    The village of Menomonee Falls iseking a summary judgment againste defendants in an ongoing lawsuitvolving the Radisson Hotel in the vil-ge.

    As part of a tax incremental financeIF) district that included the hotel, inpril 2010 the village provided a $17.6llion loan to Lodging Investors ofenomonee Falls, LLC, the ownershipoup that was to construct and managee hotel. The ownership group default-d on the loan and the village is cur-ntly owed approximately $14 million.

    The hotel is currently operatingnder a receivership following a motiony the village of Menomonee Falls in

    Waukesha County Circuit Court thatwas granted in November 2011. InFebruary, Judge James R. Kieffer grant-ed a motion giving receiver Seth Dizardadditional powers and duties over thehotel operations.

    On April 15, the village filed amotion seeking a summary judgmentagainst defendants James Heyden,Constance L. OMara Heyden andL.A.C. Concepts, the remaining partnersin the Lodging Investors group.

    There are no issues of material factin dispute and, therefore, summary judg-

    ment should be entered in favor of thevillage, Randall Crocker, an attorneyrepresenting the village in the proceed-ings, stated in the April 15 filing.

    Froedtert Health Community MemorialHospital has named Dennis Shepherd, MD,and Laurie Amundsen, MD, as the recipientsof the 2013 Spirit of Caring Awards. The Spiritof Caring-Excellence in the MedicalProfession Award was awarded to Dr.Shepherd, of Elm Grove. The Spirit of Caring-Community Service Award was awarded toDr. Amundsen, of Menomonee Falls. His professionalismand dedication to the medical profession isevident from his past leadership role of themedical staff to the realignment of the ClinicalService Units, his contributions to CommunityMemorial Hospital have been invaluable.     A hearing on the villages request isheduled for June 10.

    The summary judgment request followedMarch 15 motion filed by the village

    gainst the Heydens and L.A.C. Concepts.The village has determined that Lodging

    vestors has insufficient funds to pay for theompletion of construction, Crocker stated

    the March 15 filing.Crocker stated that Lodging Investors

    as insolvent in 2010 and 2011.Lynne Mueller, an attorney representing

    e Heydens and L.A.C., filed a responsepril 5, alleging the loan guaranty was draft-

    d by the village and is unconscionablend commercially unreasonable.

    Mueller stated that James Heyden wasnot the manager of Lodging Investors anddid not participate in the creation of the loandocuments. Mueller also alleged that the vil-lage violated its duty of good faith and fairdealing by failing to complete the properdue diligence when it issued the loan for theconstruction of the hotel property, failing toverify the value of the proposed constructionand preparing loan documents that it knewor should have known were technically indefault from the moment the loan transactionwas prepared by the plaintiff (village).

    Crocker dismissed those allegations inhis April 15 request for the summary judg-ment.

    James Heyden, a sophisticated commer-cial developer, is asking this court to excuse

    him from the contractual obligation which hefreely and knowingly assumed as part of amulti-million deal negotiated with the assis-tance of counsel. There is no basis in contractor Wisconsin law for any such argument,Crocker stated in his April 15 response.

    When reached for comment last week,Lynne Mueller, an attorney representing theHeydens and L.A.C., said a response to thevillages motion for summary judgment willbe filed by May 27.

    Our response is in part that the Villagehas not acted in good faith in this matter andshould not be able to seek recovery fromeither Lodging Investors or Mr. Heyden sinceits actions caused the failure of the hotel

    operations. We believe the filing itself showsthe continued lack of good faith of the vil-

    lage toward Mr. Heyden asguarantor the Village is pursfact that as their own motioclaim all of the guarantors Mueller stated.

    The Menomonee Falls Village Boardpproved a rezoning of land near the north-est corner of Lisbon and Pilgrim roads thatll allow for the development of a senior

    ousing complex.The board approved the rezoning of

    ree parcels from the C-3 Commercialesidential Development District and

    anned Development District to the P-2stitutional District.

    According to information from the villageaff report, Presbyterian Homes & Servicesplanning on developing a senior housing

    ampus with a continuum of care that willclude senior apartments, assisted living,emory care and skilled nursing care. A sitean submitted to the village shows fouruildings constructed over three phases.nce completed, there will be 350 units ate development.

    Director of Community Developmentatt Carran said that if the rezoning is

    pproved, the company will come back to

    the village with specific plans for lighting andbuildings.

    Carran noted that the land was original-ly zoned for Medium Density UrbanResidential Development, which would haveallowed for up to six units per acre. In 2008,the village Comprehensive Plan waschanged so that the two western parcelswere classified as mixed use while the eastparcel was classified for commercial use.

    Village President Randy Newman said

    that concerns about drainage were raisedduring the Plan Commission meeting andsaid that would be addressed as part of thefuture development of the project.

    The board supported the rezoning and achange in the Comprehensive Plan to allowthe proposal to proceed. During board dis-cussion, Trustee Michael McDonald notedthat previous plans for site included a subdi-vision or a grocery store. McDonald alsonoted the development serves as adoorstep in the community.

    I just hope like heck youre able to put inthe type of development that weve seen inother neighborhoods like this, that youve

    done such a great job, McDonald said.Newman added the proposal will be

    great for the neighborhood. It will certainlytake some angst and anguish theyve hadover the years over the many things that havebeen proposed there.

    Rezoning approved for land nearfuture road

    The board approved a rezoning of landnorth of Roosevelt Drive from the RM-2 Multi-

    Family Resident District to the PlannedDevelopment District. The land is locatedbetween Roosevelt Drive and a future roadthat will go from the current Richfield Way atWater Street to just north of Roosevelt Drive.

    Carran said the apartment complex thatwill be proposed for the area will connectedto the future road. Carran said the rezoningis requested because the developer pre-ferred moving forward with the projectthrough the Planned Development District. Aspart of future proposals, plans will be sub-mitted to the Community DevelopmentAuthority and Architectural Control Boardbefore building permits are issued. No one

    spoke on a public hearingrequest.

    Newman abstained fromvoting on the matter.
