It is with a heavy heart that we post this news.
Kellie E. Buono soared to heaven peacefully on October 10, 2014 at the age of 41 after a brave and swift fight against Melanoma.
Beloved wife of Ron Buono; devoted and loving mother to Caitlin Rose; caring daughter of Mary and Kevin Eagleton; sweet sister to Eileen Eagleton, Maureen Eagleton and DeeDee Peterson; adoring aunt to Christine Moreno, Fiona Peterson, Riley Peterson and Kevin Peterson.
Kellie is an amazing soul. She enjoyed life, loved helping people and constantly looked out for the wellbeing of family and friends. Kellie will be greatly missed by all those blessed to have known her.
Friends may visit Tuesday October 14 at 4:30 Duggan’s Serra Mortuary where a rosary will be held at 5pm. A funeral mass will be held on Wednes-day at 11 at St. Cecilia Church, 2555 17th Ave, San Francisco. Following Interment Holy Cross Cemetery, join us at The Cliff House for one last toast.

Bid Submission & Project Description:The project consists of all the associate materials and work in the specifications, including re-lamping, all vehicle indications (including indications of Programmable Visibility Heads) with new LED in incandescent look and all pedestrian indications with new countdown LED incandescent look.
Each bid shall be in accordance with the specifications and other contract documents now on file with the City Clerk, City Hall, San Rafael, California; and may be examined and copies may be obtained at the Department of Public Works, 111 Morphew Street, P.O. Box 151560, San Rafael, CA 94901. Cost shall be Twenty-five Dollars ($25) per set, non-refundable. Cost of mailing sets shall be an additional Ten Dollar ($10) per set.

A ‘no way, no how’ gets us started on
this round of contractor “Q&A.” We find
a short answer in a very long question for
a North Carolina contractor interested in
‘rolling the dice’ on a new venture in Nevada.
And, a license applicant shows us why you
keep copies of all your paperwork…
Q: We are in the process of obtaining
a contractor’s license in California. The
CSLB informed us that it might take 2 or 3
months to issue a license with the testing and
fingerprinting requirements. Is there a way to
piggyback off someone else’s license? We have
another company that we use as a subcontractor
here in Arizona that has a CA license and they
are willing to let us use it.
A: We hear this question often and the
answer is plain and simply no, you cannot
piggyback off someone else’s license. The
response we typically get is “well what if we…”
and the answer is still no. Whatever way you
may think to work it, you cannot contract for, or
perform construction work over $500 without
having your own license. No way, no how!
Q: We are a licensed North Carolina
contracting company and one of our customers
would like us to do a large project in Nevada.
We plan to subcontract the installation to a
company that currently has a contractor’s
license in Nevada. We are discussing forming
a Joint Venture (JV) with them. Would that
require that our company obtain a license first
with a Qualifying Employee from our company,
and then we apply for the JV license? Or
can we just apply for a Joint Venture license
with one licensed entity and one un-licensed
entity utilizing the other company’s qualifying
individual?
A: Nevada does not require that both
entities be licensed prior to obtaining a joint
venture license.
Q: We recently restructured the company
and the ownership now belongs 100% to our
parent company. Nothing else changed, we still
have the same tax ID number, same officers,
etc. Do we need to notify the CSLB of the
ownership change?
A: You are required to notify the CSLB of
any change to your license within 90 days of the
change. That includes things such as a name
change, address change, personnel change,
new Worker’s Compensation insurance policy,
etc. If it’s strictly ownership that changed and
everything else with the license remains the
same, then you are not required to notify the
CSLB. However, if prior to the ownership
transfer, your Responsible Managing Officer
(RMO) owned more than 10% of company,
and now that’s obviously no longer the case,
you will need to obtain a Bond of Qualified
Individual and submit that to the CSLB with
an explanation that he is no longer a 10%
shareholder.
Q: I am in the process of obtaining a “C-
10” Sole Proprietorship license and I’m about
2 months deep in the process and I realized I
actually want to operate as an Limited Liability
Company (LLC) I understand that I can act
as the Qualifier on both, providing that I own
at least 20% of the LLC, which I do. I plan to
apply under the LLC once the Sole Proprietor
license is issued. Will I need to re-certify my
experience again? I had to provide all kinds of
documentation and I didn’t keep copies of any
of it.
A: No, you will not be required to
show your experience again. You will want
to complete a waiver application and your
work experience as well as exams will not be
required. And again, for everyone, always keep
copies of documents for future use!

Quite Low (and What that Could Mean)

In my Year-End Legislative Report I only
reported on bills signed by the governor,
meaning that the MOST objectionable one, SB
792 (Padilla), was not discussed because it was
vetoed. Known as a ‘mushroom bill’ because
it grew in the dark unnoticed by most in the
wee hours of the last night of the session, the
governor thankfully listened to the arguments
of the opposition (including ours) and vetoed
the measure.
While there was absolutely no valid reason for
the governor to sign this measure, particularly
since its genesis was at 2 AM in the morning in
the closing moments of the legislative session,
the labor unions sponsoring this measure carry
considerable clout with him due to their strong
support of his campaign (past and present).
Thankfully, however, it is an election year
and the governor was fully aware that Neil
Kashkari would have welcomed this ‘gift’ had
he signed it. I should also add, Jerry Brown 2.0
is a totally different ‘animal’ than Jerry Brown
1.0, meaning that despite who the sponsors
were, chances were likely that he never would
have signed it, but then again……….? So too,
in reading his veto message he did not deny
that using certified workers was wrong, but he
‘suggested’ a more politically sensitive way to
go about accomplishing what they so desire to
do.
In case you’ve forgotten, SB 792 was a ‘gut and
amend’ of AB 1415 (Perez) which would have
required the use of only certified personnel to
apply protective coatings and linings on steel
and concrete to prevent early deterioration
due to corrosion and related environmental
contamination on all public works projects.
The sponsors were the International Union
of Painters and Allied Trades, along with the
State Building Trades and other coating and
painting-related companies.
So, what did the governor say in his veto
message? Read on:
GOVERNOR’S MESSAGEI am returning Senate Bill 792 without my signature. This bill directs the Department of Industrial Relations, in consultation with the Department of Toxic Substances Control, to adopt regulations, on or before January 1, 2016, to establish performance standards for corrosion prevention work on projects designated as public works. Unfortunately, the development of these standards is outside of the jurisdiction and expertise of these departments. Using industry accepted
standards for corrosion prevention and worker safety on public infrastructure projects is good policy and procurement requirements should ensure that all workers are properly trained and certified to do this critical work. Therefore I am directing the Department of Industrial Relations to incorporate industry accepted standards for corrosion prevention training into the appropriate apprenticeship programs. I am also directing the department to work with the Standards Board to assess the adequacy of safety standards for workers engaged in corrosion prevention work and make necessary changes. ¦ Sincerely, Edmund G. Jerry Brown’s Veto Rate is Actually Quite Low (and What that Could Mean)By Carson Bruno, Research Fellow, The

Speaking of governor’s vetoes:
September 30th was the deadline for Governor
Brown to sign or veto the 1,074 bills sent to
his desk by the legislature, officially ending
the 2013-2014 legislative session. And most of
them he signed; vetoing 13.3% of the bills.
But how does Jerry Brown 2.0’s veto rate
compare to past Governors and what does it
say about his “adult in the room” narrative and
“canoe” governing philosophy?

Jerry Brown 2.0, on average, has vetoed 12.6%
of the bills sent to him (on average, 959 bills
are sent his way each year). When compared
to his predecessors, Brown’s recent veto rate
appears lacking. Schwarzenegger, for example,
had an average annual veto rate of 26.4% (two
times Brown’s rate), despite having more bills
pile up on his desk (1,066, on average, per
year). But wait, you’ll say; Schwarzenegger
was a Republican, who had, at times, a frosty
relationship with the Golden Dome.
So, let’s go back further. Democratic Governor
Gray Davis vetoed, on average, 17.6% of the
average 1,248 bills annually sent to him. And if
we remove 2003 (Davis’ veto rate fell to 6.0%
in 2003 from 18.4% in 2002, possibly related
to the recall election), the recalled Governor’s
rate jumps to an average of 19.4%. Going
back further, Pete Wilson (16.7%) and George
Deukmejian (15.5%) both have higher veto
rates than Governor Brown 2.0.
Brown 2.0 only exceeds two modern-era
Governors: Jerry Brown 1.0 (vetoing 4.6%
of the 1,426 bills sent to him, on average)
and Ronald Reagan (on average, annually
vetoing 6.3% of 1,666 bills). The trend here
is undeniable. Between Brown 1.0 and
Brown 2.0, gubernatorial veto rates steadily
increased with each administration. Indeed, no
Governor had an average veto rate less than his
predecessor, until Jerry Brown 2.0.
But maybe more interesting is the steady
decline of bills making it to the Governor.
Since Deukmejian, fewer bills, on average,
have landed on each Governor’s desk. Jerry
Brown 2.0 has seen about half the volume
George Deukmejian did. Reasons for this
could include: legislative gridlock, a more
active and successful gubernatorial legislative
affairs office preventing bills from getting to
the Governor’s desk in the first place, or a more
discerning legislature.
There’s little evidence that legislature has been
getting more balanced and legislative gridlock
has been the norm for years, so that can’t
explain the downward trend in bills sent to the
Governor; so, let’s rule out those possibilities.
Thus, if indeed, the Governor’s legislative
affairs office has become both more active and
more successful that could explain Brown 2.0’s
low veto rate. But this would also have to mean
that past gubernatorial legislative affairs offices
were getting less active and/or less successful
and that Brown 2.0’s legislative affairs office
suddenly achieved rock star status.
But it isn’t like Brown’s predecessors were
running ineffective offices. Deukmejian,
Wilson, and Davis all had long histories in
Sacramento and were skilled politicians.
Schwarzenegger was an outsider, but he
employed many capable people with resumes
filled with Sacramento experience (and many
were Democrats, who presumably had contacts
within the Democratic-led legislature). So, this
theory doesn’t help explain Brown 2.0’s low
veto rate.
This calls into question both Brown’s “adult in
the room” narrative (i.e., he is the check on the
liberal legislature) and his “canoe” governing
philosophy (i.e., paddle to the left, then to the
right to maintain balance). At an annual veto
rate of just 13%, Brown is letting a lot of bad
public policy pass by him (evidence includes
the plastic bag ban) and on major reforms, from
the watering down of his pension reform plan
to his last minute involvement in the water
bond negotiations, he hasn’t been a forceful
leader. All of this suggests he may be the adult,
but isn’t in the room.
It does appear Brown 2.0 is attempting to
adhere to his “canoe” philosophy as evident
by his signing of bills like AB 1897, which
will hold businesses liable for the actions of
subcontractors (a major victory for labor)
while vetoing bills like SB 25, which would
have given wide ranging new powers to the
Agriculture Labor Relations Board (a major
defeat for labor). But a cursory examination
suggests his canoe is still veering leftward.
Often times in political and policy discourse,
people like to boil actions down to a single
number that is quantifiable. And in this case,
Brown 2.0 can’t compete with past Governors.
But in a state like California, and more
specifically, a capital like Sacramento, a slight
leftward steering might be the best alternative.
And even though Schwarzenegger was prone
to use his veto pen, his tenure proves that the
quality of vetoes may be more important than
quantity.

Lawsuit Abuse Chases Jobs Out of CaliforniaBy Joe Ramirez

As many of you know, California Citizens
Against Lawsuit Abuse is recognizing Lawsuit
Abuse Awareness Week. Nearly every small
business owner I know has a horror story about
lawsuit abuse. These lawsuits are much more
than a paperwork headache – they can force
small businesses to shut down and destroy jobs.
My story is not unusual. I own a private
security firm, and when a client cancelled and
moved to a national provider, I had to lay off
one of my employees assigned to the account.
We could not place him back to work and as
a result, I was hit with a lawsuit claiming that
I didn’t give the employee the appropriate
number of breaks as required by law. I was
astounded to be told by our lawyer that even
though a violation had not been committed, I
would actually spend less money if I settled the
lawsuit rather than fighting it. With reluctance,
we settled the lawsuit – and the employee and
his lawyer received thousands of dollars.
I was fortunate that my business was barely
able to absorb this massive hit. Unfortunately,
there are many businesses in California that
are forced to shut down when facing a lawsuit
such as this. In this way, lawsuit abuse takes an
enormous toll on our economy, and contributes
to the state’s difficulty creating jobs and
lowering its high unemployment rate.
Now I understand why business leaders put so
much focus on a region’s legal climate. More
than regulations or taxes, lawsuit abuse can
stop a successful business in its tracks, wasting
time and money that would be better spent
running and expanding the business.
California is slowly recognizing that lawsuit
abuse is hurting its businesses and slowing
job creation. But until California starts
following the lead of other states and passing
common sense laws to reform its legal system,
investment – and the jobs that follow- will
continue to flow to other states.

An earthquake is an abrupt ground movement resulting from the earth shifting and breaking deep underground. Earthquakes range from minor tremors to violent shaking that can destroy an entire neighborhood. In addition, earthquakes can trigger other disasters such as fires, floods, landslides, avalanches, or tsunamis. They occur at all times of the year and are currently impossible to predict. Earthquakes cause damage primarily by causing objects to fall or fly through the air. The buildings most prone to collapse are those with foundations:
• On landfills of loose, unconsolidated materials.
• On former waterways.
• On unstable soil.
• That are not reinforced and anchored to the ground. Earthquake preparation:
• Assure that you understand your employer’s emergency action plans for earthquakes. Prepare by understanding your role in the plan.
• Stabilize objects in your workplace or living area that could fall. – Make sure that shelves, mirrors, and pictures are securely attached to walls.
These heavy items should not be too close to beds or places where people sit. – Brace overhead lights and top-heavy objects like cabinets. – For items that cannot be attached to walls, ceilings, or floors, put heavier objects
on lower shelves. Put breakable items in low, latched cabinets.
• Minimize fire risks. – Make sure that electrical wiring and gas connections are not defective. If repairs
are needed, get professional help. – Flexible pipes for gas and water are less likely to break. – Gas appliances can be installed with an automatic shut-off valve triggered by
shaking. – Store flammable products and poisons like weed killers in a closed, latched,
lower shelf.

• Consider the stability of the structure. – Make sure that the structure and foundations have been properly anchored.

– If you discover any structural defects like cracks in ceilings or foundations, get professional advice.
• Prepare yourself. – Develop an action plan for your home and workplace. – Pick a spot in every room to be an earthquake shelter. This is preferably beneath
a sturdy table or against an inner wall. – Have earthquake drills with your family and coworkers. – Learn how to turn off the gas, water, and electricity. – Consider learning first aid.
Earthquake response:
• The key steps to follow are: 1. Drop. 2. Cover. 3. Hold on. Drop to the ground; seek cover beneath something sturdy like a desk or table, and hold on to the protective structure until the earthquake ends.
• While you want to reach a safe place to wait out the earthquake, limit your
movements to only a few steps.
• If you are indoors: – Drop, cover, and hold on. – If you cannot find a table or desk to use for cover, crouch in the corner of an
inside wall and protect your face and head with your arms. – Stay away from outside walls and doors. Avoid anything that can break or fall on
you, like glass or lighting fixtures. – If you are in bed, stay there unless something might fall on you. Protect your
head with your pillow. – Doorways usually are not sturdy enough to give good protection. Only use
doorways that are strong and load-bearing. – Never use elevators. – Be prepared for electrical failure or activation of the sprinkler system or fire
alarm.

– Stay outside until the shaking stops. – Keep your distance from structures that
may fall, such as houses, street lights, or electrical wires.
– The most dangerous areas are next to buildings, because of falling walls and breaking windows.
• If you are in a vehicle: – Stop safely but quickly. As with being outside, you do not want to be near tall
structures that may fall, like buildings or overpasses.
After the earthquake:
• If you are trapped under debris:
– Under the wreckage there will be a dangerous amount of dust. To avoid inhaling the dust, cover your mouth with cloth, such as an article of clothing or a handkerchief, and avoid shouting for help.
– Stay calm and still, and do not move around, as this will kick up more dust.
– Do not light matches to see.
– To alert rescuers to your location, tap on a pipe or a wall or blow a whistle if you have one. Shouting should only be a last resort.
• Check for injuries to others. If someone is injured or seriously ill:
– Call emergency medical services (EMS).
– Provide first aid.
– If breathing or the heart has stopped, administer CPR if you have been trained. If the victim has a pulse and is breathing, look for and treat other injuries to the level of your first aid training.
• Listen to the local radio and television stations for updated information and instructions.
• Do not drive unless absolutely necessary.
• Stay away from downed power lines or broken gas lines.
• At your building, check for gas, water, or sewage breaks, downed electric lines, and short circuits. Turn off appropriate utilities, and stay away from building damage and potential problem areas, such as cracks in chimneys or foundations. Communicate these kinds of issues to those responsible for dealing with them.

Un terremoto es un movimiento abrupto del terreno resultante del desplazamiento y la ruptura de la tierra a gran profundidad subterránea. Los terremotos oscilan entre temblores leves a sacudidas violentas que pueden destruir un barrio entero. Además, los terremotos pueden desencadenar otros desastres tales como incendios, inundaciones, deslizamientos de tierra, avalanchas o tsunamis. Ocurren durante todo el año y en este momento son imposibles de predecir. Los terremotos causan daño principalmente al causar que los objetos caigan o vuelen por el aire. Los edificios más propensos a derrumbarse son los que tienen bases:
• En los vertederos de materiales sueltos y no consolidados.
• En los canales anteriores.
• En tierra inestable.
• Que no están reforzadas y ancladas al suelo. Preparación para un terremoto:
• Estabilice los objetos en su lugar de trabajo o vivienda que podrían caer. – Asegúrese de que los estantes, espejos y fotos estén bien sujetos a las paredes.

temblor. – Manténgase alejado de las estructuras que
se puedan caer, tales como casas, farolas o tendidos eléctricos.
– Las zonas más peligrosas están al lado de los edificios, debido a la caída de muros y ventanas rotas.
• Si está en un vehículo: – Deténgase de manera segura, pero rápidamente. Debido a que está afuera, no
quiere estar cerca de las estructuras altas que puedan caer, tales como edificios o pasos elevados.
Después de un terremoto:
• Si está atrapado bajo los escombros: – Bajo los escombros, habrá una peligrosa cantidad de polvo. Para evitar inhalar el
polvo, cúbrase la boca con tela, tal como una prenda o un pañuelo, y evite gritar para pedir ayuda.
– Mantenga la calma y quédese quieto. No se mueva, ya que esto levantará más polvo.
– No encienda fósforos para ver. – Para alertar a los rescatistas a su ubicación, toque en un tubo o una pared o
sople un silbato si tiene uno. Gritar sólo debe ser un último recurso.
• Revise por lesiones a otras personas. Si alguien está lesionado o gravemente enfermo: – Llame a los servicios médicos de emergencia (EMS por sus siglas en inglés). – Proporcione primeros auxilios. – Si la respiración o el corazón se ha detenido, administre RCP si ha sido
entrenado. Si la víctima tiene pulso y respira, busque y trate otras lesiones según su nivel de capacitación en primeros auxilios.
• Escuche los programas locales de radio o televisión para obtener información e instrucciones actualizadas.
• No conduzca a menos que sea absolutamente necesario.
• Manténgase alejado de cables eléctricos caídos o tuberías de gas rotas.
• En su edificio, revise en busca de roturas de gas, agua o alcantarillados, líneas eléctricas caídas y cortocircuitos. Apague los servicios públicos apropiados y manténgase alejado de los daños del edificio y áreas con problemas potenciales, tales como grietas en las chimeneas o cimientos. Comunique este tipo de problemas a los responsables de tratar con ellos.

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.
ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

SEEKING ESTIMATING ADMINISTRATOR
Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.
ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
