“Fantastic course learnt a lot of new techniques I can use. Excellent course materials, would recommend to all ADIs of any experience”.“Thank you Ed (Edward Marshall) for a fantastic and informative coaching workshop. I loved that it was a small group and a very informal seating plan so every attendee could get involved. I’m looking forward to improving my teaching skills”We are coming to the end of the current advertised workshops with just Manchester on 21st November for a standards check one where I’m pleased to be a trainer that day along with James Quinn our Head of Training. We will be releasing new dates and courses very soon with posters in test centres and on our website. We are also focusing this year on visiting our groups and running tailor made workshops for them. Obviously we do need to charge for that to cover the cost of the trainers: the idea is that we run the workshop and the venue and food for the day is organised by the group. This could be for a whole day or half a day and we welcome discussing this with you if your group is interested. We have 4 of these provisionally booked so far following on from our current training days.

ADI Expo: We will be attending this event which is being held on November 20th at the Three Counties Show so we look forward to meeting many of you on the day at our stand.

AGM and Association Meeting in December:Please make a date for your diary as our 43rd AGM is on Saturday 3rd December in Walsall, West Midlands. The AGM is followed by our association meeting where Ed Marshall will be talking to us about the new practical driving test as we should have more news of a possible start date by our meeting. Ed took place in the trials and we will be able to answer any queries or concerns from members. It’s an opportunity for ADIs to consider any changes they may need to make to their current training.

Big Learner Relay:Good luck to all of our members who are involved in this excellent fundraising idea. Please send us your photos and let us know how you get on in your area. The team will be at our conference so you can add your name and join in or ask them questions. ADINJC have sponsored the relay to fly their team and headboard over to Ireland and we wish them every success over there. All the news and a video of their work is on their website at www.biglearnerrelay.co.uk

Thank you all for continuing to support the ADINJC.

Looking forward to our largest conference to date:Considerable work and effort goes into our annual conference and we have been successfully holding them for over 30 years now. It’s been a real pleasure to see how well the tickets are selling for this year: conference 2016 is in the West Midlands this month. We have sold more tickets than for previous years and have reached 200 delegates attending which is fantastic and thank you for all the support. The hotel has now sold all the rooms that were reserved as well. If you are reading this and still want a ticket there are a few left and the cheapest way to buy them currently is to ring 0800 8202 444 and quote “Intelligent Instructor” to our treasurer Peter. The ticket price is then £55. If you need a hotel room other hotels are available in the area and details can be found on the website at: www.adinjc.org.uk our programme for the day is inside this newsletter. The evening before the conference there is a drinks reception hosted by ADINJC and CA Cars so thanks to Karen and Clara for helping to support this event. We will be around at 6.15 in the hotel foyer for the reception and then a 2- course carvery meal and coffee is available for £15.95. This is in Faradays restaurant from 6.45pm until 8.00pm when last orders for the carvery food will be taken. There are other restaurants and bars nearby on the waterfront if you prefer to use them or want to eat later. We will be taking plenty of photos over the weekend which you can view and purchase afterwards if you would like to. For any information or more details about the conference the number to phone is 0800 8202 444.

Helping a group of road safety experts from America:Late last month we were thrilled to be able to help a group of Americans who travelled over to the UK to develop better strategies for teaching & training of learners, instructors and examiners back home in Washington State USA. They were Mi Ae Lipe, Mark Butcher, Loni Miller, Angie Ward, JC Fowcett, & Joseph Giammoa all from Washington. The group had already met the DVSA for a day, IAM, the Department for Transport and Dr Lisa Dorne before joining us for an afternoon. We are pleased to have been able to help them during their trip over here. The afternoon they met NJC the group discovered a great deal of very interesting and useful information with lots of note taking, photos and video. Our guests sat in on some lessons including learner lessons and PDIs being trained and watched a client centred approach to the learning. Thank you to Nick Ibbott, Lin Western and Peter Boxshall for hosting the day and helping the visitors to feel at home and see training in action. I’m sure we will hear from the Americans again once they have returned home. The Americans are also visiting DIPOD before they return back home.

Visits and our training days:I’m looking forward to visiting our member group the Worcester Association of Driving Instructors this month and the team have also recently visited the Cambridge Association of Driving Instructors and our group in Wakefield with presentations for their monthly meetings. If you would like a member of the team to visit at a meeting with updates and news please contact our secretary, Sue Duncan by email at [email protected] Our training days continue to run smoothly and it’s a service we like to offer to ADIs and PDIs who feel they want to learn more or improve their skills. Obviously everyone learns differently and some ADIs may prefer one to one training or our webinars. Training news can be viewed on the website at www.adinjc.org.uk This month there has been a standards check workshop in Maidstone and an effective coaching workshop in Milton Keynes. It’s a pleasure to work with the team especially when the feedback from delegates is so positive. A couple of quotes from delegates at the recent effective coaching workshop are:“Excellent and invaluable. Learnt a lot and took a lot away to reflect on too. This will definitely improve my ADI career”.

Following my article in last month’s newsletter something cropped up in my inbox that I thought had ‘gone away’ several years ago (the last reference I can find to it in anything I’ve written was in ADI News in 2009, when there was a lot of fuss surrounding the subject).

The thing that cropped up? Pull-Push steering.

I had an email from a new instructor asking:

“Hi John, can you help me with a steering problem?

I qualified three months ago and have really struggled to get my learners to pull and push the steering wheel. I’ve contacted the guy who did my part three training and he says that I shouldn’t worry too much – just keep the learners practising it in a quiet car park.

Are there any special exercises I can do to get them pulling and pushing OK? DK”

My thoughts:If DK had sent me that question in the early 1980’s I would have given him a couple of specific car-park exercises to do… But this is 2016… In answering the question I’ve looked at some recent (2008) and not so recent (1934) history.

Is there a right or wrong way to steer, or should our priority be to ensure that drivers retain full control and accuracy of their steering using whatever method works for them?

The DVSA (and before them DSA) have never insisted on pull-push steering and it has never been a requirement in the UK driving test.

Pull-push was first adopted a ‘preferred method’ in 1934 when the police requested ideas for ‘best driving practice’ from Lord Cottenham and Malcolm Campbell. In those days heavy cars required large steering wheels to allow drivers to get sufficient leverage to turn the wheel.

In old vehicles with heavy steering, pull-push was a fairly essential requirement unless you were the world’s strongest man – but in modern vehicles there is no need for this cumbersome steering practice. Note: that from the start, pull-push was a ‘preferred’ method – not a driving test requirement.

Potentially dangerousPutting too much emphasis on any specific steering method can be time wasting; it can take an unnecessarily long time for some people to learn. It can also be detrimental to safety because it focuses the driver’s attention towards the steering wheel rather than the road. There is a possibility (probability?) a pedantic insistence on a ‘correct’ steering method also adds to the unhealthy attitude of ‘do one thing to pass the test and then do as you like afterwards’.

Thoughts about pull-push were brought to the fore around 2008/2009 when Sir John Whitmore and I worked together to lobby the DSA on the issue. The result was that the DSA acknowledged that pull-push was not a requirement and added a technical update to their examiners guidance notes.

Quote from the examiners guidance:“To ensure uniformity, when conducting car or vocational tests and ADI qualifying examinations, only assess the candidate’s ability to control the vehicle and do not consider it as a fault if, for example, they do not hold the steering wheel at ten to two or quarter to three or if they cross their hands when turning the steering wheel. The assessment should be based on whether the steering is smooth, safe and under control.”

Control“The ultimate test of steering control is accuracy. Does the car go exactly where you want it to go? If you can achieve the same degree of accuracy through different methods, use the technique that feels most natural, makes the most efficient use of energy and provides the smoothest changes of direction.”

The quote above (from Dave Nickerson, designer of the Young Driver project) sums up what we should be aiming for; namely ‘natural efficiency’. For some people in some situations that might well be pulling-and-pushing, but for many others – in fact for the majority of drivers who passed their driving test more than 10 minutes ago, other methods are preferable. What is natural for one person might be unnatural for another.

I want to be clear here that I’m not talking about sloppy driving. Just about what fits for the individual. After all, we accept individual preference in all other areas of our lives without question. For example, I’m typing this message at a keyboard, but sometimes I use ‘voice typing’, other times I use a pencil (or even a pen!) and paper. The method used to write does not affect the finished article – and so it is with steering. If the car is fully under control it doesn’t matter a jot how the wheel is being manipulated.

Some people can’t pull-pushFor people with only one arm (or use of one arm) cars have been adapted with steering spinners, and steering arm braces; there have been steering foot-plates and joysticks… Drivers with these adaptations steer perfectly well.

Take a look at this video https://www.youtube.com/watch?v=sV-HoRGHpnY… No pull-push.Here’s another example: https://www.youtube.com/watch?v=tl28nkae5DU You will find more on you tube:

https://www.youtube.com/watch?v=8PP6tKLDoSo Steering with a footplatehttps://www.youtube.com/watch?v=nzfrueDT0UM if you watch this video closely you will notice that a steering glitch is fixed simply by directing the steerer’s observation.

https://www.youtube.com/watch?v=d9_xAdZ2KxY - Toyota concept car demonstrating a ‘no pull-push’ method for everyone. This video also shows other modes of futuristic transport that don’t need a steering wheel. The old schoolDuring the steering ‘controversy’ (2008/2009) there were many ‘old school’ drivers, particularly ex-police, who came up with all sorts of bogus reasons why we should be teaching pull-push.

While there is some evidence of air-bag injury caused by hand and arms hitting the face there was no evidence that the incidence of this could be reduced by pull-push steering. If you are a pull-push devotee I don’t want to re-kindle or re-enter a debate - if you want some ‘historic’ opinion from both sides of the discussion you can find a pdf file with three opinions on the Herefordshire RoSPA Advanced Drivers web site:

http://www.herefordroadar.org/Hereford_ROADAR/Welcome_files/Steering_debate_2010.pdfIronically, the debate about steering came at a time when several police driving schools had dropped or were in the process of dropping their insistence on pull-push.

Steering 2 John Farlam

Conclusion?Coming back to DK’s question… You don’t need to teach pull-push.

Steering is natural for most people – if you put a young driver (child) in a car they will steer, you don’t need to teach them how.

Allow your learners to steer ‘naturally’. The method will vary from person-to-person, occasionally you might find some who pull-push… Indeed, all steering has some degree of pull-push, but not the ‘regimented military precision’ of the traditional method – when I say ‘precision’ I’m talking about the execution of the method, not its effectiveness or accuracy.

Relaxation and observationThe main issues to concentrate on with steering are relaxation and observation.

Relaxation:Make sure that your learner is fully supported by the seat back-rest and that they relax their shoulders and arms. If they are gripping the wheel tightly move the focus away from the hands by asking them to relax their shoulders and upper arms. When you draw attention to the hands they will often look down at the wheel – which exacerbates the problem!

Observation:Make sure that learners look well ahead, the natural tendency will often be to look at the front of the car; also make sure that they keep their eyes moving to scan the road and that they turn their heads when turning the car at junctions making full use of the side windows. Avoid the use of reference points when driving forwards– doing this shortens observation and focusses observation very narrowly, thus reducing spatial awareness and awareness of others on the road. Reference points should never be necessary when driving forwards except, perhaps, when manoeuvring very slowly in very tight spaces.

Hopefully the ideas above and the ‘history’ will help you to help your learners to steer naturally.

DfT National Car Test Waiting Times...

Mrs Adrian and I went to the Goodwood Revival a couple of weekends ago. If you have never been, I can thoroughly recommend it. Three days of pure nostalgia. Anyway, by pure chance we got very close to Sir Stirling Moss. We just happened to be in the pit area when he returned from a demonstration lap in an Aston Martin DBR4. In British racing green of course. A photograph in that weekend’s Sunday Express revealed that Sir Stirling, whose Formula One career stretched from 1948 to 1962. Sir Stirling turned 87 on September 17th and looked very frail as he was helped from the car. He finished runner-up four times in the drivers’ championship but never actually won it. Nonetheless, he is a true motor racing legend.

In the same paper there was a piece in the gossip column which claimed that “diesel car owners are fuming over the sudden stigmatisation of their vehicles”. It went on to say that Renault has announced that it will no longer make any more diesels and more manufacturers are set to follow suit. Well this was news to me and I sought clarification from Fleet News which, coincidentally, had carried out a recent poll. It said that diesel dominance of the company car market could disappear within five years and that made much more sense to me. More than half of the respondents to the poll believed that petrol and alternatively fuelled (plug-ins and hybrids) will account for the lion’s share of fleet registrations come 2021. This rose to 81% by 2026. Figures from the Society of Motor Manufacturers and Traders (SMMT) show that sales of new diesel cars accounted for just 14% of new car registrations in 2000, whereas today the figure is 48%. Apparently the Mayor of London, Sadiq Khan, is considering a range of measures to tackle air quality in the capital, including the expansion and earlier introduction of the ultra-low emission zone (ULEZ) and five cities outside London – Birmingham, Leeds, Southampton, Derby and Nottingham – will also be given charging powers to tackle pollution.

And talking of fuel, there was a piece in the Times earlier which revealed the sad news that Tango, the tiger who featured in the Esso advertisements of the 1990s, has died at the age of 22. Apparently after the adverts ended, Tango was sold to a German Circus that mistreated him. But the Woodside wildlife park in Lincolnshire raised £250,000 to rescue him and bring Tango and his mate Julia, to Britain in 2014. Tigers usually live to the age of 16 but the oldest known tiger lived to the age of 24. Coincidentally, the Renault Classic Car Club recommends that I use Esso Supreme in my Dauphine. So I will continue putting a tiger in my tank.

There was an amusing piece in Classic Car Buyer last week. Amusing, that is, unless you happen to be a member of Leicestershire Police. They had a long wheelbase Land Rover Defender on loan from local dealership, Sturgess Land Rover. It had the full Leicestershire Police livery and was used by officers on ‘rural engagement’ duties, aimed at stopping barn thefts and poaching. Anyway, it was parked up overnight outside a police station in Market Bosworth but when an officer arrived at 05.45 to start his shift, he discovered that the vehicle was missing its doors, bonnet and headlamps. Classic Car Buyer explains: “Ever since Lode Lane stopped production of the Defender in January this year, prices of spares have skyrocketed. The cheapest way of obtaining parts is to steal them”. Leicestershire Police’s spokesperson confirmed “Enquiries into the theft are continuing. Anyone with information about the incident is asked to call PC 207 Rob Cross on 101”.

commercial vehicles across the country to analyse speeds at all times of the day and night. The slowest was the M606, a three mile stretch in West Yorkshire running from the M62 into Bradford, where drivers crawl along at an average of 24.62 mph. Which is less than the 27.8 mph achieved by Jamacian sprinter Usain Bolt at the 2009 World Athletics Championships! The fastest motorway is the M40 from London to Birmingham where the average speed is 48.6 mph. Well there we all are then.

You’ve probably heard of Young Driver, which claims to be the UK’s largest provider of pre-17 driving lessons albeit at £1.00 per minute. And I’m sure that some of you are working for them. Up until now the little darlings have had to be aged eleven years or older. But, according to a recent piece in the Saturday Motoring Telegraph, Young Driver has now introduced a new course designed to give children aged five to ten a proper taste of driving. The car is the Firefly, powered by twin electric motors enabling a restricted top speed of 10mph. It has hydraulic brakes, rack and pinion steering, independent suspension, indicators, LED lights, an adjustable driver’s seat and a Tesla-style tablet showing a speedo, clock and power reserve indicator. It was designed by Chris Johnson, who has worked for Rover and Jaguar and is head of industrial design at Coventry University. The car has remote sensors that will bring it to a halt in both forward gears before a collision and it can be stopped with a remote-control fob from 120 metres. If this appeals, you can buy one privately for £6,900 and, at additional cost, you can specify upholstered leather seats, an in-car audio system and the body in GRP or carbon-fibre. Although I’d already seen the Telegraph, Times and Western Morning News last Saturday, I bought a copy of the Mail. Well that’s not strictly true. I just happened to be shopping in Waitrose (other supermarkets are available) for any whisky that was on offer and I was able to snap up a bottle of Bushmills. This then entitled me to a free newspaper. So I was able to read my horoscope in the colour magazine, courtesy of Oscar Cainer. Apparently his uncle, Jonathan died of a heart attack in May this year, aged 58. (It would be in very poor taste for me to wonder if he had forseen that, would it not?) Anyway, I’m a Taurean and Oscar says that when life hands me a bowl of cherries it is, frankly, irresponsible for me not to feast merrily. He concludes that, this week, I have the chance to harmonise in a creative fusion. Well there we all are then. Mr Cainer’s prose makes Paul Caddick’s editorials in Intelligent Instructor read like a piece in the Times Literary Supplement.

You can’t have missed the recent story about drivers increasingly using hand held mobile phones. It was carried by all the media and the source was the publication of a ‘major’ study by the RAC. They spoke to 1,700 motorists and found that half of drivers confessed to using a handheld phone while in stationary traffic. One third have owned up to making a call while driving, a fifth admitted texting or emailing while on the move and 14 per cent had taken a photograph or video in moving traffic. On the other hand 41 per cent of drivers claimed mobile phone use by other road users was their biggest safety concern! The media all reacted differently, as usual. The Mail immediately launched a campaign for much stiffer deterrents to end what Paul Williams, RAC road safety spokesman, called an ‘epidemic’ of offending. Our new PM, Theresa May, pledged tough action saying that using a handheld phone while driving was ‘totally unacceptable’. One caller to a LBC phone-in suggested that offenders’ cars should be seized and crushed. The Government’s response was immediate. It will launch a consultation to increase to increase on-the-spot fines by a massive £50 and four penalty points rather than three. Well that’s all good isn’t it? Actually, I thought the response from the IAM was the most positive. Tim Shallcross, their technical expert

suggested that with the current cuts in road policing, any increase in enforcement was unlikely. Rather, he said, it would be up to the vehicle manufacturers to restrict the in-car screens to guidance in order to minimise distraction.

Something else which is illegal, of course, is smoking in a vehicle carrying someone under the age of 18. The law came in last October but up until now the police have chosen not to enforce it. Only three forces in England and Wales reported incidents, all of which were dealt with by verbal warnings. But on May 20th this year a man from Sheffield was fined after being caught smoking in a car with a child sitting beside him. Mind you Jake Downing, 28, also pleaded guilty to charges of having a defective hand brake, a defective front tyre and travelling with a passenger in the back of his van who wasn’t wearing a seat belt. He was fined a total of £160 and given six points on his licence. He was also ordered to pay £40 costs and a £30 victim surcharge. A good job too.

Another story which received a lot of coverage in the print media was the survey by Privilege Car Insurance which named and shamed the rudest drivers in the country. I caught up with it in AutoExpress. Apparently Bristol was number one in the top ten ahead of Liverpool and Norwich. The full chart is:1 Bristol 2 Liverpool 3 Norwich 4 Newcastle 5 Manchester 6 Southampton 7 Birmingham 8 Glasgow 9 Leeds 10 LondonBut the Bristolians were the most prepared to own up to their bad driving habits, with 61 per cent admitting poor road manners. These included using a mobile phone, speeding, not indicating and swerving across lanes. Other offences included pulling out in front of other drivers, taking up too much space on the road, blaring the horn unnecessarily and splashing pedestrians with puddles. Women over 55 were considered to be the rudest in several areas including being in the wrong lane and driving too slowly. Men, meanwhile, were found to cut corners, undertake and drive down the middle of the road. What are your observations about wherever you live?

You must know by now that I’m a number plate nut. And yes, I still have M5PSL for sale (reduced from £2k to £1.5k). Well, it seems that I’m not alone. The Sun reports that Mike Oyson, 64 of Cheadle Hulme in Manchester, has blown the entire tax-free lump sum of his pension on 5UV. He snapped it up for £51k at a DVLA auction. “Every car manufacturer sells an SUV” says Mike, looking to double his money “and I plan to give Jaguar first refusal”. I wish him luck.

You might be interested to learn that Mrs Adrian and I are flying out to America next week. After spending two days in New York, we are going to hire a Jeep and drive Route 66. So I’m not sure what form next month’s column will take. I’ve also upgraded my mobile phone to a new(er) Black Berry (but that’s another story) and so I don’t know what contact, if any, I will have with the UK.

And finally, I’m sure you know that I’m a great fan of Honest John’s column in the Saturday Motoring Telegraph? Particularly the bit where he answers queries from readers. I’ll give you a recent example:Q “Our youngest son is always having problems with his cars, and it’s always my wife and I who bail him out. You see, he always buys old bangers from dubious dealers where there’s never any comeback. We’ve decided it can’t continue in this way, so my question is, can you recommend any good adoption agencies that might take him on?”A “No, but this is my favourite letter to date”.Til next time

ADINJC - WORKING ADIs WORKING FOR YOUWHAT OUR LOCAL ASSOCIATIONS AND GROUPS SAY ABOUT US

“ADINJC are a great National Association run by working ADIs like us, they put in a tremendous amount of work to provide us with all the latest and up to date information about the industry. They offer support and advice and give us a voice at national level. Their CPD courses are excellent, well organised, reasonably priced and very useful. The Association meetings are interesting, a great source of information and also a good opportunity to network with information and also a good opportunity to network with other likeminded ADIs.”

“Sometimes life as an ADI can leave you feeling isolated. This is why it’s important to be a member of an association. Who is best, a local or national one? As a member of a local association which in turn is a member of ADINJC, I consider we have the best of both worlds. The ADINJC has provided support on numerous occasions and gives our SADDIA members a feeling that there is always someone behind us to provide help when there is always someone behind us to provide help when needed.”

ANDREW MORRISONCHAIRMAN APDI SOUTH WEST

MARK CHRISTMASSECRETARY, SOUTHEND & DISTRICT ASSOCIATION

“SmartDriving has now been an ADINJC member organisation for over four years – the benefits of direct representation, support and information offered by ADINJC has been of proven value to my 1600 members. I firmly believe that this non- profit organisation has a genuine concern for the improvement of our industry and in helping ADIs generally. No organisation is totally politically unbiased or free of “self-interest” but unlike some organisations who may be tempted to put commercial considerations or rigid political agendas before the best interests of their membership, the ADINJC are about as straight and independent as you might hope to get.”

JOHN FARLAM, SMART DRIVING

“St. Albans Association was one of the founder members of the ADINJC, and to this day all our members still benefit from being part of a brilliantly run national association for ADIs that just keeps getting better. Join to meet a dedicated team Join to meet a dedicated team helping your industry today and every day, come and take part. We did over forty years ago!”

TIM MCKERNANSECRETARY ST ALBANS ASSOCIATION

“Fantastic news 1st 4 Driving Ltd are now group members of ADINJC. All my members enjoy the many benefits including the reduced price PI/PL. I’ve been a member for many years and found their information quickest to information quickest to arrive, most comprehensive and their CPD conferences second to none.”

DAVE FOSTER MA1ST 4 DRIVING

I look at the ADINJC membership from the point of view of a multi-car driving school owner. For a very reasonable price, I have signed up my school as an association and now all of my instructors and I benefit from the regular industry information updates, monthly newsletter, association meetings and available training courses. Not to mention the fact that the governing committee will take questions and queries we put forward to the highest level of the DVSA. If you are considering becoming a member of a national association then I can't recommend the ADINJC highly enough. It’s a non-profit making organisation that puts all its resources into benefiting its members.”

RSA Chief Snubs ADIs

Due to an accident in late April 2015 – which left me immobilized for a considerable period of time - a meeting with Ms. Moya Murdock, the newly appointed CEO of the Road Safety Authority regrettably had to be cancelled. It was agreed that contact would be made again to arrange a new meeting for me and a colleague. On 17th February 2016, contact by email was made with Ms. Murdock’s secretary, and a request was made for a fresh meeting in either the second or third week in March. The prompt reply was as follows:

Dear Mr. Harrington

Thank you for your email.

Unfortunately, due to work pressures and a heavy diary schedule, Ms. Murdock is unable to meet you as requested. However, Ms. Murdock has stated that your concerns can be addressed as part of the next ADI forum. I trust this is of assistance.

Kind regards

Elizabeth

My reply:

Dear Elizabeth

Thank you for your email.

On reflection, the time frame for the requested meeting was rather short. I should have asked for the appointment at a later date. Would you now confirm if Ms. Murdock is prepared to facilitate a meeting with us anytime later this year? Whereas the ADI stakeholder’s forum may well address the concerns of those currently involved, it would not address the many issues we need to discuss with a person such as Ms. Murdock.

Yours etc.

To date, the courtesy of even an acknowledgement has not been received. This is not particularly surprising as many queries to the RSA go unanswered. When appointed, the previous incumbent – Mr. Noel Brett – received us warmly on two occasions and our meetings were positive and fruitful. We also sought a meeting with Ms. Liz O’Donnell Chairperson of the Road Safety Authority however; it took two letters to even elicit a response – and then rather oddly that came from Ms. Murdock. The view was that Ms. Murdock would convey the content of our discussions to Ms. O’Donnell.

Motor Insurance Cartel?

The major insurance companies in Ireland are finally being investigated over claims they are acting together to increase prices. The insurers have been summoned to give evidence to the state’s competition watchdog over suspected breaches of competition law. The Competition and Consumer Protection Commission says it is concerned motor insurers were signalling price increases to each other before raising premiums. This is seen as a cartel-like activity – where players in a market who are supposed to be competing against each other, instead act to regulate

A GUIDE TO ADINJC

Professional Indemnity Driving TuitionWhy is Professional Indemnity cover so important?

Because we all make mistakes in life, including in our business operations as a driving instructor.

However, if you make a mistake in running your driving school, the consequences can be very serious. You could, for instance, be sued for vast sums of money. Professional Indemnity will provide you with protection in case someone decides to take action against you even when you haven’t done anything wrong.

The ADINJC Professional Indemnity insurance, provides the valuable protection you need as a driving instructor offering professional advice to the public, to prevent this happening. It covers you when, as a result of negligence, you are sued for losses or damages by a third party. In short, it gives you peace of mind: if a claim is brought against your business, you won’t have to worry about the financial implications of a lawsuit. The ADINJC policy provides £5 Million cover for each and every member, ensuring you have sufficient cover. The policy also has a low policy excess of £500 for each and every claim.

prices. Drivers have been hit by a 68pc surge in the average cost of premiums in the last three years. In the last year alone premium rates have shot up by a third. Insurers could face fines of up to €5m, or imprisonment, if the competition body is successful in getting the Director of Public Prosecution (DPP) to take a case and the outcome is successful. Meanwhile, car rental firms fear they are being targeted by criminal gangs coming here to stage motor crashes. The criminals are lured here because the pay-out on claims is much higher than in other EU states.

‘Fronting’ Clampdown!

All insurance companies are set to clamp down heavily on young drivers getting cover in their parents’ name , but being the only user of the car themselves. Younger drivers reacted with anger to suggestions by Aviva Insurance that they are acting fraudulently by being named drivers on policies taken out by their parents. They say they have no other way of getting insurance on the road as insurance is so expensive. Insurance experts said all insurers were now set to follow Aviva’s lead and clamp down on the activity, which is known in the industry as ‘fronting’. Thousands of young people do it to save money, as insuring a car in a young inexperienced driver’s name can cost thousands of Euro each year. A broker at CoverInAClick.ie, said insurers were seeing a rise in cases whereby people were making claims on policies that are in the name of the parents, but where the child was the main driver. If there is a claim and the insurers discover ‘fronting’. Then they won’t cover accidental damage on the car and won’t cover theft, but will cover third party claims. A young driver who campaigns for lower-priced insurance said many young drivers were not aware that ‘fronting’ was illegal.

The Carnage Continues …

There were 139 road fatalities up to the end of September compared to 118 to the same time in 2015 - an increase of 21. Is road safety working?

Volkswagen Saga Continues!

Lawyers for Volkswagen walked out of a District Court in County Mayo on the 6 September after labelling an ongoing case regarding emissions as “entirely inappropriate and unfair”.

Barrister Paul Fogarty and two instructing solicitors from A&L Goodbody left Castlebar District Court after Judge Mary Devins ruled she would continue with the case. Earlier, Mr. Fogarty told Judge Devins that his clients Volkswagen Group Ireland and Volkswagen AG, had obtained legal advice that the court had no jurisdiction to take this case. The case being taken by a mum-of-three – Eithne Higgins – is seeking compensation after Volkswagen admitted cheating on emission tests. The case will deal with whether there was an issue with carbon dioxide (CO2) and/or oxides of nitrogen (NOx) emissions on the vehicle in question. A statement from Volkswagen Ireland’s technical manager was read into the record, stressing that CO2 emissions were not linked to the NOx emissions. However, this was dismissed by an emissions expert who said it didn’t stack up with theory, practice or experience. The case continues.

India’s Startling Road Fatalities

The Indian Government has revealed that 146,133 people died in crashes on the country’s roads during 2015. This figure is of concern as it is an increase of 4.6% over the road fatality rate of 139,671 for 2015.

Also, of concern is the fact that over half of the fatalities who died were aged 15-34 years of age. There were 500,279 people injured in road crashes in 2015 – a rise from the 493,471 injured in 2014. On average around 400 people per day are killed on India’s roads.

Bad driving was recorded as the cause of 80% of crashes, with speeding accounting as being a contributory factor in 62% of collisions.

India’s Ministry of Transport (MoT) is developing schemes to tackle the road safety problems by identifying and upgrading badly designed road sections and using speed cameras and red light cameras. There are also plans to introduce much tougher penalties for driving offences and more effective enforcement measures. (World Highways – Route One Publishing 20 September 2016)

Pedestrian & Cyclist Warning System

Swedish bus manufacturer Volvo has introduced a new pedestrian and cyclist detection system that emits audible warnings of approaching vehicles. The system continuously monitors the bus’s vicinity and transmits a sound to warn other road users when they get too near the bus. The driver is also alerted via sound and light signals inside the vehicle and if there is an imminent risk of an incident, the bus’s horn is activated. The system consists of a camera, image processing system and algorithms for detection of pedestrians and cyclists and will be included in Volvo’s European city bus fleet in 2017. Volvo will begin field tests of the technology on Gothenburgs Route 55 in Sweden this autumn.

Self-driving Cars – Safer!

Elon Musk has promised the safety of his Tesla electric cars will be dramatically improved by a software update to their Autopilot system. The billionaire said the vehicles – which can be set to steer and brake by themselves – will rely more on radar and less on cameras that can fail in bad weather or bright sun. It comes after a technology company executive died in May when he crashed into a truck, while his Tesla Model S was set to Autopilot.

Fatal Driver Distraction

A lorry driver was recently jailed for six years after killing on off-duty police officer shortly after opening a text message on his phone. The truck driver was found guilty of dangerous driving on the A141 near RAF Wyton in Cambridgeshire on June 2014. The female police officer died when the truck driver’s lorry ‘drifted’ into her car while she was in traffic, Peterborough Court heard.

999 – Help?

A driver involved in a police chase dialled 999 – to ask officers to stop following him. The driver failed to stop when flagged down by a patrol car and, when he could not shake off pursuing officers, he phoned the control room. He swerved in and out between cars and a lorry, and dodged ‘stingers’ deployed to burst his tyres during a 50-minute pursuit. The driver – who had only a provisional licence – admitted dangerous driving and driving without insurance when he appeared at Chichester Crown Court last month. One police car was put out of action during the chase and two more were damaged.

And finally …

Philip: “Doctor, I get so nervous and frightened during driving tests – is there anything you can give me”? “Doctor: Just try not to worry about it – you’ll pass eventually” Philip: But I’m the driving examiner”.

Public Liability Driving TuitionWhy is Public Liability cover so important?

Because we all make mistakes in life, including in our business operations as a driving instructor.Quite simply, if a member of the public (or any other third party) is injured or suffers damage to their property, arising out of the conduct of your business as a driving instructor, you could be held responsible.

The ADINJC Public Liability insurance, is designed to provide protection from claims against you by third parties who may have suffered personal injury or damage to their property, during contact with your driving school. Most motor policies provide you with a compulsory £20 Million Public Liability cover for accidents and injuries that occur as a consequence of having an accident. The ADINJC believes it’s important to ensure you also have sufficient cover away from the vehicle, and have therefore arranged for its paid up members to benefit from £10 Million Public Liability cover away from the vehicle. The policy also has a low policy excess of just £500 for each and every claim. The ADINJC policy provides £10 Million cover for each and every claim during the life of the policy.

A range of claims can arise. These can extend from accidents at your own business premises, to incidents that occur whilst providing advice or tuition whilst working away from your vehicle.

Increasingly, it is a requirement of many customers, principals, and clients (particularly local authorities and government agencies), that you be asked to present proof of Public Liability insurance before they will work with you, or allow you to work on their property or premises.

Compensation arising from Public Liability claims can be substantial, and may include loss of earnings, future loss of earnings and damages awarded to the claimant. In addition, considerable legal costs in defending the claim can be incurred, and the claimants’ legal costs may also be awarded against you if you are found to be at fault. All would be covered under a comprehensive Public Liability policy

Claims for trips, slips and falls are the most common, but there are other events that can lead to a claim against you. The following are examples of potential claims that can give rise to public liability claims against your driving school:

• you open your door for a pupil who you inadvertently trip over, causing an injury;

• you spill a hot drink in a classroom and a pupil slips over on this, causing an injury;

• a pupil falls over some cones you have positioned to practice parking, causing an injury;

• you knock over a valuable antique whilst waiting for a pupil at their home;
