The Redside Dace timing window will apply to all near/in-water works unless otherwise specified in writing by the Ministry of Natural Resources (MNR). Through review of the information provided and identified in the Summary of Plans section, TRCA staff is of the opinion that the project and implementation as proposed will not cause serious harm to fish. 14

The purpose is to acknowledge the construction of replacement retaining walls in the rear yard of an existing dwelling at 18 Taylorwood Drive in the City of Toronto (Etobicoke York). The retaining walls were constructed without the benefit of any TRCA or municipal permits. As such, an additional 100% of the regular permit fee was charged to the applicant for this permit "after-the-fact".19

EX10.4 11 COE HILL DRIVETo construct, reconstruct, erect or place a building or structure and change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units on Part Lot 33, 34, 35, 36, 37, Plan 3011 YORK, (11 Coe Hill Drive), in the City of Toronto (Etobicoke York Community Council Area), Humber River Watershed. The purpose is to acknowledge the construction of a gazebo in the rear yard of an existing dwelling at 11 Coe Hill Drive in the City of Toronto (Etobicoke York). The gazebo was built without the benefit of any TRCA or municipal permits. As such, an additional 100% of the regular permit fee was charged to the applicant for this permit "after-the-fact".21

CITY OF TORONTO [SCARBOROUGH COMMUNITY COUNCIL AREA]

EX10.5 CITY OF TORONTOTo construct, reconstruct, erect or place a building or structure and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on 5316 Lawrence Avenue East, in the City of Toronto (Scarborough Community Council Area), Highland Creek Watershed, as located on property owned by the City of Toronto. The purpose is to install an outdoor generator structure. The works involved the construction of a concrete pad for the generator, an underground power and duct control bank and new chain link fence. No in-water works were within the scope of this project. 23

TOWN OF WHITCHURCH-STOUFFVILLE

EX10.6 S.T.R. BACKGROUNDThe July 8th, 2013 severe storm resulted in millions of dollars in damage to TRCA, City and privately owned erosion control structures across the City of Toronto, with the majority of significant damage observed in the west end within Etobicoke Creek, Mimico Creek and the West Humber River.

In the days and months following the storm event, TRCA collected data on the extent of erosion damage, and disseminated information to Toronto Water, Toronto Transportation and Parks, Forestry & Recreation (PF&R) as it related to their respective property. In the spring of 2014 PF&R staff approached Restoration Services staff with requests to assist with the planning, design and implementation of repairs at several of the priority sites identified.

The following is a list of the current priority sites that TRCA has been requested to assist with . Should additional assistance be requested at locations other than what is currently listed, staff request permission to proceed under this request for authorization, subject to approval of funding, receipt of all necessary approvals and the execution of any agreements required.

RATIONALETRCA and the City of Toronto have worked cooperatively on erosion control projects for more than 30 years. Many existing erosion control structures on City-lands were constructed by TRCA, and TRCA monitors this infrastructure on the City's behalf as a value-added service to the City through its long-standing Erosion Management Program.

There is value to the City in having TRCA provide services that eliminate the risk to life and property in a prompt, cost-effective and environmentally responsible manner. TRCA is able to provide effective management of natural environment projects using their highly specialized expertise and ability to expedite approvals, facilitate community involvement, meet tight deadlines and satisfy provincial and federal environmental standards.

Recognizing TRCA's value as a leader in environmental protection and restoration, Council recently amended Schedule A of Chapter 71, Financial Control, of the Toronto Municipal Code, which permits TRCA to deliver specific capital projects on their behalf. According to Section 22 of the amendments, the projects in Table 1 are eligible projects for TRCA to deliver on behalf of the City of Toronto. FINANCIAL DETAILSThe total estimated cost to be recovered across all projects in 2014 is $2,525,000, plus HST. The cost for projects to be completed in 2015 will be determined as the design details are finalized.

Recognizing that the City of Toronto is funding the implementation of the works, TRCA will adopt the City of Toronto's purchasing policy regarding the use of union and skilled trade workers for any subcontracted work.

RECOMMENDATION

IT IS RECOMMENDED THAT this report summarizing municipal efforts to study the impacts of the expansion of the Greenbelt and plans for growing the Greenbelt be received;

AND THAT Toronto and Region Conservation Authority (TRCA) echo the advice of the Municipal Leaders for the Greenbelt (MLGB) to encourage the province to clarify and simplify the process for municipalities who want to grow the Greenbelt within their borders;

AND FURTHER THAT this staff report be forwarded to the Ministry of Municipal Affairs and Housing and all municipalities within TRCA watersheds.

BACKGROUNDAt Authority Meeting #4/14, held on May 23, 2014, Resolution #A85/14 was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) offer its support and assistance to the City of Toronto and to all municipalities within TRCA's watersheds who are considering recognizing the Greenbelt Plan's River Valley Connections in their official plans or adding public lands into the Urban River Valley designation of the Greenbelt Plan;

THAT TRCA continue its program of land acquisition in the valleys to complete the missing links and achieve a fully connected system of publicly owned urban valley lands;

THAT this report be circulated to all municipalities within TRCA watersheds;

AND FURTHER THAT staff report back on the pilot projects with municipal partners in studying the impact of the expansion of the Greenbelt.

In response to the request for a report back on municipal pilot projects related to expanding the Greenbelt, TRCA staff have been monitoring related municipal efforts and have prepared this report to update the authority on these activities.

2014 Election Greenbelt Pledge Signed by Municipal Leaders for the GreenbeltOn June 23, 2014 Municipal Leaders for the Greenbelt (MLGB) held a press conference urging the province to expand the Greenbelt by one million acres, create a 200,000 acre food belt and simplify the process for municipalities who want to grow the Greenbelt within their border. MLGB is co-chaired by Oakville Mayor Rob Burton, Guelph Mayor Karen Farbridge, Ajax Mayor Steve Parish and Toronto Councillor Glenn DeBaeremaeker. MLGB currently includes 70 elected mayors and councillors from across the province who support the Greenbelt as a permanent feature of Ontario’s landscape.

Greenbelt Urban River Valley (URV) Designation in MississaugaOn February 12, 2014 Mississauga City Council directed staff to outline a plan and cost estimate to expand the Provincial Greenbelt by designating selected public lands, within the Credit River and Etobicoke Creek watersheds, as Urban River Valley (URV). The resulting report was presented to General Committee on June 25, 2014.

Mississauga City staff reported that designation of any public land as URV would essentially upload authority and control of these lands to the province and any action by the City on these lands would need to be in conformity with the Provincial Greenbelt Plan. The Greenbelt Plan stipulates that the City’s Official Plan (OP) would still guide the permitted uses, and policy on those lands. The most significant implication of this change is that municipal parkland and trail strategies must have regard for the related section of the Greenbelt Plan. City staff did not anticipate that this will be a major issue because most of the relevant considerations already align with the City’s goals. However, City staff did caution that if the province chose to change the policy framework, the City’s OP would need to be amended to align with provincial policy. Preliminary criteria for selection of land to be designated as URV have been developed to limit this risk.

The preliminary criteria include lands that form part of the Natural Areas System and the City’s Greenbelt lands. Both of these types of lands are already afforded the highest level of protection by the City’s OP policies and therefore the URV designation is unlikely to restrict the city in its use of these lands in future (only passive recreation is to be permitted in the URV designated area including trails, benches and shelters). These lands also meet provincial requirements for Greenbelt designation in that they form part of a natural system. The process for designation of land parcels in Mississauga as URV is planned to be completed in two phases. The full workplan includes finalization of criteria and mapping of parcels, public consultation, coordination with partner agencies and preparation of a detailed submission. The first phase will focus on the lands along the Credit River and the second phase will focus on Etobicoke Creek. City staff have used preliminary criteria to identify approximately 75% of city owned lands in the Credit River corridor for consideration for URV designation. City staff are currently coordinating with other public landowners such as Credit Valley Conservation to identify lands suitable for URV designation. Coordination with TRCA is expected to occur as the work in Etobicoke Creek moves forwards in late 2014-2015.

Discussions between the City surveyor and the Crown Land surveyor anticipate that mapping can be undertaken without formal surveys and thus no costs associated with land surveying will be incurred. In general, no capital costs are expected to implement the URV designation because existing staff resources are being used. Staff will present the final parcels to be considered for URV designation to General Committee in Spring 2015.

Greenbelt URV Designation in Toronto and/or OP Recognition of River Valley Connections A report dated May 2, 2014 was presented to the City of Toronto’s Planning and Growth Management Committee on June, 19, 2014 and was adopted with amendments. This report was prepared in response to City Council’s interest in designating lands as Urban River Valley (URV) to recognize the importance of river valley connections between the Greenbelt and Lake Ontario. The report assessed the implications of adding public lands within the Don and Humber River and Etobicoke Creek corridors to the Greenbelt. The report also assessed the implications of achieving the same goals using an alternative approach of recognizing the river valley connections in the City’s Official Plan (OP) without formally adding lands into the Greenbelt through URV designation. On July 8, 2014 City Council reviewed the report and re-confirmed its support-in-principle for designating parts of the Don River, Humber River and Etobicoke Creek as URV under the Greenbelt Act.

In the May 2, 2014 report City staff expressed their opinion that designating public land in Toronto as URV would not provide any additional policy protection to these lands and that it would result in a discontinuous patchwork of land being recognized as part of the Greenbelt . Discontinuity would be introduced because only public land is eligible for URV designation and this would be compounded if upstream municipalities choose not to designate public lands as URV. This discontinuity might be confusing to the public as it does not emphasize the importance of the entire area of the river valley connections and the ecological and hydrological functions they provide.

Staff informed the Committee that a detailed review of some lands in the Don and Humber Rivers and Etobicoke Creek corridors is already underway as part of preparing an OP amendment to designate environmentally significant areas (ESAs). City staff recommended that ESA lands would be the best candidates for designation as URV as these areas meet provincial requirements for inclusion within the Greenbelt and are already given the highest level of protection in the City’s OP. Therefore the URV designation is unlikely to restrict the City in its use of these lands for active recreation or other uses in future. However, since ESA land boundaries are based on natural features, rather than parcels, staff advised that new surveys would be needed to identify these ESA areas as URV. City staff estimated that this would cost approximately $538,200.00. Further discussions between the City’s Surveyor General and the local Land Registry Office could reduce this cost if other methodologies are considered. Staff also identified costs associated with URV designation for undertaking the required public engagement.

Given the above described concerns with the Greenbelt URV designation process, City staff recommended an alternative approach be taken to recognize the importance of the Don and Humber Rivers and Etobicoke Creek as river valley connections. The recommended approach was to recognize these connections in the Official Plan (OP). This would involve amending the OP to: a) identify the Don and Humber Rivers and Etobicoke Creek as Greenbelt River Valley Connections as shown in OP mapping; and b) recognize the important functions that river valley connections provide to the Greenbelt in the OP text. The amendment can be undertaken as part of the upcoming amendment to bring the OP into conformity with the Greenbelt Plan as required by Section 5.3 of the Greenbelt Plan. Municipal OPs are not required to recognize river valley connections, because they are not within the regulated area of the Greenbelt Plan. Toronto would be the first municipality to take this approach. City staff believe that this approach would still raise public awareness of these river valleys as important ecological connections between the Greenbelt and Lake Ontario, and it can be done at no additional cost. TRCA staff also see merit in this alternative approach and note that it would better promote a systems approach by not excluding private lands, and conferring a "provincial interest" to the entire valley system and not just the public lands.

Several interested stakeholders provided correspondence in response to the May 2, 2014 report:

· Citizens Concerned About the Future of the Etobicoke Waterfront (CCFEW) disagreed with the recommendations in the May 2

nd

staff report stating “recognition of the river valley connections in the OP is a welcome addition but it is not a substitute for URV designation.” CCFEW stated that “although it may appear that URV designation affords no additional protection for these areas, it provides another layer of protection. This should …guard against … special deals to encroach upon these creek and river valleys on a case by case basis”.

· The Taylor Massey Project urged the City to include most of the southern half of Taylor Massey Creek in the areas of the Don River in the Greenbelt URV designation.

· David Crombie supported the recommendations in the report, but felt they needed to go further and urged Toronto to join Mississauga and Oakville in designating public valley lands as Greenbelt in order to set an example for neighbouring municipalities to do the same. This would complete the vision of a fully protected watershed – from the headwaters to the Great Lakes.

· Environmental Defence (ED) indicated that the Ministry of Municipal Affairs and Housing (MMAH) is keen to make the URV process work for Toronto. ED offered to assist the City with the URV designation process. ED has been working with other municipalities (Oakville, Mississauga) to move forward with URV designation and notes that they have found ways to reduce cost and administrative issues. Through the URV designation the City would retain title and flexibility to deal with City related needs on these lands.

The City’s Planning and Growth Management Committee considered all of this information and directed City staff to develop a map of lands suitable for URV designations using existing mapping resources and to discuss methods for reducing and/or defraying cost with the MMAH and the Friends of the Greenbelt Foundation. City staff were also directed to submit a report on these activities in February 2015.

Greenbelt URV Designation in OakvilleTown of Oakville and Halton Region staff completed a study of Oakville’s natural heritage lands in 2012, which considered whether lands would meet Greenbelt criteria and potential impacts of growing the Greenbelt within the Urban Area of Oakville. Staff concluded that the Greenbelt plan lacked policies within the urban areas to provide the necessary level of policy direction already found within the Regional and Local Official Plans. In 2013, the Province through Amendment 1 to the Greenbelt Plan, introduced the new Urban River Valley (URV) policy framework which addressed these concerns by recognizing the objectives in Local and Regional official plans. Furthermore, this amendment added the provincially-owned Glenorchy lands in Oakville to the Greenbelt. This was the first Greenbelt expansion achieved using the new URV designation.

The Region of Halton recently received approval of their regional Natural Heritage System within their Regional Official Plan through ROPA 38 which clearly identifies the Fourteen Mile Creek system in Oakville (south of Upper Middle Road north of the QEW) as natural heritage. On February 10, 2014 the Town of Oakville’s Council resolved to request that the publicly owned natural heritage lands, valley lands and parks in this area also be added to the Greenbelt Plan via URV designation with the exception that the Parkway Belt lands be removed from the designated area if necessary. On February 26, 2014 members of the Regional Municipality of Halton’s Regional Council supported the Town of Oakville’s request and directed staff to formally submit an application to the province requesting that these lands be added to the Greenbelt via URV designation. Halton Region Staff stated in their report that since the natural heritage system had been delineated through ROPA 38 no additional financial implications were expected.

On April 1, 2014 Halton Region received correspondence from Infrastructure Ontario (IO) expressing concern over the proposed expansion to the Greenbelt in this area of Oakville. IO owns a portion of the public lands that are proposed for URV designation. IO stated that the resolution passed by the Regional Council was premature because there is an existing planning process in progress to determine appropriate uses for the lands in this area (the Merton Study) which should be completed before any decisions are made. IO also re-iterated that the Natural Heritage System mapping in ROPA 38 is intended to be refined via site specific studies and IO has undertaken one such study on the lands it owns that fall within the proposed URV designation area (115 ha adjacent to 3

rd

line). Finally, it was IO’s opinion that consultation with the public and regional and town staff should have occurred prior to Oakville Town Council’s February 10

th

, 2014 meeting and resolution.

Greenbelt URV Designation in MarkhamOn May 6, 2014 a staff report on the upcoming 2015 Greenbelt and Oak Ridges Moraine Review was presented to the City of Markham’s Development Services Committee. This report provided an overview of issues related to the 2015 review and preliminary recommendations to the province. It recommended that the Greenbelt boundary be adjusted to reflect lands that have already been given development rights through the transition policies in the plan. It also recommended that the province clarify policies around the refinement of the Greenbelt Natural Heritage system. Finally, the report provided an overview of options related to growing the Greenbelt in Markham.

City staff reported that there are no clear policy related benefits for using the URV designation to grow the Greenbelt in Markham since natural heritage features are already protected through current policy (including the City’s OP). It was staff’s opinion that the only benefit for this designation related to raising awareness of the function of urban watercourses and reinforcing land securement and stewardship opportunities. Staff also expressed concern with the URV designation’s restriction to only public lands (which are non-continuous), and the expected significant costs for surveying and the process for delineation of lands (i.e. public consultation). Given that no additional policy protection would be provided, staff did not recommend that the City embark on application for URV designation in Markham at this time.

Instead, City staff recommended that the Province be requested to revisit the URV designation to address the following matters during the 2015 Provincial review:

· Providing additional policy protection for the URV designation in the Greenbelt Plan, so that the investment needed to approve this designation provides more policy protection than is afforded in municipal OPs.

· Provide the opportunity to consider public lands as well as private lands in order to provide a potential new Greenbelt designation to a continuous river valley system.

· Provide flexibility in the delineation of URV lands in order to manage high survey costs or request that provincial funding be made available to assist with these costs.

Summary · 2 municipalities (Mississauga, Oakville) are currently proceeding with growing the

Greenbelt by URV designation through the provincially prescribed process;· 1 municipality (Toronto) is considering the URV designation process as well as an

alternative approach of identifying River Valley Connections in OP maps and descriptive text;

· A 4th

municipality (Markham) has declined to grow the greenbelt through URV designation at this time, instead requesting that the province address a number of perceived barriers to growing the greenbelt through the 2015 review of the Greenbelt Plan;

· Other municipalities in TRCA watersheds may have discussed growing the Greenbelt (i.e. Brampton) but have not as yet taken any formal steps in this regard (that TRCA staff are aware of);

· A group of approximately 70 elected officials comprising Municipal Leaders for the Greenbelt (MLGB) are in the process of identifying “Greenbelt-friendly” candidates for the upcoming municipal elections and also encouraging the province to simplify the process for municipalities who want to grow the greenbelt within their borders;

· TRCA has previously, and continues, to offer its support and assistance to any municipality within its watersheds who are considering growing the greenbelt through URV designation and/or recognizing the important functions of the river valley connections in their official plans;

· TRCA also supports the MLGB in their request to the province to simplify the process for municipalities who want to grow the Greenbelt within their borders.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The City of Brampton has proposed to widen Castlemore Road from a 4 lane urban cross section to a 6 lane urban cross section between Airport Road to Goreway Drive, in the City of Brampton. To facilitate the road widening a structure crossing over a tributary of the West Humber River will need to be extended on the north side. In addition, a multi-use path will be constructed on the south side of Castlemore Road.

Control of Flooding:No impacts are anticipated to the storage or conveyance of flood waters.

Pollution:Standard Erosion and Sediment Control measures silt fence, cofferdam, sediment bag will be implemented prior to and will be maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering the watercourse. Erosion and Sediment Control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches:Not applicable

Erosion:No geotechnical/slope stability issues have been identified.

Conservation of Land:The Redside Dace timing window of July 1 to September 15 will be applied to this project unless otherwise specified in writing by the Ministry of Natural Resources (MNR). Through review of the information provided and identified in the Summary of Plans section, TRCA staff is of the opinion that the project and implementation as proposed will not cause serious harm to fish.

Proposal:The purpose is to construct a two storey addition to an existing dwelling within a Regulated Area of the Rouge River watershed. According to our mapping, the subject property is located entirely within the Regional Storm Flood Plain and within the Unionville Special Policy Area (SPA). The Regional Storm Flood Elevation for the property is 172.46 metres above sea level (m.a.s.l.). Based upon topographical survey data prepared by David Horwood Limited, Ontario Land Surveyor, the existing dwelling is located at an elevation between 173.09 to 173.30 m.a.s.l. and is actually outside of the flood plain. The proposed addition is also located outside of the flood plain and no new openings are proposed which are lower than the openings on the existing dwelling.

All of the proposed works are located within already disturbed, sodded areas and no significant vegetation removals are required.

Control of Flooding:TRCA Water Resources Engineering staff are satisfied that the proposed works are adequately located outside of the Regional Storm Flood Plain. There will be no impacts on the storage and conveyance of flood waters.

Pollution:Sediment control fencing will be erected and maintained for the duration of construction to prevent the transport of sediment into the nearby natural features.

Dynamic Beaches:Not applicable.

Erosion:There are no geotechnical issues associated with this application.

Conservation of Land:The works are sufficiently setback from the Rouge River, as such, the watercourse will not be impacted by the project and no fisheries concerns will result. There are no other significant natural features on or adjacent to the site that may be negatively impacted by the project.

PlantingsAll disturbed areas will be restored to the existing sodded condition and will not affect any significant natural features.

The previously existing railway tie retaining walls will remain in place while the new retaining walls are constructed directly in front of them. This method of construction is the least invasive and will minimize any negative impacts on the valley wall. The subject property is municipally described as 18 Taylorwood Drive and is located south of Eglinton Avenue West and west of Scarlett Road in the City of Toronto (Etobicoke York Community Council Area).

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The City of Toronto has constructed a concrete pad for an outdoor generator and its associated structures at 5316 Lawrence Avenue East, east of Centennial Drive. This concrete pad was necessary to install a new generator at the pumping station. Works involved the construction of a 5.9 m by 2.3 m concrete pad with a height of 0.4 m and an underground power and duct control bank for connection cables. It was at this point the City was notified that a permit would be required. Due to an oversight, permit acquisition for this site was missed. The remaining works involve the installation of a chain link fence in order to prevent vandalism and enhance public safety. A new chain link fence around the new generator will be constructed once the generator is placed on the new concrete pad. The site will be restored to pre-construction conditions upon completion of works. Construction of the concrete pad and its associated underground power and duct control bank has occurred and installation of the chain link fence will be completed by September 2014.

Fee and Permit Timing:The proponent initiated works prior to the issuance of a permit under Ontario Regulation 166/06. A permit is now being sought for TRCA's retroactive approval. The applicant has paid the application fee, plus 100% in association with the pre-permit construction.

Control of Flooding:The proposed project is not anticipated to impact flooding, conveyance or storage of floodwaters.

Pollution:The site has been stabilized since partial completion of works. The proponent will ensure that sediment is not released into the natural features during the construction of the chain link fence . Standard erosion and sediment control measures, including (silt fence) will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

Dynamic Beaches:The proposal did not have any implications to dynamic beaches.

Erosion:There were no impacts identified to slope stability or erosion as a result of these works.

Proposal:The applicant seeks permission in order to develop in a Regulated Area associated with a tributary of the Rouge River (Berczy Creek) in order to develop a warehouse and manufacturing facility. The proposed development, to take place on a currently vacant lot, includes a 805 square metre (8,665 square feet) building, a loading yard, parking and vehicle driveways, landscaped and natural areas. The lands are located in the Gormley Industrial Development northeast of the intersection of Woodbine Avenue and Stouffville Road.

The subject parcel was created and adjacent development was first established in the late 1980's prior to current natural hazard and environmental protection practices. A headwater tributary of Berczy creek was channelized and realigned across the northern boundary of the subject lands and downstream through the broader industrial development. Based on current flood plain information, flood waters associated with the tributary are not contained within the tributary channel and extend upon portions of the subject lands and adjacent public roads.

Control of Flooding:In order to proceed with this proposal, the applicant has been required to delineate the location of the flood plain on the subject lands to ensure that the proposed design mitigates the flood risk present. The proposed plans demonstrate that the proposed building along with portions of the parking area will be at an elevation that is outside of the flood plain boundary. Due to the site context, specifically the location of the channelized creek along the northern limit of the parcel and the lower elevation of the surrounding public roads, it is not feasible for the entire site to be removed from the flood plain. The applicant has made best efforts to remove as much of the parcel from the flood risk as possible.

Pollution:The applicant has submitted a detailed Erosion and Sediment Control Plan, which isolates the portion of the site to be disturbed for construction from the tributary corridor to the north. Measures to control erosion and sediment include the provision of a construction entrance mat , a double row of siltation control fencing and sediment traps. These measures will be maintained for the duration of the works.

Dynamic Beaches:Not applicable

Erosion:There are no slope stability or geotechnical concerns associated with this proposal .

Conservation of Land:As noted above, the Berczy creek tributary traverses the northern portion of the subject lands in and west to east orientation, as part of the historical channelization. The portion of the site containing the tributary and lands immediately south are to remain undisturbed and the existing vegetation is to remain undisturbed, thereby providing an environmental buffer to the watercourse corridor.

PlantingsA landscape plan has been submitted in support of this proposal, which clearly defines the area containing existing vegetation associated with the watercourse corridor to be undisturbed and for the planting of perimeter trees and shrubs adjacent to the public roads.

Proposal:The proposal is to conduct site grading and erect erosion and sediment control measures in order to facilitate the development and servicing of the King Garden Estates (DiNardo - Phase 3) residential subdivision, in the King City East Community, in the Township of King. The subject property is approximately 11.67 ha (28.83 ac) in size and is bounded by Keele Street to the west, an existing residential subdivision to the south, and to the north and east by valleyland/open space areas. The subject lands are located within the King City East Community, however, the landowners were not part of the overall King City Community Functional Servicing/Development Area Study. Nonetheless, separate technical studies and reports were submitted, reviewed and approved by TRCA staff and associated Township of King technical staff.

The proposed site grading works will take place entirely on the tableland portions of the site and outside of the previously established buffers from the natural features on the property. This includes wetlands, and valleyland open space features. Previously, as part of the associated Draft Plan of Subdivision application process, TRCA staff identified and established the limits of the natural features on the site. A 30 metre buffer from the natural features was implemented, which is consistent with the other developments within the King City Community and meets the requirements of the Oak Ridges Moraine Conservation Plan (ORMCP). The proposed works will facilitate the development of a residential subdivision on the site and fulfill a condition of draft plan approval for the King Garden Estates (DiNardo - Phase 3) subdivision.

Control of Flooding:The proposed works are located outside of the Regional Storm Flood Plain of the Humber River. As such, the storage and conveyance of flood waters will not be negatively impacted by the proposal.

Pollution:Erosion and sediment control measures including silt fencing will be erected around the work site in an effort to ensure that sediment does not migrate into the nearby wetland areas and watercourses. These measures will be monitored and maintained for the duration of the construction works.

Dynamic Beaches:Not applicable.

Erosion:Erosion will be minimized through the implementation of the aforementioned erosion and sediment control measures.

Conservation of Land:There are no geotechnical/slope stability issues associated with the proposed works. There will be no in-water works and as such, the nearby wetlands and fish habitat will not be impacted.
