OLD BUSINESS 16. Respiratory Therapists During a Crisis Mr. Frey requested this discussion during the July13, 2018 meeting discuss concerns during times of disasters or crisis during Hurricane Seasons. Scott Fryberger, Department of Health-Public Health Preparedness Coordinator and Mr. Allen Harris, Chief Administrator of the Office of Emergency Management, were present and addressed the Board. DISCIPLINARY PROCEEDINGS
MOTION FOR BOARD’S FINAL ORDER BY HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT
1. Kimberly Ann Johnson, R.R.T., Case No: 2017-16474 (PCP, Colon and Nunez)
Respondent was not present nor represented by Counsel. Ms. Iglehart summarized the case for the Board. Respondent was charged with the following violation: Section 468.365 (1)(b), Florida Statutes (2016), having licensure, certification, registration, or other authority, by whatever name known, to deliver respiratory care services revoked, suspended, or otherwise acted against. The case was presented as a Hearing Not Involving Disputed Issues of Material Fact. MOTION: Mr. Frey made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact set forth in the Administrative Complaint. The motion was seconded by Mr. Mitchell and carried 5/0. MOTION: Mr. Frey made a motion to adopted the conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes. The motion was seconded by Mr. Mitchell and carried 5/0. MOTION: After discussion, Mr. Frey made a motion to impose the following penalties:
• Respondent’s license to practice respiratory care in the State of Florida shall be placed on unsupervised probation for a period of one (1) year of the filing of the Final Order.
• Respondent’s shall comply with probationary terms ordered by the Kentucky Board.
• Fine of $300.00 to be paid within ninety (90) days of the filing of the Final Order.
• Costs of $36.27 to be paid within ninety (90) days of the filing of the Final Order.
The motion was seconded by Mr. Mitchell and carried 5/0.

The motion was seconded by Mr. Frey and carried 6/0. ADMINISTRATIVE PROCEEDINGS REQUEST FOR EVIDENTIARY HEARING AND, IF DENIED, HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT 3. Matthew Drew Shanahan, Registered Respiratory Therapist Mr. Shanahan was present and sworn in by the court reporter. The above referenced item was placed on the agenda by the Board of Respiratory Care to determine whether any disputed issues of material fact exist to warrant a hearing pursuant to 120.57(1), F.S., with the Division of Administrative Hearings (DOAH). MOTION: Mr. Mitchell made a motion to deny the request for an evidentiary hearing. The motion was seconded by Mr. Broeker and carried 6/0. MOTION: After discussion, Mr. Mitchell made a motion to grant licensure with no conditions. The motion was seconded by Mr. Frey and carried 4/2. Mr. Broeker and Mr. Colon opposed. PERSONAL APPEARANCE PURSUANT TO §456.013(3)(c), F.S. 4. Paula Bellamy-Pippens, Certified Respiratory Therapist
Ms. Bellamy-Pippens was present and sworn in by the court reporter. She was requested to appear before the board due to the “yes” answer in the criminal history section of her application. Mr. Dominguez was present and sworn in by the court reporter. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Mr. Mitchell made a motion to grant licensure with no conditions. The motion was seconded by Ms. Hom and carried 6/0. 6. Rylea Wallace, Registered Respiratory Therapist
Ms. Wallace was present and sworn in by the court reporter. She was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Mr. Colon made a motion to grant licensure with no conditions. The motion was seconded by Mr. Frey and carried 5/1. Mr. Mitchell opposed. APPLICANT RATIFICATION LISTS 7. Certified Respiratory Therapists MOTION: Mr. Frey made a motion to ratify the list of 47 names (Exhibit A), beginning with Sheila C. Porter and ending with Hondy Joseph for CRT licensure by endorsement. The motion was seconded by Mr. Mitchell and carried 6/0. 8. Registered Respiratory Therapists MOTION: Mr. Garcia made a motion to ratify the list of 291 names (Exhibit B), beginning with Shaji K. Mathew and ending with Pamela A. Bacon for RRT licensure by endorsement. The motion was seconded by Mr. Broeker and carried 6/0. 9. New Continuing Education Providers
MOTION: Mr. Colon made a motion to ratify the two names (Exhibit C), Physicians Regional System and Big Bend Area Health Education Center, for continuing education providers. The motion was seconded by Mr. Broeker and carried 6/0.
NEW BUSINESS 10. Fee Recommendations and Financial Reports

The Senior Health Budget Analyst conducted a review and analysis of the current fees and projected cash balances. It is indicated that the current cash balance projections will allow a reduction in fees and provided recommendations. MOTION: After discussion, Mr. Colon made a motion to accept the recommendation of a temporary active renewal fee reduction from $120.00 to $50.00, for one renewal cycle only for the 2019 biennium. The motion was seconded by Ms. Hom and carried 6/0. MOTION: Mr. Colon made a motion to open Rule 64B32-4.001, Florida Administrative Code, for development and approve rule language upon completion. The motion was seconded by Mr. Mitchell and carried 6/0.
64B32-4.001 Fees.
(1) The biennial renewal fee for licensure shall be $120.00, with the exception that for the
2019 renewal period the fee shall be $50.00.
(2) The reactivation fee for activating an inactive license shall be $50.00.
(3) The renewal fee for renewing the inactive status of a license shall be $50.00.
(4) If a licensee wishes to request the Board or the Department to provide a duplicate license
for replacement of a lost or destroyed license, the Board will issue the duplicate if the request is
in writing and accompanied by a payment of $25.00.
(5) In addition to all other fees collected from each licensee, there shall be a $5.00 fee
collected upon license renewal for the purpose of combating unlicensed activity.
(6) The delinquency fee shall be $120.00.
(7) The change in status fee shall be $35.00.
(8) The retired status fee shall be $50.00.
MOTION: Mr. Colon made a motion to find the proposed revisions do not have an adverse
impact on small businesses and will not be likely to directly or indirectly increase regulatory
costs to any entity (including government) in excess of $200,000 in the aggregate in Florida
within 1 year after the implementation of the rule. The motion was seconded by Mr. Frey and
carried 6/0.
MOTION: Mr. Colon made a motion to find that a violation of this rule or any part of this rule will
not designate as a minor violation. The motion was seconded by Mr. Broeker and carried 6/0. RULE DISCUSSION/DEVELOPMENT 11. Rule 64B32-2.001, F.A.C., License by Endorsement
• Initial Application MOTION: After discussion, Mr. Colon made a motion to approve the proposed revisions and open Rule 64B32-2.001, for development. The motion was seconded by Mr. Mitchell and carried 6/0.
64B32-2.001 License by Endorsement.
(1) Applicants for licensure as a Registered Respiratory Therapist or Certified Respiratory
Therapist in the state of Florida shall apply on Form DH-MQA 1145, Application by Endorsement,
Revised 07/2016 10/2018, incorporated herein as this Board’s application form and available on

the web at http://www.flrules.org/Gateway/reference.asp?No=Ref-07446, or at
http://www.doh.state.fl.us/mqa/respiratory/index.html.
(2) Each applicant applying for licensure shall pay an application fee in the form of a check or
money order payable to the Department of Health. The initial application must be accompanied
by the application fee. The application fee is nonrefundable and may not be used for more than
one year from the original submission of the application. After one year from the date of the
original submission of an application and application fee, a new application and new fee shall be
required from any applicant who desires to be considered for licensure.
(3) Every applicant for licensure as a registered respiratory therapist or certified respiratory
therapist shall demonstrate the following:
(a)1. That the applicant holds the “Registered Respiratory Therapist” or “Certified Respiratory
Therapist” credential issued by the National Board for Respiratory Care, or an equivalent
credential acceptable to the Board, or
2. That the applicant holds licensure, or the equivalent, to deliver respiratory care in another
state and such licensure was granted pursuant to requirements determined to be equivalent to,
or more stringent than, the requirements in Florida.
(b) That the applicant is not otherwise disqualified by reason of a violation of Chapter 456 or
468, Part V, F.S., or the rules promulgated thereunder.
(c) An applicant who has not practiced respiratory care for 2 years or more must complete a
Board-approved comprehensive review course within two (2) years immediately prior to the filing
of the licensure application or be recredentialed in the level in which he or she is applying to
practice in order to ensure that he or she has the sufficient skills to re-enter the profession. Board-
approved comprehensive course means any course or courses which includes, at a minimum,
fourteen (14) hours in the topics and numbers of hours as follows:
Patient assessment 3 hours
Hemodynamics 2 hours
Pulmonary Function 1 hour
Arterial blood gases 1 hour
Respiratory equipment 2 hours
Airway Care 1 hour
Mechanical ventilation 2 hours
Emergency care/special procedures 1 hour
General respiratory care (including medication) 1 hour

At this time Ms. Hall presented the preliminary discussions within the Department of a four-year renewal cycle and inquired with the Board their stance on the possible implementation. The Board indicated they would like to see a more defined perimeter of the change before deciding. Mr. Colon indicated that effective October 31, 2018 he will be ending his role with the Board of Respiratory Care. 15. Professional Association Updates, if any No reports. 17.
