TO THE SENIOR DEPUTY ADMINISTRATOR, DEPUTY ADMINISTRATORS, DEPARTMENT/ REGIONAL/ PROJECT MANAGERS, DIVISION MANAGERS AND ALL OTHERS CONCERNED

SUBJECT : ELECTION BAN ON APPOINTMENT OR HIRING OF NEW

The Commission on Election in its letter of reply dated 6 April 2018 relative to our query as to whether the National Irrigation Administration, a government - owned and controlled corporation shall be covered with prohibitions on appointment from May 4 to 13, 2018 as indicated in COMELEC Resolutions Nos. 10246 and 10247 provides the following:

"Please be informed that pursuant to Section 5 of Republic Act No. 10952, which amended Section 261 (g) of the Omnibus Election Code, insofar as BSKE is concerned, if the action of your Agency does not involve appointment, hiring or new employees, creation of new position, promotion, or giving salary increases, remuneration or privileges in the barangay, the prohibition on appointment does not apply"

Meanwhile, the Agency is still covered as to the ban on transfer or detail of officers and employees in the civil service from April 14 to May 21, 2018, to wit:

"However, as to the ban on transfer or detail of officers and employees in the civil service, the NIA is still covered by the same. Therefore, kindly follow the procedure and use the format provided for requests for authority in Sections 6,7,8,9, Rule III of COMELEC Resolution No. 10206"

H o w e v e r , as to the b a n o n t ransfer or d e t a i l of of f icers a n d e m p l o y e e s m the c i v i l service, the N I A is s t i l l c o v e r e d by the same. I h e r e t o r e , k i n d l y t o l l o w the p r o c e d u r e a n d use the f o r m a t p r o v i d e d f o r requests for a u t h o r i t y i n Sections b, 7, 8 a n d 9, Rule 111 of C O M E L E C R e s o l u t i o n N o . 1020b.

Take note that d u e to the p o s t p o n e m e n t of the O c t o b e r 2017 Barangay a n d SK Elect ions to 14 M a y 2018, C O M E L E C R e s o l u t i o n N o . 10206 w a s a d o p t e d , a n d a m e n d e d by C O M E L E C R e s o l u t i o n N o . 10246 a n d N o . 10247 insofar as the p e r i o d s a n d dates ot p r o h i b i t i o n are concerned .
