The report herewith submitted is for the calendar year 1952 andis the Seventy-sixth Annual report upon conditions of the Coal andClay mines within the State.
The reports from the various mining operators throughout theState show the tonnage to be as follows:

COAL PRODUCTION
ALLEGANY COUNTY: During the calendar year 1952, AlleganyCounty mines employed 280 miners, 30 drivers (including motor-men, brakemen, etc.) 18 inside laborers, and 59 outside employees,making a total of 387 men. The production of coal for 1952 was226,267.00 net tons. This shows a production of 808 net tons perminer employed during this period.
GARRETT COUNTY: During the calendar year 1952, GarrettCounty mines employed 223 miners, 34 drivers (including motor-men, brakemen, etc.), 26 inside laborers, and 102 outside employees,making a total of 385 men. The production of coal for 1952 was343,599.00 net tons. This shows a production of 1,540 net tonsper miner employed during this period.
FIRE CLAY PRODUCTIONALLEGANY COUNTY: During the calendar year 1952, the fire clay
mines in Allegany County employed 36 miners, 8 drivers, 12 insidelaborers, and 19 outside employees, making a total of 75 men. Theproduction of fire clay during 1952 was 67,528.02 net tons, andshows a production of 1,875 net tons per miner.
GARRETT COUNTY: During the calendar year 1952, there were20,336.00 net tons of fire clay produced in Garrett County, allstripped, employing 19 outside employees. This shows a produc-tion of 1,070 net tons per employee. These figures are for a threemonth period only, as the only clay operation in Garrett Countyceased operating at the end of March 1952.

FATALITIES
During the year 1952, one (1) fatal accident occurred in thecoal mines of Allegany County, Maryland.
An electrical accident that occurred at 10 :00 P. M., on Wednes-day, January 9, 1952, at No. 10 mine, Consolidated Fuel Company,Inc., Eckhart, Maryland, resulted iii instant death to Thomas E.Shimer, a laborer. Mr. Shimer was 34 years of age, and had 10years' mining experience, all of which was at his last occupation.He is survived by his widow, and three (3) children under 18years of age.
Mr. Shimer was helping three other men set up a conveyor.Mr. Shimer had been placing extra sections of the conveyor chainalong the conveyor, and for some unknown reason he came out ofthe place along the clearance side of the conveyor. Several minuteslater the other workmen heard him cry out, and when they 'ookedaround he was on the narrow side of the entry, between the loco-motive and a mine post, direcfly under the unguarded energizedtrolley wire, with his right arm against the side of the locomotive.
Apparently Mr. Shimer had attempted to return to his workby way of the "tight" side of the entry and had cantacted theunguarded trolley wire and the locomotive.

RECOMMENDATION—When work is to be done near a powerwire which is less than 63/2 feet above the top of the rail,the wire should be deenergized or shielded properly by aguard. Also, persons walking a'ong haulage headings orworking places should travel only along the clearance side.

DR. JOHN J. RUTLEDGE(1870 - 1952)
A fatal heart attack on September 11, 1952, terminated thelong, varied and distinguished career of John Joseph Rutledge inthe coal mining industry.
John Joseph Rutledge was born March 10, 1870 in North Alton,Illinois.
From 1889 to 1900 Dr. Rutledge was engaged in coal mining.From 1900 to 1909 he was occupied by economic geology and min-ing geology. In 1909 he returned to coal mining in the Federalservice where he remained until 1922, when he resigned to becomeChief Mine Engineer and Director of the newly created MarylandBureau of Mines.
Dr. Rutledge was Director of the Maryland Bureau of Minesuntil June, 1949, when he was made Chief Consultant, which posi-tion he held at the time of his death.
The Maryland Bureau of Mines was concerned primarily withsafety and welfare of the mines. Dr. Rutledge established nightmining classes to prepare Maryland miners for better positions incoal mining and also other industries. He established the StateMine Examining Board, of which he was Chairman, to conductexaminations and award certificates as Mine Foreman, AssistantMine Foreman, and Fire Boss.
Dr. Rutledge was always concerned about the duty of the Bureauto promote the prosperity of the Maryland coal industry. Theslogan "Maryland Coal for Maryland People," was publicized byhim throughout the State.
Many times he witnessed the tragedy of coal mine accidents,and many times he led rescue crews into mines to rescue the in-jured and carry out the dead. He was always endeavoring tobetter the working and living conditions of the men engaged inthe industry that his forebearers and he himself had made theirlife work.
Dr. Rutledge always found and gave time in the service of otheragencies in addition to his official duties. From 1938 to 1939 hewas President of the Mine Inspectors Institute of America; andfrom 1923 until his death, he served as treasurer for this organi-zation. He was a member of The National Mine Rescue Associa-tion, National Safety Council, Illinois Mining Institute, Mine Res-cue Veterans of the Pittsburgh District, and The West VirginiaCoal Mining Institute. He represented the Mine Inspectors In-stitute of America on the Mining Standardization Correlating Com-mittee of the American Standards Association. He was Chairmanof the Committee of Awards of the Joseph A. Holmes Safety As-sociation. He was also a Fellow of The Geological Society of

America, and a member of the American Institute of Mining andMetallurgical Engineers of the American Mining Congress.
Dr. Rutledge was married to Ella L. Gates of Girard, Illinois,on May 29, 1892. She died on August 22, 1950. They had threechildren, Walton Gates Rutledge, Alma R. Goldberg, and Eno R.\\Telling.
Dr. Rutledge attended the public schools and high school ofAlton, and Shurtleff College in Upper Alton, Illinois. He receivedhis B.S. in Mining Engineering from The University of Illinois,and his Ph.D. in Geology from Johns Hopkins University.

KITZMILLER MINE RESCUE TEAMThe Kitzmjller Mine Rescue Team, 1951 National Champions,
will again compete in the National Mine Rescue Contest to be heldin the Fall of 1953 at Fort Wayne, Indiana.
Although there was not a National Mine Rescue Contest thisyear, the Kitzmiller Team remained active and trained regularlyunder the Supervision of Mr. Harry B. Buckley, District Mine In-spector, and Mr. L. C. Hutson of the University of Maryland.
The Kitzmiller team is composed of Captain Carl Schell, ChesterEvans, Carl Paugh, Mervin Sims, Lee Hartman and RichardSherwood, Jr., who all reside in the vicinity of Kitzmiller, Mary-land.

During the calendar year 1952, fifteen (15) Safety Orders wereissued by the District Mine Inspectors of the Bureau of Mines.

PROSECUTIONSDuring the calendar year 1952, it was necessary to obtain six
Warrants against operators and their employees due to their con-tinued violation of the Maryland Mining Laws.
Four of these Warrants were for using black powder and wereobtained against two operators and employees. They were tried,found guilty and each paid a fine and costs.
Two of these Warrants were obtained against operators forfailing to make the required Monthly Tonnage reports. Eachoperator was fined, but one fine was suspended when the operatoragreed to comply with the law. However, due to his previousvio'ations, the other operator was required to pay a fine and costs.
METHOD OF TRANSPORTING COALThe method of transporting Maryland coal from the mine to
the railroad car has changed considerably during the past few

years. A large number of mines in Maryland are smaller minesand coal is transported from the mines to central loading points,where the coal is cleaned and sized and made ready for shipment.This method has helped the smaller operator a great deal and moreof these central loading tipples are being installed from time totime. During the year 1952 five (5) new loading points of thistype were erected.
LABOR CONDITIONS—i 952
Labor conditions during the year 1952 remained virtually un-changed from 1951. The only suspension of work due to labordifficulties was for a period of four (4) months, from April throughJuly. This suspension of work was in the Clay mines, and did noteffect the coal industry.
Most of the larger operations which suspended work in 1949due to economic conditions in Western Maryland, were still idlein 1952. This meant that the Maryland miners still had to goto the other nearby coal-producing States and to other fields ofemployment. One of these operations in Garrett County did re-sume operations during 1952 on a small scale.
ACTIVITIES OF RODNEY W. SELDERS—FUEL COMBUSTIONADVISOR FOR THE YEAR i952
During the year 1952, Mr. Selders spend a total of 125 days inthe office and laboratory in Westernport, and 25 days in the fieldcollecting coal samples, Germanium samples, advising on coalpreparation, etc. He devoted 56 days to public institutions withinthe State, during which he visited at least once, all State ownedinstitutions that use coal, with the exception of St. Mary's Semi-nary Junior College and Boys Village at Cheltenham.
Some expansion was done to the Coal Laboratory in 1952. Apartition was built separating it from other parts of the office andstorage space. A new Baker-Brunjes Ash Fusion TemperatureFurnace, complete with Pyrometer and accessories, was added atthe cost of approximately $500.00. This is of the latest design,and we believe superior to any similar apparatus now on themarket.
As reported previously, the primary function of the laboratoryis to provide a means by which a check can be made on coal pur-chased for State consumption. Last November a system was ten-tatively worked out whereby all coal purchased could be sampledsystematically, and an average of 35 of these samples have beenrun monthly since that time. However, in a task of this propor-tion we have been handicapped by a number of technical problems,but it is anticipated that this program will be operating smoothlyby October 1, 1953.

It might be wise to point out at this time that in face of theexpansion program now being carried out at most State Institu-ions, with many of them nearly doubled in capacity within thepast few years, the number of tons of coal purchased for Stateuse has ot increased at the same ratio. In fact, the figures havepractically remained static since 1950, at which time the StatePurchasing Department, in cooperation with the Maryland Bureauof Mines inaugurated a two-point program of watching the qualityof coal purchased and conservation of fuel received. In view ofthe rising cost of basic commodities such as coal, this should bean attractive program which amortizes itself in savings of publicfunds alone.
Further evidence of the value of this work can be seen by thesatisfaction of the Institutions in utilizing the fuel. During thewinter of 1950-51 we had 31 actual complaints arising over thequality or performance of coal; in 1951-52 we had seven separatecomplaints, and in 1952-53 we have had only three to date.
During the calendar year 1952, 200 samples were processed inthe laboratory.

The twenty-ninth annual Short Course in Coal Mining was heldat Crellin, Maryland, beginning June 16, 1952 and ending August1, 1952.
Instruction was given in the class room for four weeks, fivenights per week. Two ëlass periods were heM each night for aduration of one hour each.
Instruction was then given in Gas Testing, and Mine Rescue fora period of one week each, the instruction period being five nightsper week, the duration of each class averaging 3.5 hours.
The Course was heM by the University of Mary'and in coopera-tion with the Mary'and Bureau of Mines, The United States Bureauof Mines, The State Board of Education, and the County Boardsof Education of Garrett and Allegany Counties.

As in previous years, the Gas Testing Program was in chargeof the United States Bureau of Mines, in cooperation with theMaryland Bureau of Mines. Practice testing for explosive andnon-respirable gases was given, followed by supervised and re-corded tests for each individual student.
The above tests were made under variable conditions by theuse of the Flame Safety Lamp, in a special testing gallery con-structed for that purpose.

Conclusion
The school year just completed was in many respects similarto the year preceding. Again, it was found difficult in face of theprevailing economic conditions, with the accompanying curtailingof production, to awaken and sustain interest in the program.
In spite of the above, the year was completed with resultsthat compared favorably with those of last year. One of the mostfavorable signs was the increased interest in First Aid and MineRescue training.
As of this date, the future for the forthcoming school yearpromises to be at least as favorable as the one just completed,with some indications that the turning point has been reached,and that some increases may be expected in the ensuing schoolyear.
