Chair Ulrich called the fourth meeting of the 2009-2010 Board to order at 8:00 A.M., Thursday, March25, 2010, at the Board office in Montgomery, Alabama. The following were in attendance:

It was determined that a quorum was present. The proposed meeting agenda was reviewed. The newagenda items were briefed and it was agreed to deviate from the agenda in regards to the order of itemsbeing discussed to allow for the open discussion of certain agenda items on the Friday portion of themeeting.
10-116. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Reisz to adopt the revisedagenda. MOTION CARRIED UNANIMOUSLY.
Minutes of the third meeting of the 2009-2010 Board held January 26-27, 2010 were received forapproval.
10-117. IT WAS MOVED by Mr. Arnold and seconded by Mr. Santora that the minutes of thethird meeting of the 2009-2010 Board held on January 26-27, 2010 be approved ascorrected. MOTION CARRIED UNANIMOUSLY.
Action items from previous meetings were reviewed.
CORRESPONDENCE
It was suggested that two agenda items under the Correspondence section be discussed prior todiscussing applications since the Board's decision on the requests for opinions could have a bearing onpending applications.

The Board reviewed a request for a declaratory ruling from Mr. John Mogge. Mr. Mogge was askingthe board to clarify what experience engineering graduates could claim as engineering when they areemployed in the construction industry. Board members reviewed the provisions that are contained inthe Licensure Law and Administrative Code and compared them to the NCEES Model Law and Rulesand the ASCE Construction Institute Guide to Professional Engineering Licensure for theConstruction Engineer. It was the Board's opinion that there was not a conflict between thedocuments.
10-118. IT WAS MOVED by Mr. Arkle and seconded by Mr. Wilbanks that Mr. Arkle and Dr.Turner will work with the board staff to draft the declaratory opinion based on thediscussions from the board meeting. MOTION CARRIED UNANIMOUSLY.
The Board reviewed a request from Valmont Newmark, Inc. who was asking if a firm is offeringengineering services to clients to modify manufactured products to conform to the client'srequirements, does the Board consider this incidental engineering and if so does the company require aCertificate of Authorization. It was the Board's opinion that if the firm is doing custom engineering oftheir own manufactured product and not providing other engineering services then it probably wouldbe considered incidental engineering. It was agreed that each case would have to be considered on itsown merits.

IT WAS MOVED by Mr. Ulrich and seconded by Mr. Arkle that the Board ofLicensure for Professional Engineers and Land Surveyors go into Executive Sessionfor the purpose of discussing pending applications. Misters Arkle, Arnold, Reisz,Santora, Ulrich, Wilbanks, and Dr. Turner voted in favor of the motion.
Chair Ulrich announced the Board would reconvene into open session in approximately one hour at10:30 A.M. The meeting was closed to the public. The Executive Session was concluded and theBoard reconvened in Open Session at 11:45 A.M.
Applications of those applying for Professional Engineer licensure by comity, as provided by Section34-1 1-4(1)(b) of the Licensure Law, were considered.
Applications of those applying for Professional Engineer licensure by examination, as provided bySection 34-11-4(1)a. and b. of the Licensure Law having previously passed the FE Examination inAlabama or in another jurisdiction, were considered.
Applications of those applying for Engineer Intern certification, as provided by Section 34-11-4(2) ofthe Licensure Law, were considered.
Applications of those applying for Land Surveyor licensure by Examination, as provided by Section34-11-4(3)a., b., and c. of the Licensure Law, were considered. Applications of those applying for

Professional Land Surveyor licensure by examination having previously passed the Fundamentals ofLand Surveying Examination and the Principles and Practice of Land Surveying Examination inAlabama or in another jurisdiction were considered and were approved for the Alabama LandSurveying Standards, History, and Law Examination.
Applications of those applying for Land Surveyor Intern certification, as provided by Section 34-11-4(4) of the Licensure Law, were considered.

10-124. IT WAS MOVED by Mr. Santora and seconded by Mr. Arkle that the Board approvesfor examination those applicants listed as approved on Attachment #3. MOTIONCARRIED UNANIMOUSLY.
10-125. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold that the Board defersfor examination those applicants listed as deferred on Attachment #3. MOTIONCARRIED UNANIMOUSLY.
LAW ENFORCEMENT — Mr. W. Gerald Wilbanks, Advisor
The Board reviewed the status of the files pending with the Board, the Investigator, and/or theInvestigative Committee. The Board reviewed the list of those completed cases that are beingmonitored. The Board was briefed on the 2010 statistics.
The Board reviewed enforcement action taken against Alabama licensees by other licensingjurisdictions. The licensees will be notified that copies of the actions will be placed in their Alabamalicensing files and where deemed appropriate enforcement cases were to be opened.

IT WAS MOVED by Dr. Turner and seconded by Mr. Arkle that the Board ofLicensure for Professional Engineers and Land Surveyors go into Executive Sessionfor the deliberating on investigative cases previously heard by the administrative lawjudge. Misters Arkle, Arnold, Reisz, Santora, Ulrich, Wilbanks, and Dr. Turner votedin favor of the motion.

Chair Ulrich announced the Board would reconvene into open session at approximately 2:30 P.M. Themeeting was closed to the public. The Executive Session was concluded and the Board reconvened inOpen Session at 2:30 P.M.
10-127. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Arnold to reject the proposedconsent order and to find Mr. Gary R. Smith, Professional Land Surveyor #13199,guilty on all nine counts and to accept the Administrative Law Judge'srecommendations with modifications. Mr. Smith will reimburse the Board $3,446.97for the cost of the hearing and his professional land surveyor's license will be revoked.MOTION CARRIED 6-0 with Mr. Wilbanks recused. (Case 09-303-B)
10-128. IT WAS MOVED by Dr. Turner and seconded by Mr. Arkle to find Mr. NathanRedwine, a non-licensee, guilty of two offenses under the one count and to accept theAdministrative Law Judge's recommendations with modifications. Mr. Redwine willcease and desist any and all acts constituting the impersonation of AlabamaProfessional Engineer License # 19348, he will reimburse the Board $1,550.98 for thecost of the hearing and will pay a $5,000 civil penalty to the State of Alabama GeneralFund. MOTION CARRIED 6-0 with Mr. Arnold recused. (Case 09-317-C)

IT WAS MOVED by Mr. Ulrich and seconded by Mr. Arnold that the Board ratify theapproval of Engineering Certificates of Authorization CA-3933-E through CA-3978-Eissued since the January 26-27, 2010 Board Meeting and further that the list of thoseissued be included in the minutes on Attachment #4. MOTION CARRIED 6-0 withDr. Turner recused.

IT WAS MOVED by Mr. Arkle and seconded by Mr. Wilbanks that the Board ratifythe approval of Land Surveying Certificates of Authorization CA-918-LS through CA-920-LS issued since the January 26-27, 2010 Board Meeting and further that the list ofthose issued be included in the minutes on Attachment #4. MOTION CARRIEDUNANIMOUSLY.
The Board reviewed the certificate of authorization applications that had anomalies.
10-131. IT WAS MOVED by Mr. Arkle and seconded by Mr. Arnold to approve those CA'slisted as approved on Attachment #5, disapprove those CA's listed as disapproved onAttachment #5, to defer those CA's listed as deferred on Attachment #5. MOTIONCARRIED UNANIMOUSLY.

The Board was briefed on legislation being monitored. The Board deferred commenting on thepending legislation about the splitting of the board until later in the meeting.

CONTINUING PROFESSIONAL COMPETENCY — Mr. Al I. Reisz, Advisor
The Board was briefed on progress of the audit for 2010 renewals. The audit notifications have beensent with a deadline of April 22, 2010 for the providing of the necessary documentation.
FINANCE/PERSONNEL — Dr. Dan Turner, Mr. Don T. Arkle, Advisors
The reports on the receipts as well as expenditures were reviewed.
LAND SURVEYING — Mr. C. Michael Arnold., Advisor
10-132. IT WAS MOVED by Dr. Turner and seconded by Mr. Santora to accept the Board'srecommended cutoff score for the ALLS Examination, to approve the results of theALLS Exam given February 5, 2010, to license those individuals who passed theALLS Exam having previously passed the FLS and PLS Exams and further that thelist of those issued licensure as a result of passing these examinations be included inthe minutes on Attachment #1. MOTION CARRIED UNANIMOUSLY.
EXECUTIVE DIRECTOR'S REPORT
The Board discussed the conflict of the proposed July meeting date with the ASCE Alabama SectionSummer meeting.
10-133. IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Arnold to change the BoardMeeting date to July 15-16, 2010. MOTION CARRIED UNANIMOUSLY.
The Board reviewed the proposed agenda for the upcoming NCEES Southern Zone Meeting.
10-134. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Reisz that the Board supportsDr. Turner for nomination as Southern Zone Secretary-Treasurer. MOTIONCARRIED UNANIMOUSLY.
UNFINISHED BUSINESS
The Board was briefed on the results on the nominating committee's efforts to draft rules for inclusionin the Administrative Code. It was explained that the nominating committee was proposing rulechanges and that they also had adopted policy guidelines to be used by the nominating committee.
10-135. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Santora that the Board approvesthe proposed rule changes and begins the process for adoption of the rules. MOTIONCARRIED 6-1-0 with Mr. Reisz voting in the negative.
The meeting adjourned at 5:00 P.M. The meeting reconvened at 8:00 A.M., Friday March 26, 2010 atthe Board office with all board members present.

The Board reviewed pending cases that the investigative committees have completed to accept,modify, or reject the suggested courses of action.
10-136. IT WAS MOVED by Mr. Arkle and seconded by Dr. Turner that probable cause existsthat Mr. English Parks Moore, a non-licensee, and S&S Sprinkler Company hadprovided engineering services without being a licensed professional engineer or thefirm having an Engineering Certificate of Authorization. The proposed terms of theconsent order are Mr. Moore will pay the Board $797 for the cost of the investigation,he will pay a $2,000 civil penalty to the State of Alabama General Fund, he and thefirm agree to comply with the Board's Fire Protection Position Statement and that therecord of this matter will be a matter of public record. The Board accepted the termsof the consent order and issued the final order. MOTION CARRIED 6-0 with Mr.Ulrich recused. (Case 08-24-C)
10-137. IT WAS MOVED by Mr. Arnold and seconded by Dr. Turner that probable causeexists that Mr. Don R. Wijeratne, Professional Engineer #25467, had prepared designdrawings outside of his area of competency. The proposed terms of the consent orderare Mr. Wijeratne will pay the Board a $1000 fine, he will serve one year probation,and that the record of this matter will be a matter of public record. The Boardaccepted the terms of the consent order and issued the final order. MOTIONCARRIED 6-0 with Mr. Arkle recused. (Case 08-24-C)

IT WAS MOVED by Mr. Arnold and seconded by Mr. Santora that probable causeexists that Mr. Rick Caldwell, a non-licensee, and his firm Calenco, LLC had offeredengineering services without obtaining a valid professional engineer license and thefirm having an Engineering Certificate of Authorization. The proposed terms of theconsent order are Mr. Caldwell will pay the Board $144.30 for the cost of theinvestigation, he will pay a $500 civil penalty to the State of Alabama General Fund,they will cease and desist using the term "engineering" until such time as he employs alicensed Alabama professional engineer and obtains an Engineering Certificate ofAuthorization from the Board, and that the record of this matter will be a matter ofpublic record. The Board accepted the terms of the consent order and issued the finalorder. MOTION CARRIED 6-0 with Dr. Turner recused. (Case 10-08-C)

10-150. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Arkle that probable cause existsthat Mr. David L. Thomas, a non-licensee, and his firm Eagle 1 Resources had offeredengineering services without obtaining a valid professional engineer license and thefirm having an Engineering Certificate of Authorization. The proposed terms of theconsent order are that Mr. Thomas will pay the Board $646.00 for the cost of theinvestigation, he will pay a $1,000 civil penalty to the State of Alabama General Fund.they will cease and desist using the term "engineering- until such time as he employs alicensed Alabama professional engineer and obtains an Engineering Certificate ofAuthorization from the Board, and the record of this matter will be a matter of publicrecord. Monthly payments of $100 will be allowed. The Board accepted the terms ofthe consent order and issued the final order. MOTION CARRIED 6-0 with Mr. Reiszrecused. (Cases 09-294-C and 09-298-C)
The Board reviewed the provisions of two final orders where the individuals were in noncompliancewith the terms of the consent orders. No action was taken on Case 05-22-B since the individual is nowin compliance. It was briefed that the respondent in Case 09-319-B has paid his fine but has notcompleted the required professional development hours.
10-151. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner to revoke Mr. Dudley L.Greenway's Professional Land Surveyor License # 18385 for non-compliance of theprovisions of the consent order. MOTION CARRIED 6-0 with Mr. Reisz recused(Case 09-319-B)
The Board was briefed on the length of the pending disciplinary cases being scheduled for the MayBoard meeting.

10-152. IT WAS MOVED by Mr. Ulrich and seconded by Dr. Turner that the May Boardmeeting dates is adjusted so that the meeting will begin at 1:00 P.M. on May 19, 2010.MOTION CARRIED UNAMIMOUSLY.
FORMAL HEARINGS
At the request of Mr. Charles B. Robison, the Board conducted a formal hearing to render a decisionon Mr. Robison's request for reinstatement of his previously revoked professional engineer license.The Board heard testimony from Mr. Robison. A court reporter was present and a transcript of thehearing is on file in the office.
At the request of Mr. Curtis T. Pierce, the Board conducted a formal hearing to render a decision onMr. Pierce's request for reinstatement of his previously revoked professional land surveyor license.The Board heard testimony from Mr. Pierce. A court reporter was present and a transcript of thehearing is on file in the office.
At the conclusion of the hearings the Board determined it required an executive session to discuss theapplications.

IT WAS MOVED by Mr. Wilbanks and seconded by Mr. Reisz that the Board ofLicensure for Professional Engineers and Land Surveyors go into Executive Sessionfor the purpose of discussing the license re-issuance applications of Mr. Robison andMr. Pierce. Misters Arnold, Reisz, Santora, Ulrich, Wilbanks, Arkle and Dr. Turnervoted in favor of the motion.
Chair Ulrich announced the Board would reconvene into open session in approximately thirty minutesat 10:30 A.M. The meeting was closed to the public. Mr. Arkle recused himself during the discussionsregarding Mr. Pierce. The Executive Session was concluded and the Board reconvened in OpenSession at 10:30 A.M.
10-154. IT WAS MOVED by Mr. Reisz and seconded by Mr. Wilbanks to grant Mr. Robison'srequest and allow for the reinstatement of Mr. Charles B. Robison's professionalengineering license. MOTION CARRIED UNANIMOUSLY.
10-155. IT WAS MOVED by Dr. Turner and seconded by Mr. Wilbanks to deny Mr. Pierce'srequest and further that a letter be sent to Mr. Pierce voicing the Board's concernsabout repeated actions with no evidence of a change in pattern and that he must takean ethics course prior to any reissuance application being reconsidered. MOTIONCARRIED 6-0 with Mr. Arkle recused.
CHAIR'S REPORT
The Board considered the request from ASPLS to support the concept of separating the existing boardinto two boards. It was noted that this was the first board meeting since the request had been receivedand as such was the first opportunity for the Board to discuss the issue. Comments from the board staffregarding the implementation problems of the proposed legislation had been distributed earlier. Mr.Ulrich opened with comments that the Board would not be making any official motion to either

support or oppose the concept and that he anticipated that the Board members' comments would be onhow the proposed legislation would impact the current board or the impact on the two boards notnecessarily that the separation was good or bad. Comments and observations were made by all boardmembers, the executive director and board attorney. Comments were received by members of thepublic present including Mr. Ray, Mr. Lucas, Mr. Bush, and Ms. Casillas. After all who wanted tomake comments had the opportunity to do so; the discussion closed with everyone agreeing toseriously look at the issues involved remembering that the mission of any hoard was to protect thehealth, safety, and welfare of the public.
Having received no comments on the duly advertised proposed changes in the Administrative Code,the Board approved the proposed changes in fees.
10-156. IT WAS MOVED by Mr. Arnold and seconded by Mr. Ulrich that the Board adoptsthe changes to Appendix A to Chapter 4 of the Administrative Code as proposed.MOTION CARRIED UNANIMOUSLY.
CORRESPONDENCE
The Board reviewed a request from Mr. Robert Howard who had requested that the exam fee he hadpaid for the April PE exam is rolled over since he had failed to complete the NCEES registrationprocess.
10-157. IT WAS MOVED by Mr. Arkle and seconded by Dr. Turner to disapprove Mr.Howard's request for a roll-over of the PE exam fee to the October exam. MOTIONCARRIED 5-2-0 with Dr. Turner and Mr. Wilbanks voting in the negative.
The Board reviewed requests from various individuals who had requested either a refund or a waiverof the reinstatement fee for their individual license renewals.
10-158. IT WAS MOVED by Mr. Arkle and seconded by Mr. Ulrich to disapprove all requests.MOTION CARRIED UNANIMOUSLY.
The Board reviewed a letter from the Japan Engineer's Federation who was requesting guidance onhow to get their engineers licensed in the United States. It was noted that NCEES is beginning to offerthe national exams at foreign sites and that licensing boards were beginning to receive queries fromforeign engineering federations looking to get an inroad into the licensing of their engineers by a U.S.jurisdiction. The Board members agreed that this is a growing issue with global engineering and thatwe must be proactive. Recognizing that it is each state's responsibility for licensure within theirjurisdiction but that there is also a national model, it was suggested that NCEES should take the lead indeveloping a method to evaluate foreign experience.
10-159. IT WAS MOVED by Dr. Turner and seconded by Mr. Reisz that a letter be sent toNCEES asking the President to task a committee to establish a model criteria forevaluating international experience for engineering licensure. MOTION CARRIEDUNANIMOUSLY
The Board reviewed correspondence from Mr. Jonathan Bonner who was concerned that the liberalinterpretation taken in the past about the types of work that can be performed under the "incidental

architecture" clause by professional engineers is being eroded. The Board members noted that someengineers may have a liberal interpretation regarding the term incidental but that the Board believesthat incidental should be considered the same as minor.
10-160. IT WAS MOVED by Mr. Ulrich and seconded by Mr. Arkle that the Board interpretsthe term -incidental architecture" is synonymous to minor architecture. MOTIONCARRIED UNANIMOUSLY.
The Board reviewed correspondence from Mr. Warren Mason who identified concerns about languagethat was being proposed by Phenix City in regards to certifications. The Administrative Code outlinesthe procedures to be used when completing certifications. If what is being asked for is beyond theresponsibility/control of the professional engineer then it should be noted when completing thecertification.
10-161. IT WAS MOVED by Mr. Arkle and seconded by Dr. Turner to send a response to Mr.Mason identifying the provisions in the Administrative Code. MOTION CARRIEDUNANIMOUSLY.
The Board reviewed various newsletters that required no response.
OPEN FORUM
No comments were received during the open forum portion of the meeting.
CLOSING REMARKS
The next meeting of the Board for board business is scheduled for Wednesday, May 19, 2010 inMontgomery, Alabama beginning at 1:00 P.M.
