Chair Turner called the forth meeting of the 2012-2013 Board to order at 8:00 A.M., Wednesday, April, 17, 2013 at the Board office in Montgomery, Alabama. The following were in attendance:

It was determined that a quorum was present.

Minutes of the third meeting of the 2012-2013 Board held January 31. 2013 were received for approval.

13-103. IT WAS MOVED by Mr. Arnold and seconded by Mr. Foust that the minutes ofthe third meeting of the 2012-2013 Board held on January 31, 2013 be approved as presented. MOTION CARRIED 6-0.

Actions from previous board meetings were reviewed.

The Board determined that "Setting of Monuments", "Remote Supervision", and "Life Safety Designs" were to be removed from the list of action items.

The Board also determined that the letter regarding professional engineer certifications on subdivision plats should be sent to municipalities and counties.

APPLICATIONS- Mr. Phillip E. Santora, Advisor

The Board previously authorized Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. All applications for licensure, intern certification and examinations issued since the January 31, 2013 Board Meeting were reviewed.

Applications of those applying for Professional Engineer licensure by comity, as provided by Section 34-11-4( 1 )(b) of the Licensure Law, were considered.

Applications of those applying for Professional Engineer licensure by examination, as provided by Section 34-11-4(1 )a. and b. of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered.

Applications of those applying for Engineer Intern certification, as provided by Section 34-11-4(2) of the Licensure Law, were considered.

Applications of those applying for Land Surveyor licensure by examination, as provided by Section 34-11-4(3)a., b., and c. of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure by examination having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved for the Alabama Land Surveying Standards, History, and Law Examination.

13-104. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust that the Board go into executive session at 8:30a.m. to consider applications without personal appearance, and evaluation of transcripts. Dr. Turner and Misters, Arnold, Wilbanks, Barter, Santora and Foust voted in favor of the motion.

Chair Turner announced the Board would reconvene into open session in approximately thirty minutes. The meeting was closed to the public.

The meeting returned to open session at 9:10 A.M.

FORMAL HEARING

Mr. Luay Esho had filed a request for a hearing before the Board in regards to his previously denied professional engineer by comity application. A hearing regarding the application was conducted, and a court reporter was present in order to prepare a transcript of the proceedings.

Mr. William H. Alexander had filed a request for a hearing before the Board in regards to his previously denied professional land surveyor by examination application. A hearing regarding the application was conducted, and a court reporter was present in order to prepare a transcript of the proceedings.

Ms. Katherine Parris Cross had filed a request for a hearing before the Board in regards to her previously denied professional engineer by examination application. A hearing regarding the application was conducted, and a court reporter was present in order to prepare a transcript of the proceedings.

Upon completion of the hearings the Board went into Executive Session for deliberation.

13-105. IT WAS MOVED at 10:20 A.M. by Mr. Arnold and seconded by Mr. Foust that the Board of Licensure for Professional Engineers and Land Surveyors go into Executive Session for the purpose of deliberation regarding the requests submitted by Mr. Esho, Mr. Alexander, and Ms. Cross. Dr. Turner, and Misters Barter, Wilbanks, Santora, Arnold and Foust voted in favor of the motion.

Chair Turner announced the Board would reconvene into open session m approximately fifteen minutes. The meeting was closed to the public.

The meeting returned to open session at 10:40 A.M.

13-107. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold that the Board approve Mr. Alexander's professional land surveyor by examination application. MOTION CARRIED 6-0

13-108. IT WAS MOVED by Mr. Santora and seconded by Mr. Barter that the Board deny Ms. Cross' professional engineer by examination application. MOTION CARRIED 6-0

13-109. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust that the Board accept for licensure by comity those applicants listed on Attachment #1. MOTION CARRIED 6-0.

13-110. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold that the Board accept for EIILSI certification those applicants listed on Attachment #2. MOTION CARRIED 6-0.

13-111. IT WAS MOVED by Mr. Foust and seconded by Mr. Santora that the Board approves for examination those applicants listed as approved on Attachment #3. MOTION CARRIED 6-0.

13-112. IT WAS MOVED by Mr. Santora and seconded by Mr. Barter that the Board disapprove applicant Kimberli Norton's degree as a GUEC category as it applies to engineering licensure. MOTION CARRIED 6-0.

13-113. IT WAS MOVED by Mr. Santora and seconded by Mr. Barter that the Board approve applicants William Chancery and Zenda Davis' degrees as a GUEC category as it applies to engineering licensure. MOTION CARRIED 6-0.

13-114. IT WAS MOVED by Mr. Arnold and seconded by Mr. Wilbanks that the Board approve Lee Long's degrees as a related to surveying category as they apply to land surveying licensure. MOTION CARRIED 6-0.

The Board received a request from Michael Byrnes, EIT to consider approving an alternative arrangement for engineering experience to be verified for a future PE application. Mr. Byrnes proposed an arrangement where he would discuss his failure analysis of aerospace components with licensed PE's in the local area for the four years necessary to qualify for licensure. After discussion, the Board determined either a more structured mentorship program pre-approved by the Board or the verification of experience by someone considered substantially equivalent to a PE could meet the experience requirements, however it would reserve its approval until the experience is complete and PE application is received.

LAW ENFORCEMENT- Mr. W. Gerald Wilbanks, Advisor

The Board reviewed the status of the files pending with the Board, the Investigator, and/or the Investigative Committee. The Board was briefed on the 2012 - 2013 statistics.

The Board reviewed enforcement actions taken against Alabama licensees by other licensing jurisdictions and criminal convictions that were self-reported during the 2013 license renewal cycle.

13-115. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold that the cases listed as "MSl", "MS2", "LAl", "SCI", "SC2", and WVl", be notified that copies ofthe actions will be placed in their Alabama licensing files. MOTION CARRIED 6-0.

13-116. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold that a Complaint Investigation be initiated regarding "ID 1/MO 1 ". MOTION CARRIED 6-0.

The Board reviewed pending cases that the investigative committees have completed to accept, modify, or reject the suggested courses of action.

13-117. IT WAS MOVED by Mr. Arnold and seconded by Mr. Wilbanks that there was probable cause that Jonathan Powell PE #27084 and his firm provided design plans for a private school that were determined to be not compliant with the 2009 International Building Code and 2009 International Fire Code. The PE and his firm also provided an engineering design plan that was used for construction of 14 storm shelters in Alabama. The accepted terms of the Consent Order are that Mr. Powell and his firm pay $2,500 fine to the Board, he will serve a 2 year probation period, and the matter will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Mr. Foust recused. (Case 2012-14-B)

13-119. IT WAS MOVED by Mr. Foust and seconded by Mr. Santora to close Case 2012-31-B with no action. MOTION CARRIED 5-0 with Mr. Barter recused.

13-120. IT WAS MOVED by Mr. Arnold and seconded by Mr. Santora that there was probable cause that James Carpenter and his firm Carpenter Plumbing, Inc., utilized the term "Engineers" without employing an Alabama licensed professional engineer or obtaining a certificate of authorization for engineering from the Board relative to an internet website advertisement that identified the firm as "water and sewer distribution engineers." The accepted terms of the Consent Order are that Mr. Carpenter and his firm, cease and desist use of the term "engineers", pay a civil penalty $338.96 to the State of Alabama General Fund, pay to the Board $161.04 for cost associated with the investigation, and the matter will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Mr. Wilbanks recused. (Case 2012-33-C)

13-121. IT WAS MOVED by Mr. Arnold and seconded by Mr. Wilbanks that there was probable cause that John F. Hunt, PE #18784 failed to provide documentation verifying the continuing professional competency credits earned by him and reported on his 2012 professional engineer license renewal application relative to a Board audit within the specified time. The accepted terms of the Consent Order are that his professional engineer license shall be subject to one (1) year probation, his license shall be subject to audit of the claimed continuing professional competency credits twice within seven 7 years and the matter will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Dr. Turner recused. (Case 2012-35-B)

13-122. IT WAS MOVED by Mr. Foust and seconded by Mr. Santora to close Case 2012-38-B with no action. MOTION CARRIED 5-0 with Mr. Barter recused.

13-123. IT WAS MOVED by Mr. Barter and seconded by Mr. Foust to close Case 2013-04-B with no action. MOTION CARRIED 5-0 with Dr. Turner recused.

13-124. IT WAS MOVED by Mr. Arnold and seconded by Mr. Wilbanks that there was probable cause that Blue Keith Jarod McCoy, a fundamentals of surveying examination candidate, was involved in examination collusion relative to the October 27, 2012 examination administration in Alabama. The accepted terms of the Consent Order are that he must complete a continuing professional competency course in surveying ethics provided by the Department of Surveying Engineering at New Mexico State University, he cannot submit an application for the Fundamentals of Surveying examination for a period of 2 years from the date of Final Order and upon successful completion of the Department of Surveying Engineering at New Mexico State University and the matter will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Mr. Foust recused. (Case 2013-08-C)

13-125. IT WAS MOVED by Mr. Santora and seconded by Dr. Turner to close complaint relative to 2013-13-B with no further investigation. MOTION CARRIED 4-0 with Misters Arnold and Wilbanks recused.

13-126. IT WAS MOVED at 11:35 A.M. by Mr. Foust and seconded by Mr. Wilbanks that the Board go into Executive Session for the purpose of deliberation on Case 2013-05-C.

Dr. Turner and Misters Barter, Arnold and Santora, Foust and Wilbanks voted in favor of the motion.

Dr. Turner announced the Board would reconvene into open session in approximately 30 minutes The meeting was closed to the public.

The Board deliberated on the recommendations provided by the Administrative Law Judge in regards to Case 2013-05-C. Mr. Santora was recused.

The meeting was opened to the public at 12:00 noon.

13-127. IT WAS MOVED by Mr. Arnold and seconded by Mr. Barter to find Mr. Hamdan Alyami, a fundamentals of engineering candidate, guilty of the charges and to agree with the Administrative Law Judge's conclusions and recommendations with modifications. Mr. Alyami must pay to the Board $2,030.00 for cost of hearing within 30 days of the final order, his October 27, 2012 Fundamentals of Engineering examination results shall be invalidated, and if he registers to sit for another offering of the FE examination the test will be administered under special accommodations. MOTION CARRIED 5-0 with Mr. Santora recused. (Case 13-05-C)

The Board referred Case 2013-02-B and Case 2013-01-B back to the appropriate investigative committee.

The Board recessed for lunch at 12:05 PM and reconvened at 1:00 P.M.

CERTIFICATES OF AUTHORIZATION- Mr. Marc S. Barter, Advisor

The Board previously authorized the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of 50 Certificates of Authorization issued to engineering firms (CA-4562-E through CA-4612-E) and 14 Certificates of Authorization issued to land surveying firms (CA-1011-S through CA-1024-S) since the January 31, 2013 Board Meeting were reviewed.

13-128. IT WAS MOVED by Mr. Arnold and seconded by Mr. Santora that the Board ratify the approval of Engineering Certificates of Authorization CA-4562-E through CA-4612-E and Surveying Certificates of Authorization CA-1011-S through CA1024-S issued since the January 31, 2013 Board Meeting and that the list of those issued be included in the minutes on Attachment #4. MOTION CARRIED 6-0.

13-129. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Foust that the Board deny the Certificate of Authorization renewal of McCrory Surveying Company Inc., approve the certificate of authorization renewals of Pro 17 Engineering and J.P. Miller Engineering, Inc, and approve the certificate of authorization application of NCO Engineering LLC. MOTION CARRIED 6-0.

The Board was asked by System Engineering Group, Inc (SEG) to consider waiving the certificate of authorization requirements for the firm thereby allowing them to register with the Secretary of State's office. The information provided indicated the firm has the term "Engineering" in its name, only provides services to the federal government (DoD), and will not offer engineering services to the public from the Huntsville branch office. The information further indicated the Secretary of State's office will not issue them a certificate of authority (qualify them to do business) until the Board identifies that their use of the term "engineering" is allowed.

13-130. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust that the name Systems Engineering Group, Inc (SEG) fits within the current law if it only offers services to the federal government. MOTION CARRIED 6-0.

LEGISLATIVE- Mr. W. Gerald Wilbanks, Advisor

The Board discussed the status of its pending legislation that was introduced in the 2013 General Session. (HB 355/SB 232). The passing of this legislation is urgent since the Board may not be able to offer the Fundamental Exams once they convert to computer based exams under its current law.

CONTINUING PROFESSIONAL COMPETENCY- Mr. Earl R. Foust, Advisor

The Board was briefed on the results of the audit of the 2013 renewals.

FINANCE- Dr. Daniel S. Turner, Advisor

Financial reports for January and February 2013 were reviewed.

LAND SURVEYING -Mr. C. Michael Arnold, Advisor

The out-of-cycle ALLS exam was administered in the board office on February 6, 2013. The Board reviewed the results ofthe February 2013 state specific portion ofthe LS examinations.

13-131. IT WAS MOVED by Mr. Santora and seconded by Mr. Foust to accept the Board's recommended cutoff score and approve the results of the ALLS Exam given February 6, 2013 and to license the individuals who passed the ALLS Exam having previously passed the FLS and PLS Exams and that the list of those issued be included in the minutes on Attachment #1. MOTION CARRIED 6-0.

CHAIR'S REPORT

The Annual Report was reviewed. It was suggested that the staff look at the contents of the report to determine what was significant information and how to reformat the report.

Proposed changes in the Administrative Code were recommended at the December 2012 board meeting. Changes to Rule 330-X-2.01 were discussed and approved.

13-132. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Santora to approve and adopt the changes to Rule 330-X-2.01 as proposed. MOTION CARRIED 6-0.

EXECUTIVE DIRECTOR'S REPORT

Travel to the 2013 NCEES Annual Meeting was approved

13-133. IT WAS MOVED by Dr. Turner and seconded by Mr. Wilbanks that all board members, and four members of Board staff attend the 2013 NCEES Annual Meeting in San Antonio, TX August 20-25, 2013. MOTION CARRIED 6-0.

The Board was updated on the transition to Computer Based Testing (CBT) of the fundamentals exams. A process identified as "automatic" was described which allows the applicants to apply directly to NCEES to take the exam. The Board approved beginning the "automatic" process for approval of the FE and FS candidates beginning with the offering of the CBT exams.

13-134. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Foust that the Board begin the "automatic" process for approval of the FE and FS candidates beginning with the offering of the CBT exams. MOTION CARRIED 6-0.

The Board was briefed procedures to be used to meet requirements of the Alabama Immigration Law.

Travel to various in state and out of state meetings was discussed. The Board determined Board staff should attend various state society and various building official meetings to conduct outreach activities aimed at licensees, approving authorities and consumers. Since meetings held out-of-state, require approval by the governor, the Board determined in order to streamline its approval process that travel for Board business will be at the discretion of the Board Chair and Executive Director.

13-135. IT WAS MOVED by Mr. Barter and seconded by Mr. Foust to authorize out-of-state travel for Board business at the discretion of the board chair and the board executive director. MOTION CARRIED 6-0.

Travel to the 2013 Tri-State Engineering Society Meetings (AL, MS, and LA) was approved.

UNFINISHED BUSINESS

Dr. Turner led a discussion of Qualification Based Selection. In 2011 the Board adopted a position statement to further give guidance on how to comply with the QBS requirement. One option identified in the position paper is the use of two envelopes (see highlighted section of position statement). Licensees and some board members are concerned that this will lead to more bidding scenarios and have asked the Board to reconsider their position. Dr. Turner volunteered to look at the position statement and provide recommended revisions. The draft revision has been circulated amongst the board members and will be discussed with representatives of ACEC.

CORRESPONDENCE

The Board discussed a request to consider changing how it looks at the quality of the surveying services provided. The Board stated that the quality of the survey drawing produced; and the method used to determine that quality during the investigative process have always been a concern. The current "desktop" review of a questioned survey relies on evaluating the survey using the current standards of practice for land surveying in Alabama. Dr. Turner agreed to contact the individual for additional discussion, and the Board took no action.

The Board discussed a request to consider changing the definition of "retired" license status. The current process requires an individual who is in retired status to renew their license annually. The fee for renewal if over the age of 65 is $10.00. There is also a provision that if the retired licensee wants to convert the license to active status during the year they must pay $35.00 (difference between normal renewal and the retired renewal) and must do the required continuing education. The Board took no action on the request.

Newsletters and general correspondence not requiring a response were reviewed.

NEW BUSINESS

Engineering Practice Questions

The Board discussed questions received from licensees as to when the services of an architect are required. The Board advised that licensees should continue to practice within their area of expertise, and that it does not determine what an Architect can or cannot do.

Surveying Practice Questions

The Board discussed questions received from licensee relative to GIS and Surveys as well as ALTA Surveys relative to surveyor's liability and the regulation of GIS with minimum technical standards. The Board stated it does not make determinations regarding liability; that GIS is not within the practice of land surveying and therefore is not regulated by the Board, and ALTA surveys are also not regulated by this Board.

General Practice Questions

The Board was asked to clarify the requirements relative to the retention of documents, specifically signed and sealed drawings. The Board determined the Law and Code requires continuing education documents be retained for four years; and allows complaints to be filed up to 10 years from the date of occurrence, and recommended retention of documents accordingly.

The Board was asked to clarify the requirements relative to advertising on the internet using websites, pay per click advertising, banner ads, or video ads. The Board concurred that the regulations on advertising have been established in the Board's Law and Code and are clear.
