1. Introduction
1.1. Background
The Mobile Phone and Broadband Taskforce (the Taskforce) was established in 2016 from a
commitment arising from The Programme for a Partnership Government. Now in its third year
of operation, the Taskforce continues to identify solutions to barriers to the rollout of
telecommunications infrastructure and aims to improve mobile phone and broadband
coverage nationwide.
The Taskforce is chaired by Séan Canney T.D., Minister of State with responsibility for
Community Development, Natural Resources and Digital Development and it is co-managed
by the Department of Rural and Community Development and the Department of Climate
Action and Environment. The current membership of the Taskforce is as follows:

This is the third quarterly progress report of the 2019 Work Programme. Reports previously

2. Progress Update
2.1. Summary of progress made
D T T AS
DTTAS, in collaboration with the RMO, recently completed a micro-trenching pilot programme
and drafted a report highlighting the pros and cons of the method. The report outlines the
results of the pilot, identifies typical locations where micro-trenching might be suitable for use
and sets out a methodology for application. The report will be circulated to local authorities
and will allow, where appropriate, for faster deployment of high-speed broadband.
C O M R EG
ComReg continues to provide and promote information for consumers through its engagement
programme, which includes: displaying consumer guides in libraries, council buildings and
medical waiting rooms, running a public awareness campaign and more recently, ComReg’s
presence at the National Ploughing Championships.
In addition, ComReg continues to deepen its understanding of the mobile consumer
experience and has recently conducted a 2nd mobile consumer experience survey, as well as
leading positive engagement activities with stakeholders, such as its Consumer Advisory
Panel and the European Consumer Centre Ireland.
ComReg continues to monitor usage of the Outdoor National Coverage Map, noting that the
Map has been very positively welcomed by the public. ComReg has also received updated
data from the operators and is currently processing this data for the next release of the map,
which is estimated to be in Q1 2020. A mobile app version of the Map has also been developed
and will be launched shortly.

DHPLG is currently reviewing the TII (IBEC) report ‘Recommendations for the Revisions of
Telecommunications Guidelines for Planning Authorities’ to ascertain what amendments to
the existing statutory Planning Guidelines (1996 and 2012 updates) are required.
In addition, and on foot of positive engagement with Industry, DHPLG is awaiting industry’s
specific identification of a small number of key elements of the current Guidelines which could
benefit from a prompt DHPLG priority review in advance of initiating a more detailed and
focused review.

DHPLG is also supporting the LGMA in the development of the new ePlanning system. Piloting
of the system will commence in Q4 2019 and Q1 2020 in Tipperary County Council with a
subsequent rollout of the programme to the rest of the local authorities in Q2 2020.
AS AI
On 20 August 2019, the ASAI published its Telecommunication Guidelines. The Guidelines
will complement the existing ASAI Code in ensuring that certain marketing terms used by
telecommunications operators convey clear meanings that are not misleading to consumers.
The ASAI conducted an extensive consultative process followed by strong and positive
engagement with key providers. The Guidelines came into force on 1 September 2019 and
operators were given a lead in period of 3 months, until 1 December, to allow them to amend,
if necessary, their advertising.
The ASAI is now working on phase 2 of the review which relates to the circumstances in which
descriptors such as the word ‘unlimited’ are used.
I B E C ( T I I )
All telecommunication operators are currently working on developing a common ‘information
resource’ webpage which will appear on their websites and give consumers easily
understandable information about the products and technologies on offer. The webpage will
also direct consumers to ComReg’s website for anything in relation to consumers’ rights.
In addition, all operators are currently reviewing a draft voluntary code of practice for granting
and sharing access to mobile telecommunication infrastructure. This code of practice will be
put in place by end 2019 and it is anticipated that the code will support continued cooperation
among telecommunication companies which, in turn, will result in improved coverage in rural
areas.
Industry is also working closely with DRCD, providing the Department with updates on network
improvements, both current and future.
E S B N
ESBN has completed its trial in the Dublin Docklands on the issues governing the use of public
lighting infrastructure for siting small cell technologies. This trial, involving Dublin City, Sligo
and Laois County Councils, as well as Densair, explored how best to provide power to small
cell technology on public lighting poles. The findings of this trial will form the basis for a guide
for local authorities on how to bring power to poles in an efficient and cost-effective way. The

guidance document, which will be completed by year end and distributed to local authorities,
will provide clarity on how best to connect small cells on public lighting infrastructure.

DRCD continues to support the role of the Broadband Officers. 2020 will see the provision of
co-funding of €42,000 per local authority to continue to employ a dedicated Broadband Officer
with responsibility for improving telecommunication services in their areas, engaging with
industry and facilitating the rollout of essential infrastructure.
In addition, DRCD continues to provide extensive assistance to all local authorities regarding
the WiFi4EU initiative. In the last call, held in November, Ireland secured an additional 16
vouchers, each worth €15,000. To date, a total of 100 vouchers have been successfully
applied for, which amounts to €1,500,000. This will greatly improve the deployment of free
public WiFi throughout the country. In order to ensure an even greater impact on local
communities, DRCD is co-funding each voucher secured by the LAs with up to €15,000 in
additional funding.

DCCAE’s National Digital Strategy team continues to work closely with Broadband Officers,
identifying local opportunities to increase awareness of the Digital Skills Scheme. Newly
designed information leaflets were issued to all Broadband Officers in Q2 for distribution
amongst local networks. Since January 2019, over 11,000 people have been in receipt of
Digital Skills training, which is an increase of 30% on the number of people trained in the same
period in 2018. DCCAE also continues to support LAs on a range of digital initiatives, including
in public libraries.
DCCAE also continues to implement the 2019 Taskforce Communications Strategy, in
collaboration with DRCD. 2019 has seen a marked increase in social media and comms
activity, which will further increase local awareness of Taskforce actions.

A communications strategy has been finalised and is being implemented. To date, a
communications calendar and stakeholder list has been produced and the use of social

National Stakeholder Forum in October, and shared across social media platforms.

The SII (Spectrum, Intelligence and Investigation) Forum has been established and a first
meeting took place on 18 June. There were 20 participants from 14 organisations in
attendance representing a wide range of stakeholders including fixed, wireless and mobile
operators as well as the emergency services and the IAA. There was positive engagement
from all parties with agreement being reached on the Terms of Reference of the Forum and
draft new reporting procedures.
The second meeting took place on 24 September 2019. There were 18 participants
representing 10 organisations in attendance.

from the review of legislation governing TII's and the road authorities’ statutory
roles and functions in so far as they relate to telecommunications operators
accessing the assets under their control or TII fully exploiting such assets: -the

TII has raised concerns regarding the inadvertent layer of bureaucracy created by the
Communications Regulation (Premium Rate Services and Electronic Communications
Infrastructure) Act 2010. Inter alia, the provisions of the Act require that TII must consult
with the local authority (for up to 21 days) before granting a license.
One possible option, as identified by DCCAE, is to amend the Act of 2010. The question
remains as to whether this also requires corresponding amendments to the Roads Act, with
all parties cognisant of the need to avoid any further unintended consequences.
DCCAE awaits DTTAS’ views in respect of same.

Discussions have been held between DTTAS and TII on this matter. Specific amendments
would be required to the Roads Act in order to allow TII to actively manage or promote the
use of its motorway ducting.
From discussions it is clear that TII does not have the telecoms experience to participate
commercially in the telecoms sector. For this reason, the Board of TII has previously
expressed doubt as to whether in present circumstances it would be appropriate for TII to
become actively involved in the management of telecommunications services.
However TII is prepared to facilitate the provision of ducts as part of major projects and also
to facilitate the filling of “gaps” along major routes.

The JULA group is currently considering a proposal to broaden its remit to include over
ground telecoms infrastructure. This approach has received the support of several
stakeholders. Including over ground infrastructure into the work of the JULA group will allow

forwarded to the Minister for consideration.

DHPLG has engaged with the Broadband Officers of all local authorities in order to gather
accurate and up-to-date information regarding this issue.
Of the 31 local authorities, responses have been received from 27. Of these, 13 have
granted no temporary permissions since the issuing of Circular Letter PL 07/12. The 14
local authorities that have granted temporary permissions for telecommunications
infrastructure have done so a combined total of 47 times over this seven-year period; an
average of approximately 7 temporary permissions granted nationally per annum. However,
35 (approx. 75%) of these temporary permissions were granted before end 2015, meaning
only 12 temporary permissions have been granted since then.
The most common reasons for the granting of temporary permissions have been:
• To allow for potential future development.
• To assess the visual and residential impact of the structure.
• To have regard for changes in technology and design.
In this regard, it should be noted that Circular Letter PL 07/12 updated certain sections of
the Telecommunications Antennae and Support Structures Guidelines (1996) to, inter alia,
advise that where a renewal of a previously temporary permission is being considered, the
planning authority should determine the application on its merits with no time limit being
attached to the permission, except in certain exceptional circumstances where particular
site or environmental conditions apply.
In addition to the planning reasons for the granting of these temporary permissions, the
turnover of local authority staff has also been identified as a contributory factor in some
instances.
In light of these findings, DHPLG considers a formal reissue of Circular Letter PL 07/12 to
be the appropriate approach to address this Action and will look to do so in due course,
pending further engagement with industry.

To date, Irish LAs have secured 100 vouchers worth €1.5 million under the EUs WiFi4EU
scheme. DRCD Has committed to match-funding the initiative with an additional €15,000
per voucher secured. So far this year €331,000 has been provided by DRCD towards 42
WiFi4EU deployments across the country. It is anticipated that the first networks will go live
in Q1 2020.
In addition, DRCD continues to develop the Broadband Connection Points initiative, an
action under the NBP, to bring connectivity – including free public Wi-Fi – to some 319 sites
nationwide. Connections will begin in the new year.
Lastly, a number of Digital Innovation Projects have matured in recent months with others
coming online soon. These include publicly available Wi-Fi and mobile connectivity in
Donegal, Galway City, Fingal, Sligo and Offaly.

are broadband enabled, including mandating that ducting is in place to facilitate

TII’s standards have been updated to require the installation of ducting on all new roads,
not just motorways. A number of schemes are currently being constructed that would not
previously have required ducts to be installed. These include the:
• N4 Colloney to Castlebaldwin
• N5 Westport to Turlough and
• N22 Ballyvourney to Macroom.
The installation of ducting on non-motorway national roads at present is determined by
where new road schemes are being constructed; we do not install ducts on existing sections
of national road.
There are legacy gaps on the motorway network and the prioritisation of works on these
sections is determined by:
(a) Interest from industry players on potential use of such ducting,
(b) TII’s own ducting and communications requirements to service Intelligent
Transportation Systems (ITS) needs.

Following circulation of the ASAI Draft Guidance to key stakeholders, additional time for
submission of comments was requested as well as a meeting with TII and member
companies. A range of areas was covered at this meeting and the companies agreed to
put any further comments in writing. Both the initial comments and the output from the
meeting were analysed and where appropriate comments taken on Board.
The Guidance Note was published on 20th August 2019 and came into effect on 1st
September 2019. A three month lead in was allowed to give companies time, where
necessary, to bring their marketing communications into line with the Guidance Note. The
release of the Guidance Note resulted in coverage in a range of national media.

provided them with copies of the newly designed “Digital Skills for Citizens” promotional

The telcos suggest that the information resource referred to in Action 5 provides consumers
with a link to the ComReg list of suppliers for mobile repeaters as a way to promote the use
of compliant mobile repeaters (however, telcos note that the cost of compliant mobile
repeaters remains prohibitive for most consumers).

3. Topical Discussion
3.1. Introduction
It is essential that the Taskforce remains dynamic and responsive to new developments in the
sector. This year, the format of the Taskforce has been refreshed, with a wider array of
stakeholders invited to participate in quarterly thematic sessions, where emerging trends in
the digital sphere are debated.
This new Taskforce format now affords a greater range of stakeholders the opportunity to feed
into the decision-making process, ensuring that telecommunications policy remains fair,
proactive and future-focused.
3.2. Update on Q2
The topical discussion held at the Q2 meeting addressed the Internet of Things, its
development and deployment and the impact of this new technology on varied areas, from
farming and agriculture to smart cities.
On foot of this discussion, an action was suggested and its progress is detailed below.
Action: DRCD will invite representatives of VT at an upcoming Telecommunication
Action Group (TAG) meeting, attended by all Broadband Officers, to give them a
presentation on their Sigfox technology.
Update: DRCD invited VT to take part in the September TAG in Nenagh, Co. Tipperary.
Will Ferguson gave a comprehensive presentation to all in attendance and highlighted the
different uses of their Sigfox technology. Examples tailored to the audience, such as
connected defibrillators and farming assets tracking, were presented and demonstrated
how the Internet of Things can improve the lives of all members of local communities.
BBOs were provided with VT’s contact details to enable further engagement if required.
3.3. Telecommunication Advertising Guidelines
The Advertising Standards Authority for Ireland (ASAI) recently issued new Guidelines relating
to the advertising of mobile phone and broadband services. These new Guidelines were
developed on foot of an action arising from the Mobile Phone and Broadband Taskforce.
The Guidelines complement the existing ASAI Code in ensuring that certain marketing terms
used by telecommunications operators convey clear meanings that are not misleading to
consumers. The Guidelines came into effect on 1 September and operators were given a 3
month period to implement them.

In keeping with this year’s revamped model, the second session of the Taskforce meeting saw
a wider selection of stakeholders convened to discuss the new Guidelines, their
implementation, the potential implications for industry and the next steps for all involved.
In addition to the Taskforce members, attendees for the topical discussion included
representatives of TII (Ibec), representatives from a wide range of service providers and the
ASAI.
Two presentations were given, after which Minister Canney presided over a frank discussion.

Ms Orla Twomey, CEO of the Advertising Standards Authority for Ireland
Ms Twomey gave a detailed presentation on the newly issued Telecommunication Guidelines.
ASAI stated that they are happy to engage with the telcos at any stage of the process.
A few operators have met with the ASAI already to present the progress made on complying
with the new guidelines, in order to confirm that they are taking the right approach and will
therefore meet the implementation deadline of 1 December.
ASAI specified that they will carry out ad-hoc monitoring of implementation.
ASAI mentioned that they are already working on the second phase of the Guidelines, which
will focus on the term ‘unlimited’. ASAI has already started engaging with telcos on the matter.
This next phase will complete in Q1/Q2 2020.
ASAI also highlighted that the use of ‘unlimited’ in advertising is often a cause for concern for
consumers.
Mr Torlach Denihan, Director of Telecommunications Industry Ireland, IBEC, speaking on behalf of industry.
Mr Denihan highlighted the very good engagement that industry has had with the ASAI since
May, when the telcos were consulted on the draft Guidelines.
He explained that telecoms operators are also working on the content that will appear on a
common resources webpage that will appear on all telcos websites. Two pages are envisaged,
one for fixed and one for mobile technology. Mr Denihan also stated that this common resource
page will include a link to ComReg Consumers’ Rights Information’s page.
The common webpage will have information relating to, for example: mobile coverage,
differences in networks (2G-4G), short non-technical descriptions of the different technologies,
impacting factors of poor service etc.

Industry is close to completing the work on the common webpage and will share their review
with ComReg and ASAI before publication.
All telcos welcomed the ASAI Telecommunication Guidelines and agreed that they were a
very helpful tool.
It was however noted that some metrics were more difficult to measure than others and for
this reason, advertising would not mention them to avoid breaching the Guidelines (i.e. mobile
speed claims)
D I S C U S S I O N
Key points discussed included the following:
ComReg welcomed the ASAI Guidelines, including the upcoming work on the use of
the word ‘unlimited’ in advertising.
It was also mentioned that due to the nature of the technologies involved and their fast
moving progression, the Guidelines would need to be reviewed frequently to keep
pace with market evolution.
The ComReg Outdoor Coverage Map was seen by all as a very positive development
and a great tool for consumers. The upcoming version of the Map as a mobile App
was also welcomed.
The question of whether the new Guidelines would have an impact on competition
between telcos was raised. According to Industry, it won’t have a negative impact and
competition should remain as it is.
Industry stated and agreed that any guidance that creates clarity within the market,
such as the ASAI Guidelines, forms the basis of genuine competition and affords all
operators the opportunity to compete on a level playing field.
Telcos have met with ASAI to discuss their current work in relation to the new
Guidelines and ensure they are on the right track with their new approach to
advertising.
It was also suggested that further engagement between telcos and the ASAI would be
needed on 5G; ASAI welcomed the suggestion.
Mr Denihan, on behalf of Industry, stated that Ibec is very supportive of retaining the
Taskforce and values the opportunity to engage with stakeholders that the Taskforce
provides.
The Minister thanked ASAI, Ibec and all telcos for the work that they are all doing to
ensure that consumers are given accurate and helpful information through advertising.
The Minister also praised the group on their strong collaboration to advance this
action.
