Governor Brown signaled that finding a way to pay for rebuilding the state’s neglected highways, roads and bridges would be a top priority in 2015 during his annual State of the State address to the Legislature.

After recalling the historic passage of Proposition 1, the statewide water bond, in November, he said transportation infrastructure is also crucial to the state’s long-term success.

“Equally important is having the roads, highways and bridges in good enough shape to get people and commerce to where they need to go,” the Governor told lawmakers. “It is estimated that our state has accumulated $59 billion in needed upkeep and maintenance. Each year, we fall further and further behind and we must do something about it.

“So I am calling on Republicans and

Democrats alike to come together and tackle this challenge. We came together on water when many said it was impossible. We came together - unanimously - to create a solid Rainy Day Fund. We can do it again.”

As Sacramento Bee Columnist Dan Walters reported:

“State highway officials have been beating the drums about the maintenance shortfall for years, to no avail.California’s once-awesome highway system, largely built during the three decades after World War II, is pounded by more than 300 billion vehicle-miles of travel each year and is decaying rapidly.

The problem is actually much larger than $59 billion in deferred maintenance because it does, as Brown says, get worse every year.

Looking ahead, we should be spending at least $100 billion more on maintenance, repair and reconstruction over the next decade.

Fixing the highways should be a higher priority than building Brown’s pet bullet train project which, by the state’s own numbers, would reduce automotive traffic by no more than 1 percent.

Brown didn’t propose how to raise more

highway money. Presumably it would be some form of user fee or tax.

Later in his speech, Brown revealed his other automotive priority, to “reduce today’s petroleum use in cars and trucks by 50 percent” in the next 15 years to cut down on carbon emissions.

The question thus arises: How would the state raise the tens of billions of dollars needed to fix the state’s highways if it is – somehow – sharply reducing use of the fuel on which highway taxes are levied?

The answer, presumably, would be to supplant or supplement the gas tax with some kind of levy based on mileage.

The gas tax, which hasn’t changed in two decades, is clearly antiquated. As the fuel efficiency of cars has increased over the years, its revenues have flattened. Drivers of electric cars don’t pay it, and their numbers would increase dramatically under the state’s plans to lower fuel use by 50 percent.

Last year, Brown signed a bill creating an administrative task force to recommend a method for shifting to a mileage-based transportation tax system.

also a very hard sell politically, especially since it would presumably increase overall revenues to pay for the highway backlog.

Not only would anti-tax politicians and groups be leery, but owners of electric and hybrid cars, who are largely exempt from highway user taxes now, might mount resistance to any effort that makes them pay the same mileage fees as those who drive gas-guzzling SUVs.”

California considering plan to replace gas tax with charge per mile driven

I have reported several times on the mileage-based study bill that was signed into law at the end of last session. Paul Rogers of the San Jose Mercury wrote the following article this week about the first meeting of the mileage-based study group. Also attached is a white paper that discusses the mileage-based tax in greater depth if you are interested.

More people are driving electric cars. Gasoline cars are getting better mileage. And California’s vehicles are causing less pollution.

But all that good news is generating a major problem: As motorists buy less gasoline, state gas tax revenues that pay for roads have been falling for a decade, leading to more potholes and traffic jams.

Now, in a move that could solve the problem -- or cause a political pileup -- state officials have begun to seriously study a plan to replace California’s gas tax with a fee for each mile a motorist drives.“We’re going to have to find another way to

finance the upkeep of the roads,” Gov. Jerry Brown said earlier this month in rolling out his 2015 budget, noting that California has a $59 billion backlog of maintenance needs on state highways and bridges. Brown gave no specifics. But last fall he signed

a law that set up a commission to study a “road usage charge” and establish a pilot program by Jan. 1, 2017. The 15-member commission had its first meeting on Friday in Sacramento.

The idea is far from reality, but it’s raising a hornet’s nest of practical and political questions, from how government would track the miles to what happens when people drive out of state or on private roads.

But it is gaining momentum. This year, Oregon is beginning a test program in which 5,000 volunteers will pay 1.5 cents per mile driven, and be refunded each month what they paid under the state’s 30-cent gasoline tax. Colorado and Washington State also are studying similar pilot programs.

“I think there’s a long way to go before this is implemented. But we have a real problem when it comes to infrastructure in California,” said U.S. Rep. Mark DeSaulnier, D-Richmond, who wrote the bill when he was a state senator. “We have to do something.”

Silicon Valley is getting involved early.

The chairman of the California Transportation Commission, which chose the 15 members of the study panel, is Carl Guardino, CEO of the Silicon Valley Leadership Group.

Guardino said he wants the new commission, formally

called the California Road Charge Pilot Program Technical Advisory Committee, to explore every angle, and receive wide public and media scrutiny.

“This is a game-changer for transportation policy in our state,” he said. “And we better do it right. We will be trampled by innovation if we don’t do this right.”

Meanwhile, Oregon’s transportation department announced this month it has signed a contract with a San Jose company Azuga that makes GPS tracking devices that plug in below a vehicle’s dashboard.

After an outcry by the public and privacy groups about government potentially tracking the location of vehicles, Oregon changed its test

program so that motorists can choose to report their mileage however they want. They can keep their own handwritten diaries, or use a GPS device or some other technology, such as a smartphone app.“Public concerns, you never get rid of them, they never go away, but you can calm them down if you make the right choices,” said James Whitty, who manages the program for the Oregon Department of Transportation.

Speaking at the first meeting on Friday of California’s commission studying the issue, Whitty said the key is to provide choices to the public, to protect the privacy of the data and be open about the program with motorists.

The devices Oregon intends to employ track mileage and gasoline consumption. They send the information electronically from the car to private contractors like Azuga, which provides motorists with a monthly bill. The state then refunds drivers for any gas taxes accrued.

Among the critics of the concept are electric car owners.

“I think it’s too early to start penalizing electric car drivers,” said Felix Kramer, of Berkeley, who owns a Tesla Model S and a Nissan Leaf. “Heavy vehicles take a lot more out of the roads than light vehicles. Electric vehicles are lighter. You have to look at road impacts.”

Kramer said the state should raise the gas tax instead.

California leaders say they are open to learning more.

“There are pros, there are cons. We have to pay for roads,” said state Senate Minority Leader

Bob Huff, R-Diamond Bar. “This is a way that might be part of that. “

California has more than 100,000 electric cars on the road now. That’s less than 1 percent of the 23 million cars in the state. But electric vehicles -- whose owners pay no gas tax -- represented 3 percent of new car sales last year. And federal mileage standards on gasoline cars continue to require better fuel efficiency.

As a result, the amount of gasoline sold in California peaked in 2003, at 15.9 billion gallons. It has fallen steadily since then, despite population growth, to 14.6 billion gallons in 2013, a drop of 8 percent. And as people have bought less gasoline, state gas tax revenues have fallen from $2.87 billion in 2003 to $2.62 billion in 2013.

Critics skeptical of government are wary of the new approach.

“They are going to lower the gas tax and introduce the mileage tax,” said Don Batyi, with the Inland Empire Car Club Council, which represents more than 4,000 car collectors in Riverside and San Bernardino counties. “I have a strong feeling we won’t get a fair shake on this.”

California has funded its state and local roads with a gas tax since 1923.

But that state tax, now 36 cents a gallon, hasn’t been increased since 1994 due to political opposition. Similarly, the federal gas tax of 18.4 cents a gallon has also remained unchanged for more than two decades, leading to a debate now in Washington, D.C., about whether it should be raised when gas prices are low.

Like cigarette tax revenue that falls as fewer people smoke, the gas tax is a victim of California’s success in reducing oil dependency. But California has the most congested freeways in the nation, said state Transportation Secretary Brian Kelly.“We do want to reduce pollution and greenhouse gases from vehicles. That’s a good thing to do,” Kelly said. “And it’s also a good thing to invest in our infrastructure. We have to find a way to thread the needle and achieve both.”

Road tax diversions and realityNot to ‘OD’ you on transportation, but Dan Walters wrote another article on transportation this week as a follow up to his comments of last week:

“A recent column about a growing backlog of deferred maintenance in the state highway system and the difficulty of raising more revenue for roadwork generated an unusually high number of reader reactions.

The responses fell into two broad categories – anger that existing gas taxes and other transportation revenues had been diverted into non-transportation uses, and skepticism that the Department of Transportation could be trusted to do the needed work.

It appears that both attitudes are fairly widespread and therefore need some factual analysis.

The first stems from what happened during several difficult state budget cycles as the Great Recession clobbered general revenue.

Schwarzenegger and the Legislature borrowed heavily from various special funds, including those devoted to transportation.

Those loans became part of what Schwarzenegger’s successor, Jerry Brown, dubbed a “wall of debt” of more than $30 billion that he’s been taking down.

The transportation fund loans totaled $3.8 billion and are being whittled down, with interest, as general fund revenue increases. Very little remains to be repaid.

Whatever one might think of such emergency loans, the money taken temporarily from transportation funds is not a factor in the larger discussion of meeting highway needs. And five years ago, voters passed a ballot measure to block future raids on highway money.

If there is a legitimate issue, it is the money that’s beginning to flow to the state from the inclusion of auto fuel in the “cap-and-trade” program of curtailing emissions of carbon dioxide.

At least a few hundred million dollars a year are being indirectly extracted from motorists to be spent for other purposes, including Brown’s pet bullet-train project.

The second issue raised by readers is the competency of Caltrans to make highway improvements – an estimated $59 billion in deferred maintenance and rehabilitation – even if the money is made available.Caltrans once had a global reputation for building and maintaining highways, but it has deteriorated along with the roadways themselves.

The immense cost overruns and shoddy work

on the Bay Bridge project certainly added another layer of tarnish to the agency’s image. And the Legislature’s budget analyst, Mac Taylor, has said the agency has 3,000-plus more project support workers than the workload justifies, especially since a big highway bond issue passed during the Schwarzenegger regime has largely been exhausted.

Were Brown and the Legislature ever to agree on a financing plan for the much-needed highway work, an important corollary will be deciding whether Caltrans should be entrusted with designing and overseeing it, or whether it should be outsourced to private engineering firms.”

In wake of

Measure BB, counties mull transportation sales tax campaignsOne other funding option that appears to have a chance for ‘helping the cause’ of transportation is based upon the success of Alameda County’s Measure BB in this past November’s election, BB’s success has encouraged a growing number of Northern California counties to consider placing similar proposals before their voters in 2015 and 2016.

Alameda County’s transportation sales tax for 30 years, which will generate almost $8 billion during that time, leveraging more than $20 billion in economic growth and creating 150,000 new jobs.

The Sonoma County Board of Supervisors has already placed a five-year, quarter-cent general sales tax measure on the June ballot this year. The county’s roads are considered among the worst in the Bay Area.

In 2016, another 10 counties are actively considering some form of transportation sales tax measure: Contra Costa, Marin, Monterey, Placer, Sacramento, San Francisco, Santa Clara, Santa Cruz, Solano and Stanislaus.

Andy Fields, of the California Alliance for Jobs said local action is essential as the most historically reliable form of infrastructure and transit funding around the state.

“Given the tens of billions of dollars in deferred statewide maintenance and additional billions needed for new projects, local funding must be raised as well as statewide funding in order for the state’s transportation network to be properly maintained and expanded,” Fields said.

“Local measures provide funds for a wide range of needed improvements, everything from repairing local streets to rebuilding freeways to providing mass transit improvements and safe routes to school. It’s a critical component of efforts to rebuild California.”

There is one problem with not telling the

truth on your license application that is

almost self-explanatory. Don’t let this happen

to you. Does passing one national evaluation

exam open doors to state licensing? As you

will learn, it’s yes and no!..

Q: I have had an Inactive Sole Proprietor “C-

36” Plumbing license since 2002. I never got

my business off the ground but I’ve kept paying

the fees to keep it Inactive. I work for a General

Building contractor and they want me to add

my “C-36” qualification to their license. I have

several convictions from back in the 90’s and

now that the CSLB requires fingerprinting, I

need to know, first, whether that will prevent me

from being a Responsible Managing Employee

(RME) on his license, and second, if the fact

that I lied on my application back in 2002 and

marked “no” to the conviction question will

affect my Inactive Sole proprietor license.

A: To answer your first question, the fact that

you have convictions will not alone prevent you

from acting as the RME on your company’s

license. Each conviction is evaluated on a case-

by-case basis to determine whether it’s related

to the duties or qualification of a contractor and

whether it presents any potential conflict with

the public’s health, safety, or welfare.

Although it depends on things such as the

severity of the crime, the length of time that

has passed since the crime, and rehabilitation

efforts, a very small percentage of applications

are denied due to criminal background.

With regards to your Sole Owner license, while

the CSLB most likely has authority to go back

and say that your 2002 application was falsified,

they do not play the “gotcha” game. Still

possible, but it is highly unlikely that your Sole

Owner license would be affected.

Q: We are forming a new Limited Liability

Company and are interested in obtaining

Contractor Licenses in numerous States across

the country. I saw on your website that you

specialize in CA, NV, and AZ, all of which we

are interested in. One of our new employees

has passed the NASCLA (National Association

of State Contractors Licensing Agencies)

General Building exam. Will that work for us

to be licensed in the States that you handle?

A: Nevada accepts the General Building

NASCLA exam in place of their ‘B’ or ‘B-2’

trade exam. You will need to submit your

transcripts from NASCLA along with your

application. Your company will still need to

apply for a Nevada license and meet all the

other licensing requirements such as passing

the Business/Management exam, references,

providing a financial statement, fingerprinting,

etc.

California and Arizona do not recognize the

NASCLA General Building exam. Your

Qualifier will need to take and pass the trade

and law exams in order to become licensed.

Q: I am an attorney and you have obtained

license histories and copies of license files for

us before. What I need for an upcoming case

is the work experience page that a contractor

originally submitted when they filed their

application. Is that something you can get for

us?

A: No, the only way to obtain a copy of that

document is to Subpoena it. Be aware too that it

will be a redacted version. The CSLB typically

leaves out third party information or personal

information if mentioned on the form.

In an emergency situation, evacuating employees out of a

building poses unique challenges. Appropriate exits, emergency lighting, communication systems, alarms and sprinkler systems are critical for employee safety. Emergency routes need to be developed, posted, and properly maintained to ensure easy accessibly in an emergency situation. Drills are a critical component of all emergency actions plans to ensure that emergency procedures are understood and followed by all occupants.

Evacuation Drills

� Ensure your emergency action plan addresses all emergency situations. Know when to evacuate, and when not to… such as during weather-related emergencies or earthquakes.

� Identify and train Floor Emergency Evacuation Coordinators who will be responsible for sounding the alarms and organizing the evacuation drills.

� Perform regularly scheduled evacuation drills, make needed improvements to the plan, and document these events.

� All employees shall follow evacuation drill procedures professionally and evaluate for

improvement.

� Exit workstations in a calm and orderly manner. Use the evacuation map to determine the closest and safest route out of the building. Do not stay behind.

� Determine a primary and secondary means of evacuation from the building so that, in the event of a real evacuation, you will know another way out if the first choice is blocked.

� Identify the locations of workstations and equipment/furniture on the floor to make low

visibility escape easier.

� Recognize the sounds and signals of the emergency alarms. Report any malfunctioning alarms or emergency equipment immediately.

� Perform a head count at the designated meeting location and ensure all personnel have

safely exited the building.

� Only re-enter when it is reported by the person in command that is safe to do so.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials.
