AN ACT TO AMEND SECTIONS 41-29-113, 41-29-115, 41-29-117, 1

41-29-119 AND 41-29-121, MISSISSIPPI CODE OF 1972, TO REVISE 2

SCHEDULE I THROUGH V OF THE UNIFORM CONTROLLED SUBSTANCES LAW IN 3

CONFORMITY WITH FEDERAL LAW; TO INCLUDE SALVIA DIVINORUM AS A 4

CONTROLLED SUBSTANCE IN SCHEDULE I; AND FOR RELATED PURPOSES. 5

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6

SECTION 1. Section 41-29-113, Mississippi Code of 1972, is 7

amended as follows: 8

41-29-113. The controlled substances listed in this section 9

are included in Schedule I. 10

SCHEDULE I 11

(a) Any of the following opiates, including their isomers, 12

esters, ethers, salts and salts of isomers, esters and ethers, 13

unless specifically excepted, whenever the existence of these 14

derivatives, and their isomers with similar chemical structure and 139

pharmacological activity to those substances contained in the 140

plant such as the following: -1 cis or trans 141

tetrahydrocannabinol, and their optical isomers; -6 cis or trans 142

tetrahydrocannabinol, and their optical isomers; -3,4 cis or trans 143

tetrahydrocannabinol, and their optical isomers.) (Since 144

nomenclature of these substances is not internationally 145

standardized, compounds of these structures, regardless of atomic 146

positions are covered.) ("Tetrahydrocannabinols" excludes 147

dronabinol and nabilone.) However, the following products are 148

exempted from control: THC-containing industrial products (e.g., 149

(i) paper, rope and clothing made from cannabis stalks; (ii) 150

processed cannabis plant materials used for industrial purposes, 151

such as fiber retted from cannabis stalks for use in manufacturing 152

textiles or rope; (iii) animal feed mixtures that contain 153

sterilized cannabis seeds and other ingredients (not derived from 154

the cannabis plant) in a formula designed, marketed and 155

distributed for nonhuman consumption; and (iv) personal care 156

products that contain oil from sterilized cannabis seeds, such as 157

shampoos, soaps, and body lotions (provided that such products do 158

not cause THC to enter the human body.) 159

(d) Depressants. Unless specifically excepted or unless 176

listed in another schedule, any material, compound, mixture, or 177

preparation which contains any quantity of the following 178

substances having a depressant effect on the central nervous 179

system, including their salts, isomers, and salts of isomers, 180

whenever the existence of such salts, isomers, and salts of 181

isomers is possible within the specific chemical designation: 182

(1) Gamma-hydroxybutyric acid (other names include: 183

GHB, gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-hydroxybutanoic 184

acid; sodium oxybate; sodium oxybutyrate) * * *; 185

(2) Mecloqualone; 186

(3) Methaqualone. 187

(e) Any material, compound, mixture or preparation which 188

contains any quantity of the following central nervous system 189

stimulants including optical salts, isomers and salts of isomers 190

unless specifically excepted or unless listed in another schedule: 191

origin, or independently by means of chemical synthesis, or by 214

derivative, or preparation of opium or opiate, excluding naloxone 217

hydrochloride, apomorphine, thebaine-derived butorphanol, 218
