The Committee noted a report by the Director of Planning and Environment on development control applications and miscellaneous matters, including the current situation regarding planning appeals (copy of report pc-111012-r04-lsm circulated with agenda and appended to signed minutes together with the revised Update Report tabled at the meeting).

(The Chairman advised the Committee that the following planning applications (Item 1 and 2) relating to the site at 48A Common Lane, Titchfield would be considered together).

Item (1) P/09/0581/VC - 48A Common Lane, Titchfield The Committee received the deputations referred to in minute 5 above. The Committee was referred to the Update Report which provided the following information:- Two letters have been received updating previous comments given in objection to the application; - The condition was put in place for justified and important reason and requires the site to be restored to countryside when the site ceases to be used by Mr and Mrs Bunting. - The business is no longer operating in the manufacture of wood products and therefore a variation of a condition relating to this permission should be refused. One letter has been received updating previous comments given in support of the application: - Remaining in business at Common Lane is essential at this time or recession taking into account employment of several men. At the invitation of the Chairman, Councillor Mrs Hockley addressed the Committee on this application. Upon being proposed and seconded, the officer recommendation to grant planning permission subject to the conditions in the report was CARRIED. (Voting: 9 for; 0 against). RESOLVED that planning permission be granted subject to the existing conditions but with a variation to condition 1 to allow the use to be carried out by Mr and Mrs H G Bunting and Messrs J and S Bunting. Reasons for the Decision - The development is acceptable taking into account the policies and proposals of the Development Plan as set out below. The variation of the personal condition to allow the use to be carried out also by Messrs J & S Bunting is not considered to have any unacceptable planning implications which are not already sufficiently controlled by way of other planning conditions. There are no other material considerations judged to have sufficient weight to justify a refusal of the application, and where applicable conditions have been applied in order to satisfy these matters. The scheme is therefore judged to be in accordance with section 38(6) of the Planning and Compulsory Purchase Act 2004 and thus planning permission should therefore be granted. The Committee was referred to the Update Report which provided the following information:- Two letters have been received updating previous comments given in objection to the application: - There is an enforcement notice in place - the site office should be removed - The office is not ancillary to wood manufacturing - There is a clear intention to use the office for operating a fencing contractor's business. The business website gives 48A Common Lane as the business address and post still arrives there. There will be an increase in activity on the site. This will lead to further non-compliance of planning conditions relating to P/99/0658/CU - The office is in the countryside and

strategic gap - moving it back further is contrary to policy - The office causes nuisance and noise and is detrimental to the amenities of nearby residents . Visual impact of portacabin. The planning agent has submitted the following short statement regarding the current and proposed use of the portacabin:- The site office is required by Mr & Mrs Bunting to enable the use of the land for the manufacture of timber products to continue on the site. The previous planning permission for this use included the provision of ancillary office space. The building will be used for office and administrative purposes which are ancillary to the manufacturing use including dealing with correspondence, processing orders and business transactions, telephone calls, file handling and storage, computer and other office equipment occasional meetings with suppliers, supervision and management of the manufacturing business. The existing building would be relocated to the proposed position on the site. The existing building is not and will not in the future be used for the purposes of the fence contracting business. The current use of the Common Lane site is very limited as the business is currently focused on establishing the fence contracting arm of the business on a new site at Cherry Tree Farm in that part of Burridge falling within the district of Winchester. The office activities associated with the fencing contracting arm of the business are carried out at the new premises. The workshop and all of its equipment have been retained on the Common Lane site and the manufacturing activity will resume in due course once the business has established the fence contracting use on the new site. The operators have relocated the contracting business from the site and so the requirement to cease the use of the land as a fencing contractor's yard has been complied with. It has been noted that the advertising for the business still refers to the Common Lane site. The business is still in a period of transition and this will be addressed as part of the exercise to establish the fence contracting arm of the business on the new site. A further planning statement was received from the agent on 11 October 2011 regarding the current and future use of the office building:-

1 This additional statement sets out the position in relation to the use of the office building following the cessation of the use of the land as a fencing contractors yard as required by the Enforcement Notice issued by the Council on 4 May 2010. 2 The site office is required by Mr & Mrs Bunting to enable the use of the land for the manufacture of timber products to continue on the site. Subject to the repositioning and lowering of the office building as proposed, the proposed retention of the office building in conjunction with the lawful use of the site for the manufacture of wood products would not harm the amenities of nearby residents. The building's visual appearance would not harm the character of the countryside or strategic gap. Other material considerations are not judged to have sufficient weight to justify a refusal of the application, and where applicable conditions have been applied in order to satisfy these matters. The scheme is therefore judged to be in accordance with Section 38(6) of the Planning and Compulsory Purchase Act 2004 and thus planning permission should therefore be granted. Item (3) - P/11/0483/FP - Hinton Hotel and The Limes, Catisfield Lane, Fareham The Committee received the deputations referred to in minute 5 above. At the invitation of the Chairman, Councillor Mrs Hockley addressed the Committee on this application. Upon being proposed and seconded the officer recommendation to refuse planning consent was CARRIED. (Voting: 9 for; 0 against). RESOLVED that planning permission be REFUSED. Reasons for the Decision - The development is not acceptable taking into account the policies and proposals of the Development Plan as set out below. It is considered that the proposals would impact upon nature conservation, provide inadequate affordable housing and highway mitigation measures, lack of information to support loss of public house; lack of off-site open space contribution; inadequate parking; lack of transport contribution; harmful impact of nursing home building upon conservation areas and setting of listed buildings; unacceptable design layout - overdevelopment, cramped, limited garden sizes, dominance of car parking, relationship of car parking with dwellings, poor quality of environment for future occupiers, harmful development in the countryside and Meon Valley Strategic Gap. There are no other material consideration judged to have sufficient weight to outweigh the impact of the proposed use and justify permitting the application. The scheme is therefore judged to be contrary to Section 38(6) of the Planning and Compulsory Purchase Act 2004 and thus planning permission should therefore be refused. Upon being proposed and seconded the officer recommendation to REFUSE planning permission was approved. (Voting: 9 for; 0 against ) RESOLVED that planning permission be REFUSED. Reasons for the Decision - The demolition is not supported by a permitted scheme of works and as such the demolition is not considered to preserve or enhance the character or appearance of the Catisfield Conservation Area. Policies - The adopted Fareham Borough Core Strategy Policy: CS6 - The Development Strategy and PPS5 - Planning for the Historic Environment. Catisfield Conservation Area Character Assessment.

Item (5) - P/11/0500/TO - 56 Andalusian Gardens, Whiteley The Committee received the deputations referred to in minute 5 above. A proposal that the application be REFUSED CONSENT on the grounds that the proposed tree works are not considered necessary and have a harmful effect of the visual amenity of the area, was seconded and voted on and CARRIED. (Voting: 8 for refusal; 1 against refusal). RESOLVED that CONSENT be REFUSED. Reasons for the Decision -The proposed tree works are not acceptable taking into account the policies and proposals of the Development Plan as set out below. The Committee considered that on the basis of the submitted information the felling of the tree is unnecessary and would be harmful to the visual amenities and character of the area. Policies: The Adopted Fareham Borough Local Plan Review (FBLPR) Policy; DG4 - Site Characteristics. N.B. The Head of Development Management undertook to investigate the tree works which had been undertaken on the western side of the tree prior to obtaining consent. Item (6) - P/11/0598/VC - 238 Botley Road, Burridge Upon being proposed and seconded, the officer recommendation to grant planning permission subject to the conditions in the report was CARRIED. (Voting: 8 for; 0 against). (N.B. Councillor Bayford had left the meeting when this matter was considered). RESOLVED that subject to the conditions in the report planning PERMISSION be granted. Reasons for the Decision - The development is acceptable taking into account the policies and proposals of the Development Plan as set out below.. The proposal is not considered to result in unacceptable impacts upon the street scene or character of this area including its countryside qualities, or upon the amenities of neighbouring properties, or on the local highway network, other material considerations being judged not to have sufficient weight or direction to justify a refusal of the application, and, where applicable, conditions having been applied in order to satisfy these matters. The scheme is therefore judged to be in accordance

Correction: Page 38, under Relevant Planning History, P/10/0713/OA, should read "erection of 15 dwellings" not 14 as stated. The Committee was referred to the Update Report which provided the following information:- The applicant has amended the proposed street lights to simple 1m tall bollard lighting which would alleviate concerns over light spill.

Upon being proposed and seconded, the officer recommendation to APPROVE planning permission subject to the conditions in the report and continuation of a 1.8 metre fence along the northern boundary rear of the parking spaces was CARRIED. (Voting: 9 for; 0 against). Therefore the complete removal of the seven trees and their replacement with suitable species is the most viable option in arboricultural terms.

The fencing on the property's front boundary is considered to be visually obtrusive, incongruous and unsympathetic to the visual amenities of the street scene and area. RESOLVED that, subject to the conditions in the report, planning PERMISSION be granted. Reasons for the Decision- The development is acceptable taking into account the policies of the Local Plan as set out below.. The proposal is not considered likely to result in an impact on the amenity of adjoining occupiers and the character of the area. There are no other material considerations that are judged to have sufficient weight to justify a refusal of the application, and where applicable conditions have been applied in order to satisfy these matters. MISCELLANEOUS MATTERS Item (1) P/09/0892/FP Cams Hall Estate, Portchester The Committee received the deputations referred to in minute 5 above. Councillor Price proposed that criminal proceedings to be taken for the removal of the trees covered by the TPO. The motion did not find a seconder and fell. A motion was moved and seconded that:- subject to the landowner entering into a planning obligation pursuant to Section 106 of the Town and Country Planning Act 1990 on terms drafted by the Solicitor to the Council to secure: (i) Satisfactory replacement planting for an area of 15 metres outside the

development site and 45 metres within the development site being undertaken within the current planting season (end of November 2011) ; and

(ii) Satisfactory replacement planting on the development site should consent P/09/0892/FP not be implemented by spring 2012;

that no action be pursued in respect of the trees subject to Tree Preservation Order 616 being felled. Upon being proposed and seconded the above revised recommendation was voted on and CARRIED. (Voting: 6 for; 1 against). (N.B. Councillors Bayford and Davies had left the meeting when this matter was considered). Part of the area within the application site had consent under P/09/0892/FP authorising the removal of the landscape hedge within the application site and the Committee were satisfied that, were consent P/09/0892/FP not to be implemented by spring 2012, then the planning obligation would secure the replanting of this area which would restore the amenity of the area should the development not proceed. Committee were satisfied that it was not in the public interest to bring criminal proceedings under the TPO for the unconsented area of hedging/trees that had been removed given that replanting could be secured.

7. TREE PRESERVATION ORDER

The Committee considered the confirmation of the following Fareham Tree Preservation Order which had been made by officers under delegated powers and to which no comment or objection had been received:- Fareham Tree Preservation Order No 663 - Durnford, Brownwich Lane and 65 Common Lane. Titchfield Order served on 4 August 2011 covering six oaks located as follows:-

4x in the garden of Durnford, Brownwich Lane 2x in the garden of 65 Common Lane.

RESOLVED that Fareham Tree Preservation Order No 663 be confirmed as

made and served.
