Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

Do you know you can’t use the same ‘fingerprints’ in two differ-ent states? We ‘qualify’ an answer for an out-of-state contrac-tor, share tips on Nevada licensing and learn why your ‘finger-prints’ can’t cross state borderlines…

Q: I noticed that nevada doesn’t use the terms RMO/RME like California. Does that mean that the Qualifying Individual must be contracted as an executive and be given a title (Vice President for example) in the State of nevada? If this is the case, could you please tell me what are the different titles that may apply?

A: For the State of Nevada, your “Qualified Individual” may either be an employee or an Officer. The Qualifier does not need to be given an Officer title in order to act in that capacity; however, if he/she is an Officer, the titles to choose from are President, Vice Presi-dent, Secretary, or Treasurer.

Q: We are in the process of updating our Officers on our CA and NV licenses. I am discovering that the new Officers are required to get fingerprinted for CA. Will they also be required to get finger-printed for NV? If so, can the fingerprints they get here in CA be used for nV purposes as well?

A: Yes, the nevada State Contractors Board does require that all personnel you list on the application get fingerprinted. The finger-prints are not transferable from one State to another. For CA, the Officers cannot get fingerprinted until the application is submitted and they receive the request from the CSLB. For nevada, they can get fingerprinted ahead of time and submit these with the applica-tion.

Q: My company is going to need a CA license for a project we have coming up and we were wondering if the Qualifying individ-ual has to be an employee of the entity obtaining the license, or can he be an employee of a subsidiary company or parent company? I’m not sure if it matters, but neither the subsidiary company nor parent company has a license in CA.

A: A Responsible Managing Employee (RME) must be a bona fide employee of the applying entity. This means that the RME must be employed by the firm and actively involved in the operation of the business at least 32 hours per week or 80 percent of the total busi-ness operating hours per week, whichever is less.

Q: We just received our renewal for our CA License, but our RME left the company a few months ago (unbeknownst to the CSLB) so he is not available to sign. We have designated a new RME but he is not on record yet. He has some projects to finish with his own license before he wants to be added to our license. Can we request an extension? Or can we have the new qualifier sign and attach an explanation of our future plan?

A: The CSLB will not accept a renewal unless it is signed by the Qualifying individual, as well as an Officer, listed on the license. The CSLB will not give you an extension, nor will they accept the new Qualifier’s signature until he is officially added to the license, even with an explanation. In order for them to process the renewal, we suggest simultaneously submitting a Replacement of Qualifier application with the Renewal Application signed by the new Quali-fier so that they can (hopefully) be processed together.

The Legislative Analyst’s Office (LAO) released a report this week (attached) that I swear must have been based on my annual Year-End Legislative Report that I mailed to you last week! You may recall that I discussed in my report my involvement with a private equity firm that represents over 450 of the wealthiest families in the United States (no foreign money!!!) whose fortunes are building myriad infrastructure projects such as the just opened $120 million new Jordan Bridge in Virginia. You also may recall that I’m working on a top secret project to bring private infrastructure into California through, what we hope will be a pilot project that, in-turn, opens the flood gates that will enable private equity firms to fund and build many of California’s $500 billion worth of infrastructure needs. IF we are successful, it will certainly provide a major “shot in the arm” to the construction industry, while ensuring that our state’s future is bright!!!

Following is an article from the Press Enterprise that discusses the LAO’s report. The report discusses two ongoing Public, Private Partnerships (P3) that haven’t been nearly as successful as they should have been, because of the costs of the projects as well as the selection process that was used. Mind you, that much of the existing problems with these two projects were due to the “over-involvement” (translated to mean they had their “grubby hands” trying to “love them to death”) of the public workers’ unions who look at P3 and any other private approach as a direct threat to their existence (hence my reason for keeping my project under wraps)!!! What is promising is that the LAO recognizes that there is considerable merit to this approach with some major “tweaks” to the existing process. Also bear in mind that the approach I’m working on differs from P3 in that they have nO government involvement except to help facilitate the land swap or other mechanism to build their project(s).

“California has massive demands for public projects, and limited money to pay for them. So the state should be looking at ways to tap private capital to help build highways, courthouses and other projects. But the Legislature needs to ensure a stronger process for deciding which public construction would benefit from a partnership with the private sector.

The state legislative analyst released a report last week outlining how the state could better use public-private partnerships on infrastructure projects. Traditionally, public agencies award a contract to design a project, then seek competitive bids from companies for the construction, all paid for with tax money. Under a

public-private partnership, agencies contract with a private partner to design, finance and build infrastructure — and sometimes even operate and maintain the finished project.

Joint efforts between public agencies and private interests can provide substantial advantages for taxpayers, such as greater certainty on price, fewer delays and less fiscal risk to the public. Such partnerships can also result in more innovative approaches to design and construction, and further stretch taxpayer dollars through access to private financing.

But those benefits vanish if the public sector mishandles such deals. And the analyst reports that the state’s record on that score needs improvement, judging by two projects now under way — a courthouse in Long Beach and the Presidio Parkway in San Francisco, each with a price tag of nearly $500 million. The analyst estimated the courthouse could have been up to $160 million cheaper, and the parkway as much as $140 million less, if the state had used a more traditional approach to build the projects. The report said that both projects were poorly suited for public-private ventures, and faulty analysis led agencies to choose the wrong approach.

Instead, the state needs clear and consistent guidelines for selecting which projects should use a private partnership. Complex projects, for example, can benefit from private-sector innovation. Private involvement should ease the risk to taxpayers, and provide financing that might not otherwise be available. Turning unsuitable projects into public-private ventures is wasteful and self-defeating.

Public agencies also need to do a better job evaluating the potential costs and risks before deciding which approach to use. Agencies should study a broad range of options for building infrastructure, as well. The report noted that fiscal analyses for the courthouse and parkway projects compared only two approaches, and then based conclusions on flawed assumptions about cost overruns, tax benefits and other factors. But private partnerships on projects should not waste public money.

Better ways of financing and delivering projects are crucial for a state with hundreds of billions of dollars in projected need for highways, schools, water systems, courthouses and other public projects over the next decade or two. Public-private partnerships can help with that challenge — if the state ensures that their use delivers a public benefit.

Are You Practicing Scaffolding Safety?The majority of scaffold accidents on the construction site are caused by falls, slipping or being struck by an object from above. All of these accidents can be prevented by taking the proper precautions. Here’s how. General Safety Tips

• To prevent slipping hazards, conduct a daily routine inspection to ensure all walking and working surfaces are free from potential hazards. If you spot a hazard, remove it.

• Never move, dismantle or alter a scaffold unless under the supervision of a qualified person while doing such activities.

• Never move a scaffold with workers still on it.

• Keep scaffold loads below maximum capacity and remove your equipment when the scaffold is not in use.

• Be alert for bad weather. High winds and driving rain and snow can be dangerous when working at high levels.

Protection for Those Below

Always hoist up heavy tools, equipment and supplies, rather than carry them up by hand.

There must be a 3½"-high toe board to prevent things falling off a scaffold. If things on the scaffold are taller than 3½" (above the toeboard) other

systems, like debris nets, must be used to catch falling tools or materials.

Always wear a hard hat when working on and around a scaffold.

Never walk under or near the scaffold if roped off when work is being performed above.

Fall Protection Basics To help protect you against potentially deadly falls, fall protection is needed when working 6 feet or more above a lower level, and consists of either a personal fall-arrest system or guardrail systems, depending on the job. If using a fall arrest system, keep the following in mind:

• Always attach your lanyard to a vertical lifeline, horizontal lifeline or scaffold structural member.

• If you are using a vertical lifeline, make sure that you are fastened to a fixed safe point of anchorage, independent of the scaffold. This includes structural members of buildings, but not standpipes, vents, electrical conduit, etc. They may give way under the force of a fall.

• Clean and test your gear regularly, and never tamper with your fall protection system.

When working on scaffolding, your safety is our top priority. Make it yours, too!

When working on or around scaffolding, following some simple safety tips goes a long way in preventing injuries from slips, falls and being struck by falling objects.

Asuntos de Seguridad Puntos que los supervisores deben plantear

¿Pone en práctica la seguridad en andamios?La mayoría de los accidentes en andamios en los lugares de construcción son causados por caídas, resbalones u objetos que caen provocando heridas. Todos estos accidentes se pueden evitar tomando las precauciones adecuadas. Descubra cómo hacerlo. Consejos generales de seguridad

• Para evitar peligros de resbalones, realice una inspección diaria de rutina para verificar que en todas las superficies de trabajo y por donde se camina no haya posibles riesgos. Si divisa un riesgo, elimínelo.

• Nunca mueva, desmonte o altere un andamio a menos que se encuentre bajo la supervisión de una persona capacitada mientras realiza tales actividades.

• Nunca mueva un andamio con trabajadores que todavía se encuentren sobre él.

• Mantenga las cargas de andamio por debajo de la capacidad máxima y quite su equipo cuando el andamio no esté en uso.

• Esté atento al mal clima. Los vientos fuertes y la nieve y lluvia intensa pueden ser peligrosos cuando trabaja en niveles altos.

Protección para los de abajo

Siempre eleve las herramientas pesadas, el equipo y los suministros en lugar de llevarlos en la mano.

Debe haber un tablón de pie de 3½" de alto para evitar que las cosas caigan del andamio. Si las cosas sobre el andamio son más altas que 3½" (sobre el tablón de pie), otros sistemas, como redes de desechos, se deben utilizar para atrapar las

herramientas o materiales que puedan caer.

Siempre use un casco cuando trabaje sobre y alrededor de un andamio.

Nunca camine debajo o cerca del andamio si está cercado cuando se está realizando trabajo arriba.

Puntos básicos para la protección de caídas Para ayudarlo a protegerse de caídas posiblemente fatales, es necesaria la protección contra caídas cuando trabaja a más de 6 pies sobre un nivel inferior. Esta protección consiste en un sistema personal para detención de caídas o en un sistema de baranda de seguridad, según el trabajo. Si utiliza un sistema para detención de caídas tenga en cuenta lo siguiente:

• Siempre ate su acollador a una cuerda de salvamento vertical, a una cuerda de salvamento horizontal o a una extremidad estructural del andamio.

• Si utiliza una cuerda de salvamento vertical verifique que esté sujeta a un punto fijo de seguridad, independiente del andamio. Esto incluye extremidades estructurales de edificios pero no incluye columnas reguladoras, ventilaciones, conductos eléctricos, etc. Pueden sucumbir ante la fuerza de una caída.

• Limpie y pruebe su equipo regularmente y nunca altere el sistema de protección contra caídas.
