Minutes of 294 th SEAC Meeting Date 05/10/2016 The 294 th meeting of SEAC was held in Directorate of Environment, U.P. on 05/10/2016 following members were present in the meeting along with Secretary, SEAC: 1. General Discussion: The committee noted that there have been various cases where the SEIAA/SEAC has directed the proponent to submit information and project proponent, even after longtime, have not submitted the replies or have submitted replies after long delay. The 294

th meeting of SEAC was held in Directorate of Environment, U.P. on

05/10/2016 following members were present in the meeting along with Secretary, SEAC:

The Chairman welcomed the members to the 294th

SEAC meeting.

General Discussion:

The committee noted that there have been various cases where the SEIAA/SEAC has

directed the proponent to submit information and project proponent, even after longtime, have

not submitted the replies or have submitted replies after long delay. In this situation, even after

the disposal of matter from the level of SEIAA/SEAC, the status of project remains pending (at

the project proponent side) and thus increases the no. of projects in the pendency list. In this

situation, it is advised to submit the information by project proponent within a time limit. The

committee discussed and deliberated that if the project proponent does not submit information as

directed by the committee within 02 months, the matter shall be delisted and shall not be treated

as pending at SEAC. After delisting of the file, the matter shall only be considered after

submission of complete information with a fresh application from the project proponent citing

reasons of delay. After duly submission of replies/form, the matter shall be taken up by the

committee in chronological order as per submission date of replies/application. These

recommendations have to be implemented on all projects being considered by SEAC.

The Members of SEAC unanimously took following decisions on the agenda points

discussed:

The committee noted that the matter was earlier discussed in SEAC meeting dated

21/07/2016 wherein the project proponent was directed to submit information:

1- Submit the structural design duly signed by the qualified structural engineer of the

date prior to the start of the project work and approved layout plan of the complete

project should also be submitted along with the building plans.

2- Submit the date of start of construction with 100/- Rs. Affidavit.

The project proponent submitted their replies through letter dated 16/08/2016. A

presentation was made by Shri Shivendra Nath, project proponent along with their consultant

M/s Environment and Technical Research Center. The committee discussed the reply and

observed that the structural design certificate issued by Dr. Khalid Moin mentions the project

details as existing blocks which suggests that vetting has been done regarding the proposed

construction. The project proponent submitted that the details in the certificate have been

mentioned on the basis of approved drawings hence, this language has been used and there is no

construction on the proposed part of the project. However, the committee directed to submit

corrected vetting certificate for 22 floors with mention of proposed blocks. The committee also

directed to get the structural drawings signed by the structural engineer and vetted by the

designated authority with date.

Regarding date of start of construction the project proponent has submitted affidavit

dated 05/08/2016. Necessary additional documents in this regards should also be submitted.

Existing site photographs should also be submitted.

The matter shall be discussed after submission of above information.

2. BEAVE HEART Raj Nagar (Housing Complex) Khasra N0- 1083, Vill-Noor Nagar,

The committee noted that the matter was earlier discussed in SEAC meeting dated

28/06/2016 wherein the project proponent was directed to submit information:

1. Submit compounding letter with fee receipt.

2. Prima-facia the SEAC feels that this is the case of violation.

3. In tower A, B, G there is increase in units and height by converting stilt into the

ground floor therefore the project proponent has to provide the construction status

date wise of each floor of A, B & G and show that drawing, design, structural

stability certificate were already approved before start of construction. Also

submit the approval of proposed construction of units on ground floor as to be

converted from stilt floor by competent authority.

4. Revised parking is to be submitted for new proposal.

The project proponent submitted their replies through letter dated 19/08/2016. A

presentation was made by Shri Jaiprakash Malpani, project proponent along with their consultant

M/s Eko Pro Engineers Pvt. Ltd. The proponent, through the documents submitted and the

presentation made, informed the committee that:-

1. The environmental clearance is sought for Group Housing Project “Beave Heart” Raj

Nagar at Khasra N0- 1083, Vill-Noor Nagar, Ghaziabad, U.P. M/s Belgravia Projects Pvt.

4. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The project proponent also submitted letter dated 27/11/2016 from Ghaziabad

Development Authority issued for M/s Belgravia Pvt. Ltd. khasra no. 1083, Village-Noornagar,

Ghaziabad. The project proponent also submitted that no construction has been done beyond

compounding and revised drawings after compounding has been approved by GDA. Structural

safety certificate and fire NOC have been submitted. The committee noted that the structural

design for B block was approved for 11 floors before construction, hence, 12th floor can not be

allowed now, when the construction has already been started with approval of 11 floors only. In

block A & G, the project proponent proposal for converting stilt into housing on ground floor

may be allowed with condition that all other layout plan shall remain the same.

The committee discussed the matter and recommended grant of environmental

clearance for proposed expansion in block A & G in the project along with general

conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Provision of parking should be restricted to ECS as required under Development

Authority bye-laws.

2. Provision of setback on all sides should be made as per Development Authority bye-laws.

3. Copy of all NOCs from different Departments shall be obtained prior to start of

construction.

4. Necessary planning for any anticipated expansion should be incorporated in present

design in view of structural stability.

5. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste

(Management and Handling) Rules, 2000 (as amended).

6. 03 m peripheral green shall be provided around the project inside the project boundary.

7. 15% area of the total plot area shall be compulsorily made available for the soft green

belt development including the peripheral green belt.

8. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

9. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for

the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement.

10. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase. 100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

11. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

12. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

13. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

minimum 2% of the total project cost shall be prepared phase wise and approved by

Board of Directors of the company. A copy of resolution as above shall be submitted to

the authority. A list of beneficiaries with their mobile nos./address should be submitted

alongwith six monthly compliance reports.

14. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

15. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

16. All entry/exit point should be bell mouth shaped.

17. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

18. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

19. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

20. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to

be carried out as CPCB Guidelines.

21. Crèche to be provided during the construction/operation phase.

22. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

23. Provision of separate room for senior citizen with proper amenities shall be made.

24. Protection shall be provided on the windows of the high rise flats for security of

residents.

25. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

26. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

27. For any extraction of ground water, prior permission from CGWB shall be taken.

28. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

29. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

30. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

3. Group Housing at Pot No-GH-01D, Sector-16, Greater Noida West- Sri Garav Garg,

Director, A-128, Sector-63, Noida. File No. 2673

The committee noted that the matter was earlier discussed in SEAC meeting dated

28/06/2016 wherein the project proponent was directed to submit information: 1. The project proponent was absent. The consultant has failed to submit evidence for no

construction at the site for which EC has been asked alongwith proof and photographs.

2. In blocks A, B, C, D the floors have been added therefore, the project proponent has to bring

the proof that structural design was approved before the commencement of the project.

Revised approved map from competent authority is to be submitted alongwith comparative

statement showing status of the project.

3. Total project cost is Rs. 100 Cr. Corporate Social Responsibility (CSR) cost is Rs. 2.0 Cores;

need based project plan of phase wise work to be done along with budgetary provision should

be prepared and approved by Board of Directors of the company. A copy of resolution as

above shall be submitted to the authority. List of beneficiaries and address and photographs is

to be submitted accordingly.

The project proponent submitted their replies through letter dated 12/08/2016. The

proponent submitted affidavit for no construction. An inspection of the site has also been

undertaken by Regional Officer, UPPCB, Greater Noida and Deputy Director, Directorate of

Environment on 18/02/2016 and communicated to Directorate of Environment through letter

dated 16/03/2016. The committee discussed the inspection report according to which there are 04

towers proposed in the project out of which civil work for 02 towers basement is under progress

whereas construction work for rest 02 towers have not been initiated. The project proponent also

submitted that the project has got approval from authority for 3.5 FAR and all the maps and

drawing have been approved by the development authority on this FAR. The project proponent

also submitted construction status of proposed towers in the project.

A presentation was made by Shri Gaurav Garg, project proponent along with their

consultant M/s Eko Pro Engineers Pvt. Ltd. The proponent, through the documents submitted

and the presentation made, informed the committee that:-

1. The environmental clearance is sought for Expansion of Group Housing Project at Pot

No-GH-01D, Sector-16, Greater Noida, U.P. M/s Ratan Buildtech Pvt. Ltd.

2. The environmental clearance for earlier proposals was issued by SEIAA, U.P. through

letter no. 1600/Parya/SEAC/1565/2012/AD(H), dated 08/10/2013.

5. An underground tank shall be planned within the premises for storage of rain water for

water recharge purposes.

6. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste

(Management and Handling) Rules, 2000 (as amended).

7. 03 m peripheral green shall be provided around the project inside the project boundary.

8. 15% area of the total plot area shall be compulsorily made available for the soft green

belt development including the peripheral green belt.

9. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

10. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for

the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement.

11. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase. 100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

12. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

13. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

14. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

minimum 2% of the total project cost shall be prepared phase wise and approved by

Board of Directors of the company. A copy of resolution as above shall be submitted to

the authority. A list of beneficiaries with their mobile nos./address should be submitted

alongwith six monthly compliance reports.

15. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

16. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

17. All entry/exit point should be bell mouth shaped.

18. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

19. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

20. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

21. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to

be carried out as CPCB Guidelines.

22. Crèche to be provided during the construction/operation phase.

23. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

24. Provision of separate room for senior citizen with proper amenities shall be made.

25. Protection shall be provided on the windows of the high rise flats for security of

residents.

26. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

27. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

28. For any extraction of ground water, prior permission from CGWB shall be taken.

29. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

30. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

31. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

The committee noted that the matter was earlier discussed in SEAC meeting dated

18/06/2016 wherein the project proponent was directed to submit information:

1- Justification for proposed common biomedical waste treatment facility at Kumbhi,

Kanpur when already 2-3 common biomedical waste treatment facilities have been

installed within 150 km radius.

2- The project proponent to submit the inventory of Hospitals/clinics/Dispensaries

/Health care units including the details of beds with in 150km radius.

3- Status of operation of other nearby common biomedical waste treatment facilities

with capacity of incinerator.

4- All the facts submitted should be verified by C.M.O.

5- The committee also decided to provide objection letter of association of Sangam

Medi Services Pvt. Ltd. dated 14/06/2016 association of Common Bio Medical Waste

facility operation in UP letter dated 21/03/2016 to the proponent to give para wise

comments to be considered in SEAC meeting.

The project proponent submitted their replies through letter dated 16/08/2016. A

presentation was made by Shri Sanjay Prakash Garg, representative of project proponent along

As per information only one CBWTF has Authorization. Uttar Pradesh Pollution Control Board (UPPCB) had issued Closure Notice on 27/05/2014 to M/S Willword

Environment due to non-performance. As on date, application is under consideration.

9. Selected land is in adjoining to existing TSDF (Hazardous facility), far away from

habitation area.

10. The project proposal falls under category 7(da) of EIA Notification, 2006 (as amended).

The committee discussed the matter and recommended following TORs for conducting

EIA studies regarding the proposals in view of amendment in EIA Notification dated

17/04/2015:

1. An agreement/membership of hazardous waste management as per the provisions of

revised hazardous waste management rules, 2008 shall be submitted alongwith the EIA

6. Land requirement for the facility including its break up for various purposes, its

availability and optimization.

7. Details of proposed layout clearly demarcating various activities such as security,

Storage Room, Pollution Control Devices like APCS and ETP, ash storage/disposal area,

vehicle washing areas, and others such as admin area, worker’s room, health centers,

greenbelt, etc.

9. Details on collection and transportation of Bio Medical Waste from health care

establishments. No. of vehicles and feature of vehicles, etc.

10. Details of waste storage facilities/rooms.

From the information submitted by the project proponent as per above table it was

informed that in Tower A & D 10 floors have been added while the construction have been done

in G+2 in Tower A and G+6 in Tower D. In Tower B & C the construction has been done in

G+19 as per pervious EC. No construction has been made in the commercial.

1. Through Notarized affidavit dated 28-06-2016, the project proponent informed that the

construction on the tower A & D was started on 1-04-2015. As on date, the tower A& D

are 2B+G+2 and 2B+G+6 respectively. Tower A & D are now proposed as 2B+G+17

and 2B+G+17 respectively.

2. The project proponent also submitted digital photographs of tower A & D as per the

direction of SEAC meeting dated 19-08-2016.

The committee discussed the matter and recommended grant of environmental

clearance for proposed project along with general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Provision of parking should be restricted to ECS as required under Development

Authority bye-laws.

2. Provision of setback on all sides should be made as per Development Authority bye-laws.

3. Copy of all NOCs from different Departments shall be obtained prior to start of

construction.

4. Necessary planning for any anticipated expansion should be incorporated in present

design in view of structural stability.

5. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste

(Management and Handling) Rules, 2000 (as amended).

6. 03 m peripheral green shall be provided around the project inside the project boundary.

7. 15% area of the total plot area shall be compulsorily made available for the soft green

belt development including the peripheral green belt.

8. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

9. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for

the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement.

10. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase. 100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

11. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

12. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

13. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to

minimum 2% of the total project cost shall be prepared phase wise and approved by

Board of Directors of the company. A copy of resolution as above shall be submitted to

the authority. A list of beneficiaries with their mobile nos./address should be submitted

alongwith six monthly compliance reports.

14. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

15. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

16. All entry/exit point should be bell mouth shaped.

17. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

18. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

19. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

20. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to

be carried out as CPCB Guidelines.

21. Crèche to be provided during the construction/operation phase.

22. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

23. Provision of separate room for senior citizen with proper amenities shall be made.

24. Protection shall be provided on the windows of the high rise flats for security of

residents.

25. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

26. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

27. For any extraction of ground water, prior permission from CGWB shall be taken.

28. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

29. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

30. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

01/08/2016 wherein the project proponent was directed to submit information:

The committee noted that the matter was earlier discussed in SEAC meeting dated

18/06/2016 wherein the project proponent was directed to submit information:

1. The details of the minimum and maximum ground level concentration of the

particulate in the predominant wind direction particularly in the month of winter at

low height to be resubmitted with incremental concentration level.

2. All analysis reports station wise and date of sampling with photographs be

submitted.

3. Details landscape plan be submitted.

4. Proposal for online monitoring of PM 10 and PM 2.5 be submitted.

5. Monitoring stations at Highway should be marked and mentioned in Traffic Study.

The ambient noise level monitoring at all stations be conducted and analysis be

submitted in bar chart form.

6. Details of CSR to be submitted with the name of beneficiaries and phase wise

implementation plan.

1. The proponent to submit the fresh proposal for the grant of EC for plot 2B and if

required for 2A separately as EC was granted for entire plot 2 for which EC as

expired.

2. Building plan, Services plan, Landscaping plan, parking plan, approved by competent

authority and stability certificate vetted by IIT is be submitted for plot no. 2B.

3. Complete area statement in single unit of sqm to be submitted alongwith the area

details of all features in percentage.

4. Plan for bio composting at the site is to be submitted.

presentation was made by Shri Rajeev Gupta, project proponent along with their consultant M/s

Envirta Sustainable Solutions India Pvt. Ltd., New Delhi. The proponent, through the documents

submitted and the presentation made, informed the committee that:-

22. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

23. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

24. Landscape plan, green belts and open spaces may be described separately.

25. Study the existing flora and fauna of the area and the impact of the project on them.

26. Examine existing crèche, education, health facilities, police, post Office, Banks and other

services and make adequate provisions in the proposal.

27. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

28. Application of renewable energy/alternate energy, such as solar and wind energy may be

described including solar water heating in the guidelines for entrepreneurs.

29. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

30. Identification of recyclable wastes and waste utilization arrangements may be made.

31. Explore possibility of generating biogas from biodegradable wastes.

32. Arrangements for hazardous waste management may be described as also the common

facilities for waste collection, treatment, recycling and disposal of all effluent, emission

and refuse including MSW, biomedical and hazardous wastes. Special attention should be

made with respect to bird menace.

33. All community facilities is to be proposed as per norms and is to be submitted.

34. Provisions made for safety in storage of materials, products and wastes may be described.

35. Disaster management plan should be prepared.

36. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

37. Parking provision is to be made for higher ECS worked out either as per state bye-laws or

construction manual of the MoEF.

38. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned.

39. Use of local building materials should be described.

40. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details

with provisos of sampling port for monitoring be described.

41. Work out MGLC for the combined capacity of DG sets.

42. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

43. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

Environmental Management Plan and Environmental Monitoring Plan.

45. Total cost of the project should be certified by Chartered Accountant. Corporate Social

Responsibility (CSR) plan along with budgetary provision amounting to 2% of project

cost shall be prepared and approved by Board of Directors of the company. A copy of

resolution as above shall be submitted to the authority alongwith list of beneficiaries with

their mobile nos./address.

46. Details of all internal and peripheral roads width.

47. Source and quantity of required water during construction and management of generated

waste water.

48. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

49. Declare/submit the running cost of STP and other environmental management services

(e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.)

in the proposals which are to be including in the allotment letters.

50. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction

has been undertaken at site except fencing of the site to protect it from getting

encroached and construction of temporary shed(s) for the guard(s). (if fencing has not

been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to be

false or misleading at any stage, the project will be rejected and clearance given, if any

to the Project will be revoked at our risk and cost.” IV. Project does not fall under any buffer zone of no-development as declared /identified under

any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along

with EIA.

c. Current, site photographs viewing towards the project area from four directions indicating

date of photograph taken, direction from which taken, name of the project, and signature of

Project proponent along with consultant with seal should be submitted, so as to ensure that

no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification

of 2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for

assessment of representativeness and reliability of baseline environmental attributes

detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along

with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in

the preparation of these reports and the Name of laboratory through which the samples

have been got analysed should be stated in the report. It shall clearly be indicated whether

said laboratory is accredited by NABL or approved under the Environment (Protection)

Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name

project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the information’s

is to be submitted along with the EIA.

for provision of creche and convenient shopping and list of tress to be planted alongwith revised

parking plan. Minimum 03 m peripheral green is also committed by the proponent as per

landscape plan.

The committee discussed the matter and recommended grant of environmental

clearance on the project proposals along with general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. 18 nos. of fire hydrant should be installed.

2. Provision of parking should be restricted to ECS as required under Development

Authority bye-laws.

3. Provision of setback on all sides should be made as per Development Authority bye-laws.

4. Copy of all NOCs from different Departments shall be obtained prior to start of

construction.

5. Necessary planning for any anticipated expansion should be incorporated in present

design in view of structural stability.

6. An underground tank shall be planned within the premises for storage of rain water for

water recharge purposes.

7. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste

(Management and Handling) Rules, 2000 (as amended). Municipal solid waste

management plan alongwith list of identified vendors.

8. 03 m peripheral green shall be provided around the project inside the project boundary.

9. 15% area of the total plot area shall be compulsorily made available for the soft green

belt development including the peripheral green belt.

10. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

11. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for

the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement. Evacuation route is to be shown on map.

12. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase. 100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

13. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

14. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

15. The cost of the project is Rs. 216.6 Cr. Corporate Social Responsibility (CSR) plan along

with budgetary provision amounting to minimum 2% of the total project cost (Rs. 4.32

Cr.) shall be prepared phase wise and approved by Board of Directors of the company. A

copy of resolution as above shall be submitted to the authority. A list of beneficiaries

with their mobile nos./address should be submitted alongwith six monthly compliance

reports.

16. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

17. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

18. All entry/exit point should be bell mouth shaped.

19. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

20. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

21. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

22. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to

be carried out as CPCB Guidelines.

23. Crèche to be provided during the construction/operation phase.

24. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

25. Provision of separate room for senior citizen with proper amenities shall be made.

26. Protection shall be provided on the windows of the high rise flats for security of

residents.

27. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

28. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

29. For any extraction of ground water, prior permission from CGWB shall be taken.

30. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

31. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

32. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

The committee noted that the matter was earlier discussed in SEAC meeting dated

02/08/2016 wherein the project proponent was directed to submit information:

been submitted. 138 KLD treated waste water shall be discharged in to CSTP. The committee

discussed the replies and directed to submit following information:

1. Distance of the site from Okhla Bird Sanctuary is 6.4 KM. MoEF Notification dated

01/12/2009 provisions as follows:

"The projects to be located within 10 KM of the National Parks, Sanctuaries,

Biosphere Reserves, Migratory Corridors of Wild animals , the project proponent

shall submit the maps duly authenticated by Chief Wildlife Warden showing these

features vis-a-vis the project location and the recommendations or comments of the

Chief Wildlife Warden thereon (at the stage of EC)."

In compliance to above, certification on map should be submitted from Chief

Wildlife Warden as required.

2. Digital photographs of all proposed towers showing that no construction has been

started yet.

3. Plan for water body with Kachha base should be submitted for storm water collection

for water recharge.

4. Permission for discharge of 138 KLD into CSTP by the competent authority.

5. Total cost of the project is Rs. 115.65 Cr. Corporate Social Responsibility (CSR) plan

The committee discussed the matter and found that there is increase in the residential area

from 42 Ha. to 46 Ha. and recommended following TORs and general guidelines for conducting

EIA studies:

45. Use of local building materials should be described.

46. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack details with

provisos of sampling port for monitoring be described.

47. Work out MGLC for the combined capacity of DG sets.

48. Provide for conservation of resources, energy efficiency and use of renewable sources of

energy in the light of ECBC code.

49. Application of resettlement and rehabilitation policy may be described. Project affected

persons should be identified and rehabilitation and resettlement plan should be prepared.

50. Examine separately the details for construction and operation phases both for Environmental

Management Plan and Environmental Monitoring Plan.

51. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to 2%

of project cost shall be prepared and approved by Board of Directors of the company. A copy

of resolution as above shall be submitted to the authority alongwith list of beneficiaries with

their mobile nos./address.

52. Details of all internal and peripheral roads width.

53. Source and quantity of required water during construction and management of generated

waste water.

54. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

55. Declare/submit the running cost of STP and other environmental management services (e.g.,

Municipal Solid Waste Disposal, Green belt Maintenance, Water Management etc.) in the

proposals which are to be including in the allotment letters.

56. The proponent will submit the schedule of monitoring/data collection programme to the

Office of Directorate, Member Secretary, UP Pollution Control Board and District Magistrate

of related District.

General Guidelines: a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested by

Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for any

such litigation what so ever, the sole responsibility will be borne by the Project proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil construction has

been undertaken at site except fencing of the site to protect it from getting encroached and

construction of temporary shed(s) for the guard(s). (if fencing has not been done, then the

same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and I/We

am/are aware that if any part of the data and information submitted is found to be false or

misleading at any stage, the project will be rejected and clearance given, if any to the Project

will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified under

any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented are

factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted along with

EIA.

c. Current, site photographs viewing towards the project area from four directions indicating date

of photograph taken, direction from which taken, name of the project, and signature of Project

proponent along with consultant with seal should be submitted, so as to ensure that no

construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA notification of

2006 and the Methods of Monitoring and analysis (Annexure-IV): Guidance for assessment of

representativeness and reliability of baseline environmental attributes detailed under EIA

manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this

EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with

their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in the

preparation of these reports and the Name of laboratory through which the samples have been

got analysed should be stated in the report. It shall clearly be indicated whether said laboratory

is accredited by NABL or approved under the Environment (Protection) Act, 1986 (Please refer

MoEF office memorandum dated 4th August, 2009). The name project leader of the EIA study

shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be submitted

within 15 days from the date of receipt of the letter and remaining of the information’s is to be

submitted along with the EIA.

12. Proposed Mix Use Project at Plot No.-TCG/1-A-V-6 & TCG/1-A-V-7, Gomti Nagar,

Phase 1, Vibhuti Khand, Lucknow, U.P. File No. 3723

The project proponent did not appear in the meeting. However, their consultant M/s ENV

DAS India Pvt. Ltd. submitted letter dated 05/10/2016 that approved layout plan and structural

certificate are still awaited therefore they should be allowed to present the case after receipt of

the same from the concerned authorities. The matter shall be discussed after submission of

complete information and request from project proponent to consider the matter in chronological

order.

is 225 KLD. The fresh water requirement is 168 KLD (which is 70% of the domestic

6. It is expected that the project will generate approx 194 KLD of wastewater. The

wastewater will be treated in the STP provided within the complex generating 155 KLD

of recoverable water from STP which will be recycled within the project but 76 KLD will

become surplus during non rainy season and 79 KLD during rainy season.

7. 04 nos. of rain water harvesting pits are proposed.

8. The power supply shall be supplied by Paschimanchal Vidyut Vitaran Nigam Limited.

Total electrical load for the Group Housing Project will be approx. 3210 KVA.

9. 02 no. of DG sets of (1 x 1000 KVA, 1 x 500 KVA) capacity each i.e. 1500 KVA for

power back up in the Group Housing Project.

10. 646 ECS parking is proposed for the project.

11. The total population of the project will be 2,802 persons that include staff as well as

commercial population.

12. The project proposals are covered under category 8 "a" of EIA Notification, 2006, as

amended.

The project proponent submitted structural stability certificate dated 06/09/2014 from

Jamia Milia Islamia alongwith details of the project. Approved maps and drawings of the project

have also been submitted. Revised built up area statement of all towers with basement+stile +

floors have been submitted. 71 excess parking have been deleted and plan submitted. An

affidavit regarding CSR plan has also been submitted. The committee discussed the replies

submitted by the project proponent and recommended grant of environmental clearance

on the project proposals along with general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Provision of parking should be restricted to ECS as required under Development

Authority bye-laws.

2. Provision of setback on all sides should be made as per Development Authority bye-laws.

3. Copy of all NOCs from different Departments shall be obtained prior to start of

construction.

4. Necessary planning for any anticipated expansion should be incorporated in present

design in view of structural stability.

5. An underground tank shall be planned within the premises for storage of rain water for

water recharge purposes.

6. Municipal solid waste shall be disposed/managed as per Municipal Solid Waste

(Management and Handling) Rules, 2000 (as amended).

7. 03 m peripheral green shall be provided around the project inside the project boundary.

8. 15% area of the total plot area shall be compulsorily made available for the soft green

belt development including the peripheral green belt.

9. Project falling with in norm area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

10. Criteria/ norms provided by competent Authority regarding the seismic zone be followed

for construction work. Provision of alarm system, to timely notify the residents, in case of

occurrence of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and regular mock drills should be arranged for

the residents. Rise of stairs should be constructed in a way, so that it should provide

smooth movement.

11. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase. 100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

12. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

13. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal.

14. Total cost of the project is Rs. 94.73 Cr. Corporate Social Responsibility (CSR) plan

along with budgetary provision amounting to minimum 2% of the total project cost (Rs.

1.90 Cr.) shall be prepared phase wise and approved by Board of Directors of the

company. A copy of resolution as above shall be submitted to the authority. A list of

beneficiaries with their mobile nos./address should be submitted alongwith six monthly

compliance reports.

15. LEDs should be used in all common areas and corridors. 100% solar lighting is to be

provided in the open areas/ stairs cases.

16. Parking guideline as per Development Authority should be followed. Parking for disabled

persons should be explored.

17. All entry/exit point should be bell mouth shaped.

18. To discharge excess treated waste water into public drainage system, permission from the

competent authority to be taken prior to any discharge.

19. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

20. Height of the stack should be provided based on combined DG sets capacity and be 6mt

higher than the tallest building.

21. Post project monitoring for air, water (surface + ground), Stack noise of D.G. sets, STP to

be carried out as CPCB Guidelines.

22. Crèche to be provided during the construction/operation phase.

23. LIG & EWS housing to be provided as per U.P. Govt. Orders and building bye laws.

24. Provision of separate room for senior citizen with proper amenities shall be made.

25. Protection shall be provided on the windows of the high rise flats for security of

residents.

26. Unless and until all the environmental issues are sorted out the occupancy will be

restricted and would be only allowed after achieving the Permission from the competent

authority.

27. The project proponent shall ensure that the project site does not attract/infringe any buffer

zone of no activity identified/declared under law.

28. For any extraction of ground water, prior permission from CGWB shall be taken.

29. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

30. Possibilities of use of treated waste water for irrigation purposes should be explored. Drip

irrigation should be tried upto extent possible. No fresh water will be used for irrigation

purpose.

31. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including

the proper treatment and the disposal of the wastes.

is not restricted under any order issued by Hon'ble Court.

2. A certificate from District Magistrate, Allahabad that no mining work is being

undertaken on the site as on date.

The project proponent submitted letter from District Mining Officer, Allahabad to

Secretary, SEAC dated 06/09/2016 certifying information as above. The committee discussed the

the road, within the project. Section of all internal roads should be provided. Right of way

and carriage way width should be clearly marked on the map. Vehicular

movement/circulation plan. Revised parking plan as per bye-laws. It is also to be ensured

that the width of the proposed road as to be admissible as per building bye laws specially

4.5 metre wide road bye laws to be submitted.

7. Area statement with tower wise and floor wise details alongwith no. of units also in

percentage. Details of all block with dimensions set back and area chart details are to be

submitted.

9. Structural design certificate signed by structural engineer and vetting authority should be

and the presentation made, informed the committee that:-

1. The environmental clearance is sought for Type-V Residential for Judicial Officers

(Multi Storied Apartment) at Khasra No-513 M & 514 M, Vill-Nasarpur, Loni,

Ghaziabad.

2. The deposit work for above mentioned project is awarded to Unit-28, Construction &

Design Services, U.P. Jal Nigam (A U.P. Government Undertaking) by the Uttar Pradesh

Shashan, Lucknow in the Judgeship of Chairman Infrastructure Committee, Honable

High Court, Allahabad in the year 2012.

3. Previously, the project was proposed for the built-up area 18,107.93m2 and this office

obtained the NOC for “Consent to Establishment” from State Pollution Control Board to

start the construction at the site and subsequently we started the construction. But Later

the area of each floor is revised from 985.35m2 to 1145.90 m2 by U.P. Govt. So the total

proposed built-up area for the project gets changed to 20,817.77 m2

4. It has been brought to our notice that when the built-up area of the project is > 20,000 sq.

mtrs. it comes under the purview of EIA Notification 2006 of schedule 8(a), Category B.

Hence, we have applied for Environmental Clearance (EC) under schedule 8(a), Category

2. Municipal Water Supply

• Waste Water Generation & Disposal: � It is expected that the project will generate 38 KLD (@ 80% of total fresh water used)

of wastewater. The waste water generated during operation phase will be disposed in

the existing Trunk Sewer line on the Arya Samaj Mandir Road demarcated in the site

layout plan. STP is not proposed in the plan.

• Usage: Breakup of water requirements for various usages:

� Irrigation: 5.0 KLD

� Domestic: 30 KLD

� Miscellaneous use like back wash and make up for water body and decorative

fountain and general washing (L.S.): 10 KLD

� D.G. Sets: 2.5 KLD

12. The project proposals are covered under category 8"a" of EIA Notification, 2006, as

amended.

The committee discussed the replies submitted by the project proponent and observed

that block A was earlier approved for G+7 and now it is proposed for G+11. The committee

noted that structural drawings are undated and directed to get the date of vetting to be mentioned

on the drawings. Approved maps and drawings for the project should also be submitted.

The matter shall be discussed after submission of information as above.
