UPRR Construction Agreement
A Union Pacific Railroad (UPRR) Construction Agreement is
required to construct the Harrisburg Overpass over the UPRR
Railroad tracks located just west of Hughes Road.
Union Pacific Railroad will require METRO to pay for work
associated with this project.
Union Pacific Railroad will install new crossing panels for
revised at-grade frontage roads and adjust the crossing gates
to clear the overpass structure.
No Small Business participation is anticipated since Union
Pacific Railroad self performs their own work.

UPRR Construction Agreement

• Authorize President & CEO to execute a Construction
Agreement with Union Pacific Railroad for a not-to-exceed
amount of $275,000.00 for the construction of the Harrisburg
Overpass.
• Estimate cost per Union Pacific Railroad is $228,635.00. Since
METRO must pay actual cost not estimated cost, a contingency
of approximately 20% is fair and reasonable for a total not-to-
exceed amount of $275,000.00.
• Total requested contract value is within METRO’s established
budget.

• METRO is completing the acquisition process for a parcel of land owned by the University of Houston – Downtown (UHD) on the east side of Main Street south of Naylor Street
• The parcel to be acquired is approximately 14,373 sq. ft.
• This parcel provides right-of way for a signalized, dedicated left-turn lane at Naylor and Main Streets (completed), which provides greater accessibility to the UHD parking area and the Wellington Fisher Partnership property
• This acquisition is included in the FY 2015 MRE CIP budget

METRO did not anticipate acquisition of this parcel, as UHD planned to trade the subject property to the City of Houston, and in return, UHD would receive Shea Street right-of-way owned by the City of Houston, one block to the south
This acquisition is necessary and guided by the terms in the February 17, 2011, Memorandum of Understanding (MOU) between University of Houston Downtown (UHD) and METRO
After the MOU between METRO and UHD was signed, the City of Houston discovered that the Shea Street right-of-way was owned by TxDOT. TxDOT chose not to participate in the trade

Background
• METRO Rail Expansion (MRE) Program Control Services which includes the monitoring and evaluation ofscheduling, cost control, and estimating for the Rail Expansion Program.
• Total Contract Value is $7.5M. Contract commenced in 2010 with a Period of Performance of 4 years with two(2) each additional one-year option periods.
• Expenditures thru June 2015 are $6.406M.
• There is $918,874.02 remaining in the contract. This amount is also included in METRO’s capital budget forFY2015 and FY2016. Therefore, no additional funding is required.
• Current period of performance expires September 30, 2015. Proposing to exercise the second one-yearoption period.
• This second one-year option period is primarily due to the delay’s by HRT for the axle counter issues and theconstruction delays at Burnett Plaza. Anticipated expenditures for this work is $403,400.00.
• Additional capacity to be used should support be necessary for assistance, contractual dispute, or litigation.

• Under this contract, as of September, 30, 2015, METRO will be reducing the contractor headcount by three.Leaving one full time scheduler and one part-time Senior Transit System Engineer.

Service & Inspection (S&I) and Rail Operations Center
(ROC) Lift Modifications

• The CAF H3 LRV was delivered with different lifting points than the existing LRV fleet vehicles
• CAF was to design the lifting points of the H3 to match METRO’s existing H1 fleet. The lifts for the ROC expansion and the S&I were all designed to work for the H1
• The lifts for the Rail Operations Center (ROC) expansion and the Service and Inspection (S&I) were supposed to be able to lift both the Houston-1 (H1) and the Houston-3 (H3) Light Rail Vehicles (LRV)
• CAF has denied responsibility for the lift issue, and METRO has thus far been unable
to reconcile the problem. To properly maintain the H3 LRV fleet, METRO needs to move forward with the lift modifications and collect from CAF through the Dispute Resolution process

• Authorize President & CEO to purchase equipment needed to modify
the new lifts at both the Service and Inspection and Rail Operations
Center maintenance facilities, to be able to hoist CAF H3 LRVs, for a
not-to-exceed amount of $1,025,000.00 which includes a 10% owner
controlled contingency to cover unknown conditions that may occur.
• This will be a sole source purchase from MACTON Corporation, the
manufacturers of the lifts.

The Southeast Transit Center has been a candidate for housing development on unutilized property surrounding the facility.
METRO has recently received interest from the Harris County Houston Authority to purchase portions of the Southeast TransitCenter for transit oriented development.
Staff seeks Board guidance on how to proceed with transit oriented development opportunities.

• With the launch of the New Bus Network, the Southeast Transit Center will

METRO’s policy for unsolicited proposals follows FTA guidelines
METRO Procurement rules and FTA guidelines expect competition to satisfy the requirement for full and open competition
METRO Staff believes that there is an opportunity for Transit Oriented Development at Southeast Transit Center and should the Board agree, Staff will move forward with a Request for Proposal based on Board guidance
