Executive Director Mr. John Ware reported on the following:1. State Budget Update: The Board’s operating budget request for the biennium that

begins on July 1, 2011 was included in the state budget bill (House Bill 153) that was passedin the House of Representative on May 5 . The budget bill is currently being considered byth

the Senate and I testified in support of the Board’s budget request before the Senate FinanceCommittee on May 12 . After the Senate passes its version of the budget, the process willth

move to a conference committee and then back to the Governor and hopefully a new budgetwill take effect before the end of the fiscal year on June 30 . th

2. Audit: I distributed to the Board a copy of the Board’s audit for the period July 1,2008 through June 30, 2010. I am pleased to report that the Auditor of the State did not findany noncompliance or significant control deficiencies in the Board’s procedures andoperations.

3. NASASPS Conference: The annual conference of the National Association of StateAdministrators and Supervisors of Private Schools (NASASPS) was held May 1-4, 2011 inDenver, CO. Approximately 175 representatives from other states, accrediting agencies,guaranty agencies, schools, and the U.S. Department of Education were in attendance.During the annual members meeting, I was re-elected President of the NASASPS Board ofDirectors.

4. Federal HEA Update: The United States Department of Education (USDOE) isfinalizing its implementation of the Reauthorization of Higher Education Act (approved byCongress last year) through the rulemaking process. There are a number of significantfederal rule changes that are going into effect on July 1, 2011. I have given the Board a copyof a brief summary of the program integrity rule changes. The USDOE has not yet issuedthe final rule related to it’s gainful employment proposal but we are anticipating that the rulewill be issued soon.

Executive Director Mr. John Ware reported on the 3 Quarter Financial Report (see attachedrd

report).

Investigator Ms. Kimberly Stein reported on the following:

Below is a summary of investigate activity for FY 11:Since the March 30, 2011 meeting, we have opened fourteen (14) new cases. The new cases includeten (10) new student complaints and four (4) new investigative inquiries.Since the March 30, 2011 meeting, we have closed twenty-five (25)total cases.

WHEREAS National Center for Urban Solutions TEC currently holds a valid certificate ofregistration with this Board; andWHEREAS the school has failed to submit fees and other items requested by the Board as part ofthe school’s certificate of registration renewal; andWHEREAS this constitutes a violation of Sections 3332.07 and 3332.09 of the Ohio Revised Codeand, Sections 3332-1-04.4 of the Ohio Administrative Code.Therefore be it resolved that:RESOLVED, that the Executive Director of this Board, be, and he hereby is, directed to notifyNational Center for Urban Solutions TEC and the owner thereof, that this Board intends to initiateformal disciplinary action pursuant to Ohio Revised Code Section 3332.091 and in accordance withOhio Revised Code Chapter 119 for the aforementioned violations.
