RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITYAGREEMENT (“AGREEMENT”): In consideration for being permitted toparticipate in any way in the Sea Gull Century/Metric Century(“ACTIVITY”), an event sponsored by Salisbury University, I, for myself, mypersonal representatives, assigns, heirs and next of kin:

1. ACKNOWLEDGE, agree and represent that I understand the nature ofbicycling activities and that I am qualified to participate in such Activity. Ifurther acknowledge that the Activity will be conducted over public roadsand facilities open to the public during the Activity and upon which thehazards of traveling are to be expected. I further agree and warrant that ifat any time I believe conditions to be unsafe, I will immediately discontinuefurther participation in the Activity.

2. UNDERSTAND that all participants in the Activity are required towear BICYCLING HELMETS, and I agree to wear a bicycle helmet whileriding a bicycle as part of any event connected with the Activity.

3. FULLY UNDERSTAND that (a) BICYCLING ACTIVITIES INVOLVE RISKSand DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENTDISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangersmay be caused by my own actions, or inactions, the actions or inactions ofother participants in the Activity, the condition in which the Activity takesplace, or THE NEGLIGENCE OF THE “RELEASEE” NAMED BELOW; (c) theremay be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either notknown to me or not readily foreseeable at this time; and I FULLY ACCEPTAND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES,COSTS AND DAMAGES I incur as a result of my participation in the Activity.

4. HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE AND AGREE TOINDEMNIFY AND SAVE AND HOLD HARMLESS Salisbury University, itsadministrators, officers, volunteers, staff, agents and employees; otherparticipants; and any other sponsors (including Trek Bicycle Corporation, ParkTools, Sun Rims and the League of American Bicyclists), advertisers and, ifapplicable, owners and leasers of premises on which the Activity takes place(the “RELEASEES” referred to herein) FROM ALL LIABILITY, CLAIMS, LOSSESOR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED INWHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OROTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS.

5. I GIVE Salisbury University UNRESTRICTED PERMISSION to useand/or publish pictures of me for promotional purposes. I hereby waive anyright that I may have to inspect and approve the finished product or copythat may be used in connection with an image that the photographer hastaken of me or the use to which it may be applied. I further releaseSalisbury University from any claims for remuneration associated with anyform of damage, foreseen or unforeseen, associated with the propercommercial or artistic use of images.

6. I understand that my registration information will not be shared orreleased to other businesses for solicitation purposes.

7. There is no rain date; we ride rain or shine. In case of severeweather, Sea Gull Century reserves the right to cancel/alter/modify thetour for safety concerns. In any case, we do not refund tour entry fees ortransfer registrations to another tour year. In the unlikely case a tour iscanceled, you may claim your registration fee as a tax-deductible donation.

All funds raided through the Sea Gull Century tour supports SalisburyUniversity and the local community.

I have read this agreement, fully understand its terms, understandthat I have given up substantial rights by signing it and have signed it freelyand without any inducement or assurance of any nature and intend it to becomplete and unconditional release of all liability to the greatest extentallowed by law and agree that if any portion of this agreement is held to beinvalid that the balance, notwithstanding, shall continue in full force and effect.
