Minutes of 200th SEAC Meeting Date 12/01/2015

The 200th meeting of SEAC was held in Directorate of Environment, U.P. on

12/01/2015. Following members were present in the meeting along with Secretary,

SEAC:

The Chairman welcomed the members to the 200th SEAC meeting.

The minutes of 199th SEAC meeting dated 10/12/2014 were confirmed.

The Members of SEAC unanimously taken following decisions on the agenda points

discussed:

1- Stone Mining Project at Aarazi No-3114 & 3215, Khand no.-18, Vill-Kosharakalan,

Tehsil-Meja, Allahabad, U.P. (Leased Area-5.00 Acre) Sri Dinesh Bahadur Singh,

Vill-Kosharakalan, U.P. File No. 2139/JDCA-S

The committee noted that an application dated 10/03/2014 was made by the project

proponent for environmental clearance of Stone Mining Project at Aarazi No-3114 & 3215,

Vill-Kosharakalan, Tehsil-Meja, Allahabad, U.P. (Leased Area-5.00 Acre), which was

received in the Directorate on 10/03/2014. A presentation was made by Shri Akhand Pratap

Singh, representative of project proponent alongwith their consultant M/s Sawen Consultancy

Services Pvt. Ltd. The proponent, through the documents submitted and the presentation

made, informed the committee that:

1. The environmental clearance is sought for Stone Mining Project at Aarazi No-3114 &

3215, Khand no.-18, Vill-Kosharakalan, Tehsil-Meja, Allahabad, U.P. (Leased Area-5.00

Acre).

2. Mining Lease area was granted to the applicant Shri Dinesh Bahadur Singh for 05years

from 28/12/2007 to 27/12/2012. Application is applied for renewal of mining lease.

3. 41,080 cum/annum stone collections are proposed.

4. The mining plan has been prepared by Shri Pankaj Pandey (RQP No.-

RQP/DDN/086/95A). 5. 45 persons shall be employed for mining work.

6. The water requirement will be limited to 3.25 KLD from nearby villages.

7. A 7.5 wide strip will be left at periphery of the lease area which will be used to store

overburden generated and later will be converted into green belt.

8. The mining will be opencast type and carried out manual manner.

9. The ultimate depth of mining shall be restricted 25 m below ground level.

10. This project does not attract any of the general conditions applicable on mining projects

specified in EIA Notification 14/09/2006.

11. The mining operation will not be carried out in safety zone of any bridge or embankment

or in eco-fragile zone such as habitat of any wild fauna.

12. Regarding the project, no litigation is pending in any court.

13. The Project proposal falls under category – 1(a) of EIA Notification, 2006 (as amended).

The committee also noted that the details and the data provided in the proposal as well

as in the mining plan do not match hence, directed the project proponent to submit the

proposals in accordance to the mining plan. The matter is deferred till the reply is

received.

2- Sand/Morum Mining Project at Arazi No-107, Khand-8, Vill-Surawandalapur,

Tehsil-Meja, Allahabad. (Leased Area-5.00 Acre) Sri Amarjeet, Mahuarikala, Distt-

Allahabad. File No. 2141/AD-Sub.

The project proponent did not appear. However, an application has been

submitted on behalf of proponent that they would not be able to appear due to health conditions and have requested to schedule the matter in next meeting. The committee

deferred the matter for next meeting.

3- Sand Stone Mining Project at Gata No-2885 Vill-Vijaypur, Tehsil-Sadar, District-

Mirzapur, U.P. (Leased Area-1.15 Ha) Sri Gulam Sarvar, Vill-Paschim Mohal,

Gopiganj, Distt-Bhadohi, U.P. . File No. 2145/AD-VB

The project proponent informed the committee that their consultant M/s Eko Pro

Engineers Pvt. Ltd. are not present and requested for deferment of the matter till next

meeting. The committee expressed its displeasure as deferment of the matter amounts to

wastage of slot/committee time that is fixed for hearing of the matter. The committee directed

that the matter should be closed and shall be open only after submission of request letter from

the project proponent alongwith commitment of the consultant they shall appear for the

presentation, as and when scheduled for SEAC

4- Sand Mining Project at Khasra no. 346 Ka, 348, 350, 351, 352, 353 & 354 Ka, Vill-

The project proponent informed the committee that their consultant M/s Eko Pro Engineers Pvt. Ltd. are not present and requested for deferment of the matter till next

Mining Project at Survey No-989/12 Vill-Makarbai, Tehsil-& Distt-Mahoba, U.P. (Leased Area-1.21 Ha). A presentation was made by Shri Jaigopal Singh, representative of project

proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for building stones Khanda, Gitti and boulder

(Granite) Mining Project at Survey No-989/12 Vill-Makarbai, Tehsil-& Distt-Mahoba,

U.P. (Leased Area-1.21 Ha)

2. Mining Lease area was granted to the applicant Shri Premprakash for 10 years from

05/04/2010 to 04/04/2020.

3. 20,000 M3/annum Khanda, Gitti and Boulder collections are proposed.

4. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-

RQP/DDN/165/2005/A) and has been approved by Directorate of Geology and Mining, U.P.

5. 28 persons shall be employed for mining work. 6. The water requirement will be limited to 1.71 KLD from nearby villages.

7. A 7.5 wide strip will be left at periphery of the lease area which will be used to store overburden generated and later will be converted into green belt.

8. The mining will be opencast type and carried out semi mechanized. The mining machinery shall include Jack hammer, Tractor Mounted Compressor, Pokland, etc.

9. Mining will be done from top to bottom by making benches having height of 3 m and

width of 6 m.

10. The ultimate depth of mining shall be restricted to 24 m (from top of the surface of hill).







The committee discussed the matter and recommended grant of environmental clearance for the project proposals as above with general and specific conditions attached as

annexure-1 and annexure-2 to these minutes. The committee also stipulated following conditions:

1. The mining will be carried out above the mean sea level. 2. Mining will be carried out strictly according to the mining plan.

3. Approach road should be made motorable. 4. A buffer/safe zone shall be maintained from the habitation as per mining

guidelines. 5. CSR detail plan with Rs. 0.50 Lac/annum shall be prepared and submitted

within one month. Separate audit statement approved by CA shall be

submitted regarding CSR activities with physical details alongwith 06 monthly

compliance of the project.

their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti & Boulder Stone Mining Project

at Survey no. 997 Mi, Vill-Sindhora, Tehsil-Sadar, District-Mirzapur, U.P. (Leased Area-

0.80 Ha).

2. Mining Lease area was granted to the applicant Shri Rajesh Kumar Tripathi for 05 years

from 30/01/2008 to 29/01/2013. The lessee has applied for renewal of mine lease through

application dated 08/10/2011. 3. As per form-1, 15,600 TPA Khanda, Gitti and Boulder collections are proposed.

4. The mining plan has been prepared by Shri Indra Singh (RQP No.-RQP/DDN/078/94-A). 5. 300 working days is proposed for the mining activity.

6. 16 persons shall be employed for mining work. 7. The water requirement will be limited to 1.02 KLD from nearby villages.

8. A 7.5 wide strip will be left at periphery of the lease area which will be used to store overburden generated and later will be converted into green belt.

(Leased Area-4.04 Ha). A presentation was made by Shri Jitendra Pratap Singh, authorized representative of project proponent alongwith their consultant M/s GRC India Pvt. Ltd. The

proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti & Boulder Stone Mining Project at Sarvey No-1744, 1745, Khand-58, Vill-Bhatauti, Tehsil-Meja, District-Allahabad, U.P.

(Leased Area-4.04 Ha). 2. Mining Lease area was granted to the applicant Shri Vijay Kumar Agarwal for 10 years

from 06/03/2010 to 05/03/2020.

3. As per form-1, collections of 13,000 TPA Khanda, Gitti and Boulder stone are proposed.

4. The mining plan has been prepared by Shri Pankaj Pande (RQP No.-RQP/DDN/086/94-

A) for period of 2014-15 to 2018-19.

5. 300 working days is proposed for the mining activity.

6. 47 persons shall be employed for mining work.

7. The water requirement will be limited to 0.44 KLD from nearby villages through

borewells/dugwells.

machinery shall include Jack hammer, Tractor Mounted Compressor, Pokland etc.

10. Mining will be done from top to bottom by making benches having height of 6 m and width of 6 m.

11. The ultimate depth of mining shall be restricted 48 m (from top of the surface of hill). 12. This project does not attract any of the general conditions applicable on mining projects

specified in EIA Notification 14/09/2006. 13. The mining operation will not be carried out in safety zone of any bridge or embankment

or in eco-fragile zone such as habitat of any wild fauna. 14. Regarding the project, no litigation is pending in any court.


The committee also noted that letter no. 2899/Khanan-2014-15 dated 06/01/2015 has

been issued by Shri Mohd. Mahboob Mining Officer, Allahabad that there is no approved

mining lease within 500 m of the proposed site. The committee discussed the matter and

recommended grant of environmental clearance for the project proposals as above with

general and specific conditions attached as annexure-1 and 2 to these minutes. The committee

also stipulated following conditions:

1. Approach road should be made motorable.

2. Unmetalled 500 m length of road to be metalled.

3. A certificate of C A. to be submitted to office after six month regarding details

of expenditures dines under CSR expenditure with photographs.

4. A buffer/safe zone shall be maintained from the habitation as per mining

guidelines. 5. CSR plan with Rs. 1.00 Lac/annum shall be prepared and submitted. Separate

1. The environmental clearance is sought for Sand Mining at Gata No. 541, 542, 543,

Village-Ratanpur Naudaandi, Tehsil-Beheri, District-Bareilly, U.P. (Leased Area 4.85

Ha).

2. As per form-1, collection of 1,88,500 TPA sand/moram is proposed from 4.85 Ha mining

lease area.

3. Mining Lease area was granted to the applicant Shri Alok Tomar for 03 years from

14/07/2011 to 13/07/2014. District Magistrate, Bareilly through his letter dated

29/08/2013 directed to stop the mining work till submission of environmental clearance in

the matter. Renewal of the mining lease shall be applied after issuance of environmental

clearance.

4. The mining is proposed from the river bed of river Gaula.

5. 250 working days is proposed from mining activity.

The project proponent submitted their replies through letter dated 08/03/2014

social responsibility have been submitted. The committee discussed the replies and

recommended grant of environmental clearance on the project details as given at Para-

4. The ultimate depth of mining will be restricted to 03 meter/ water table, whichever is less.

The mining would be restricted to unsaturated zone only above the phreatic water table

has been proposed which is a part of non forest Government revenue land.

The committee noted that the matter was earlier discussed in SEAC meeting dated 06/06/2014 wherein the project proponent was directed to submit following information:

1. Copy of provisions related to deemed renewal of minor mineral lease and its

applicability in the matter.

2. Copy of mining plan.

3. Copy of application submitted by the proponent for renewal of lease.

4. No washing process of mineral shall be included under this environmental

clearance.

5. Water requirement is to be reduced in the total water requirement as proposed

including requirement of washing. So water requirement is to be corrected

accordingly.

6. It is an old lease therefore application for new lease is to be submitted to the

competent authority and the copy of the same is to be submitted to SEIAA.

The project proponent submitted their replies through letter 19/06/2014 and

28/10/2014. The project proponent submitted that the lessee applied for the renewal of the

lease on 12/06/1998 for a period of 20 years i.e. 16/06/1999 to 15/06/2019. Copy of renewal

application have also been submitted. As per the provision in MINERAL CONCESSION

RULES, 1960, Rule 24A-6, the lease will be deemed to be renewed, if it is not disposed of by

the State Government before the date of expiry of the lease. Copy of provision have been

annexed. Further, the scheme of Mining along with Progressive Mine Closure has been

approved by IBM vide letter no- UP/Allahabad/Silica Sand/M. Scheme-02/09-10 dated

4/12/2009. The project proponent also informed that project proposals does not involves any

washing of silica sand. Water requirement has also been accordingly calculated to be 1.5

KLD.

The committee discussed the replies and observed that the proposed mining capacity

is 25,000 TPA whereas the total excavation in six years (from 2003-04 to 2008-09) is 27,038

Ton. The committee directed that a mining plan/scheme commensurate to the proposed

mining of silica sand should be submitted.

The committee also directed to submit following information:

1. Copy to be submitted of application of renewal as applied to Geology and

mining and to Collector.

The committee noted that terms of reference in the matter were issued through letter

no. 2203/Parya/SEAC/848/DDS/2011 dated 26/09/2011. The project proponent through

his application dated 29/12/2014 have requested to extend the validity of ToR dated

26/09/2011 for one more year as per provisions of MoEF OM No. J-11013/41/2006-IA-

II(I) Part dated 08/10/2014.

The committee examined the matter and gone through the provisions of MoEF OM

dated 08/10/2014 with reference to extension of validity period. The committee observed

that validity period of ToR have been made valid for 03 years and may be extended for

one more year provided that the application is made by the applicant to the regulatory

authority at least 03 months before the expire of the validity period together with an

updated form-1, based on proper justification and also recommendation of EAC/SEAC.

The committee noted that 03 years validity period regarding ToR dated 26/09/2011

has already expired prior to issuance of MoEF OM dated 08/10/2014. Also the applicant

has not made applied as per time frame prescribed in OM dated 08/10/2014. Hence, the

provisions of OM dated 08/10/2014 do not apply on ToR dated 26/09/2011.

Accordingly, the committee refused to extend the validity period for ToR dated

26/09/2011. The committee also deliberated that the proponent is at liberty to make a

fresh application for issuance of ToR in the matter.

Secretary, SEAC informed the committee that an undated application,

received in the Directorate on 12/03/2013, was made by Dr. Javed Anwar Warsi,

Chairman, The Muslim Educational Welfare Society for environmental clearance of

F.H. Medical College, Near Railway, Over Bridge, NH-2, Tundla, Firozabad, U.P.

The matter was discussed in SEAC meetings dated 30/05/2013 wherein it was found that the construction work has already been started regarding the project prior to

environmental clearance. The committee had directed to take further necessary action as per MoEF OM dated 12/12/2012 related to violation cases. Accordingly, the State

Govt. was requested to direct UPPCB for initiation of legal action in the matter for violation of E.P. Act through letter dated 25/08/2014 . UPPCB through his letter

dated 29/12/2014 has informed that legal action in the matter has been initiated in the court of Chief Judicial Magistrate, Firozabad under E.P. Act, 1986.

The committee discussed the letter dated 29/12/2014 of UPPCB and also the

provisions of notification dated 22/12/2014 wherein School, College, Hostel of Educational Institution have not been included in projects or activities. The committee

directed that a clarification should be sought from MoEF Govt. of India whether the proposed project shall be covered under EIA Notification or not in the light of

notification dated 22/12/2014. The matter shall be discussed after receipt of clarification from Govt. of India.

fresh application was submitted to SEAC, UP against which a fresh ToR was issued. As the monitoring for this project was already done based on the previous ToR for the period

of March-May, 2013 and as the monitoring period is still valid (not more than 02 years), it is requested to allow the proponent to use the same monitoring base line data for the

submission of EIA/EMP report. The committee discussed the matter and deliberated that there are MoEF guidelines

regarding validity of monitoring data to be used for preparation of EIA. The same should

be followed in the matter. The committee shall appraise the matter chronologically after

environmental clearance is deemed to be granted if no communication in this regard

have been made by SEIAA whereas, in this case, more than 150 days have been

passed. The project proponent has further mentioned that accordingly, in their case,

they understand environmental clearance for the project has deemed to grant by

SEIAA.

The committee discussed the matter and deliberated that the proposals are

being considered in chronological order by committee for appraisal and the present

matter shall also be discussed accordingly. However, the committee is trying to speed

up the appraisal process so that more cases can be disposed off in each meeting. The

committee recommended that question of deemed clearance may be putup to SEIAA

for discussion/decision.

Clearance, U.P. The applicant through his writ has made a prayer as follows: A reply in the matter was communicated to Chief Standing Counsel, High

Court, Allahabad thorough letter dated 17/12/2014 informing that the matters are examined by the SEAC in chronological order and it was proposed to be included in

SEAC agenda as and when, the order of matter shall be reached chronologically. However, as the matter is under consideration at Hon'ble High Court, it shall be

presented in the next meeting of SEAC for further necessary action.

The Secretary, SEAC informed that committee that Shri Brijesh Pandey, S/o Shri

Yogesh Chandra Pandey, R/o Obra, District-Sonebhadra through his letter dated 02/12/2014

has requested that environmental clearance regarding Aarazi no. 246/1, area 110 acres,

Mauza-Gurdah, Pargana-Agori, Tehsil-Robertsganj, District-Sonebhadra should not be issued

without forest clearance as Aarazi no. 246/1 is within 01 K.M. of Kaimur Wild Life

Sanctuary. The committee discussed the letter dated 02/12/2014 and observed that no specific

details of applications have been mentioned in the letter and forest clearance is a separate and equally important prerequisite for grant of mining lease by District Administration, which is

to be issued by forest department. However, in mining cases it can be additionally stipulated that forest clearance shall be taken by the proponent as necessary under law.

directed to appear alongwith necessary documents which may explain his claim for the

restricted period and also the letter of intent in District Administration that his claim is being

considered and is under process.

The matter should be scheduled for presentation in next SEAC meeting for mining

recommended grant of environmental clearance on the project details as given at Para-A

not appear to be realistic in view of use of machinery in the project. The same should be provided headwise and should be revised accordingly. CSR plan should also be

The project proponent submitted their replies through letter dated 17/12/2014. The

committee examined the matter and observed that clarification regarding ground water table

and depth of mining has not been submitted. The committee deliberated that project

proponent directed to submit complete information. The matter shall be discussed after

submission of information.

5. 20-25 persons shall be employed for mining work. 6. The water requirement will be limited to 1.75 KLD from nearby villages.



8. Mined mineral will not be piled or stored at site but it will be transported through trucks

and trolleys to the nearby markets.

9. No hazardous material will be used that are listed under Hazardous Waste (Management,

Handling &Transboundary Movement) rules 2008 & MSIHC rules.

10. Drilling and blasting will be done as per MCR-1960 and AMP.

11. As per the requirement, only 2.4 kg/per day explosive material will be used.

mining areas within 500 m radius of the project which makes the cluster area 11.0 acres

which is less than 05 ha. The committee discussed the replies and recommended grant of

also been submitted. However, the Secretariat has received letter dated 12/01/2015 from Shri Udai Gopal, Advocate, Allahabad (Counsel for Petitioner) through which it has been

informed that mining activities have been restricted on the proposed project site as per Hon'ble High Court Allahabad direction dated 09/12/2014 in writ petition no. Writ C

66008/2014. The committee deliberated that the project proponent and Shri Udai Gopal, Advocate, Allahabad (Counsel for Petitioner) should be invited to present their comments in

view of Hon'ble High Court Allahabad direction dated 09/12/2014 in the next meeting for mining projects. The matter is deferred till next meeting.

9- Sand/Moram Mining at Zone-10, Khand-18, Thana-Sarai Akil, Kaushambi. (Leased

Area 12.14 Ha) Mr. Junaid Ahamad, R/o Kateya, Tehsil-Chayal, Distt-Kaushambi,

U.P. File No. 1432/AD-Sub.

The committee noted that the matter was earlier discussed in SEAC meeting datd 12/12/2014 wherein the committee deliberated as follows:

"A presentation was made by Mr. Junaid Ahmad on the replies submitted through

letter dated 19/10/2014. The committee discussed the replies and directed that

reply submitted by the proponent should be E-mailed to all the Members who can

go through it and may sent their comments. According communication based on

comments of the Members shall be communicated to the project proponent."

The committee Members discussed the matter and deliberated that they have received

copy of replies from the project proponent. The mater should be listed under discussion head

of next meeting's agenda.

Annexure-1

General Conditions for Stone Mining Projects:

1. This environmental clearance is subject to allotment of mining lease in favour of project

proponent by District Administration/Mining Department.

2. Forest clearance shall be taken by the proponent as necessary under law.

3. Any addition of the mining area, change of Khasra numbers, enhancement of capacity, change

in mining technology, modernization and scope of working shall again required prior

environmental clearance as per EIA notification, 2006.

4. No change in the calendar plan including excavation, quantum of mineral and waste shall be

made.

5. Mining will be carried out as per the approved mining plan. In case of any violation of mining

plan, the Environmental Clearance given by SEIAA will stand cancelled.

6. Four ambient air quality monitoring stations shall be established in the core zone as well as in

the buffer zone for RSPM, SPM, SO2, NOx monitoring. Location of the stations should be

decided based on the meteorological data, topographical features and environmentally and

ecologically sensitive targets and frequency of monitoring should be undertaken in consultation

with the State Pollution Control Board. The monitored data for criteria pollutants shall be

regularly up loaded on the company's website and also displayed at website.

7. Data on ambient air quality (RPM, SPM, SO2, NOx) should be regularly submitted to the

Regional office, MoEF, GoI, Lucknow and the State Pollution Control Board / Central

Pollution Control Board once in six months. 8. Ambient air quality at the boundary of the mine premises shall confirm to the norms prescribed

in MoEF notification no. GSR/826(E) dt. 16.11.09.

9. Fugitive dust emissions from all the sources shall be controlled regularly. Water spraying

arrangement on haul roads, loading and unloading and at transfer points shall be provided and

properly maintained.

10. Measures shall be taken for control of noise levels below 85 dBA in the work

environment. Workers engaged in operations of HEMM, etc. shall be provided with ear plugs /

muffs and health records of the workers shall be maintained.

11. Industrial waste water (workshop and waste water from the mine) should be properly collected,

treated so as to conform to the standards prescribed under GSR 422 (E) dated 19th May, 1993

and 31st December, 1993 or as amended from time to time. Oil and grease trap shall be

installed before discharge of workshop effluents.

12. Personnel working in areas shall be provided with protective respiratory devices like mask

and they shall also be imparted adequate training and information on safety and health aspects.

13. Special measures shall be adopted to prevent the nearby settlements from the impacts of

mining activities.

14. The transportation of the materials shall be limited to day hours time only.

15. Provision shall be made for the housing the labourers within the site with all necessary

infrastructure and facilities such as fuel for cooking, mobile toilets, safe drinking water,

medical health care, crèche etc. The housing may be in the form of temporary structures to be

removed after the completion of the project.

16. A separate Environmental Management Cell with suitable qualified personnel shall be set-up

under the control of a Senior Executive, who will report directly to the Head of the

Organization.

17. The Project Proponent shall inform to the Regional Office, MoEF, GoI, Lucknow and

State Pollution Control Board regarding date of financial closures and final approval of the

project by the concerned authorities and the date of start of land development work.

18. The funds earmarked for environmental protection measures shall be kept in separate

account and shall not be diverted for other purpose. Year wise expenditure shall be reported to

the MoEF, GoI, Lucknow and State Pollution Control Board

19. The Regional Office, MoEF, GoI, Lucknow and State Pollution Control Board shall monitor

compliance of the stipulated conditions. A complete set a documents including Environment

Impact Assessment Report, Environmental Management Plan, Public hearing and other

documents information should be given to Regional Office of the MoEF, GoI, Lucknow and

State Pollution Control Board

20. A copy of the environmental clearance shall be submitted by the Project Proponent to the Heads

of the Local Bodies, Panchayat and Municipal Bodies as applicable in the matter.

21. The Project Proponent shall advertise at least in two local newspapers widely circulated,

one of which shall be in the vernacular language of the locality concerned, within 7 days of the

issue of the clearance letter informing that the project has been accorded environmental

clearance and a copy of the clearance letter is available with the State Level Environment

Impact Assessment Authority (SEIAA).

22. The Project Proponent has to submit half yearly compliance report of the stipulated prior

environmental clearance terms and conditions in hard and soft copy to the SEIAA,U.P.

on 1st June and 1st December of each calendar year.

23. The SEIAA m a y alter/modify the above conditions or stipulate any further condition in the

interest of environment protection.

24. Concealing factual data or submission of false/fabricated data and failure to comply with

any of the conditions mentioned above may result in withdrawal of this clearance and attract

action under the provisions of Environment (Protection) Act, 1986.

Annexure-2

Specific Conditions for Stone Mining projects:

1. A comprehensive EIA including mining areas within 15 K.M. to assess impact of the

mining activity on the surrounding area shall be undertaken and report submitted to this

Authority within one year. 2. No two pits shall be simultaneously w or k e d i.e before the first is exhausted and

reclamation work completed, no mineral bearing area shall be worked. 3. After exhausting the first mine pit and before starting mining operations in the next pit,

reclamation and plantation works in the exhausted pit shall be completed so as to ensure

that reclamation, forest cover and vegetation are visible during the first year of mining operations in the next pit. This process will follow till the last pit is exhausted. Adequate

rehabilitation of mined pit shall be completed before any new ore bearing area is worked

for expansion.

4. Adequate buffer zone shall be maintained between two consecutive mineral bearing deposits.

5. Sprinkling of water on haul roads to control dust will be ensured by the project

proponent. 6. Green belt development shall be carried out considering CPCB guidelines including

selection of plant species and in consultation with the local DFO / Agriculture

Department. Herbs and shrubs shall also form a part of afforestation programme besides tree plantation. The company shall involve local people for plantation programme.

Details of year wise afforestation programme including rehabilitation of mined out area

shall be submitted to the Regional Office, MoEF, GoI, Lucknow every year. 7. Blast vibrations study shall be conducted and a observation report submitted to the

Regional office, MoEF, GoI, Lucknow and UPPCB within six months. The report shall

also include measures for prevention of blasting associated impact on nearby houses and

agricultural fields. 8. Controlled blasting techniques with sequential blasting shall be adopted. The blasting shall

be carried out in the day time only.

9. Appropriate arrangement for shelter and drinking water for the mining workers has to be ensured at the mining site.

10. Maintenance of village roads used for transportation of minerals are to be done by

the company regularly at its own expenses. The roads shall be black topped. 11. Rain water harvesting shall be undertaken to recharge the ground water source.

12. Status of implementation shall be submitted to the Regional Office,

MoEF,GoI,Lucknow and UP Pollution Control Board within six months and thereafter

every year from the next consequent year.

13. Measures for prevention and control of soil erosion and management of silt shall be

undertaken. Protection of dumps against erosion shall be carried out with geo textile

matting or other suitable material, and thick plantations of native trees and shrubs shall be carried out at the dump slopes. Dumps shall be protected by retaining walls.

14. Trenches / garland drains shall be constructed at foot of dumps and coco filters

installed at regular intervals to arrest silt from being carried to water bodies. Adequate number of Check Dams and Gully Plugs shall be constructed across

seasonal/perennial nallahs, if any flowing through the ML area and silts arrested. De- silting

at regular intervals shall be carried out.

15. Garland drain of appropriate size, gradient and length shall be constructed for both mine pit

and for waste dump and sump capacity shall be designed keeping 50% safety margin

over and above peak sudden rainfall (based on 50 years data) and maximum discharge in the area adjoining the mine site. Sump capacity shall also provide adequate retention

period to allow proper settling of silt material. Sedimentation pits shall be constructed at the

corners of the garland drains and de- silted at regular intervals.

16. Ground and surface water, if any in and near the core zone (within 5.0 km of the lease) shall be regularly monitored for contamination and depletion due to mining activity and

records maintained. The monitoring data shall be submitted to the Regional Office,

MoEF, GoI, Lucknow and U.P.Pollution Control Board regularly. Further, monitoring

points shall be located between the mine and drainage in the direction of flow of ground water shall be set up and records maintained.

17. Fugitive dust generation shall be controlled. Fugitive dust emission shall be regularly

monitored at locations of nearest human habitation (including schools and other public amenities located nearest to sources of dust generation as applicable) and records

submitted to the Regional Office, MoEF, GoI, Lucknow and U.P.Pollution Control Board

regularly. 18. Baseline data for ambient air quality shall be generated and maintained and RSPM level in

ambient air in the nearby human habitation (villages) shall also be monitored along with

other parameters.

19. Transportation of minerals shall be done by covering the trucks with tarpaulin or other

suitable mechanism so that no spillage of mineral/dust takes place.

20. Occupational health and safety measures for the workers including identification of work

related health hazards, training on malaria eradication, HIV, and health effects on exposure to mineral dust etc. shall be carried out. Periodic monitoring for exposure to respirable

mineral dust on the workers shall be conducted and records maintained including health

records of the workers. Awareness programme for workers on impact of mining on their health and precautionary measures like use of personal equipments etc. shall be carried out

periodically. Review of impact of various health measures shall be conducted followed by

follow up action wherever required.

21. The project proponent will ensure for providing employment to local people as per

requirement, necessary protection measures around the mine pit and waste dump and

garland drain around the mine pit and waste dump.

22. Top soil / solid waste shall be stacked properly with proper slope and adequate safeguards and shall be utilized for backfilling (wherever applicable) for reclamation and rehabilitation

of mined out area. Top soil shall be separately stacked for utilization later for reclamation

and shall not be stacked along with over burden. 23. Over burden (OB) shall be stacked at earmarked dump site(s) only and shall not be kept

active for long period. The maximum height of the dump shall not exceed 20 m, each stage

shall preferably be of maximum 10 m and overall slope of the dump shall not exceed 35o.

The OB dump shall be backfilled. The OB dumps shall be scientifically vegetated with

suitable native species to prevent erosion and surface run off.

24. Monitoring and management of rehabilitated areas shall continue until the vegetation becomes self sustaining. Compliance status shall be submitted to the Regional Office,

Ministry of Environment & Forests, GoI, Lucknow and U.P.Pollution Control Board on

six monthly basis.

25. Slope of the mining bench and ultimate pit limit shall be as per the mining scheme approved by Indian Bureau of Mines.

26. Permission for abstraction of ground water shall be taken from Central Ground Water

Board. Regular monitoring of ground and surface water sources for level and quality shall

be carried out by establishing a network of existing wells and constructing new

piezometers during the mining operation. The monitoring shall be carried out four times

in a year i.e. pre-monsoon (April-May), monsoon (August), post-monsoon (November) and winter (January) and the data thus collected shall be regularly sent to MoEF, Central

Ground Water Authority and Regional Director, Central Ground Water Board.

27. The waste water from the mine shall be treated to conform to the prescribed

standards before discharging in to the natural stream. The discharged water from the

Tailing Dam, if any shall be regularly monitored and report submitted to the Regional Office, Ministry of Environment & Forests, GoI, Lucknow, Central Pollution

Control Board and the State Pollution Control Board.

28. Hydro geological study of the area shall be reviewed by the project proponent

annually. In case adverse effect on ground water quality and quantity is observed mining shall be stopped and resumed only after mitigating steps to contain any adverse

impact on ground water is implemented.

29. Vehicular emissions shall be kept under control and regularly monitored. Vehicles used for transportation of minerals and others shall have valid permissions as prescribed

under Central Motor Vehicle Rules, 1989 and its amendments. The vehicles

transporting minerals shall be covered with a tarpaulin or other suitable enclosures so that no dust particles / fine matters escape during the course of transportation. No overloading

of minerals for transportation shall be committed. The trucks transporting minerals shall not

pass through wild life sanctuary, if any in the study area.

30. Prior permission from the Competent Authority shall be obtained for extraction of ground

water, if any.

31. A final mine closure plan, along with details of Corpus Fund, shall be submitted to the

Regional office, Ministry of Environment & Forests, GoI, Lucknow and U.P. Pollution Control Board 5 years in advance of final mine closure for approval.

32. Project Proponent shall explore the possibility of using solar energy where ever

possible. 33. Commitment towards CSR has to be followed strictly.

34. Regular health check-up record of the mine workers has to be maintained at site in a proper

register. It should be made available for inspection whenever asked.

35. Project Proponent has to strictly follow the direction/guidelines issued by MoEF,

CPCB and other Govt. Agencies from time to time.

36. The blasting will be done only after getting the permission from the Mining Department.

Annexure-3

GENERAL CONDITIONS PRESCRIBED BY SEIAA/SEAC, UP FOR SAND/MORUM

MINING PROPOSALS General Conditions: 1. This environmental clearance is subject to allotment of mining lease in favour of project

proponent by District Administration/Mining Department.

2. Forest clearance shall be taken by the proponent as necessary under law.

3. Any change in mining area, khasra numbers, entailing capacity addition with change in process

and or mining technology, modernization and scope of working shall again require prior

Environmental Clearance as per the provisions of EIA Notification, 2006 (as amended).

4. Precise mining area will be jointly demarcated at site by project proponent and officials of

Mining/Revenue department prior to starting of mining operations. Such site plan, duly verified

by competent authority along-with copy of the Environmental Clearance letter will be displayed

on a hoarding/board at the site. A copy of site plan will also be submitted to SEIAA within a

period of 02 months.

5. Mining and loading shall be done only within day hours time.

6. No mining shall be carried out in the safety zone of any bridge and/or embankment.

7. It shall be ensured that standards related to ambient air quality/effluent as prescribed by the

Ministry of Environment & Forests are strictly complied with. Water sprinklers and other dust

control majors should be applied to take-care of dust generated during mining operation.

Sprinkling of water on haul roads to control dust will be ensured by the project proponent.

8. All necessary statutory clearances shall be obtained before start of mining operations. If this

condition is violated, the clearance shall be automatically deemed to have been cancelled.

9. Parking of vehicles should not be made on public places.

10. No tree-felling will be done in the leased area, except only with the permission of Forest

Department.

11. No wildlife habitat will be infringed.

12. It shall be ensured that excavation of minor mineral does not disturb or change the underlying

soil characteristics of the river bed /basin, where mining is carried out.

13. It shall be ensured that mining operation of Sand/Moram will not in any way disturb the,

velocity and flow pattern of the river water significantly.

14. It shall be ensured that there is no fauna dependant on the river bed or areas close to mining for

its nesting. A report on the same, vetted by the competent authority shall be submitted to the

RO, PCB and SEIAA within 02 months.

15. Primary survey of flora and fauna shall be carried out and data shall be submitted to the RO,

PCB and SEIAA within six months.

16. Hydro-geological study shall be carried out by a reputed organization/institute within six

months and establish that mining in the said area will not adversely affect the ground water

regime. The report shall be submitted to the RO, PCB and SEIAA within six months. In case

adverse impact is observed /anticipated, mining shall not be carried out.

17. Adequate protection against dust and other environmental pollution due to mining shall be

made so that the habitations (if any) close by the lease area are not adversely affected. The

status of implementation of measures taken shall be reported to the RO, UPPCB and SEIAA

and this activity should be completed before the start of sand mining.

18. Need-based assessment for the nearby villages shall be conducted to study economic measures

which can help in improving the quality of life of economically weaker section of society.

Income generating projects/tools such as development of fodder farm, fruit bearing orchards,

vocational training etc. can form a part of such program me. The project proponent shall

provide separate budget for community development activities and income generating

programmes.

19. Green cover development shall be carried out following CPCB guidelines including selection of

plant species and in consultation with the local DFO/Horticulture Officer.

20. Separate stock piles shall be maintained for excavated top soil, if any, and the top soil should be

utilized for green cover/tree plantation.

21. Dispensary facilities for first-aid shall be provided at site.

22. An Environmental Audit should be annually carried out during the operational phase and

submitted to the SEIAA.

23. The District Mining Officer should quarterly monitor compliance of the stipulated conditions.

The project proponent will extend full cooperation to the District Mining Officer by furnishing

the requisite data/information/monitoring reports. In case of any violations of stipulated

conditions the District Mining Officer will report to SEIAA.

24. The project proponent shall submit six monthly reports on the status of compliance of the

stipulated environmental clearance conditions including results of monitored data (both in hard

& soft copies) to the SEIAA, the District Officer and the respective Regional Office of the State

Pollution Control Board by 1st June and 1st December every year.

25. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila

Parisad/ Municipal Corporation and Urban Local Body.

26. Transportation of materials shall be done by covering the trucks / tractors with tarpaulin or other

suitable mechanism to avoid fugitive emissions and spillage of mineral/dust.

27. Waste water, from temporary habitation campus be properly collected & treated before

discharging into water bodies the treated effluent should conform to the standards prescribed by

MoEF/CPCB.

28. Measures shall be taken for control of noise level to the limits prescribed by C.P.C.B.

29. Special Measures shall be adopted to protect the nearby settlements from the impacts of mining

activities. Maintenance of Village roads through which transportation of minor minerals is to be

undertaken, shall be carried-out by the project proponent regularly at his own expenses.

30. Measure for prevention & control of soil erosion and management of silt shall be undertaken.

Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or

other suitable material.

31. Project Proponent shall explore the possibility of using solar energy wherever possible.

32. Under social corporate responsibility a sum of 5% of the total project cost or total income

whichever is higher is to be earmarked for total lease period. Its budget is to be separately

maintained. CSR component shall be prepared based on need of local habitant. Income

generating measures which can help in upliftment of poor section of society, consistent with the

traditional skills of the people shall be identified. The programme can include activities such as

development of fodder farm, fruit bearing orchards, free distribution of smokeless Chula etc.

33. Possibility for adopting nearest three villages shall be explored and details of civic amenities

such as roads, drinking water etc proposed to be provided at the project proponent’s expenses

shall be submitted within 02 months from the date of issuance of Environment Clearance.

34. The funds earmarked for environmental protection measures should be kept in separate account

and should not be diverted for other purpose. Year wise expenditure should be reported to the

Ministry of Environment and Forests and its Regional Office located at Lucknow, SEIAA, U.P

and UPPCB.

35. Action plan with respect to suggestion/improvement and recommendations made and agreed

during Public Hearing shall be submitted to the District mines Officer, concern Regional

Officer of UPPCB and SEIAA within 02 months.

36. Environmental clearance is subject to obtaining clearance under the Wildlife (Protection) Act,

1972 from the competent authority, if applicable to this project.

37. The proponent shall observe every 15 day for nesting of any turtle in the area. Based on the

observations so made, if turtle nesting is observed, necessary safeguard measures shall be taken

in consultation with the State Wildlife Department. For the purpose, awareness shall be created

amongst the workers about the nesting sites so that such sites, if any, are identified by the

workers during operations of the mine for taking required safeguard measures. In this regards

the safety notified zone should be left so that the habitat/nesting area is undisturbed.

38. The project proponent shall undertake adequate safeguard measures during extraction of river

bed material and ensure that due to this activity the hydro geological regime of the surrounding

area shall not be affected.

39. The project proponent shall obtain necessary prior permission of the competent Authorities for

withdrawal of requisite quantity of water (surface water and groundwater), required for the

project.

40. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation

with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and

grease in the river from the vehicles used for transportation.

41. Vehicular emissions shall be kept under control and regularly monitored. The vehicles carrying

the mineral shall not be overloaded.

42. Provision shall be made for the housing of construction labour within the site with all necessary

infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking

water, medical health care, crèche etc. (MoEF circular Dated : 22-09-2008 regarding stipulation

of condition to improve the living conditions of construction labour at site).

43. Personnel working in dusty areas should wear protective respiratory devices and they should

also be provided with adequate training and information on safety and health aspects.

Occupational health surveillance program of the workers should be undertaken periodically to

observe any contractions due to exposure to dust and take corrective measures, if needed.

44. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila

Parishad/ Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom

suggestions/ representations, if any, were received while processing the proposal. The clearance

letter shall also be put on the website of the Company by the proponent.

45. The environmental statement for each financial year ending 31st March in Form-V as is

mandated to be submitted by the project proponent to the concerned State Pollution Control

Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently,

shall also be put on the website of the company along with the status of compliance of

environmental clearance conditions and shall also be sent to the Regional Office of the Ministry

of Environment and Forests, Lucknow by e-mail.

46. The green cover development/tree plantation is to be done in an area equivalent to 20% of the

total leased area either on river bank or along road side (Avenue Plantation).

47. Debris from the river bed will be collected and stored at secured place and may be utilized for

strengthen the embankment.

48. Safety measures to be taken for the safety of the people working at the mine lease area should

be given, which would also include measure for treatment of bite of poisonous reptile/insect

like snake.

49. Periodical and Annual medical checkup of workers as per Mines Act and they should be

covered under ESI as per rule.

Annexure-4

Specific Conditions for Sand Moram Mining:

1. The Environmental clearance will be co-terminus with the mining lease period.

2. Project falling with in 05 KM area of Wild Life Sanctuary is to obtain a clearance from

National Board Wild Life (NBWL) even if the eco-sensitive zone is not earmarked.

3. The project proponent will submit the approved mining plan within 03 month from the date of

issuance of the E.C. letter. Failing which E.C. will be deemed to be cancelled.

4. Social Corporate Responsibility (SCR) plan along with budgetary provision amounting to 5%

of total project cost shall be submitted within three month on need base assessment study in

the study area. Income generating measures which can help in up-liftment of weaker section

of society consistent with the traditional skills of the people identified. The programme can

include activities such as development of fodder farm, fruit bearing orchards, vocational

training etc. In addition, vocational training for individuals shall be imparted so that poor

section of society can take up self employment and jobs. Separate budget for community

development activities and income generating programmes shall be specified.

5. The mining work will be open-cast and exclusively manual. No mechanical work or

drilling/blasting should be involved at any stage.

6. It shall be ensured that there shall be no mining of any type within 03 m or 10% of the width

which-ever is less, shall be left on both the banks of precise area to control and avoid erosion

of river bank. The mining is confined to extraction of sand/moram from the river bed only.

7. The project proponent shall undertake adequate safeguard measures during extraction of river

bed material and ensure that due to this activity the hydro-geological regime of the

surrounding area shall not be affected.

8. The project proponent shall adhere to mining in conformity to plan submitted for the mine

lease conditions and the Rules prescribed in this regard clearly showing the no work zone in

the mine lease i.e. the distance from the bank of river to be left un-worked (Non mining area),

distance from the bridges etc. It shall be ensured that no mining shall be carried out during the

monsoon season.

9. The project proponent shall ensure that wherever deployment of labour attracts the Mines

Act, the provision thereof shall be strictly followed.

10. The project proponent will provide personal protective equipment (PPE) as required, also

provid adequate training and information on safety and health aspects. Periodical medical

examination of the workers engaged in the project shall be carried out and records

maintained. For the purpose, schedule of health examination of the workers should be drawn

and followed accordingly.

11. The critical parameters such as PM10, PM2.5, SO2 and NOx in the ambient air within the

impact zone shall be monitored periodically. Further, quality of discharged water if any shall

also be monitored [(TDS, DO, pH, Fecal Coliform and Total Suspended Solids (TSS)].

12. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical

areas prone to air pollution and having high levels of particulate matter such as loading and

unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul

roads.

13. It should be ensured that the Ambient Air Quality parameters conform to the norms

prescribed by the Central Pollution Control Board in this regard.

14. The extended mining scheme will be submitted by the proponent before expiry of present

mining plan.

15. Four ambient air quality-monitoring stations should be established in the core zone as well as

in the buffer zone for monitoring PM10, PM2.5, SO2 and NOx. Location of the stations

should be decided based on the meteorological data, topographical features and

environmentally and ecologically sensitive targets and frequency of monitoring should be

undertaken in consultation with the State Pollution Control Board.

16. Common road for transportation of mineral is to be maintained collectively. Total cost will be

shared/worked out on the basis of lease area among users.

17. Proponent will provide adequate sanitary facility in the form of mobile toilets to the labours

engaged for the project work.

18. Solid waste material viz., gutkha pouchs, plastic bags, glasses etc. to be generated during

project activity will be separately storage in bins and managed as per Solid Waste

Management rules.

19. Green area/belt to be developed along haulage road in consultation of Gram Sabha/Panchyat.

20. Natural/customary paths used by villagers should not be obstructed at any time by the

activities proposed under the project.

21. Digital processing of the entire lease area in the district using remote sensing technique

should be done regularly once in three years for monitoring the change of river course by

Directorate of Geology and Mining, Govt. of Uttar Pradesh. The record of such study to be

maintained and report be submitted to Regional office of MoEF, SEIAA, U.P. and UPPCB.

22. A copy of clearance letter will be marked to concerned Panchayat / local NGO, if any, from

whom suggestion / representation has been received while processing the proposal. The

clearance letter shall also be put on the website of the company.

23. State Pollution Control Board shall display a copy of the clearance letter at the Regional

office, District Industry Centre and Collector’s office/Tehsildar’s Office for 30 days.

24. The project authorities shall advertise at least in two local newspapers widely circulated, one

of which shall be in the vernacular language of the locality concerned, within 7 days of the

issue of the clearance letter informing that the project has been accorded environmental

clearance and a copy of the clearance letter is available with the State Pollution Control Board

and also at web site of the SEIAA at http://www.seiaaup.com and a copy of the same shall be

forwarded to the Regional Office of the Ministry located in Lucknow, CPCB, State PCB.

25. The MoEF/SEIAA or any other competent authority may alter/modify the above conditions or

stipulate any further condition in the interest of environment protection.

26. Concealing factual data or submission of false/fabricated data and failure to comply with any

of the conditions mentioned above may result in withdrawal of this clearance and attract

action under the provisions of Environment (Protection) Act, 1986.

27. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if

preferred, within a period of 30 days as prescribed under Section 11 of the National

Environment Appellate Authority Act, 1997.

28. Waste water from potable use be collected and reused for sprinkling.

29. During the school opening and closing time vehicle movement will be restricted.
