As per tender, consultant shall submit as-built cost after the completion of the project. We presume MRPL will share all the purchase cost with consultant for this. Please confirm.

All the purchase orders & work orders for the project are placed by MRPL, based on the recommendation of the Consultant. Also a copy of all the PO is shared with the Consultant as and when it is placed. Hence the purchase cost is already available with the Consultant to prepare the as-built cost.

108 9 Capitalization of assets

As per tender, consultant shall provide details of capitalization of assets as and when required. We presume MRPL will share all the expenditure details related to this project (Direct + indirect) with the consultant for the above. Please confirm.

All the purchase orders & work orders for the project are placed by MRPL, based on the recommendation of the Consultant. Also a copy of all the PO is shared with the Consultant as and when it is placed. Hence the purchase cost is already available with the Consultant to prepare the as-built cost.

This is a EPCM consultancy tender. BIDDER shall finalize the number of tenders and packages for the project based on the engineering and as per C&P procedure of MRPL LSTK contract is not applicable in this tender.

108 3 Penalty for over estimation

As per tender, in case of over estimation for bulk material beyond 5% and awarded contract value beyond 10% total penalty of 10% of the contract value (5% + 5%) shall be levied on consultant. This is very high.

While the penalty (5%) for over estimation is very high, for awarded total contract value overrun if any is not truly within the control of consultant (e.g. the variation of unit rate). Hence we request to allow us with the following:

• Reduction of the penalty for over estimation as 2.5% in place of 5% specified
