range of pre inquiry changes to the Southern Area Local Plan 1998 (modified June 2001) Written Statement and Proposal Map, to take account of the Structure Plan 2000, the First Alteration to the Structure Plan and the Council’s qualified consent to the Ravenscraig Masterplan outline application; (2) informing the Committee of the progress of the Southern Area Local Plan Finalised Draft and seeking approval for changes to the plan and subsequent progression towards a Local Plan Inquiry; (3) outlining the background relative thereto; (4) containing in an Appendix to the report, (a) the Pre Inquiry changes and the Director’s comments thereon, and (b) the revised changes to Housing Schedule 2, Housing Schedule 5 and Schedule INDl relating to Private Housing Development Opportunities, Housing for Rent Shared Ownership and Special Needs Development Opportunities and Industrial and Business Development Opportunities respectively, and (5) recommending that the Committee (a) agree the contents of the Pre Inquiry changes to the Southern Area Local Plan Finalised Draft 1998 (Modified June 2001) Written

Statement and the Pre Inquiry changes to the Southern Area Local Plan Finalised Draft 1998 (Modified June 2001) Proposal Map as contained in Appendices 1 and 2; (b) agree that the Pre Inquiry changes be placed on deposit with the Scottish Ministers and be subject to a period of statutory consultation, and (c) authorise the Director of Planning and Environment to apply for a Local Plan Inquiry Date.

Decided:

(1) that the content of the Pre Inquiry changes to the Southern Area Local Plan and Finalised Draft 1998 (modified June 2001) Written Statement and the Table of Pre Inquiry Changes to the Southern Area Local Plan Finalised Draft 1998 (modified June 2001) Proposal Map as outlined in Appendices 1 and 2 to the report be approved;

SPP PLANNING FOR RURAL DEVELOPMENT - CONSULTATION DRAFT

5. There was submitted a report (docketed) dated 31 March 2004 by the Director of Planning and Environment (1) advising the Committee of the proposed response by North Lanarkshire Council to the Consultation Draft of the Scottish Planning Policy - Planning for Rural Development; (2) outlining the background relative thereto; (3) providing a summary of the issues raised; (4) containing in Appendix 1 to the report, the Director’s comments on the draft document which, it was proposed, would form the proposed response to the Scottish Executive, and (5) recommending that the Committee (a) note the contents of the report, and (b) approve Appendix 1 of the report as the Council’s response to the Scottish Executive.

Decided:

(1) that the report be noted, and

(2) that the comments contained in Appendix 1 of the report be approved as the Council’s response to the Scottish Executive on the SPP Planning for Rural Development Consultation Draft.

SCOTTISH PLANNING POLICY (SPP) 7 - PLANNING AND FLOODING

6. Under reference to paragraph 6 of the Minute of the meeting of this Committee held on 7 July 2003 there was submitted a report (docketed) dated 10 March 2004 by the Director of Planning and Environment (1) advising the Committee of the issue, by the Scottish Executive, of a revised Scottish Planning Policy document containing new policy guidance on the role of the planning system in addressing flooding; (2) outlining the background relative thereto; (3) summarising the implications for the Council and indicating that while the SPP had been issued previously as a planning guidance document, there were implications for other functions, in particular for Building Standards, Emergency Planning and Roads, and (4) recommending that the Committee note the report.

Decided: that the report be noted.

SCOTTISH PLANNING POLICY (SPP) 17 - PLANNING FOR TRANSPORT - CONSULTATION DRAFT

7. There was submitted a report (docketed) dated 10 March 2004 by the Director of Planning and Environment (1) informing the Committee of the main proposals of the draft SPP 17 Planning and Transport; (2) outlining the background relative thereto; (3) summarising the proposals and considerations contained therein; (4) seeking agreement to a proposed response as contained in an Appendix to the report, and (5) recommending that the Committee (a) note the general provisions contained in the Consultation Draft document - Planning for Transport, and (b) agree to respond to the consultative draft in terms of the detailed comments contained in paragraphs 6.1 and 6.2 and the Appendix to the report.

Decided:

(1) that the general provisions contained in the Consultation Draft document - Planning for Transport, be noted, and

(2) that the Director of Planning and Environment be authorised to respond to the consultative draft in terms of the detailed comments contained in paragraphs 6.1 and 6.2 and in the Appendix to the report.

HOUSING LAND 2003

8. There was submitted a report (docketed) dated 12 February 2004 by the Director of Planning and Environment (1) advising the Committee of the outcome of the North Lanarkshire Housing Land Survey 2003 which considered the location and scale of future housing provision in North Lanarkshire and included an analysis of land developed between 1 April 2002 and 31 March 2003 for housing use; (2) outlining the background relative thereto; (3) containing in Tables 1, 3 and 4 of the report, Effective Private Sector Land Supply 2003, Private Sector Completions 1996-2003 and Private Sector Completions 2003 respectively, and (4) recommending that the Committee note the report.

Arising therefrom the Convener advised the Committee that Members would, in future, be notified of the dates of Public Inquiries on proposed housing developments affecting their areas.

Decided: that the report be noted.

CONSULTATION BY THE FORESTRY COMMISSION REGARDING REFINING THE SCOTTISH FORESTRY GRANT SCHEME

9. Under reference to paragraph 5 of the Minute of the meeting of this Committee held on 4 February 2004 there was submitted a report dated 9 March 2004 by the Director of Planning and Environment (1) advising the Committee of a consultation response to the Forestry Commission on the review of the recently introduced Scottish Forestry Grant Scheme and which had been submitted to the Commission, following consultation with the Convener, in order to comply with the deadlines for submissions; (2) outlining the background relative thereto; (3) providing a summary of the proposed response to the Consultation document, and (4) recommending that the Committee (a) note the content of the response which had been submitted, and (b) note the potential benefits arising from the implementation of specific proposals contained within the document.

Decided:

(1) that the response to the Forestry Commission Consultation Document “Refining the Scottish Forestry Grant Scheme” be noted, and

(2) that the potential benefits arising from the implementation of specific proposals contained within the document be also noted.

ASSESSMENT OF THE LONG TERM POTENTIAL FOR DEVELOPMENT OF THE GARTCOSHlGARTLOCH AREA

10. Under reference to paragraph 9 of the Minute of the meeting of this Committee held on 22 January 2003 there was submitted a report (docketed) dated 2 March 2004 by the Director of Planning and Environment (1) advising the Committee of work carried out to date on the potential for the development of the Gartloch/Gartcosh area, as required by Strategic Policy 2 of the Glasgow and Clyde Valley Joint Structure Plan 2000; (2) outlining the background relative thereto; (3) containing in Appendices to the report a map of the study area and an analysis of the constraints and opportunities of settlement within that area; (4) summarising the outcome of the constraints and opportunities study; (5) indicating the method by which the study has progressed to date including the establishment of a formal consultative mechanism with stakeholders and agreed appropriate working arrangements with Area Committees through the North Lanarkshire Local Plan process, and (6) recommending that the Committee (a) note the terms of development constraints for the GartcoshlGartloch study area by consultants lronside Farrar; (b) agree that the Director of Planning and Environment be authorised to negotiate an extension of the lronside Farrar contract to prepare a development option appraisal for the Gartcosh/Gartloch study area, in accordance with Contract Standing Orders 16.3, and (c) agree that the results of the consultants’ study be reported to the Committee for agreement and action prior to any active engagement with developers/stakeholders.

Arising therefrom it was agreed that a briefing meeting be held for those local Members whose Wards could be affected by any proposals arising from the study.

Decided:

that the terms of the development constraints framework for the GartcoshlGartloch study area by consultants lronside Farrar Limited be noted;

that the Director of Planning and Environment negotiate an extension of the current contract with lronside Farrar to enable them to prepare a development option appraisal for the Gartcosh/Gartloch study area, in accordance with Contract Standing Order 16.3;

that a briefing meeting be held for those local Members whose Wards could be affected by any proposals arising from the study, and

that the conclusions of the consultants’ study be reported to Committee for agreement and action prior to any active engagement with the developers/stakeholders as part of the established consultation and working arrangements for the North Lanarkshire Local Plan.

PEDESTRIAN MOVEMENT - STATION ROAD, STEPPS

11. There was submitted a report (docketed) dated 24 March 2004 by the Director of Planning and Environment with regard to pedestrian movement at Station Road, Stepps.

Decided: that consideration of the matter be continued.

FUNDING FOR WISHAW CITIZENS’ ADVICE BUREAU 200412005

12. Under reference to paragraph 11 of the Minute of the meeting of this Committee held on 3 March 2004, there was submitted a report dated 31 March 2004 by the Director of Planning and Environment

(1) seeking approval for the payment of additional funding to Motherwell and Wishaw Citizens’ Bureau for the operation of the Bureau located in Wishaw; (2) outlining the background relative thereto; (3) indicating that an application was submitted by the CAB in the sum of f56,000 for the core costs of the Wishaw Bureau for 2004/2005; (4) intimating that as part of the Council’s budget process, transitional funding for SIP schemes was included for 2004/2005, and the Chief Executive’s Department had agreed to provide f35,000 towards the core costs of the Wishaw Bureau; (5) indicating that the award was conditional on the Bureau funding the remaining f21,000, and (6) recommending that the Committee (a) approve the payment of f35,000 for the Wishaw Citizens’ Advice Bureau for 2004/2005, and (b) otherwise note the report.

Decided:

(1) that a payment of f35,000 in relation to the Wishaw Citizens’ Advice Bureau for 2004/2005 be approved, and

(2) that the report be otherwise noted.

FEES AND CHARGES 2004/2005 - DROPPED KERBS

13. There was submitted a report (docketed) dated 18 March 2004 by the Director of Planning and Environment (1) seeking authorisation to increase charges for the installation of dropped kerbs by applying the Road Maintenance Contract Inflation figure; (2) indicating that the provision of dropped kerbs is delivered through the Roads Maintenance Contract and recommending that the actual roads maintenance contract inflation figure be applied to current fees; (3) providing a comparison of fees in relation to single and double dropped kerbs including actual average costs to the Council, existing charge and proposed charge applying Roads Maintenance Contract inflation, and (4) recommending that the Committee authorise the application of the Roads Maintenance Contract inflation figure to the fees charged for dropped kerb provision as detailed in the report

Decided: that the application of the Roads Maintenance Contract inflation figure to the fees charged for dropped kerb provision as detailed in the report be approved.

NORTH CARBRAIN UNDERPASS REPLACEMENT CONTRACT - ADDITIONAL FUNDING

14. Under reference to paragraph 7 of the Minute of the meeting of this Committee held on 20August 2003 there was submitted a report dated 18 March 2004 by the Director of Planning and Environment (1) seeking authorisation for additional funding to complete the current North Carbrain Underpass Contract; (2) indicating that the original tender submitted by PLS Construction Limited had been valued at f539J05.41; (3) intimating that during the course of construction, difficult unforeseen ground conditions were revealed necessitating additional excavation works at underpasses 2, 3, 4 and 6 with similar excavations revealing unrecorded public utility apparatus, requiring both diversion works to these apparatus and the redesign of substantial elements of the underpasses themselves; (4) advising that this had resulted in additional costs being incurred amounting to f27,245, and (5) recommending that the Committee authorise the additional funding as detailed in the report.

Decided: that the additional funding for the North Carbrain Underpass Replacement Contract in the sum of f27,245 be approved.

AMENDMENT TO APPROVED LIST OF CONTRACTORS

15. Under reference to paragraph 12 of the Minute of the meeting of this Committee held on 3 March 2004 there was submitted a report dated 31 March 2004 by the Director of Planning and Environment (1) seeking to remove from the Standing Approved List of Contractors, Lightways Limited; (2)

indicating that following the award of several contracts to the company, inspections had revealed that their compliance with contract specification in relation to the installation depth of ducting and cabling had deteriorated to an unacceptable level; (3) indicating that the Council had instructed Lightways Contractors Limited to re-lay shallow cable, and (4) recommending that Lightways Contractors Limited be removed from the Standing Approved List of Contractors.

Decided :

(1) that Lightways Contractors Limited be removed from the Standing Approved List of Contractors for Road Lighting and Cabling - Installation, Road Lighting and Cabling - Maintenance, Machine Surfacing and other Flexible Maintenance (patching), and

(2) that the Director of Planning and Environment submit a further report on completion of all remedial works by Lightways Contractors Limited at which time consideration may be given to re-instating the Company to the Council’s Approved List of Contractors.

PROVISION OF CAR PARK AT THE FRANK FERGUSON CENTRE, MOTHERWELL ROAD, BELLSHILL

16. Under reference to paragraph 23 of the Minute of the meeting of this Committee held on 22 October 2003 there was submitted a report dated 16 March 2004 by the Director of Planning and Environment (1) advising of the action taken by the Director of Administration, in consultation with the Convener, in accepting a tender by Blacktop Roads (Strathclyde) Limited in the sum of f35,123.25 which had been consistently and competitively priced for the provision of a car park at the Frank Ferguson Centre, Motherwell Road, Bellshill; (2) indicating that (a) all the necessary permissions were in place for the work to be carried out, and (b) it was intended that the work should be completed within the current financial year, and (3) recommending that the Committee note the report.

Decided: that the action taken by the Director of Administration, in consultation with the Convener, in accepting the offer from Blacktop Roads (Strathclyde) Limited in the sum of f35,123.25 for the provision of a car park at the Frank Ferguson Centre, Motherwell Road, Bellshill, be noted.

WEATHER FORECAST PROVISION CONTRACT

17. Under reference to paragraph 10 of the Minute of the meeting of this Committee held on 18 June 2003 there was submitted a report dated 24 February 2004 by the Director of Planning and Environment (1) advising of the action taken with regard to the award of the West of Scotland Local Authority Weather Service Partnership Contract to PA Weathercentre; (2) indicating that tenders were issued to four providers; (3) intimating that the tenders had been assessed on the basis of price and quality; (4) advising that the bid by PA Weathercentre in the sum of f 150,000 represented good value and that South Lanarkshire Council on behalf of the partners had awarded the four year contract which will commence on 16 May 2004 with an option to extend for a further two years; (5) indicating that project costs arising comprise a one-off fee of f500 paid to South Lanarkshire Council and thereafter an annual cost of f18,150 to be paid to that Council, these costs to be met from the Transportation Revenue budget, and (6) recommending that the Committee (a) note the action taken with regard to the award of the West of Scotland Local Authority Weather Forecast Service Partnership Contract to PA Weathercentre, and (b) note that the performance of the contractor will be the subject of continuous monitoring by the Partnership Steering Group.

Decided :

(1) that the action taken with regard to the award of the West of Scotland Local Authority Weather Forecast Service Partnership Contract to PA Weathercentre be noted, and

APPROVAL OF PAYMENT OF OVERTIME FOR OFFICERS ON OR ABOVE SPINAL COLUMN POINT 35

18. There was submitted a report (docketed) dated 11 March 2004 by the Director of Planning and Environment seeking authorisation to pay overtime, in retrospect, to Officers within the Department’s Trading Standard Section as detailed therein, who earned in excess of spinal column point35 and who had been required to work overtime to change a number of risk factor codes for premises subject to Trading Standards Inspections.

Decided :

(1) that payment of overtime, in retrospect, to the Officers detailed in the report be approved, and

(2) that the report be referred to the Policy and Resources (Personnel) Sub-Committee for approval.

TRANSPORTATION VACANCIES REPORT

19. There was submitted a report (docketed) dated 31 March 2004 by the Director of Planning and Environment (1) highlighting difficulties encountered in filling certain vacancies in the Roads and Transportation Section and bringing forward proposals to address the situation; (2) outlining, in an Appendix to the report, reasons for the recruitment problems currently being experienced throughout the country; (3) summarising the attempts made to date to recruit staff at all levels; (4) indicating that at the present time there were nine vacancies in the Roads and Transportation Section which represented 9% of the establishment; (5) intimating that unless the recruitment difficulties could be addressed in the short term, the staffing situation was likely to worsen as a consequence of pending retirals, and (6) recommending:-

the engagement of recruitment agencies to locate appropriate part-time and full-time staff subject to discussion and consultation with the Head of Personnel Services;

ENVIRONMENTAL PROTECTION ACT 1990 - ENFORCEMENT OF LITTER AND FLYTIPPING PROVISIONS

20. Under reference to paragraph4 of the Minute of the meeting of the Planning and Environment (Protective Services) Sub-Committee held on 6 August 2002 there was submitted a report dated 31 March 2004 by the Director of Planning and Environment (1) indicating that as part of the Streetsmart Campaign, enforcement measures to address the litter and flytipping provisions of the Environmental Protection Act 1990 and other relevant legislation will be introduced and increased where necessary; (2) outlining the background relative thereto; (3) indicating that the Protective Services Division has responsibility for enforcing the provisions covering flytipping which in some cases overlaps with those of the Scottish Environmental Protection Agency; (4) intimating that the Cleaning and Related Services Division of the Department of Community Services have undertaken work to remove tipped waste throughout North Lanarkshire on a programmed basis; (5) proposing that the Protective Services Division recruit four Environmental Wardens on a temporary basis for a period of six months to assist Environmental Health Officers to deliver an effective enforcement response to littering and flytipping, and (6) recommending (a) that the Committee note that the enforcement work associated with litter and flytipping will be increased, and additional staff resources are required to accommodate this; (b) that the appointment of four Environmental Wardens on a temporary basis for a period of six months at grade AP2 be approved, and (c) that the matter be referred to the Policy and Resources (Personnel) Sub-Committee.

Arising therefrom it was agreed that the Director of Planning and Environment bring forward a report on (1) the feasibility of enforcement action being taken to address problems associated with the practice of companies attaching posters to lampstandards, traffic lights etc., and (2) the outcome of the six month initiative involving the recruitment of Environmental Wardens to enforce littering and flytipping.

FLOOD THREAT FROM THE HALL GILL WATERCOURSE, WISHAW

23. There was submitted a report (docketed) dated 18 March 2004 by the Director of Planning and Environment (1) advising the Committee of the findings of flood risk assessment on the Hall Gill Watercourse, Wishaw; (2) outlining the background relative thereto; (3) indicating that (a) following the exceptional rainfall on 30 May 2003 in the CastlehilllGowkthrapple area, the Director of Planning and Environment had commissioned a specialist study on the hydrology and hydraulics of the Hall Gill watercourse, and (b) that the report, prepared by JBA Consulting, had considered the flood risk associated with the watercourse; (4) intimating that the consultants report had confirmed that there was a continuing flood risk from the Hall Gill watercourse to the Cambusnethan Priory Cottages downstream from the watercourse; (5) summarising the measures which have already been undertaken in the short term to alleviate the problem, and (6) recommending that the Committee (a) note the report by JBA Consulting on the flood risk associated with Hall Gill watercourse; (b) note the
