John T. Daniel, M.D. , President of the Board of Medical Examiners of the State of NorthCarolina, called the meeting to order at 7:00 p.m. , at the North Raleigh Hilton, Raleigh,North Carolina.

VII. NP Joint Subcommittee Meeting - December 3, 1989

Members of the Joint Subcommittee meet on Sunday morning, December 3, 1989, toconduct the following business:

A. Recommendation from the niirsing members regarding NAACOG certification—approved by the Joint Subcommittee

B. Cynthia Eaton, currently approved. as an ANP, wishes to change her title to FNPas a result of additional training. The Joint Subconunittee adopted a motion thatMs. Eaton be allowed to apply for approval as an FNP furnishing the requirededucational documentation.

C. Proposed NP Rules and Formulary

1. The Joint Subcommittee members discussed in detail the proposed rules andagreed upon several wording changes. The proposed rules as adopted by theJoint Subcommittee are attached.

2. The Joint Subcommittee adopted a motion that the physician members willtake the changes in the rules proposed by the Joint Subcormnittee back to theBoard of Medical Exatniners at its January 1990meeting.

Specifically, the Board of Nursing requests that a countersigning time of fivew~orkin days be considered instead of five days and that under parentertdmedications which may be prescribed, epinephrine and benadryl be added tothe Rules and the Formulary.

3. The Joint Subcommittee discussed the pro rata division of NP fees andadopted a motion that only the $75 fee collected for applications handled byboth Boards will be split 50/50.

On November 30, 1989, Dr. Stratas presented the PHEP Subconunittee Report. He notedthat PHEP indicated there was a need for $20,000 in addition to what has alrearly beenbudgetecl. The PHEP Subcotnmittee reviewed all of the program cases and anonymouscases.

On December 1, 1989, the Board of Merlical Examiners unanimously adopted a motionmade by Dr. Henry and seconded by Dr. Godwin that the Board write the administrator ofthe hospital that, under the requirements of G.S. 14.13, he is indeed to report to the Board ofMedical Examiners any change in status, e.g. , medical leave of absence.

ADMINISTRATIVE RULE HEARING

The hearing was called to order at 8:30a.m. on Friday, December 1, 1989.

Notice for this hearing was run in the September 15th issue of the North Carolina Register asrequired by the Administrative Procedure Act.

The N.C. Board of Medical Examiners, pursuant to authority vested in it by General Statutes90-9 and 90-14, proposed to amend rules contained in Chapter 21 of the North CarolinaAdministrative Code. These amendments if adopted will become effective March 1, 1990after proper filing and review procedures are followed by the Office of AdministrativeHearings.

The subjects to be addressed at this hearing are:

(1) The rules requiring U.S.A. or Canadian citizenship or iimnigrant status have beenrepealed or ainended to delete all mention of citizenship from the Board's rules.This action was handled on an emergency temporary basis following the requiredprocedures. The rules are now proposed to be repealed or amended on apermanent basis.

(2) A rule is proposed which if adopted will set standards of practice; specifically,prescribing activities.

Persons interested were instructed in the advertisement in the N.C. Register that written ororal statements relevant to the actions proposed may be presented at this hearing. Twowritten statements have been received at the Board's office; Julian Bobbitt, Attorney, andG. Dan Roberson, M.D.

Thad Wester, M.D. appeared on behalf of the Department of Public Health. He indicatedthat the proposed rule on prescribing causes considerable concern, especially as it relates tothe doctor/patient relationship as written, and would be devastating in the areas ofiminunizations, sexually transmitted disease clinics, TB clinics, and in epidemics. Dr.Wester indicated that if the intent of the proposed rule is to address the abuse of controlledsubstances or mind-altering substances, he would like the Board to consider alternativewording. He then presented a revised rule for the Board to take under advisement.

Dr. Patterson: It also would be devastating to every hospice program. My wife is ahospice nurse. If we adopt this rule, every hospice will not be ableto perform. Every person who needs a change in pain medicationwould have to come to the ER. We are doing a grave disservice.

Dr. Henry: Every patient in the hospice program has a physician because of thenature of his disease. The rules and regulations are such that theywould fall within the scope of the rule.

Dr. Patterson: That implies that if the patient needs increased pain medication,there must be documentation of a physical examination, etc. lf thatis not the intent. . .

Dr. Henry: The spirit of the regulation. . . the patient had a physician by thephysician. Example, a cancer patient. . . it would be documented inthe chart.

Dr. Patterson: Your interpretation of the spirit any my interpretation of Paragraph 2are entirely different. I think that whatever point in time, we need tomake it clearer.

Dr. Nance: What constitutes a physical examination?

This hearing was adjourned at 8:45 a.m. on December 1, 1989.

As a result of the discussion that took place, Dr. Daniel appointed Dr. Patterson and Dr.Henry to bring a proposal back to the Board at its January 1990meeting.

EMS REPORT

Dr. Nance, the Board's Liaison Representative to the Office of Emergency MedicalServices, presented the ALS application report to the full Board.

On December 2, 1989 the Board of Medical Exatniners unanimously adopted a motion madeby Dr. Nance and seconded by Dr. Godwin that the Board approve the 114 initialapplications and 107 recertification applications for Advanced Life Support personnelsubmitted by the Office of Emergency Medical Services. The Board also adopted a motionmade by Dr. Nance and seconded by Dr. Godwin that the Board approve the 216 Bee StingCertifications submitted by the Office of Emergency Medical Services.

On December 2, 1989, Dr. Daniel presented a report on the public hearing regarding theproposed changes to the MICN rules which was held on November 3, 1989. As a result ofthis report, on December 2, 1989, the Board of Medical Examiners unanimously adopted amotion made by Dr. Daniel and seconded by Dr. Godwin that the Boarcl approve thefollowing changes to the MICN rules:

Inclusion of external cardiac pacing for EMT-Advanced Intermediates andEMT-Par amedics;Inclusion of language which will permit the administration of approvedmedications via the endotracheal tube for EMT-Advanced Intermediates andsublingual medication administration for EMT-Advanced Intermediates andEMT-Paramedics.

As afurther result of this report, on December 2, 1989, the Board of Medical Examinersunanimously adopted a motion made by Dr. Nance and seconded by Dr. Henry that theBoard table the following change to the MICN rules until such time as the Board receivesdocumentation as to how many of the procedures have been done and the outcome of eachprocedure (Dr. Patterson recommended contacting Dr. Milewski) and that EMS is told that,in the meantime, they are not to perform such procedures:
