Two years ago, the TSPS Board of Di-rectors and its Governmental Affairs Committeefaceddownnolessthanthreebillsinthe82ndTexasLegisla-ture relative to professional licensing

agencies for surveyors, engineers, architects and geoscientists.

Facedwithextremebudgetshortfalls,theLegis-lature and Governor sought measures to reduce

the size and cost of state government … including the con-solidation of Texas licensing agencies, such as the Texas Board of Profession-alLandSurveyors.

Thankfully, no legislative action targetedTBPLSas an independent agency. Governmen-talAffairsCommit-

teemembers,DirectorsandOfficers,aswellasLegislativeLiaisonandGeneralCounselMarkHanna, spent hours of their time appearing at the Capitoltotestifyandattendcommitteemeetingsand meet with legislators and Governor’s staff.

Now,asanewsessionapproaches,theCommit-tee is aware the agency consolidation issue could arise again and will watch closely for any bills introduced that could negatively affect the land surveying profession or its licensing agency.“Right now, all’s quiet on the Western Front,” saidMickeyNowell,GovernmentalAffairsCom-mitteeChair.“We’renothearingany(consolida-tion)talk,butanylegislatorcanputanypieceoflegislation out there.”

NowellnotedthatTSPSandTexaslandsurvey-orshavebootsonthegroundattheCapitol.“MarkHannaisnotonlyourGeneralCounsel,buthe’salsoourlegislativeliaison,”Nowellsaid.“Markmonitorslegislationthatcouldaffectsurveyors. Also, any legislation we want to pass, heputsitstogetherandfindsthesponsorsforit.”

Legislative SessionContinued from page 1Sometimes, those sponsors may be legislators who have existing and friend-lyrelationshipswithTSPSmembers.Thisyear’sMeetandGreeteventsatlocal TSPS chapter events, in which state representatives and senators were invited and honored by the surveyors, have been integral to increasing good willandalliesattheStateCapitol.

Earlierthisweek,HannasentCommitteemembersthewordingforaproposed bill suggesting changes to the Surveyors Practices Act. The new wording proposed for the Act allows for electronic testing, which is neces-sarynowthatNSPSisgoingtoelectronictestingforalloftheirexams,Nowellsaid.Theproposedbillalsoaddressespenaltiesandthelicensingboard’sabilitytofileinjunctionsagainstpeopleinTexaswhosurveywith-out a license.

Butthethreatofconsolidationstilllooms,althoughNowellhopesitisaslightly smaller threat than last session.

“The big issue is still going to be the budget,” he said. However, he has heard that the shortfall is not as severe as the last session, but how that will affectbudget-cuttingdecisionsremainstobeseen.I’malwaystheeternaloptimist,”Nowellsaid.“I’mthinkingitmaybequietforus…that’swhatI’m hoping for.”

InadditiontoliaisonMarkHannaandtheTSPSBoardofDirectors,Nowellwill have the support of his committee, including legislative veterans Pat Smith,MikeParker,HenryKuehlem,GeorgeSandersandJerryFults–allTSPS Past Presidents.
