Sutton v Nokia 514 203 Texas & CAFC 1210-1218

The technology development shown in the preceding video was integrated onto PSION devices, Wireless Access, Motorola pagers and PC laptops. Michael signed technology development support agreements with PSION in 1987-1992.

In 1993, signed marketing licensing partnership agreements with Fay Richwhite for use in pagers with an option for digital cellular devices.

In Sept 1994, met Nokia in Seattle and demonstrated the working software and devices; offering licensing agreements for the PCT Patent pending technologies.

In 1997 & 1998 was issued a New Zealand and US Patent. (262,206 & 5,771,238).

In 2005 engaged three legal firms in Texas whom identified Nokia's alleged infringements and commenced an action for "wilful, wanton and reckless" damages.

In 2007 Carl Belding (Chief Legal Officer for Nokia worldwide) died falling from a hotel in Switzerland.

In 2009 Judge Davis ruled in a Summary Judgement that the Patent could not be built.

In 2010 the Court of Appeal refused to reverse this ruling.

In 2011 the Court of Appeal refused to grant a rehearing enbanc (bench of five Judges).

Android: Out Call: EnumDiscoverer● Enum Discoverer hooks & overlays the mobile phone application.● The application undertakes DNS (Internet Domain Name Service) lookup

(s) of the number being dialed.● Using Enum, DNS, Ietf RFC procedures near-instantly return URLs and

other links to the callers social media and communications services.● The application "presents" the information retrieved and enables the user

to browse this information while in the call.● This enable the originating party (caller) to have access to the PKI/SSL

keys, geo-location, sip, flicker, linkedIn and Twitter, skype, email, physical addresses.

● These details are auto-loaded into the receivers directory.

number.● Using Enum, DNS, Ietf RFC procedures it near-instantly returns URLs

and other links to the callers social media and communications services.● The application "presents" a new telephone interface on the mobile/pc/ip

phone including the information retrieved.● Callerid enables via Enum the receiving party to have access to the

PKI/SSL keys, geo-location, sip, flicker, linkedIn and Twitter, skype, email, physical addresses etc prior to answering the phone.

Objective

● To “mirror” critical email from the Users office or Internet Service Provider computer using radio paging for delivery to notebook PCs:

○ Immediate delivery.○ 24 hour background reception.○ Cost effective service.○ Minimal user interaction.○ International applicability.

Page 28: Michael S Sutton

Compatible with:

● Microsoft MAPI:○ Microsoft Exchange Windows 95○ Microsoft MSMail Windows 3.11

● Current generation 7 bit POCSAG paging channels● Existing Telecom paging data entry systems● Motorola NewsStream pagers, 157 MHz● Wireless Access PCMCIA pagers 930 MHz

Page 29: Michael S Sutton

Innovation:

● Enhances existing services on paging networks.● Sends 8 bit binary files as small data packets.● Enforces optimal compression.● Encrypts the data packets for transmission level security.● Overcomes varying network restrictions without network capital

expenditure.

Page 30: Michael S Sutton

Customer Requirements: ● Automated Email reception.● Eliminate lead-time for final email delivery.● Compatibility with existing user programs.● Embedded files can be transmitted.● Original email held at office/ISP centre.● Access to normal paging message sources.● Mobile business user solution.

AWACS software provides

● 8 bit data:○ Enables computer compatible data to be sent

● Compression○ Minimizes cost○ Minimises on-air time○ Maximises efficiency

● Encoding○ Prevents casual monitoring of message traffic

ITU Geneva September 1995

Page 32: Michael S Sutton

Operational Parameters ● Max message size 16k● NZ delivery via Telecom Paging 157.950 MHz● Paging transmission 1200-2400 baud● Future channels allocated to paging in 930 MHZ channels

○ Six channels (est. to support 100,000 users)

Page 33: Michael S Sutton

Key Benefits

● Minimises Message Aging ● Low Cost● Automatic● Software Compatibility● Leveraged from existing proven services● Supports the convergence of telecommunications & computing

functions

Page 34: Michael S Sutton

Next Steps

● Principle agreement● Contract third party for integration of AWACS with TCNZ’s “On-

line Services” MHS computing technologies.● Sales channels: On-line Services direct marketing, Data-link

solution providers, Telecom Paging and the Internet WWW.
