The applicants propose to temporarily or permanently place, dump or remove any material originating on the site or elsewhere within a Regulated Area of the Etobicoke Creek WatershedOntario Khalsa Darbar Inc., 7080 Dixie Road, City of Mississauga. CARRIEDBACKGROUNDThis application has been submitted for approval of works after-the-fact. The applicant is presently seeking permission to retain the fill (approximately 10,360 cubic metres of fill) that has recently been placed on the subject property within the Regulatory Floodplain of Etobicoke Creek

TRCA Enforcement staff observed the filling on the subject property, adjacent to the Etobicoke Creek on October 13, 2009. TRCA Enforcement staff subsequently issued a notice of violation on October 16, 2009, as the required permits (pursuant to Ontario Regulation 166/06) had not been attained from TRCA. The owners were subsequently charged under the Conservation Authorities Act for the unlawful placement of fill without attaining a permit from TRCA, and legal proceedings in the form of charges before District Court commenced August 24, 2010. This matter is anticipated to be proceeding through the courts in the fall of 2010. Violation notices and charges under the Conservation Authorities Act have previously been issued on this property to the same owners as a result of previous filling activity and watercourse alterations in another section of the river corridor on the property.

Following the enforcement notices, TRCA staff received a permit application and associated materials on January 14, 2010 to regularize the prior placement of approximately 10,360 cubic metres of fill on the site.

As a result of the adverse impacts to the control of flooding (detailed further below) TRCA staff cannot support this permit application. In the case of the proposal for approval of works after-the-fact for 7080 Dixie Road, TRCA staff concludes that the control of flooding has been adversely affected. Before refusing permission, TRCA must hold a Hearing to which the applicant and other interested persons are a party (Conservation Authorities Act, R.S.O. 1990, c. C.27 - 28(12)). The applicants have requested such a hearing before the TRCA Hearing Board.

PROPERTY LOCATION AND DESCRIPTIONThe subject property is located on the west side of Dixie Road, north of Derry Road, and is traversed by the main West Branch of Etobicoke Creek. The subject property is surrounded by employment lands, just west of the Lester B. Pearson International Airport, in the City of Mississauga. The south portion of the property contains an existing temple facility and associated parking lot and recreational field. The north portions of the parking lot and temple are within TRCA's Regulated Area adjacent to the Etobicoke Creek valley corridor. The recreational field, located just north of the temple, is located entirely within the Regional Floodplain and is subject to flood depths of up to two metres. A TRCA permit was previously issued for an addition to the existing temple and an expansion to the parking lot in 1997 (TRCA Permit #C-97053). A TRCA permit was also issued in 2006 for an additional parking lot expansion as well as the removal of fill and slope stabilization works adjacent to the creek, to resolve a previous violation on the property (TRCA Permit #C-06078).

TRCA JURISDICTIONPursuant to Ontario Regulation 166/06, a permit is required from TRCA prior to any development, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

Development is defined as:i) the construction, reconstruction, erection or placing of a building or structure of any

kind,ii) any change to a building or structure that would have the effect of altering the use or

potential use of the building or structure, increasing the size of the building or structure or increasing the number of dwelling units in the building or structure,

iii) site grading,

iv) the temporary or permanent placing, dumping or removal of any material, originating on the site or elsewhere.

An Ontario Regulation 166/06 permit must be applied for and obtained before any grading or site alteration works can commence within portions of a property regulated by TRCA. In the case of 7080 Dixie Road, a permit under Ontario Regulation 166/06 would have been required prior to the site grading works and fill placement commencing within TRCA’s Regulated Areas; this has been conveyed to the same proponent on several occasions through previous violation and permitting processes on the same property.

TRCA staff review all permitting requirements in concert with our Valley and Stream Corridor Management Program (VSCMP) policies (1994). VSCMP integrates TRCA's natural hazard management, public safety responsibilities and reaffirms its commitment to ecosystem planning at a watershed level. The VSCMP outlines policies for new development and modifications to existing properties within highly urbanized areas such as the area surrounding and including the subject property.

THE PROPOSALThis permit application is to seek permission after-the-fact for the fill placed within a TRCA Regulated Area, and the Regulatory Floodplain, adjacent to Etobicoke Creek. According to the report submitted in support of this application, prepared by MPS Engineering Inc., dated January 2010, approximately 10,360 cubic metres of fill has been placed over an area of 12,140 square metres (for an average depth of 0.85 metres). The submitted report and application identify that the fill has been placed on an existing soccer field in order to create a level soccer field for the benefit of temple members. The fill placed on site is located within the Regional Storm floodplain.

STAFF REVIEW OF THE PROPOSALControl of FloodingThe submission does not meet the five tests under Ontario Regulation 166/06 as it negatively impacts the control of flooding. The report completed by MPS Engineering Inc., submitted with the application states that the fill placement has resulted in the direct loss of 8,640 cubic metres of floodplain storage during a Regional Storm event. TRCA staff has determined that this loss of flood storage is unacceptable and that the cumulative impacts to the available flood storage throughout the watershed, should this type of activity be allowed, would result in adverse changes to the function of the floodplain and its ability to convey flood waters. The loss of flood storage will result in an increase in peak flood flows and water levels.

As noted above, the Valley and Stream Corridor Management Program is utilized by TRCA staff to guide the review of applications pursuant to Ontario Regulation 166/06. The VSCMP stresses in 'Principle No. 4' that valley and stream corridors are vulnerable to the incremental and cumulative impacts of land use change. As a result, the VSCMP does not permit large-scale filling within the floodplain, which results in significant incremental and cumulative losses to floodplain storage for the purposes of facilitating development. This proposal is inconsistent with the following policies of the VSCMP:

1. Section 3.2.1.C) identifies that alterations of valley corridors through such activities as filling shall not be permitted to create additional useable area and/or accommodate development. The fill has been placed within the valley corridor and is contrary to policy 3.2.1.C).

2. Section 4.1- New Development, of the VSCMP “emphasizes the need to protect and rehabilitate valley and stream corridor landforms, features and functions while being sensitive to the development characteristics and needs of the… Region as a whole and to the use of these important resources by the… community.” The placement of fill within the Regulatory Flood Plain of the Etobicoke Creek valley contributes to the cumulative storage loss of flood waters in the watershed. Granting permission to “regularize” the fill placed on site:i. may put additional properties upstream or downstream at risk of flooding during a

Regional Storm event as a result of the cumulative impacts to floodplain storage;ii. would set a precedent that would make it difficult to refuse future applications of this

nature. The cumulative impacts of such approvals would compromise the ability of TRCA staff to effectively manage flood risk on a watershed basis.

Prohibiting development such as this that creates potential risk to life and property is further emphasized in Policy 4.1, which states that “(T)he main thrust of the Authority’s policies and procedures for undeveloped valley and stream corridors is to prevent new development that would introduce risk to life and property associated with flooding, erosion and slope stability…” The fill placed on the subject property is considered development and introduces potential flooding risk to life and property within the Etobicoke Creek watershed and is not consistent with Section 4.1 of the VSCMP.

3. Policy 4.2.2.E. of the VSCMP recognizes the need for provisions dealing with ancillary structures and property improvements, such as minor filling. Section 4.2.2.E.1) states that minor alterations to grade/landscaping, if located within the Regulatory Flood Plain, may be permitted so long as the location and design of the alterations do not result in unacceptable impacts to flood storage and conveyance. As previously stated, the filling on this site is not minor, and it is the opinion of TRCA Water Resources Engineering staff that the fill placed in the Regulatory Flood Plain has resulted in an unacceptable loss of flood storage and is inconsistent with this policy.

4. The unacceptable impact is further emphasized in Policy 4.2.2.E.5) of the VSCMP, which states that property improvements and ancillary structures that introduce greater potential for valleyland impacts, such as filling, shall be prohibited. As noted above, the significant amount of fill placed on site has resulted in an unacceptable loss of flood storage, and thus a significant impact on the Etobicoke Creek valleyland.

CUMULATIVE IMPACTS TO FLOODPLAIN STORAGE / PRECEDENTThe submitted engineering report concludes that the placement of fill will only marginally increase the Regional Storm event water levels across the subject site. However, these impacts are cumulatively important in terms of scale of impact. Although the report suggests the fill has caused only marginal impacts, TRCA Water Resources Engineering staff conclude that this anticipated degree of change is unacceptable in this sector of the urbanized main Etobicoke Creek.

When determining the risks associated with the fill activity, TRCA staff must also consider the management of the reach as a whole, and not only the subject site. TRCA staff is concerned about the loss of floodplain storage as this activity will negatively impact the overall function of the valley system to convey flood flows and will result in higher water levels downstream of the subject site. It is not possible to model the cumulative impacts to the Regional Floodplain water levels as a result of fill in the floodplain on a site-specific basis, given the current hydraulic modelling tools available. Although the impacts cannot be determined on a site specific basis, the cumulative impacts of permitting such fill or structural encroachments within the Regional Storm Floodplain will result in increases to the floodplain water levels. The recent floodplain mapping update of the Etobicoke Creek watershed indicated a significant watershed sensitivity to incremental development and floodplain change. In fact, additional areas of the subject property are now flood vulnerable during a Regional Storm event.

Based on the preceding, TRCA staff has adopted a floodplain management approach that prohibits the placement of significant amounts of fill in the floodplain. This submission is, therefore, not supported as it contributes to the impact created by the cumulative loss of Regional Floodplain storage within the Etobicoke Creek watershed. Permitting this intrusion could be argued by future applicants to have established a precedent which will lead to similar applications or fill proposals after-the-fact within TRCA’s jurisdiction, given the constant pressure for more land use intensification within existing urban areas. This, in turn, would lead to additional lands being located within the Regional Storm Floodplain and potentially greater flood risks to those lands which are already vulnerable to flooding. Planning and Development staff receive inquiries for similar works both in rural and urban areas on a frequent basis. Most inquiries for such works do not progress beyond the preliminary inquiry stage in part because staff has the ability to refer to TRCA's historically consistent approach to watershed management which has not allowed such works to be permitted.

If this application is approved, staff will have difficulty opposing future applications for the placement or recognition of placement of significant amounts of fill within valley corridors, which will result in additional negative impacts to our more urbanized watersheds. If this application is approved, such works could also be proposed by others in order to create additional tableland for development. The cumulative impacts of permitting such development would put additional properties at risk of flooding and expose TRCA to liability for having permitted it. Indeed, the TRCA's position before the Mining and Lands Commissioner on future appeals relating to its refusal to permit filling will become less defensible.

It is the opinion of TRCA staff that this application does not have any merit and could possibly, if approved, be argued by future applicants to have created a significant and negative precedent for TRCA and undermine the legitimacy of TRCA's policies which have also been upheld by the Mining and Lands Commissioner.

CONCLUSION AND RECOMMENDATION The restrictions to development within the floodplain, including the requirement for a TRCA permit, have been conveyed to the proponent through previous violation, planning and permit processes and is not a new circumstance. In summary, staff recommends that the application be denied for the following reasons:

1. The submission does not meet the tests applied to applications under Ontario Regulation 166/06. Specifically, this proposal will adversely affect the Control of Flooding as it:

results in a loss in flood storage during a Regional Storm event within the Etobicoke Creek valley;

2. The submission does not comply with the objectives or policies of TRCA's Valley and Stream Corridor Management Program. Specifically, it does not conform with Sections 3.2.1.(C), 4.1, New Development, 4.2.2.E. and 4.2.2.E.5., Property Improvements and Ancillary Structures.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of Phase 2A of subdivision 19T-03V01 for proposed single family lot residential development of this site, TRCA staff established the limits of the open space lands (i.e. Block 33 on Plan of Survey) which is comprised of the valley corridor of the East Don River at this location.

TAXES AND MAINTENANCEBased on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2012 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

BACKGROUNDThe Meadowcliffe Drive Erosion Control Project was originally developed in 1985, at the request of several homeowners concerned over the loss of property and the potential long term risk to their homes. After geotechnical review by Terraprobe in 2006, and review of long term solutions to the shoreline erosion by Shoreplan Engineering, TRCA submitted the Environmental Study Report for the project to the Ministry of the Environment per the Environmental Assessment Act in March, 2010. The preferred solution determined through the Environmental Assessment process is a shoreline treatment consisting of cobble beach anchored by a series of parallel headlands which will protect 600 metres of eroding bluff below Meadowcliffe Drive. Construction of this project commenced in the summer of 2010, in terms of stockpiling materials for the project.

The project will provide protection for 13 parcels of land involving 10 owners along the south side of Meadowcliffe Drive between Cudia Park and Bellamy Ravine. The subject parcels being acquired are strips of land below the 86 metre contour line which is approximately the lower one quarter of the bluff face. The lands to be retained by the owners include the upper portion of the bluffs face together with the tablelands above the bluffs and the improvements.

The Ontario Heritage Trust (OHT) owns a property at 1 Meadowcliffe Drive. TRCA acquired the shoreline from this property when TRCA undertook the Bellamy Ravine Erosion Control Project. Based on a review of the survey, TRCA owns sufficient land at this location for construction of the access road and revetment. It may be necessary in the future to enter into an agreement with OHT to undertake slope buttressing.

RATIONALEThe subject property is required for the construction of the Meadowcliffe Drive Erosion Control Project.

TAXES AND MAINTENANCEThe parcels of land will be turned over to the City of Toronto under the terms of the existing management agreement.

This request was circulated to City of Toronto staff and TRCA staff for review and comment. The following comments have been received:

City of Toronto Staff CommentsThe City is not allowed to sell parkland; however, the City can exchange parkland provided that the exchange meets Parks, Forestry and Recreation Department (PF&R) objectives and meets policies set out in the Official Plan.

Section 2.3.2.4 of the Official Plan notes that:

Parkland Cannot Be Sold: The policy prohibits the sale of city-owned land (not just parkland but any city lands) that are part of the Green Space System which means designated Parks and Open Space (POS).

But it Can Be Exchanged: The policy recognizes that in some cases it would be acceptable to exchange City-owned POS land if the land to be exchanged is:

nearby (i.e. within normal walking distance);equivalent or larger in area; andcomparable or superior green space utility (i.e. does the exchange make the park the same or better).

PF&R staff has said that this land exchange would comply with the Official Plan policies for land exchange involving areas designated as open space.

TRCA Staff CommentsPlanning and Development staff does not support the request for disposal of TRCA lands at this location for the following reasons:

The Valley and Stream Corridor Management Program (VSCMP) sets out the policy Framework for TRCA. The VSCMP defines the limits of stream/valley corridors to include a minimum of 10 metres inland from the top of valley bank, provided that the stream or valley is in a stable condition. In the case of the subject lands, the top of valley bank is located on the far eastern portion of the property near the road, placing the entire property within the valley and its 10 metre buffer.

In addition, one of the principles in the VSCMP states: "the successful management of valley and stream corridors is dependent on good tableland management". Removing lands that are considered to be buffers from public ownership does not meet the notion of good tableland management. Finally, as part of day-to-day negotiations with the development industry and private property owners, staff always endeavors to obtain a buffer for the protection of ecological features/stream and valley corridors as well as to protect private lands.

A plan illustrating the location of the subject lands is attached.

CONCLUSIONWhile the City of Toronto's Official Plan policies do allow exchanges of park land in certain circumstances, the disposal of the subject parcel of land is contrary to TRCA's VSCMP policies as well as TRCA's mandate to conserve natural areas and protect adjacent land from natural hazards. Therefore, staff is recommending that the subject parcel be retained.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the Town of Caledon for a stormwater management facility which will assist Fernbrook Homes (Etobicoke Creek) Limited with their development in this vicinity;

WHEREAS it is in the opinion of TRCA that it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the Town of Caledon and Fernbrook Homes (Etobicoke Creek) Limited in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing 0.5688 hectares (1.4056 acres), more or less, be granted to the Town of Caledon for a stormwater management facility to facilitate the development of adjacent lands owned by Fernbrook Homes (Etobicoke Creek) Limited, said land being part of Lot 18, Concession 1 E.H.S., designated as Part 1 on Plan 43R-33386, Town of Caledon and City of Brampton, Regional Municipality of Peel, subject to the following terms and conditions:

(e) Fernbrook Homes (Etobicoke Creek) Limited shall monitor the effectiveness of the facility for a two year period following construction and rectify to the satisfaction of both Town of Caledon and TRCA staff any performance issues;

(f) The Town of Caledon is to be responsible for all repairs and/or maintenance of the stormwater management facility which may be required in perpetuity and for indemnifying TRCA from any and all claims arising from the construction;

(g) An archaeological investigation is to be conducted before any site disturbance with any mitigative measures required being carried out all at the expense of Fernbrook Homes (Etobicoke Creek) Limited to the satisfaction of TRCA;

(h) Any additional considerations as deemed appropriate by TRCA staff or its solicitor.

THAT said easement be subject to an Order in Council being issued in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended;

CARRIED BACKGROUNDThe proposed stormwater management facility will service lands owned by Fernbrook Homes (Etobicoke Creek) Limited located north of Mayfield Road and east of Highway 10, Town of Caledon and City of Brampton, Etobicoke Creek watershed.

In accordance with TRCA guidelines ''Use of Authority Owned Lands For Storm Water Management" approved at Authority Meeting #11/92, held on January 22, 1993, the proponent has demonstrated that the proposed location on TRCA-owned land is reasonable and all technical requirements of TRCA staff has been satisfied. A permit is required under Ontario Regulation 166/06 and the report relating to the permit is on the agenda of this Executive Committee meeting.

The Town of Caledon hosted a Public Information Session on April 5, 2006 to explain the proposed application. The Town of Caledon Council endorsed the staff recommendation supporting draft approval of the Fernbrook subdivision on July 7, 2009 which was also a public meeting.

The subject land is part of a larger parcel acquired from the E. & H. B. Ellis under the Snelgrove Dam & Reservoir Project on February 28, 1972 and from A. & R. Snell under Etobicoke Creek component of the Land Acquisition Project on August 17, 1976.

Staff has carried out negotiations with representatives of the developer and respectfully submit that the compensation package relating to the 0.5688 hectares (1.4056 acres) easement, is fair and reasonable.

The total compensation package includes $295,176 for purchase of the permanent easement and an additional payment to produce an ecological net gain in the Etobicoke Creek watershed. This payment will be determined based on the characteristics of the subject lands and the impacts the stormwater management facility has on the natural environment.

FINANCIAL DETAILSIt is proposed that the compensation obtained from this easement be utilized for the purchase of priority properties under the Greenlands Acquisition Project.

BACKGROUNDThe subject lands form part of a larger acreage acquired by TRCA from Glen-Rouge Parks Limited on January 26, 1968 and the Municipality of Metropolitan Toronto on October 4, 1983, under the Rouge River Component of the Land Acquisition Project. The City of Toronto has conveyed lands to TRCA over the years for nominal consideration of $2.00 and has requested that TRCA lands required for the construction of the cul-de-sac as part of the partial closure of Kirkhams Road be conveyed for the nominal consideration of $2.00.

This City of Toronto road project has been reviewed under the Schedule C Municipal Class Environmental Assessment (EA) process by TRCA staff. The City proposal consists of the removal of the severely deteriorated Kirkhams Road bridge and substructure; re-instatement and renaturalization of the Rouge River valley; relocation of the existing watermain by trenchless technology under the Rouge River; creation of cul-de-sacs north and south of the river; and a gate at Meadowvale Road which will be used for access by maintenance vehicles. Only the north cul-de-sac will occur on TRCA property. The EA process has been completed and TRCA staff is presently reviewing a permit application pursuant to Ontario Regulation 166/06 for the proposed Kirkhams Road project. The permit application will be considered at a future Executive Committee meeting.

Rouge Park staff has reviewed the proposed sale of TRCA-owned land to the City of Toronto for the purpose of constructing a cul-de-sac following the removal of the Kirkhams Road bridge and confirm that the City has selected an appropriate location in an area of relatively limited environmental sensitivity. Overall, Rouge Park is supportive of the Kirkham's Road bridge removal, as it will ultimately be ecologically beneficial to this section of the Rouge River valley and, therefore, has no opposition to the proposed property sale.

A plan illustrating the fee simple conveyance and temporary easement locations is attached.

Plantings:All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan will be prepared and form part of the permit pursuant to Ontario Regulation 166/06.

CARRIEDBACKGROUNDWithin the TRCA jurisdiction, mitigation of the increase in flood flows resulting from urban development has traditionally revolved around controlling the peak rate of runoff from developing areas. This has typically been achieved by utilizing detention facilities (stormwater management (SWM) ponds) in new developments for temporarily storing and then releasing stormwater at a controlled rate. The level of control that the SWM ponds are required to provide is based on maintaining the pre-development peak rate of stormwater runoff up to the 100-year storm, to a level not exceeding the rate of runoff assuming a pre-development condition in the area being serviced by the SWM pond. However, recent analysis conducted by TRCA in the development of the Humber River watershed plan has indicated that ongoing development may also impact the magnitude of flood flows in excess of the 100-year storm, including the Regional Event (Hurricane Hazel) that defines the extent of the regulatory floodplain in the TRCA jurisdiction. As a result, Regional Event flood flows, and the extent of the regulatory floodplain, may increase as urbanization continues in accordance with municipal plans for growth. This expansion of the regulatory floodplain may cause existing development to enter into the floodplain, or may cause existing development in the floodplain, such as downtown Woodbridge, to be exposed to an increased flood risk. Given the obligation of TRCA to ensure that the floodplains are managed to minimize risk to life and property, it is evident that this issue needs to be investigated promptly, and if necessary new stormwater management criteria should be identified for future development to mitigate these risks.

Proposed WorkA hydrologic study of the Humber watershed is proposed to be undertaken, that will simulate the hydrologic response of the watershed in a continuous manner in order to assess the effects of future development in the Humber watershed outside the current Official Plan boundaries (“white belt” areas south of the Oak Ridges Moraine and Greenbelt). The study will make informed assumptions regarding the future land use in the white belt areas, by consulting municipal and regional planning documents as well as through discussions with municipal partners. Hydrologic models will be prepared to simulate flood flows from both current and future development conditions over a 30 year or greater period of historic record, as well as for Hurricane Hazel and other known extreme storm events. Increases in the magnitude, duration and frequency of occurrence of flood flows will be quantified throughout the watershed. If current quantity control criteria are inadequate to mitigate the impacts of future development on flood risk, enhanced stormwater quantity control criteria will be developed for application to future development in white belt areas.

RATIONALEWith the municipalities of Vaughan, Caledon and Brampton contemplating expansion of urban boundaries beyond the limits as defined in current Official Plans, it is imperative that an assessment of the impacts of development in these areas on downstream flood risk be undertaken. TRCA's approach to management of flood flows needs to be revisited in order to inform development of floodplain management policies and criteria that are consistent with minimizing risk in the floodplain. The proposed work also fulfills a recommendation of the Humber watershed plan for assessing the impacts of future development through rigorous hydrologic modeling, and to determine appropriate stormwater quantity control criteria to prevent increases in flood flows and flood risk within watercourses in the Humber watershed.

Requests for Proposals were sent to three consultants as follows, and included a “Terms of Reference for Hydrologic Study of Impacts on Flood Flows and Mitigation of Future Development in the Humber River Watershed” that provided information on the objectives, key tasks and deliverables that would be required:

Based on the evaluation criteria, the AMEC proposal had the highest score, and staff is recommending award of the contract to AMEC Earth & Environmental. While cost was not a criterion used in ranking the proposals, the AMEC proposal is also the lowest bid. AMEC has performed similar work in the past for TRCA, and staff was satisfied with the firm’s performance on these projects and have confidence that the work proposed in this study will be competently delivered.

FINANCIAL DETAILSThe total cost to be paid to AMEC Earth & Environmental for works defined in the Terms of Reference is $179,870 plus applicable taxes. An additional amount of $20,130 will be set aside to cover any contingencies related to the undertaking, for a total project cost of $200,000 plus HST. The project will take place through the remainder of 2010 and into 2011 and will be fully covered by funds provided by the Region of York in account 107-15 and funds provided by the Region of Peel in account 127-90.

The construction of the East Don Trail project was given approval to proceed by Resolution #A44/09 at Authority Meeting #3/09, held on April 24, 2009, subject to funding from the City of Toronto as part of the Natural Environment and Stand Alone projects and completion of the required approval processes.

Phase 1a trail construction works were implemented in 2009/2010, including the establishment of the approved trail alignment/construction access route between Milne Hollow Park and Wynford Heights Crescent and the installation of a 34 metre prefabricated, self-weathering steel pedestrian footbridge (bridge 1c) north of Wynford Heights access trail. Bridge 1c was installed on its footings in early February 2010.

Phase 1b construction is now in progress and will complete the trail link between Milne Hollow and Moccasin Trail Park through the installation of Bridge 1b and protective canopy structures under overhead railway crossings as well as asphalt paving in accordance with City of Toronto standards for pedestrian multi-use trails. Accordingly, TRCA staff prepared Request for Quotation RSD #10-35 packages to obtain pricing for the asphalt paving components identified as part of the plan.

The East Don Trail project has federal infrastructure funding incorporated, and as such, all works must be installed and completed in advance of the March 31, 2011 deadline. Asphalt paving works are targeted to be completed not later than December 31, 2010.

RATIONALERequests for Quotation were sent to the following seven (7) paving contractors, who were selected based on their area of business expertise and past experience on TRCA projects:
