The 340th Meeting of Registration Committee (RC) was held under the Chairmanship of

1.0 Confirmation of minutes of the 339th meeting of the Registration Committee.

As no comments were received, the Minutes of 339th Meeting were confirmed. It was however, brought to the notice of the Committee that in case of application for grant of registration of Cyazafamid 34.5% SC under Agenda Item No.6.6 “indigenous manufacture” was inadvertently mentioned in place of “import”. The Committee approved the correction in the same.

2.0 Follow up action on the decisions taken by the Registration Committee in its 339th meeting.

The Committee noted the action taken by the Secretariat with satisfaction.

2.1 Applications pending under various sub-sections of the Insecticides Act, 1968.

The RC while noting the status of applications pending under various categories and appreciating the efforts of the Secretariat to overcome it, also desired to step them up.

2.2 Presentation of M/s Dow Agro Sciences for grant of registration for indigenous manufacture of Penoxsulam 21.7% SC w/w u/s 9(3).

The representative of the applicant made a presentation and clarified the issue regarding the safety of the soil metabolite BSTCA. It was concluded that the presence of this metabolite in infinitesimal quantity shall not be of any concern. After detailed deliberation, the Committere approved the grant of registration subject to fixation of MRL. The Committee decided that the conditions (i) and (iii) in regard to the agenda item (6.5) of Minutes of the 339th meeting may also be ensured.

2.3 Presentation of M/s Unikil Pesticides, Vidisha per the decision under agenda item no. 3.2 of the 339th RC meeting

In compliance to the Order of the Hon’ble High Court of Delhi, an opportunity was given to M/s Unikil Pesticides, Vidisha to make a presentation before the Committee on their case in person. The Committee heard the representationist as well as the submissions made by the Secretariat of CIB & RC and decided that a self-speaking Order shall be passed separately and communicated to the applicant.

3.0 Government Business

3.1

Harmonization of the data requirement as per OECD and EU guideline as recommended by Kanungo Committee Report.

The Committee accepted the views of Secretariat of CIB&RC on the comments received from various stakeholders on the protocols approved in 339th Meeting (Annexure-I). It further decided that relevant modifications in the existing guidelines may be placed before the Committee along with complete set of protocols in the next Meeting. The Committee also desired that the Report of the Expert Working Group constituted for looking on the various mathematical models for spray operators exposure studies may be placed before it.

3.2 Consideration of findings recorded during special inspection of the premises of M/S Shobikaa Impex Pvt. Ltd., Karur (T.N.)

The Committee consented to the draft for issuing a show cause notice to M/S Shobika Impex Pvt. Ltd., Karur (T.N.) as a follow up action of the special inspection. The Committee also considered the reply of ANA laboratories to the show cause notice and, after detailed deliberations, decided that no application enclosing the data generated by ANA Laboratories be henceforth accepted for the purpose of registration. However, the applications already received till the date of display of the minutes on the website may continue to be examined.

3.3 Consideration of request of Associations of Pesticide Industry regarding stipulation of a condition for origin of invoice by the registered source at the time of export.

The Committee decided to continue with its existing decision, already in vogue. However, the issue shall be discussed with the Pesticide Industry during the next Meeting of Open House.

3.4 Alleged violation of the Insecticides Act, 1968 and Insecticides Rules, 1971 by M/S Sumitomo Chemicals India Pvt. Ltd., Mumbai.

The Committee approved the grant of extension of 30 days for submitting the reply to the show cause notice. It also decided that no further extension shall be granted.

3.5 Consideration of the issue of defending decisions taken by the Registration Committee in case of appeals, court cases, etc.

The Committee delegated full powers to the Secretariat of CIB&RC to defend the decisions taken by the RC based on the available records.

3.6 Consideration of request of Associations of Pesticide Industry regarding verification of source of import.

The Committee did not accept the contention of the Associations of Pesticide Industry and decided to continue with its existing decision. It, however, decided that, in case, no response is forthcoming from the country of source, the verification may be got done through the respective Embassy of India through DNA, India.

3.7 Addl.

Consideration of the revised Scheme for carrying out Storage Stability Studies (Data) for registration of Insecticides.

Approved.

3.8 Addl.

Consideration of closing of files under Export, Chemical/Bio-pesticide u/s 9(3) & 9(3B) and other category, pending for reply of deficiencies for more than 6 months.

The Committee decided that if, after the issue of letter of deficiency, no reply is received within a period of six months, the application shall be closed after giving 30 days notice for all categories of applications, except export. Since the applications for export category are dealt on priority, the period for reply to deficiencies shall be maximum 90 days. However, the procedure for closing the applications shall remain the same. The Committee also decided that the application once closed shall not be re-opened.

Consideration of reports of effect of neonicotinoids on honey bees.

The Committee decided to recommend to DAC to constitute a Committee for review the use of neonicotinoids as well as other category of pesticides which are found toxic to pollinators including honey bees. In the meanwhile, a condition “Not To Be Used On Crops Where Honey Bees Are Pollinators/Foraging” may be incorporated in the certificates of registration as well as on label & leaflet of such products, which is to be printed in BOLD LETTERS.

The Committee deliberated the agenda in detail and decided that applicant may be asked to make a presentation with specific reference to the following:

i. Anaerobic soil metabolism. ii. Persistence in plant, soil and water. iii. Justification for combination product.

6.2 Consideration of an application of M/s Crystal Crop Protection Pvt Ltd., Delhi for grant of registration for indigenous manufacture of Emamectin Benzoate 1.9% EC u/s 9(3).

Approved and decided that a condition may be incorporated in the Certificate of Registration as well as on label & leaflet which may be prinited in BOLD LETTERS "Do Not Spray on crops on which Honey Bees Are Pollinators/Foraging”.

6.3 Consideration of an application of M/s Godrej Consumer Products Ltd., Mumbai for grant of registration for indigenous manufacture of Imiprothrin 0.05% + Cypermethrin 1.0% CL u/s 9(3).

6.5 Consideration of an application of M/s Sumitomo Chemical India Pvt. Ltd., New Delhi for grant of registration for import of HDPE Long Lasting Net incorporated with Permethrin 2% w/w u/s 9(3).

The Committee decided as under:-

(i) Not approved for sale in open market since the issue for disposal of used LLIN is not decided by MoE & F.

(ii) Applicant should submit separate application for change in the name of the supplier alongwith relevant documents.

6.6 Consideration of an application of M/s Krishi Rasayan Exports Pvt. Ltd., New Delhi for grant of registration for import of Emamectin Benzoate Technical from a New source u/s 9(3).

The Committee recalled that this case was approved in 336th meeting as under:- “Approved subject to verification of the source of import from DNA, China”. Accordingly, the verification was taken up with ICAMA, China. Events were chronologically explained in the Agenda Notes alongwith annexures. It was also informed that the process of verification was being done from ICAMA, China, by the Secretariat of CIB&RC, while a reference was also got made by the applicant from the Hunnan Pesticide Association. The representative of the applicants, Shri L.R. Agarwal, made a verbal presentation in RC with the prior permission of the Chairman, wherein he was asked to provide the authentic documents to clarify about the import of the sample of Emamectin Benzoate Technical 95% minimum as the data on bio-efficacy was of 2004 and the verification documents (Annexure-6.6.3) showed that the source was not allowed to produce Emamectin Benzoate Technical 95% minimum in 2004, whereas letter from Hunan Pesticide Association (Annexure – 6.6.4) got sent by the applicant on his own without any reference from Sectt of CIB & RC indicated that source actually started systhesis of this product during 2004 and export license of the product by 2005 with license No.CHD 178 - 2005.

Thereafter, the members of the Committee discussed and deliberated the issue, and approved the grant of registrartion to the applicant subject to submission of authentic documents to clarify about the import of the sample of Emamectin Benzoate Technical 95% minimum or verification of the letter of Hunnan Pesticide Association from ICAMA, China, as this association is not a Government body.

6.7 Consideration of an application of M/s Pravara Agro Bio-Tech, Ahmednagar (MS) for grant of registration for indigenous manufacture of Beauveria bassiana 1.15% WP u/s 9(3) (Strain : BB-IARI-RJP, Accession Number : MCC-1022).

8.0 ENDORSEMENT CASES

8.1 Consideration of an application of M/s Crystal Crop Protection Pvt. Ltd., Delhi for change in the name of source of import for Imidaclopride Technical from M/s Wuxian Pesticide Factory, Jiangsu, Mudu, Suzhou, Jiangsu, China to M/s Chongquing Banan Foreign Trade Imp. & Exp. Corporation, to M/s Chongquining Banan Foreign Trade Imp. & Exp. Corporation, Jiangbei, China.

The Committee was apprised that there was a typographical error in the name of source of import in the Agenda. After deliberation and on the basis of annexures in the agenda, the Committee approved the change in name of the source of import for Imidacloprid Technical from M/s Wuxian Pesticide Factory, Jiangsu, Mudu, Suzhou, Jiangsu, China to M/s Suzhou Bianzing Agro-Biochemical Co. Ltd, China.

8.2 Consideration of request of M/s BASF India Ltd., Mumbai for Label expansion of Metiram 55 + Pyraclostrobin 5% WG on Chilli crop.

Approved, subject to fixation of MRL.

8.3 Consideration of a Request of M/s Godrej Consumer Products, Mumbai for the endorsement of alternate packaging of Transfluthrin 1% FU in primary packaging, secondary packaging and in transport packing.

Approved, as proposed in Agenda. 8.4 Consideration of a Request of M/s Godrej Consumer Products, Mumbai for the

endorsement of alternate packaging of Transfluthrin 0.88% LV in transport packing/shipper inserting 48 Nos. of Liquid Vaporizer + Heating device instead of 100 Nos.

1. Test substance: Stably positioned radiolabelled (preferably C14 radio isotope) active ingredients should be used so that all significant moieties or degradation product can be tracked.

It was virtually impossible to procure radio-labelled pesticides within India thereby necessitating its import which is not possible for many registrants. Further, there are very few laboratories which are equipped to conduct metabolism studies with radioactive substances, therefore, it was requested that use of radioactive pesticides (active ingredients) should be kept optional and opportunity should be given to registrants to generate the data using unlabelled pesticides analyses.

Considering the global scientific development, the metabolism studies with radiolabelled items can not be dispensed with. The lab who wants to conduct these studies are required to upgrade themselves. Hence, this comment may not be accepted.
