1. Major Legislative Changes This Update covers a total of 440 changed (i.e. new, amended, repealed, etc.) Acts, Regulations, Codes of Practice and other legislative instruments. For all of the legislative changes covered by this Update, refer to Section 6 of this document. Following are some of the major changes included in this Update: Commonwealth

• Commencement, assent, amendment and other changes to 11 Industrial Chemicals Acts and Regulations;

• Commencement of some provisions of the Industrial Chemicals Act 2019;

• Commencement of the National Construction Code (NCC) 2019;

• Amendment of the Renewable Energy (Electricity) Regulations 2001; and

• Commencement of the Great Barrier Reef Marine Park Regulations 2019.

New South Wales

South Australia • Amendment of the Work Health and Safety Regulations 2012; and

• Amendment of the Code of Practice for vessel and facility management (marine and inland waters) 2008.

Tasmania • Amendment of the Work Health and Safety Regulations 2012

• Amendment of the Environmental Management and Pollution Control Act 1994, commencement of the Environmental Management and Pollution Control Order 2019 and commencement of the Environmental Management and Pollution Control (Environmental Licences) Regulations 2019; and

• Amendment of the Occupational Licensing Act 2005 and the Occupational Licensing (Gas-fitting Work) Regulations 2010.

Northern Territory

• Amendment of the Petroleum Act 1984 and Petroleum (Environment) Regulations 2016.

New Zealand

• Amendment of the Accident Compensation Act 2001 and commencement and revocation of several Accident Compensation Regulations;

• Amendment of the Climate Change (Eligible Industrial Activities) Regulations 2010; and

• Amendment of several Land Transport Rules.

References to the above legislation and (where applicable) the referenced AS and NZS Standards have been included in the WHSE Compliance Guidelines, as applicable in each case.

2. Changes to Government Departments and Authorities

NSW Planning and Environment - Energy NSW

Publications formerly managed by the New South Wales Department of Industry – Resources and Energy are now managed by the NSW Department of Planning and Environment - Energy




NSW (https://energy.nsw.gov.au/). The changed has been incorporated in the documents, as applicable.

WA Commission for Occupational Safety and Health

The Western Australia Commission for Occupational Safety and Health (web site address https://www.commerce.wa.gov.au/worksafe/commission-occupational-safety-and-health-0) is a tripartite body made up of employee, employer and government representatives as well as occupational safety and health experts. The Commission’s web site lists Approved codes of practice, Approved guidance notes and Other documents (some of which are also listed on the WorkSafe WA web site). References to the Commission for Occupational Safety and Health and the URL of its web site have been added to the documents, as applicable.

3. Miscellaneous

National Construction Code 2019

The Australian Building Code Board (https://www.abcb.gov.au/) has made the National Construction Code 2019 available for preview and the Code is expected to commence in May 2019. The release consists of: • NCC 2019 Volume One

• NCC 2019 Volume Two

• NCC 2019 Volume Three

• NCC 2019 Guide to Volume One

Some of the key changes from the 2016 Edition (which will be superseded) are: • Quantification;

• Readability;

• Fire safety;

• Fire sprinklers in Class 2 & 3 buildings;

• Bonded Laminate Concession;

• Energy efficiency;

• Volume Two Acceptable Construction Practice;

• Condensation management;

• Roof-top spaces;

• Accessible adult change facilities; and

• Plumbing.

The new Code, and the Standards it references, have been incorporated in the documents, as applicable. Please note that in addition to many AS and AS/NZS Standards referenced in the Code (which are all noted and included in the update), the NCC 2019 also references

standards from countries other than Australia and New Zealand (e.g. ANSI, ASTM European Union Commission, etc.).

Model Work Health and Safety Regulations

The latest version of the Model Work Health and Safety Regulations was issued by SafeWork Australia in January 2019 and it includes all amendments made since 2011. However, the Model Work Health and Safety Regulations 2019 and the amendments they incorporate do not automatically apply in any jurisdiction in Australia (i.e. Commonwealth, States and Territories), until and unless they have been adopted by each jurisdiction and have been incorporated in the legislation in force in that jurisdiction. When this takes place, the changes will be reflected in the WHSE Compliance Guidelines.

Commonwealth Safety, Rehabilitation and Compensation Regulations 2019

The Commonwealth Safety, Rehabilitation and Compensation Regulations 2019 commenced in March 2019 and the Safety, Rehabilitation and Compensation Regulations 2002 was repealed. The change has been incorporated in the documents, as applicable.

Victorian Electricity Safety (Equipment Safety Scheme) Regulations 2019

The Victorian Electricity Safety (Equipment Safety Scheme) Regulations 2019 commenced in April 2019 and the Electricity Safety (Equipment) Regulations 2009 was revoked. The change has been incorporated in the documents, as applicable.

Commonwealth Industrial Chemicals Legislation

There were quite a few changes to the Commonwealth Industrial Chemicals (Notification and Assessment) legislation in March and April 2019. The changes include: • Industrial Chemicals (Notification and Assessment) Act 1989 (amended March 2019)

Construction and Operation of Solar Farms Code of Practice 2019

The Queensland Code of Practice Construction and Operation of Solar Farms Code of Practice 2019 commenced May 2019. The Code covers requirements related to the safe design, construction, commissioning, operation, maintenance and end of life management of solar farms. References to the Code have been incorporated in quite a few WHSE Compliance Guidelines, including the addition of a definition and specific requirements to WHSE Compliance Guideline WHSE-CG-072. While the Code is Mandatory only in Queensland, it can serve as a useful resource in all other jurisdictions.

Vehicles as a Workplace National Guide

‘Vehicles as a Workplace – Work Health & Safety Guide’ is a National Guide providing guidance on managing the WHS aspects of vehicles as a workplace and ensuring compliance with WHS and road traffic legislation. The Guide was issued in March 2019 jointly by the following statutory authorities: • Commonwealth National Heavy Vehicle Regulator (NHVR);

• Commonwealth Austroads;

• Commonwealth Comcare Australia;

• SafeWork NSW;

• Queensland Work Health, Safety and Workers' Compensation Services;

• SafeWork South Australia;

• WorkSafe Tasmania;

• Northern Territory WorkSafe; and

• WorkSafe ACT

References to the Guide have been incorporated in the WHSE Compliance Guidelines as applicable, including the addition of specific requirements to WHSE Compliance Guideline WHSE-CG-049.
