As you can see from the cover, this edition of Listed is focused on RPAC, the REALTORS® Political

Action Committee. When I think about RPAC, my first thoughts are not about campaign contributions,

or candidate interviews, or calls to action. All those things are important, but at its most fundamental

level, RPAC is all about commitment—your commitment to our PAC and to our sustained engagement

in the political and governing processes at the local, state, and national levels.

When I think about the commitment of RAR members to Richmond RPAC over the past two years

particularly, I am both proud and grateful. I’m proud of the fact that despite challenging economic

times for us all, the overwhelming majority of our RPAC donors have continued to contribute. In 2009,

RAR members donated $76,829 to RPAC; an amount for which both leadership and especially your

Governmental Affairs staff are deeply appreciative.

The fact that many, many of you have continued to support RPAC during these leaner times sends

a clear signal that you consider political involvement a priority for your Association. In turn, I want to

assure you that your Association is deeply and daily committed to providing you with the most

effective representation possible. The feature article, found on page 12, outlines a number of recent

RPAC engendered success stories.

But the real success of our public policy efforts is far deeper and broader than the outcome on any

one legislative measure or regulatory proposal. In the Richmond metropolitan area, RAR is viewed as

an essential participant in land use, planning, community development, and affordable housing

conversations. While our staff no doubt calls on politicians, it is often the case that the elected officials

are the ones picking up the phone and picking the brains of our staff. That’s a real success story.

Establishing relationships, garnering respect, earning a seat at the table for policy discussions—all

of this takes tremendous time, energy, and effort over very long periods of time. Historically, this has

been our commitment at RAR, and it will continue to be so in the future. Why? Because each and

every time we change proposed regulations and make them less costly and burdensome, or we

provide input on critical land use conversations, or we win passage of much needed legislation—when

we do all of these things, we honor your commitment to our efforts and to our PAC.

Satellite Office Closing

Due to a decline in the amount of foot

traffic at RAR's Midlothian Turnpike

location, the Board of Directors has

decided that it is no longer cost-effective

to staff and manage a second RAR facility.

As a result, RAR South will be closing its

doors on May 27th. We look forward to

continuing to serve all of our members

at our 8975 Three Chopt office.

RAR Golf Tournament Rescheduled

New Date is October 14

The RAR golf tournament, which was

previously scheduled for May 20, has been

moved to Thursday, October 14, 2010.

Please stay tuned for more details as the

event date draws nearer.

Ask the MLS Expert Sessions will take

place on June 18 and July 16, 2010 from

11:30 am to 1:00 pm.

These sessions are free to attend. Special "lunch and learn" sessions will

be held on June 18 and July 16. During

these sessions, MLS staff will be available

to answer questions and provide helpful

information about Tempo and other

aspects of MLS use. *Lunches will not

be provided. Please bring a bagged lunch.

CVR MLS RULES AND REGULATIONS?

MLS CAUTIONARY TALES

Governing Rule or Regulation: Compensation Notice to Membership dated Monday, August 24, 2009 and CVR MLS Rules & Regulations, Section 12.3.3 Notice to Membership; Monday, August 24, 2009: Recently, we have noticed an increase in compensation references in the Agent Only Comments section of CVR MLS listings.Some of these references suggest that the stated compensation is subject to lender approval and may be subject to changeand/or compensation will be split 50/50 between the selling and listing agents. Offers of compensation made by listingbrokers through the MLS system are UNCONDITIONAL and must be stated as either a percentage of gross selling price ora definite dollar amount. References to compensation in Agent Only Comments are informational only and do not trump oralter the unconditional offer of compensation stated in the compensation field(s). In cases where Agent Only Comments areinconsistent with stated percentage or dollar amount in the compensation field(s), CVR MLS policy is that the information inthe compensation field will control. To avoid notices of violation and fines, agents should remove any such comments fromtheir MLS listing content.

12.3.3 - Remarks FieldOnly information that is descriptive and relevant to an accurate portrayal of the property being marketed may be included inthe general Remarks field. Information considered specific to the agent/office contact, or self-advertising and promotional isprohibited. Specific information prohibited in the general remarks field includes, but is not limited to, agent/office name,agent/office phone number, cell phone numbers, e-mail address, web site address, URL, or any HTML links of any kind thatdirectly or indirectly link to a company or agent advertising, or any other information of this nature. Information specific tothe office or agent may be entered into the Agent Only Remarks field. (Violation of this rule is subject to a $250.00 fine asoutlined in Section 19.4)

Explanation: There may be no references to compensation in Agent Only Comments

Violations: Over the past month 35 warning letters have been sent out to our members who have violated this rule. A fine is incurred forviolations not corrected within the time frame specified in the warning letter. An agent receiving more than three warning lettersin a thirty day time period will automatically be fined $1,000 per the rules and regulations.

An important aspect of providing MLS services is to help ensure the quality of the listing data in the system. The Tempo system is checked dailylooking for listings that are in violation of the CVR MLS Rules & Regulations. Anonymous faxes/emails from members of the association reportingviolations on listings are also an extremely valuable source of quality control information. Anonymous tips can also be sent by a member from the“Click here to contact the MLS with questions or concerns regarding this listing” feature that has been added to the bottom of Agent Reports. Should you have questions about what is correct procedure, please contact the MLS Department at 804.422.5004.

hen Steve Harney talks, REALTORS® listen. They listennot only because he is a larger-than-life New Yorkerwho immediately draws his audience in, with a magnetic

presence, down-to-earth vernacular and a great sense of humor.They listen because he is a leading expert in negotiation andleadership training for residential real estate professionals. He hashad a history of success over the last 20 years, which began as atop performing residential REALTOR® before he steadily built hisown 500 agent real estate firm. The message he brought tothe members of the Richmond Association of REALTORS® onApril 15, 2010, is sure to have a lasting impression.

“Don’t sell your buyers and sellers, educate them!” he said.“Take them with you through the process.”

When speaking with buyers, Steve suggests, “Talk priceversus cost.” The price of the property is what the ‘sticker’ says. “Cost,” he says “is what that property is going to cost the buyerover the life of the loan.”

He went on to say that agents need to show their buyers andsellers that now is still the best time to buy or sell a property. Heexplained that as interest rates begin to climb again, buyers

waiting for prices to fall are in essence eating into any savingsthey may have experienced had they purchased while rateswere still low. “Historically, interest rates go up quickly anddramatically,” Steve exclaimed as he revealed the pattern of ratesover the period of 2003-2008.

As an example of what a buyer sitting on the sidelines has tolose, he displayed a slide (below) that showed a property thatdropped from $400,000 down to $360,000. He advised that forevery 1% increase in interest rates there would need to be another10% decrease in list price to maintain any savings. The chartreveals that as prices level off and interest rates continue to tickup, the property ends up costing the buyer more over the life ofthe loan.

“Finally,” Steve advised, “project forward for your clients.Don’t only look backwards. Don’t plan just on last year’s solds. “Good agents,” he suggested, “know how to deliver good news.Great agents know how to deliver tough news, if that is what theysee coming in the future.” L

Internet technology is known for changing very rapidly andupgrades to Internet browsers are no exception. Recently, therehas been much speculation about the continued support ofInternet Explorer 6 or IE6. Search giant Google announced thatit would drop IE6 from the list of supported browsers for GoogleDocs and its Google Sites hosting services starting on Monday,March 1, 2010. Then, video site YouTube named March 13 as itsend-of-support date for IE6. Microsoft themselves, however,despite admitting to some of its many flaws, has stated that theywill support IE6 until Windows XP SP3 support is removed,meaning IE6 will be officially supported until 2014.

Although Microsoft Internet Explorer is still included on theminimum requirements list for the Tempo™ MLS system, at somepoint in the future members may want to consider a move up to

a newer version ofthe browser.

To determinewhich version ofInternet Explorer iscurrently running onyour system, openthe browser on yourPC and click onHelp from the topmenu and then clickon About InternetExplorer. Holdingdown the Alt keyand typing in the let-ter H will display the version as well. If operating with version7.0 or version 8.0, you are in good shape. If you have version 6,it may be time to start thinking about an upgrade.

Licensed users of Microsoft Windows operating systems canvisit www.microsoft.com to download and install MicrosoftInternet Explorer version 8. It is free, but may require the assis-tance of someone knowledgeable in browser downloads or evenan IT professional.

compensation fields available in Tempo,

Other Compensation and Buyer Agent

Compensation. Only the type that is

being offered should be used. If only

offering Buyer Agent Compensation and

not offering Other Compensation leave

the first field blank. Scroll down to

enter compensation information in

Buyer Agent Compensation field and the

Other Compensation field will no longer

be required.

Entering List Price: When entering List Price

use all of the zeros in the price, but do not

use any decimals. Unlike standard searches

in Tempo™ where the box labeled “in 000’s”

can be used and the last three zeros in the

list price can be absent, when adding a

listing the full list price in whole dollar

amounts must be entered.

Adding Images and Attachments: Images and

attachments cannot be uploaded to an incom-

plete listing. Once the listing input form has

been completed and the green Submit button

has been clicked, select Inventory Watch on

the Tempo™ homepage. Click on the link for

Active Listings and point to the iBubble. Click

on the link labeled Edit, and the link to upload

images and attachments will be visible on the

left side of the screen.

I worked at Thalhimers for 13 yearsprior to starting my own companies, so anything related tothat strikes a chord of nostalgia for me: 7-layer chocolate cake,Snowbear, the Thanksgiving Parade. Having a storefront inCarytown for 12 years also means I love the WatermelonFestival. Oh, and you’ll find us with the dogs at the EasterParade each year, too.

Favorite Vacation Spot Caribbean Islands, skiing out West, hiking the Blue Ridge andin Montana, visiting Canada and Europe. We were just talkingabout going to Iceland when the volcano erupted!

Hobbies/Activities outside the officeI love hiking, walking, canoeing/kayaking, skiing and tennis. Ilove doing anything outdoors. I take a 30-minute walk ANDa 30-minute reading siesta out in my hammock every day.

Below are just a few examples of how RPAC defends againstcostly proposals, and at the same time promotes initiativesdesigned to help your business grow and prosper.

RPAC Protects Your Business and Your Bottom Line

• Miss Utility and Real Estate Signs - During the 2010 GeneralAssembly session, REALTOR® lobbyists won passage of legislationclarifying that placing a sign with metal, plastic, or wooden polesin the ground by hand or by foot, without the use of tools or equip-ment, does not require a call to Miss Utility before installation.Eliminating the need to contact Miss Utility enables REALTORS® toinstall signs immediately, rather than waiting three to four businessdays to have the utility lines marked.

• Interpleader Legislation - In the event of an escrow disputeor foreclosure, brokers will be able (as of July 1) to file aninterpleader form in General District Court. Filing an interpleaderform will take less time, cost less money, and allow a judge todetermine the appropriate dispersal of escrow funds.

• Stormwater Regulations - REALTORS® supported legislation to

delay implementation of recently adopted regulations controllingpost-development storm water. The regulations are now delayeduntil December 1, 2011; a delay that may enable positive changesto be made in the regulations. As currently proposed, the regulationswill add approximately $5,000 to the cost of a new home.

• Cash Proffers - RAR Governmental Affairs successfully divertedan attempt to pursue a cash proffer system in the City ofRichmond. Cash proffers are a one time, per-home fee paid bythe builder and then passed on to the home buyer. Cash profferscan run as high as $18,000 in some jurisdictions in the area andclearly diminish the supply of affordable housing.

• Partial Tax Exemptions for Real Property - Richmond RPACsupported the adoption of a Henrico County ordinance that pro-vides a tax break to homeowners who rehabilitate and renovateolder properties, thus improving the overall quality of housingstock in the county.

• Homebuyer Tax Credits - RAR, VAR, and NAR worked hard tosecure the expansion and extension of homebuyer tax credits inan effort to stimulate the housing market.

dwin H. Friedman wrote, “Leadership can be thought ofas a capacity to define oneself to others in a way thatclarifies and expands a vision of the future.” The

Richmond Association of REALTORS® position of respect andinfluence in Central Virginia is due in large part to the quality anddedication of its volunteer leaders. Recognizing the importance ofleadership excellence, RAR launched the LeadershipDevelopment Academy in October of 2009.

The Leadership Development Academy is a 10-month pro-gram designed to develop visionary, service-oriented REALTOR®

members for professional, civic and community leadership roles.The program exposes a diverse group of participants to a varietyof topics through one-day seminars, site visits and experientiallearning sessions. Working with a professional leadership coach,participants identify and develop their personal and professionalleadership styles and communications skills. The program offers acomprehensive overview of the significance of community andcivic involvement as well as insight into the REALTOR® organiza-tion and governance.

The goals of the Leadership Development Academy are to:

• Identify strong, dynamic leaders from among our membership.• Develop and promote an appreciation for the relevance,function and value of RAR and CVR MLS.• Cultivate a pool of REALTOR® members to serve as future TaskForce/Committee Chairs and Board Members.

• Enhance the knowledge and skills of participants and providemember firms with potentially qualified prospects for leadershiproles within their organizations.• Infuse our membership and community with individuals whowill serve as Association advocates and ambassadors.

pril 22, 2010 a new Environmental ProtectionAgency (EPA) regulation, the Renovation, Repair &Painting (RR&P) rule, went into effect requiringthat contractors performing renovation, repair and

painting projects that disturb lead-based paint in homes, child-carefacilities, and schools must be certified and follow specific workpractices to prevent lead contamination. This rule applies tocommon activities like sanding, cutting, and demolition that cancreate hazardous lead dust and chips and cause them to beexpelled into the air, which can be harmful to adults and children.

The health effects of lead exposure are extremely dangerousto children under the age of six and to pregnant women. Leadexposure in children and fetuses can cause permanent damage tothe brain and central nervous system and lead to the developmentof learning disabilities and behavioral problems. Exposure to leadas an adult can lead to high blood pressure, kidney or brain damageand cancer. Paint is the primary source of lead contamination inhousing. Lead was originally added to paint to enhance its colorand durability but was found to be harmful and was banned bythe Consumer Product Safety Commission (CPSC) in 1978. TheRR&P rule therefore, only applies to homes and facilities builtprior to 1978.

To become certified, contractors and renovators are requiredto take eight hours of training, of which two hours must be hands-ontraining. Certification training covers lead-based paint testing,work-space containment, safe work practices, clean up procedures,proper record keeping and how to train non-certified workers

on-the-job. Individual certification is good for five years. The costof training is set by individual training providers, so it can varyfrom provider to provider. Additionally, renovation firms mustalso be certified by the EPA. To become certified, firms need tosend in a two-page application to EPA and pay a fee of $300.Firm certification is also good for five years.

The EPA estimates that the cost to comply with these newrequirements will range from $8 to $167 per job, but may costmore for outdoor projects. Contractors contend that the cost will befar greater than these estimates. Firms found to be non-compliantwith this rule may be liable for civil penalties up to $32,500 foreach violation identified.

In addition to contractors and renovators, property ownerswho perform work on pre-1978 rental housing or space rented bychild-care facilities must also be certified and follow the lead-safework practices under the RR&P rule. Before beginning work,contractors and property owners must provide tenants with a copyof the EPA’s lead hazard information pamphlet, Renovate Right:Important Lead Hazard Information for Families, Child CareProviders, and Schools and document their compliance with thisrequirement using the EPA’s pre-renovation disclosure form. Bothitems can be found on the EPA’s website, www.EPA.gov.

Homeowners are an exception to the RR&P rule and canperform renovation, repair or painting work on their own homeswithout becoming certified as long as they are the occupants. Ifthey rent out their property to others, they must comply with therule and hire a certified renovator to perform the work or becomecertified themselves.

Understanding the EPA’s new Renovation, Repair &Painting (RR&P) Rule

Other exclusions to the RR&P rule include emergencyrenovations that follow the EPA’s cleanup guidelines, renovationactivities in pre-1978 homes that do not contain lead-based paintcomponents and minor maintenance or repair activities whereless than six square feet of lead-based paint is disturbed in theinterior or where less than twenty square feet of lead-based paintis disturbed on the exterior. Window replacement is not considereda minor maintenance or repair job and would be subject to theRR&P rule.

Currently, homeowners may “Opt-Out” of the RR&P workpractice requirements, if all of the following are true: • The owner resides in the house • No child under 6 years old resides in the house and the

house is not a child-occupied facility• No pregnant woman resides in the house • No child-occupied facility exists on the property and, • The owner signs a written acknowledgement that a certified firmis not required to use the work practices found in the RR&P ruleon the project.

By opting-out, the homeowner essentially relieves thecontractor and the contractor’s firm from being certified to performthe work, which waives the homeowner’s rights to later sue thecontractor for any resulting lead exposure if unsafe or negligentwork practices are employed. The EPA is currently under a courtorder to delete this opt-out provision but has not done so to date.

As a REALTOR®, being aware of this new rule and its exceptionsbecomes extremely important when hiring or recommendingcontractors for renovation projects for clients. Property managersshould be especially cautious when advising homeowners toperform repairs themselves or offering to perform repairs forthem. If receiving compensation for a role in hiring or managingrenovation, repair or painting work, a firm must be certifiedunder the rule. When in doubt, always seek professionaladvice. Remember, it is a REALTOR’S® duty, under the REALTOR®

Code of Ethics, to protect the client by not acting outside of aREALTOR’S® area of expertise.
