    Nick Sabella has taught his sister to never givein and never give up.

    Danielle Sabella, along with her co-workers atthe BeachHouse Restaurant, is now showing herbrother that she learned the lesson well.

    After everything I have watched him go through,to see him not give up, keep moving forward to justlook at this as a test in life, has changed my lifeand the way I look at everything, Danielle Sabellasaid.

    Nick Sabella, 21, was a star on the Manatee HighSchool baseball team when a tumor the size of anorange was found in his brain.

    He was a senior at Manatee High School when

    he received thefi

    fth annual Tony Saunders CourageAward from the Tampa Bay Rays.The award, presented at Tropicana Field in St.

    Petersburg, is given to a local athlete who best exem-plifies the courage, character, competitive desire andfighting spirit of the former Rays pitcher who twicebroke the humurus bone in his pitching arm but cameback to play.

    Nick Sabella continued to play baseball and cap-tain his team even after doctors discovered the firsttumor.

    Since then, the former Hurricanes infielderhas undergone multiple surgeries for benign braintumors.

    Now he is facing another procedure in the nextyear, as well as mounting healthcare expenses andpiling bills.

    From 4 p.m. to 9 p.m. Dec. 14, the BeachHouseRestaurant, 200 Gulf Drive N., Bradenton Beach, willhost a benefit for Nick Sabella and his family.

    Danielle Sabella has worked for the BeachHousefor more than a year.

    Now the restaurant team has become her extendedfamily and her brothers.

    With the support of restaurant owner Ed Chiles,general manager Rebecca Shannon and others beganorganizing the December benefit.

    I know the Sabella family is a giving familywithin the community, said Shannon. And Istrongly feel that this is our opportunity to give backto this wonderful family.

    The Benefit on the Beach will feature live music,raffles of getaway vacations, sports equipment, res-taurant certificates, music recordings, furnishings, artand photography works, concert tickets and electron-ics.

    We have enough very nice gifts for all to dosome Christmas shopping, Shannon said of the raffleitems. They wont find a better deal.

    The entertainment lineup will include ReggieWilliams, The Prospect, AMI Dub Squad and BootLeg.

    The menu will include barbecue chicken andfish sandwiches, hamburgers, baked beans, coleslaw,chips and beverages for a 21-and-over crowd and theunderage set.

    Admission will be $7 per person.

    Boats at anchor offer a pic-ture-perfect vista of Island life an idyllic time filled withsoft breezes, good companyand the warm glow of a sun-rise or sunset dipping beneath

    the horizon.But also looming on the

    horizon for vessels parkednear the shore is a raft of reg-ulations that could topple themoored ships in local, state orfederal waters.

    The battle between on-the-water boatowners and on-the-land waterfront homeownershas festered for decades. Alltoo often the fight is a case of

    the haves versus the have nots.Youve got some guy whospent a zillion dollars on hisprime waterfront home. Hesgot a mortgage, insurance bills,landscaping expenses and allthe other financial accoutre-

    ments associated with livinghis watery dream.

    And what does he seeone morning upon awaken-ing? Some guy with a boatanchored just off his seawall,

    enjoying his view without allthat financial baggage. Yikes!

    Unfortunately for Joethe Homeowner, the waterswhere his new neighborresides are sometimes murkywhen it comes to who ownswhat. The water is prettymuch public domain. Thebottom under the water where the anchor of Joe theBoater has his vessel moored

    can belong to city, state,federal or some other entity.Sometimes enforcementis possible, sometimes itstroublesome. Invariably, itseems, its time consuming.

    The problem of errant

    boaters taking up residencein nearshore waters is exac-erbated by their numbers. Asingle zillion-dollar sailboatmoored off the shore isntusually a cause for a cry for

    enforcement help. Multiplythat single boat by a score ormore, though, and have thembe less than fine sailing craftcaptained by outstanding sail-ors, and the problem is well, a problem.

    Some boaters are less thanstellar when it comes to thecondition of their vessels, theshape of their anchor lines orrodes, the mandatory rules ofseamanship regarding lightsat night, the placement of theanchorage away from fragilebottom features like seagrassbeds or coral, and the disposalof garbage and waste.

    If the adage of everythingrunning downstream is true,

    then a corollary of all marinedebris ending up on shore alsoseems to be true.

    Government has addressedthe matter of boaters and hom-eowners in a surprisingly gen-

    tile manner as far as the gov-ernment types are concerned.Most jurisdictions limit thetime a boat can spend at anchorto no more than a few days.

    Some waterfront jurisdic-tions have established anchor-ages or mooring fields that areregulated to a variety of levels.Regulation can be as benign assimply setting aside a swathof water and saying go there,and play nice.

    Sometimes the anchorageshave more stringent require-ments, with charges based onlength of vessel and length ofstay. Harbormasters are onhand to patrol the offshorefields, citing those not meetingthe requirements with warn-ings or fines.

    Some areas even welcomethe boaters to specific areasand offset the offshore rent

    with docking space for smallboats, showers, laundry facili-ties, rest rooms and sundries.

    The rent derived from theboaters is used to maintainand upgrade the facilities and,if the revenue is sufficient, canbe used to reduce taxes for Joe

    the Homeowner.

    Case studies

    One of the first establishedmooring fields in Florida, andone of the nicest, is in VeroBeach on the east coast. The

    city is a port of call for yacht-ing snowbirds traversing theEastern Seaboard, and themooring field of 100 or sospaces features establishedanchorages and buoys forboats of all sizes.

    By the way, an anchor-age is simply an officialrestricted area where boat-ers would use their ownground tackle anchorsand rodes to secure theboat in position. A moor-ing field is a controlledarea where boaters tie upto a floating buoy that isattached to the bottom by aheavy weight or some typeof auger system, whichwould have to be providedand maintained, and boat-ers would be ass ignedtheir position by a harbor-master.

    Vero Beach has a nicedeepwater mooring field adja-cent to the Intracoastal Water-way, tucked away betweentwo big mangrove islands.

    On shore, boaters canuse rest rooms, showers andlaundry. Bikes are available

    Closer to home, Sarasotashould have similar facilities

    finished and operational nextyear. Its been a long process 19 years at least but thearea just south of Marina JackRestaurant on the bayfront willbe a mooringfield of 100-plusvessels of all sizes.

    And even c loser tohome is a planned managedanchorage and mooringfield south of the HistoricBridge Street Pier in Bra-denton Beach. That fields

    configuration is under dis-cussion as to mooring oranchorage permutations,but shoreside facilities havebeen completed as part ofthe renovations to the pierin the past few years.

    Preliminary assessmentsof the bay bottom in the areaindicate it could accommodateupwards of a score or so boats,depending on vessel size.

    Problems in water world

    The Florida Fish and Wild-life Conservation Commissionhas recognized that conflictsexist between the boating andhomeowning communities.

    Boaters fear that their rela-tively unfettered lifestyle willbe overly regulated by govern-ment. Government officialsargue that homeowners shouldhave protection from outlaw

    boaters who throw trash inthe water, dump raw sewer-age overboard and have poor-quality mooring lines that snapduring storms, leaving boatsadrift to damage seawalls andother vessels.

    FWC officials last weekaddressed the matter of vesselsand moorings. Draft legislationto create a pilot program to testboat anchoring and mooringregulations in various parts of

    the state, among other provi-sions, will be submitted to theFlorida Legislature in 2009.

    Public access sites forboaters have diminishedbecause of developmentof waterfront propertiesand privatization of boat-ing facilities, said FWC

    Major Paul Ouellette. Asa result, some boaters haveanchored or moored theirvessels on the water perma-nently, or for long periods,and often behind waterfrontproperties. The vessels canbecome derelict, create nav-igational hazards and prop-

    erty damage, harm seagrassand corals, and create pollu-tion.

    Under pressure fromhomeowners and others, localgovernments implementedlocal codes and ordinancesthat are in conflict with statelaws. However, for boaters itwas confusing because theyoften experienced local juris-dictions with different rulesand regulations.

    Ouellette admits that theconflict between Joe the Hom-eowner and Joe the Boater isa real problem. There aredefinitely two sides to this,he said. Boaters believe boat-ing is the last bastion of free-dom, but waterfront propertyowners do not want to dealwith a boats pollution, noiseand other problems espe-cially when boats are practi-cally anchored in their backyards.

    Adding to the murky situa-tion is jurisdictional discrepan-cies that often plague the cruis-ing boater. Its hard to play bythe rules when the rules keepchanging, and all too often

    where and how you spend onenight on the water can vary thenext evening.

    The situation becameespecially confusing forboaters as they traveledfrom county to county andencountered local jurisdic-tions with inconsistent reg-

    ulations, Ouellette said.However, based on

    public input, the FWC isproposing slightly moreauthority to regulate anchor-ing and clarify local gov-ernment authority. Boatersgenerally felt laws shouldbe overseen by the FWC toensure uniformity and con-sistency. But local govern-ments wanted more author-ity to address problems that

    were unique to their owncommunities and fell out-side the scope of what thestate can enforce.

    A total overhaul of stateregulations addressing moor-ing or anchoring of boaters isexpected next year, with morechanges anticipated over time.

    As the population ofFlorida boaters increases,we will continue to haveto revise our statutes andprovide and improve boat-ing access , Ouel le t teconcluded. Freedom tonavigate must be weighedagainst growth managementso boating isnt just for theelite.
