Our State GovernmentMontana is governed by a state Constitution ap-proved in 1972, which replaced its original 1889Constitution. The new Constitution and a body ofstate laws are administered by Montana’s executiveofficers and by various boards and commissions.The governor is elected to a four-year term and isprohibited from seeking re-election after holding theoffice for eight years in any 16-year period. Thegovernor holds a relatively strong veto power overproposed legislation.
The lieutenant governor, attorney general, auditor,secretary of state and superintendent of public in-struction also are elected for four-year terms andsubject to the same term limits as the governor. Acopy of the Montana Constitution can be purchasedfor a small fee from: Secretary of State, State Capi-tol, Helena, MT 59620.
The Montana Legislature consists of a 50-memberSenate and a 100-member House. Senators holdfour-year terms, and House members serve two-yearterms, and all are subject to the same term limits asabove. Regular legislative sessions convene in Janu-ary of odd-numbered years, for a maximum of 90working days. Special sessions of the Legislaturemay be called by either the governor or the Legisla-ture itself.
The highest court of appeals in Montana is the stateSupreme Court, which consists of one chief justiceand six associate justices — each elected to eight-year terms. The trial courts for major civil and crimi-nal cases are the state’s 56 district courts. Thesejurisdictions are presided over from one to fourjudges, each elected to a six-year term. Municipalcourts, police courts and justice-of-the-peace courtshandle less serious cases.
Montana includes governments for 56 counties and125 incorporated cities and towns. Local govern-ment most frequently employs a three-memberboard of commissioners on a county level and amayor-council form on a municipal level — al-though seven local governments operate under thecommissioner-manager system, including five of thestate’s largest cities.
