The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Sometimes the ‘landscape’ of contractor’s regulation is like ‘separat-ing the forest from the trees’. We give added perspective to a recent answer that some thought had us ‘barking’ up the wrong tree! We save another aspiring contractor half of what he might have paid to license his corporation…

Q: In a recent column in a Builder’s Exchange, you were asked what type of license was required to build a deck with a patio covering. You stated that a “B,” “C-5”, or a “C-27” was needed. How can a “C-27” land-scape contractor do structural building of a deck with a cover over it? This has confused a number of us. Can you please explain?A: Thank you for your inquiry. A “C-27” Landscape contractor may contract to build a deck with a patio cover because it’s considered part of the outdoor landscape. According to Board Rule 832.27 a landscaping con-tractor can perform “landscape systems and facilities…which are designed to aesthetically, architecturally, horticulturally, or functionally improve the grounds within or surrounding a structure or a tract or plot of land…” Generally there are no restrictions on the height, size, or type of deck that a landscaping contractor can build, however certain structural work may be precluded. The CSLB reviews and determines these restrictions on a case-by-case basis.

Q: I read your recent column regarding the deck and patio cover. Would it make any difference if the cover was not included? I build backyard decks all the time but do not hold any of the listed classifications (I have a “C-61”/”D-41”). In case I am doing it wrong, please do not use my name or city.A: Thank you for your call, answers here are always anonymous. As we discussed, the “C-61”/”D-41” can properly build wooden decks as long as there is no cover or enclosure. By definition, “a siding and decking (“D-41”) contractor applies or installs all types of exterior siding including wood, wood products, vinyl, aluminum and metal siding to new or existing buildings. This contractor also constructs wooden decks and related hand-rails. This work shall not include the construction or installation of covers or enclosures of any kind.”Regarding using your business name, rest assured that we do not include – and have never included – the actual name of the person or company asking the question. All questions and answers are anonymous and therefore only referenced by a “fictitious” name in quotes. The goal is to share knowledge, not blow your cover! Q: I read your column through the Central California Builder’s Exchange

and appreciate your advice. I am considering starting my own General Engineering construction business within the next 6 months. I do not have a contractor’s license yet but have managed a very successful construction business for over 15 years. To speed up the process, does it make sense to apply for and obtain a contractor’s license in my own name? I would not operate as a sole proprietor but would use my personal contractor’s license to obtain another one for the business. I plan to operate as an LLC or corporation.A: It does not speed up the process to apply for a license in your own name prior to applying for a corporation or LLC license. Whenever there is a change of entity (i.e. sole proprietor applying for a corporate license or whatever the case may be) you are required to re-apply for a license, so in essence you would be going through the licensing process twice. not to mention paying the license and bonding fees twice!

If you don’t intend on doing business as a sole proprietor then you may be best applying in the company name right off the bat. It’s also best to con-sult with an attorney or CPA when making these business decisions.

A federal Court of Appeals struck down a national Labor Relations Board (nLRB) rule requiring most companies to post a notice informing employees of their union rights.

The controversial poster rule required most private-sector employers to put up nLRB-created workplace posters entitled, “Employee Rights Under the national Labor Relations Act.” The poster generally informs employees of their rights to organize a union, bargain collectively through representatives chosen by the employees and to make efforts to improve the terms and conditions of their employment.

A three-judge panel for the U.S. Court of Appeals for the District of Columbia said the nLRB violated employers’ free speech rights and overstepped its legal authority. Judge Raymond Randolph noted that federal law protects “the rights of employers (and unions) not to speak” and that the poster rule was “compelled speech.”

The rule, according to the federal court, treats the failure to post the nLRA notice “as evidence of anti-union animus in cases involving, for example, unlawfully motivated firings or refusals to hire — in other words, because it treats such a failure as evidence of an unfair labor practice.”

The posting requirement was initially scheduled for implementation in november of 2011. That deadline was first delayed until April 30, 2012, and then put on hold indefinitely pending the outcome of legal challenges.

This particular challenge was brought by the national Association of Manufacturers (nAM) and other business groups.

“Today, manufacturers claim an important victory in the fight against an activist nLRB and its aggressive agenda,” said nAM President and CEO Jay Timmons, in a statement. “The poster rule is a prime example of a government agency that seeks to fundamentally change the way employers and employees communicate. The ultimate result of the nLRB’s intrusion would be to create hostile work environments where none exist.”

In a separate lawsuit, a federal trial court in South Carolina also concluded in April 2012 that the nLRB lacked the authority to promulgate the posting rule. The nLRB challenged the decision and the case is pending before the U.S. Court of Appeals for the Fourth Circuit. The appeal was heard in March 2013.

The nLRB has statutory jurisdiction over private sector employers whose activity in interstate commerce exceeds a minimal level.

We, the undersigned organizations, representing thousands of businesses

and millions of Americans from all sides of the political spectrum, write to express our desire for greater accountability in the electronic employment verification (E-Verify) provisions of the Border Security, Economic Opportunity, and Immigration Modernization Act (Title III of S. 744). We believe that a simple reform is needed to protect small businesses and their legal employees.

Our concern is that the system could create unnecessary burdens on Americans by initially failing to confirm hundreds of thousands of authorized workers. If the present E-Verify error rate (0.26%) was applied nationally, it would fail to approve 156,000 authorized employees every year.

As E-Verify’s rollout expands from just 7.5 percent of employers to 100 percent, it is vital to us that the error rate remains at least this low. Errors thrust employers into a state of regulatory uncertainty as to whether their new hire will be able to work or not. Many small employers lack the full time human resource staffs necessary to help workers correct these problems, and they will often incur significant costs attempting to do so.

Errors also burden legal workers, forcing them to spend time and money sorting out the errors at federal offices. These errors will disproportionately impact authorized foreign-born workers and naturalized citizens, who are at least 20 times as likely to receive an error as a native born American, according to E-Verify’s most recent independent audit. Based on this number, one recent study found that foreign-born workers would receive 82 percent of all errors. This could create an incentive for discrimination against foreign-born workers. It also places an undue burden on the Social Security Administration, impacting seniors and those with disabilities who rely on a timely response from SSA.

Basic accountability can protect both workers and employers. We propose that Congress require that E-Verify’s error rate remain at or below its current level before small businesses are forced to comply with the mandate. This gives the government over four years to work out any issues with the system, and Department of Homeland Security (DHS) Secretary Janet napolitano has already testified that she believes that the current rate can be maintained.

Requiring the government to consider the impact on small businesses and foreign-born workers before E-Verify implementation is just simple accountability. It will protect businesses from the bureaucratic limbo that comes from not knowing if a new hire will be able to work, and it will give authorized employees the confidence that their transition to a new job will not be subject to costly and unnecessary delays.

For these reasons, we urge you to support this commonsense reform.

Fire Safety and Prevention Home safety tips

your family have a plan if a fire

Fire Safety

The best way to practice fire safety is to make sure one doesn’t break out in the first place. This means being aware of potential hazards in your home. Start by keeping the following tips in mind: Check all electrical appliances, cords and outlets. Make sure they are all in working condition, without loose or frayed cords or plugs.

Use caution with portable heaters. Never place one where a child or pet could accidentally knock it over, and keep it at least three feet away from flammable objects.

Be careful in the kitchen. Cooking is the leading cause of home fires. Always practice safe cooking habits, such as turning pot handles to avoid being knocked over, and supervising children while cooking.

Check the fireplace. It should be kept clean and covered with a screen to keep sparks contained. Burn only wood in a home fireplace and never

leave a fire burning unattended.

Beware of cigarettes. They are the number one cause of fire deaths in the U.S. Most are started when ashes or butts fall into couches or chairs, so use caution if you smoke in your home.

Use candles safely. Keep them out of the reach of children, away from curtains and furniture, and extinguish them before you leave the room. Do not allow children to use candles when unsupervised by an adult.

Be aware of holiday dangers. If you use a cut Christmas tree, be sure to keep it watered daily, and inspect all lights yearly for worn or frayed cords.

Fire Prevention

Make your home fire safe by following these tips: Install smoke alarms on every level of your home.

Use the smoke alarm’s test button to check it every month and replace the batteries at least once a year.

Replace smoke alarms every 10 years.

Have at least one working fire extinguisher in your home.

Plan escape routes by determining at least two ways to escape from every room.

Caution everyone to stay low to the floor while escaping and never open doors that are hot.

Select a safe location outside your home where everyone should meet, and practice your escape plan at least twice a year so everyone knows it well.

gates Cooperative Construction Manager (Sausalito)

The Gates Cooperative is a 38 member organization of houseboat owners that are seeking permanent legal berths. These berths are to be located in the County approved expansion of the adjacent Waldo Point Harbor. In order to occupy the new berths, each houseboat must be brought to code standards established by the County. The Gates Cooperative, along with its institutional partners, the County of Marin, Marin Housing Authority, and EAH Inc. (Project Team) is seeking a Construction Manager to oversee the rehabilitation or replacement of the member-owned boats. Under the direction and supervision of Marin Housing Au-thority, the Construction Manager will:

1. Meet regularly with the Project Team, the Gates Co-op member-ship and the Waldo Point Harbor Construction Manager

2. Review the relevant existing documents and history of the project3. Consult regularly with the Project Financial Manager on the

overall project budget4. Develop construction budgets for individual Co-op households in

coordination with the Project Financial Manager and each owner5. Seek collective purchasing agreements, identify potential con-

struction donations and other cost savings mechanisms6. Prepare written recommendations that will enhance the design,

constructability, and cost and time efficiency of the individual houseboat plans, in coordination with the Co-op Project Architect and owner

7. Review the plans for compliance with codes as determined by the County Building Inspector and plan check comments

8. Identify the contractor pool and manage the bidding process 9. Develop a construction schedule with the Project Architect and in

coordination with Waldo Point Harbor’s construction manager10. Monitor construction process; verify work completed for pur-

poses of contractor applications for payment11. Review requests for change orders and submit to Project Finan-
