APPLICABLE TO USE OF SERVICE FOR

Single-phase residential purposes, in an individual residence and in an individual flat or

individual apartment in a multiple family dwelling; residential purposes in a rooming house wherenot more than four rooms are available for rent; single-phase farm service when supplied throughthe farm residence meter; use exclusively in connection with religious purposes by corporations or

associations organized and conducted in good faith for religious purposes, and including the

operation by such corporation or association of a school, notwithstanding that secular subjects aretaught at such school; for single-phase service exclusively in connection with a community

residence as defined in subdivision 28, 28A or 28B of Section 1.03 of the Mental Hygiene Law,provided that such residence is operated by a not-for-profit corporation and if supervisory staff ison site on a twenty-four hour per day basis that the residence provides living accommodations for

fourteen or fewer residents; and use for any post or hall owned or leased by a not-for-profitorganization that is a veterans organization. Available from MED facilities of adequate capacityadjacent to the premises and at appropriate character.

PURCHASED POWER ADJUSTMENT (PPA)

All kilowatt-hours sold under this service classification shall be subject to Purchased PowerAdjustment Charges in accordance with Section XII of the Massena Electric Department Tariff

and consistent with Rule IX of the NYMPA generic tariff.

TERMS OF PAYMENT

All bills are due when rendered. Full payment must be received on or before the date shown on

the bill to avoid a late payment charge of one and one-half percent (1-1/2%) pursuant to NYMPA

generic tariff Rule VIII (D).

TERM

Customer agrees to take service on a monthly basis, however, Customer may terminate

service after three days' written notice to the MED.

SPECIAL PROVISIONS

In buildings, apartments or flats primarily intended for residential purposes where not

more than two rooms, or not more than 50% of the area of the building occupied exclusively bythe resident are used for professional or commercial purposes, this classification will apply to

both uses. Otherwise, the appropriate Commercial Rate will apply to such professional or

commercial use, including residence use if not separately metered.

CONTROLLED WATER HEATING CREDIT

A credit of $2.00 per billing period shall apply where the Department has installed load controlequipment to curtail use of electricity for hot water heating (other than space heating).

Curtailments will be at the Department's option but generally shall not exceed four hours per dayduring those days the Department wishes to limit system peak demands. To qualify for this credit,the load control equipment must be connected to all of customer's domestic hot water supply

(other than those used solely for space heating).

In addition to the above credit, customers will receive an additional introductory credit of $25

(limited to one introductory credit per customer location).

The minimum connection period for this service is one year.

Continuous. Single or three-phase alternating current approximately 60 hertz, at one standardsecondary voltage approximately 120 volt 2 wire, 120/240 volt 3 wire, 120/208 volt (Network) 3wire, 120/208 volt 4 wire, or 277/480 volt 4 wire. The MED will indicate, upon application, thetype or types of service available and appropriate to the Customer's requirements.

DETERMINATION OF DEMAND

Whenever the energy consumption exceeds 2,000 kilowatt hours per month for three

consecutive months then a demand meter shall be installed. When the demand meter indicates a

demand of 7 kW or greater for three consecutive months then the billing will be rendered under

Service Classification No. 3 or 4 as appropriate as determined by MED. A demand meter, once

installed, shall not be removed until after the energy consumption has been less than 2,000

kilowatt hours per month for 12 consecutive months, which requirement may not be avoided by

temporarily terminating service.

TERMS OF PAYMENT

All bills are due when rendered. Full payment must be received on or before the date shown

on the bill to avoid a late payment charge of one and one-half percent (1-1/2%) pursuant to

greater for three consecutive months then the billing will be rendered under Service Classification

No. 4 as determined by MED.

indicate voltage available and appropriate to the Customer's requirements. Characteristics depend

upon available circuits.

Classification superseded hereby, and thereafter until canceled by Customer upon 90 days' priorwritten notice to the MED. Cancellation by Customer followed by resumption of service at the

same location within one year shall not modify in any way the determination of Demand.

When the amount of investment by the MED or other conditions of the service are such as towarrant, the MED may, with the permission of the Public Service Commission, require the initial

term be longer than one year.


The Demand shall be the highest average kilowatts measured in a 15-minute intervalduring the month, but not less than three quarters of the highest such Demand occurring

during any of the preceding 11 months. When the Demand is less than 24 kW for 12

consecutive months, which requirement may not be avoided by temporarily terminatingservice, then the billing will be rendered under Service Classification No. 2 or 3 as

appropriate as determined by MED.

b. The Reactive Demand shall be the highest average kilovolt-amperes of lagging reactivedemand measured in a 15-minute interval during the month less one-third of the highest

kilowatt demand measured during the month. The Reactive Demand shall be determinedwhen Customer's kilowatt demand has exceeded 500 kilowatts for three consecutivemonths or when the connected load of Customer indicates that the kilowatt demand may

normally exceed 500 kilowatts. Reactive Demand determination shall continue until thekilowatt demand has been less than 500 kilowatts for 12 consecutive months.

HIGH VOLTAGE CREDIT

A high voltage credit will be applicable when a Customer receives a service voltage higher

than 2,200 volts. When a Customer provides the high voltage equipment to accept a servicevoltage higher than 2,200 volts, then the service voltage will be the incoming line voltage. Whenthe MED provides all or part of the high voltage equipment, the service voltage will be the

secondary voltage of the transformer.

For service at voltages in excess of 2,200 volts, the Demand Charge will be modified as

follows:

1. Service voltage between 2,200 and 15,000 volts, the Demand Charge will be reduced byforth-six cents ($0.46) per kW of demand billed above the first 25 kW.

2. Service voltage above 15,000 volts, the Demand Charge will be reduced by ninety-fourcents ($0.94) per kW of demand billed above the first 25 kW.

LOAD CONTROL SERVICE

A credit of $4.50 per kW of billing demand curtailed shall apply where the Department has

installed load control equipment to curtail the customer's load. Curtailments will be at theDepartment's option but generally shall not exceed four hours per day during those days the

Department wishes to limit system peak demand.

The minimum connection period for this service is one year. Should the customer decide todiscontinue this service within the first year, the customer shall be required to return all monthly

credits to the Department.

For all purposes not otherwise specifically provided for in other Service Classifications in thisschedule when Active Demand is 500 kW or greater, and for which an allocation of power hasbeen approved by NYPA under NYPA's Municipal Industrial Development Program. Available at

115,000 volts.

ALLOCATION AGREEMENT

Prior to the commencement of service hereunder, the Customer and MED shall execute anAgreement governing the terms and conditions associated with the NYPA allocation.

MONTHLY RATE

Customer shall pay to MED the cost of Municipal Industrial Development (MID) Power, plus

a Customer Charge, as set forth below.

MID POWER: Monthly MID Cost per NYPA Bill to MED

CUSTOMER CHARGE:

Notwithstanding the rates set forth in the Allocation Agreement, Customer shall pay MED amonthly customer charge of $500.

SPECIAL PROVISIONS

a. The MED will furnish, install, own, operate and maintain an enclosed, photoelectrically

controlled Mercury or High Pressure Sodium luminaire complete with at least 30-inch pipe

bracket, ballast and from 150 Watt to 1,000 Watt multiple lamp.

b. The lighting unit will be installed only on private property owned or leased by the

Customer. The Customer will furnish the necessary pole or other support, except as

hereinafter provided, and the necessary wiring to connect the unit on the line side of the

Customer's meter. The MED reserves the right to require a mounting height which will

provide proper light distribution from the unit. Where a MED owned pole is appropriately

located on premises owned or leased by the Customer, the MED may waive the

requirement that the support by furnished by the Customer, and it may install the unit on

the MED-owned pole.

c. Upon request of the Customer, the MED will change the location of the lighting unit,

providing a proper support is furnished and the Customer agrees to pay the MED for the

cost incurred in making such change.

d. Lighting service will be provided every night from dusk to dawn aggregating

approximately 4,170 hours per year, unless prevented by accidents or other causes beyond

the control of the MED.

e. The Customer shall notify the MED whenever the lamp shall become extinguished or outof service for any reason and the MED shall replace the lamp and/or make the necessary

repairs during normal working hours.

Whenever, at customer's request, MED relocates equipment of facilities to suit theconvenience of the customer, the customer shall reimburse MED the cost incurred, plus acharge of 30% on material and 50% on labor to cover indirect overhead costs.

C. Special Installation Work

The applicant shall pay the cost of any special installation to meet their particularrequirements for service at other than standard voltage or frequency, and for the supply ofcloser voltage regulation than is required by standard practice.

D. Contract or Jobbing Work

Construction jobbing or contract work on customers premises such as wiring, installation ofappliances or motors, or such services, the costs of which are not normally included in theOperating Property or Maintenance Accounts of MED, performed by MED will be charged foron the basis of current labor, transportation and material costs plus a charge of 30% on materialand 50% on labor to cover indirect overhead costs.

E. Outside Contractors

Whenever it becomes necessary for MED to use outside contractors or where the need of SpecialServices (not normally provided for by MED personnel) are required for the convenience of thecustomer, MED will bill the customer actual costs plus a 5% administration charge to coverindirect costs.

F. Rentals1. Use of pole for private equipment to serve public, per

H. Dishonored Payment

Should MED receive a negotiable instrument from a customer or applicant as payment of anybill, charge or deposit due, and such instrument is subsequently dishonored or is uncollectible forany reason, the Company may charge back to the customer or applicant any credits given byvirtue of the receipt of such negotiable instrument and treat the account as if no such paymentwas ever received.

In addition, the Company shall charge the applicant or customer a $15.00 handling charge onsuch instrument.

SERVICE CLASSIFICATION NO. 8

Individual Service Agreements

APPLICABLE TO THE USE OF SERVICE FOR:

Electric service under this tariff is for non-residential customers who would normally be served

under Service Classification No. 4 and meet all of the criteria contained in this rider. Utilizing Individual

Service Agreements signed under this tariff, MED proposes to provide incentives and thus promote the

location of new business ventures within MEDs service territory, as well as promote the expansion of

current non-residential customers.

ELIGIBILITY:

Eligible customers for this service classification are customers who develop or construct new

facilities, extensively refurbish an existing or retired facility or expand production at an existing facilityand the new or added demand is at least 100 kW. To be eligible to participate for this service, customers

shall also meet and continue to satisfy NYPAs requirements listed in the Municipal and Rural

Cooperative Industrial Economic Development Program Guidelines as they may be modified from time to

time, or requirements for other NYPA Economic Development power supply programs as they may be

modified from time to time, and shall work with MED to receive an allocation of additional demand and

energy from NYPA. It shall be a condition precedent for service pursuant to this classification that MED

receive an additional allocation of energy and demand from NYPA. Should any such additional

allocation of power be changed, lessened or modified, MED reserves the right to alter the ISA or transfer

the customer to S.C. No. 4 service, or other rate class available at that time.

In addition, the eligible customer must supply documentation of a viable alternative, competitive

energy supplier outside of MEDs service territory or show that its product offerings would be lesscompetitive within their relevant geographic market (local, national, or international) but for the existence

of the rates offered under this service classification.

CONTRACT TERM:

The term of any initial offering of an Individual Service Agreement (ISA) shall be at least

twelve months and shall be limited to a term of five years unless a longer term is approved by the New

York State Public Service Commission. If a customer desires an ISA with a term in excess of five years

and MED is willing to agree to this arrangement, MED will request authorization from the New York

State Public Service Commission to enter into that arrangement. If the Commission grants MED the

authority it requests on terms acceptable to them, MED will then enter into the agreement.

FILING REQUIREMENTS:

MED will file information concerning each Individual Service Agreement with the Public Service

Commission within 30 days of executing the agreement. Quarterly, MED will file reports to the Public

Service Commission detailing the number of Individual Service Agreements, capacity associated with the

Individual Service Agreements and revenues collected from Individual Service Agreements.

FINANCIAL ARRANGEMENTS

At the sole discretion of the MED, the MED may waive certain costs due to it, in whole or in part,

or make other necessary financial arrangements with customers served under this Rider, so long as the

MED believes that the revenue derived from the applicant will provide sufficient revenue over and above

the incremental cost incurred by the MED. These costs include, but are not limited to the following:

(A) Special installation to meet their particular requirements for service at other thanstandard voltage or frequency and for the supply of closer voltage regulation than is

required by standard practice. (See Section C, Tariff Leaf No.: 27)

(B) Surety bonds

TERM

The term of each Individual Service Agreement will not exceed five years.

All customers receiving service under this service classification will not be charged the PPAC (purchase

power adjustment).

For all contracts entered under this service classification, MED will request trade secret protection so

rates and terms are not available to the general public.

PURCHASED POWER ADJUSTMENT CHARGE (PPAC)

APPLICABILITYAll customers receiving service under any of the Massena Electric Department serviceclassifications are subject to purchased power adjustment charges, except those customersreceiving service under Service Classification No. 8 (Individual Service Agreements).

ADJUSTMENT CHARGEThe PPAC shall be the amount added to each kilowatt-hour of each rate schedule to reflect andrecover all purchased power and transmission costs billed to the Massena Electric Department

from all service providers.

CALCULATION OF THE PURCHASED POWER ADJUSTMENT CHARGEThe PPAC shall equal the total cost of all power and transmission costs billed to the MassenaElectric Department in each month divided by the total kWh purchases in that month less thebase cost of purchased power measured at system input level adjusted by a loss factor (Factor ofAdjustment) of 1.06. The resultant cost per kilowatt-hour shall be rounded to the nearest$0.000001/kilowatt-hour and applied as a charge or credit to all kilowatt-hours billed in thefollowing month.

For the first year after the tariff leaf effective date the monthly bill increases will be capped at anamount not to exceed 10% of a bill calculated under the previous method, a 12-month rollingaverage, during the months of January, February, March, April and May 2009. The amountexceeding the 10% cap for the months listed will be aggregated and amortized, in equal amounts,over the months of July, August, September, October, November and December. The 10% willbe used for the months listed to minimize the impact the change in calculation will have oncustomers during the winter months. This cap will only be in effect during the months listed,the PPAC will be calculated using the standard formula in each subsequent year. The 10% capwas based on the usage of an average customer during the winter period (1,400 kWh).

BASE COST OF POWERThe base cost of power for computation of the PPAC shall be $0.016403/kilowatt-hour asmeasured at the system input level. The base cost of power measured at the sales level shall be$0.017387/kilowatt- hour.

TEMPORARY STATE ASSESSMENT ADJUSTMENT

Pursuant to Section 18-a(6) of the Public Service Law (PSL), and Case 09-M-0311 Implementationof Chapter 59 of the Laws of 2009 Establishing a Temporary Annual Assessment Pursuant to PublicService Law Section 18-a(6) (the Order), the Town of Massena Electric Department (MassenaElectric) is authorized to implement a surcharge to recover the Temporary State Energy and UtilityService Conservation Assessment (Temporary State Assessment).

The Temporary State Assessment, which is applicable to municipal electric corporations, requiresan annual payment for the next five years equal to 2% of gross operating revenues from intrastateutility operations, exclusive of the first $500,000, less the amounts assessed for Department ofPublic Service costs and expenses (General Assessment) that are authorized in the annual State

Budget.

Recovery of the revenues required for payment of the Combined General and Temporary StateAssessment less the amount of the General Assessment which is currently included in Base Rateswill occur over the 5 year period July 1, 2009 through June 30, 2014. Massena Electric will utilizethe surcharge method of recovery. The rates and charges for service under all ServiceClassifications including fuel adjustment charges will have an additional surcharge. The surchargewill be calculated as a percentage of each bill rendered, such percentage will be uniform for allService Classifications. This alleviates any disparate treatment between Service Classifications. Forthe year July 1, 2010 through June 30, 2011 the rate charged for recovery will be 1.90%. This ratewas developed using the Temporary State Assessment Adjustment and the projected sales for the

period July 1, 2010 through June 30, 2011. No carrying charges will be imputed at this time asMassena Electric has the funds necessary to cover the Temporary State Assessment and will not beseeking additional funding at this time. Reconciliation of the amounts collected through thesurcharge will be performed annually. In each subsequent year, a new Temporary State Assessmentsurcharge will be calculated, due to changes in projected intrastate gross operating revenues.
