Monsoon Greetings!

I am happy to inform you all that the impact of implementation of much awaited RERA (Real Estate Regulation & Development) Act, 2016 is slowly gaining ground based on the number of mandatory registrations by the Builders / Developers / Real Estate Agents etc, with the RERA Authorities from Maharashtra Day. RERA has opened its website for the public at large and particularly for those who wants to buy �lat / dwelling unit / commercial units / of�ice space etc in the Residential and Commercial Project as well anywhere in our Maharashtra. It is a user friendly website where almost all the information pertaining to the projects like locations of the plot, area in Sq Mts, promised Amenities & Facilities, assured time-frame for completing the entire projects, expected date of handing over of the projects, terms & conditions of payments payable by the buyer to Developer, current status of each of the project quarterly basis (which is mandatory to be uploaded by the Builders), full details of Registered Agreements between the Flat Buyers and Builders among others.

There are mandatory disclosures – like details of Developer / original land owners, particulars of the projects, land status, statutory approvals, contractual obligations apart from obligations of promoters like compulsory registration of each and every project that he intends to take-up with Maha RERA Authority, adhering to project speci�ications and approved plans, to make public the complete details of projects on Maha RERA's Website, Depositing 70% of payments collected from the Buyers in a separate Bank Account to be solely used for a certain project only after mandatory certi�ications by professionals like Chartered Accountant, Engineer and Project Architect thereof. Also, the Builders have to refund payments received from the �lat buyers should there be default by the Builder.

Further, the Builder must update the Website with compulsory quarterly information on sale of the components and progress thereof. Further, the Developers should get accounts audited by the another practicing Chartered Accountant within six months. It is mandatory that the Builder has to register the Agreement on receipt of 10% of the amount and submit all the relevant information about his projects from time-to-time with RERA Authorities. On the part of allottees they have to make payment due and payable to Builders, within the stipulated & agreed time. Should there be delay on the part of �lat buyers then he has to pay the interest also to the builders as his obligation.

The key objectives of the RERA Act are: Ensuring Transparency & Ef�iciency in real

estate sector in regards to sale of plot, apartment, building or real estate project.

Consequently, Government of Maharashtra also promulgated the following rules:

Establishing Appellate Tribunal to hear appeals from the decisions, directions or orders of the Real Estate Regulatory Authority

Establishing adjudicating mechanism for speedy dispute redressal

Under this Act, Government of Maharashtra established Maharashtra Real Estate Regulatory Authority (MahaRERA), vide Noti�ication No. 23 dated 8 March 2017, for regulation and promotion of real estate sector in the State of Maharashtra, with its headquarters at Mumbai.

You may contribute in this task by inviting MahaSeWA's Membership Relationship Of�icers (MRO) in your society's meeting, who will thoroughly explain as to the importance of this MLC Election-2018. Also, you may issue a circular addressing to your bona�ide society members with Form No. 18. Once your society complies the required things and you recon�irm it to MahaSeWA, we will ensure that your name is included in the Electoral Roll thereof.

Apart from the above, the mandatory Educational Training Programme for Society members pursuant to Section-24(A) of MCS Act 1960 would be conducted by MahaSeWA in your Society's door-steps on a prescribed Government fees. International Day is “Co-operatives Ensure No one

is left behind”. This itself shows that progress of all

people in the strata of the society.

International Co-operative Day is an annual

celebration of the Co-operative movement

observed on the �irst Saturday in July since 1923 by

the International Alliance this alliance is a non-

governmental co-operative federation or, more

precisely, the co-operative union representing co-

operatives and the co-operative movement

worldwide.

The Alliance provides a Global Voice and forum for

knowledge, expertise and co-ordinated action for

and about co-operatives. The members of the

Alliance are International and National Co-

operative organizations from all sectors of the

economy, including agriculture, banking,

consumer, �isheries, health, housing, insurance and

workers. The Alliance has members from 100

countries, representing close to one billion

individuals worldwide. Around one hundred

million people work for Co-operatives globally. Co-

operatives are values bested business owned by

or imprisonment of 3 years or both is provided in the RERA.

At the time of registration of the project, the developer needs to provide the date by which the project shall be completed and the possession shall be handed over to the allotees in which the existing society members are also included. The developer also is required to submit the stage wise completion of the project, milestones to complete the project. There will be quarterly updating of the project details. Any aggrieved person also may �ile a complaint against such developer and get the necessary action initiated against such erring developers.

Society has a saySince the entire regulation is to protect the interest of the allotees including the existing �lat owners, the society should facilitate and insist the developers to register with RERA at the earliest. If required a letter to advise the developers to register under the same be initiated. After the registration, if the developer still does not undertake the work as desired, a complaint can be lodged for the cancellation of the registration as provided under section 7 of the RERA and then as contemplated under section 8 of the Act, the society may demand the project be handed over to them for due completion. Thus, the developer who is not performing can be removed easily with the help of Real Estate Regulatory Authority. Redevelopment can be started once again in such societies which could not decide about the next course of action.

Prabhu explains how this helps projects stuck in limbo

There are many buildings, especially in the city of Mumbai, where the developers have taken the IOD and commencement certi�icates. The buildings are demolished and the work has stopped at middle way. They have stopped the rent and some of the �lats have been sold. The society and its members are not in a position to take the next course of action. Any legal action means the redevelopment will be in a big litigation and wait for the developer to come out with some workable solution.(1) Some developers introduce the new partners

and the society accepts such suggestion out of necessity.

(2) Some developers suggest for reducing the offers in terms of lesser area and not to demand further corpus. Many societies have accepted such lower offers.

(3) Some of the developers have been taken to the court by the �lat purchasers where the courts have given stay order for not to create third party rights and many more such situations.

RERA can helpIs there any relief under the Real Estate (Regulation and Development) Act, 2016 which has been effectively implemented in Maharashtra from 1st May 2017.As per section 3 of the RERA, 2016, all the developments including the redevelopment projects are required to be compulsorily registered with RERA by 31st Jul, 2017.

Failure to register the project before this date, shall render the developer to pay penalty of 10% of the estimated cost of the project as determined by the Authority. If such default is continued, further penalty of 10% of the estimated cost of the project

GST FOR HOUSING SOCITIES IN MAHARASHTRAGST is applicable to the dealer-person who is

rendering the service or supplying the goods in

its regular course of business activity.

1) Person has been de�ined under 2(84) as

follow:-

“person” includes— (a) an individual; (b) a Hindu

Undivided Family; (c) a company; (d) a �irm; (e) a

Limited Liability Partnership; (f) an association of

persons or a body of individuals, whether

incorporated or not, in India or outside India; (g)

any corporation established by or under any

Central Act, State Act or Provincial Act or a

Government company as de�ined in clause (45) of

section 2 of the Companies Act, 2013; (h) anybody

corporate incorporated by or under the laws of a

country outside India; (i) a co-operative society

registered under any law relating to co-

operative societies; j) a local authority; (k)

Central Government or a State Government; (l)

society as de�ined under the Societies Registration

Act, 1860; (m) trust; and (n) every arti�icial

juridical person, not falling within any of the above.

From this it can be noted that under clause (i) a

co-operative housing or commercial premises

society will be covered.

2) Can the activities of housing Societies be

considered as “Business Activity”?

The term business has been de�ined under Section

2(17) as follow:- “business” includes –-- (a) any

trade, commerce, manufacture, profession,

vocation, adventure, wager or any other similar

activity, whether or not it is for a pecuniary bene�it;

(b) any activity or transaction in connection with or

incidental or ancillary to sub-clause (a); (c) any

activity or transaction in the nature of sub-clause

(a), whether or not there is volume, frequency,

continuity or regularity of such transaction; (d)

supply or acquisition of goods including capital

g o o d s a n d s e r v i c e s i n c o n n e c t i o n w i t h

commencement or closure of business; (e)

p r o v i s i o n b y a c l u b ,

association, society, or any

s u c h b o d y ( f o r a

subscription or any other

co n s i d e ra t i o n ) o f t h e

facilities or bene�its to its

members; (f) admission, for

a consideration, of persons

to any premises; (g) services

supplied by a person as the

holder of an of�ice which has

been accepted by him in the course or furtherance

of his trade, profession or vocation; (h) services

provided by a race club by way of totalisator or a

license to book maker in such club ; and (i) any

activity or transaction undertaken by the Central

Government, a State Government or any local

authority in which they are engaged as public

authorities;

The above clause (e) speci�ically covered a

Society, thus the housing society will be

considered as carrying out activities in

furtherance of business and will be liable for

3) Registration

A Co-op Housing Society is required to be

registered under GST if the Aggregate turnover

exceeds Rs 20 Lakhs annually. Aggregate

turnover shall include all taxable and exempt

services. Aggregate turnover means all billing

other than Municipal Tax but includes interest

received from banks and members.

If the society has to pay GST under reverse

Charge (Supply of services by advocate)

irrespective of the turnover the society has to

register under GST.

4) Exemptions

charged to such Members.

4) Reverse charges

If the Society receives any supply of services

from advocates / �irm of advocates the society

has to register under GST and pay the GST under

reverse. In case of a society registered under

GST the GST shall be paid on inward Supply of

goods/ services by an unregistered Vendor

under Reverse Charge.

5) Taxation on Bills raised on members

a) Municipal Taxes is covered under services

provided by the society to its members as an

agent of the service recipient and thus

outside the provision of GST. However exact

amount of Municipal Tax is required to be

recovered from members as paid to BMC.

b) Water Charges- Water is procured by the

society from Municipal Corporation and is

supplied to the Members. Water is goods

and attracts Zero rate of tax. c) All other charges including electricity

With the Real Estate (Regulation and Development) Act, the government hopes to bring transparency and fair practices to the realty sector. The Real Estate (Regulation and Development) Act came into force in Maharashtra on May 1, 2017. The law will change your home-buying experience. Here are some key take aways:

BENEFIT TO CUSTOMERS:-

1. The customers can view online all the documents, as the promoter is required to submit all documents related to the project which is considered necessary by the RERA

2. The Promoter has to form and register the Society within three months from the date 51% of the �lats booked, in such a building or a wing, even if the project is under construction.

3. Customers will only pay for carpet area

4. If the Promoter want to leave the project mid-way by selling to another Promoter or party, then the Promoter is require to take written approval of 2/3rd of project's consumers and also the prior approval of the RERA. If a consumer or his family holds more than one unit in the project then he/she will be considered as one consumer only.

5. If the Promoter want to amend or change any Plans and layouts, then the Promoter has to take the permission from 2/3rd buyers.

6. The Promoter has to specify the project completion time in the RERA application form. Accordingly, the Promoter is accountable to follow the timelines otherwise he will suffer losses/ penalties.

7. Project cost estimation where bifurcation of Land Cost and the Construction cost has to be mentioned, this will bene�it the public at large as they will be aware about the pro�it that will be earned by Promoter.

8. To repair any structural defects in the construction even after 5 years of handover of the project.

9. Upload of sanctions on receipts basis and the project details in 3 months but it was suggested to do at earliest.

10. If due to a change in government policy, the promoter is entitled to additional FSI etc., the promoter can build additional �loors in a registered ongoing project where initially those �loors were not planned but with consent of allottees

11. Section 13(1) of the Act prohibits the promoter from taking more than 10% of the cost of apartment without entering into a written agreement for sale, duly registered.

OBLIGATION OF DEVELOPER:-

1. The Promoter has to register the project before he starts any form of advertising, marketing, booking, selling, offer for selling or inviting people to purchase plots, apartment or buildings.

2. It is mandatory for the Promoter to register the project with the RERA and obtain a valid registration number before proceeding.

3. The Promoter must deposit 70% of the payment received from the consumers in an escrow account and ensure that the amount is

solely used for the development of the project

for which it was taken.

4. Every phase will be considered a standalone

real estate project and the Promoter have to

obtain registration under this Act for each

phase separately. If the project is being done

phase wise and in the 1st phase we are not

providing common amenities like Club House

etc., then promoter cannot put ads and make

brochures showing common amenities.

5. At the time of registration, the Promoters shall

provide the details of past 5 years projects

done and even what was the possession date

promised and when was possession given.

6. The Promoter shall provide the details of FSI

proposed and approved.

7. The Promoter must adhere to the project plan

at all times.

8. Estimated �igures given can be changed. But

there is lot of information which cannot be

changed. Therefore, the Promoter shall be

careful while putting information.

9. Both the developers and the landlord or any

such party which is the bene�iciary of a sale of a

project & receives payments from consumers

as real estate developers (Promoters) are

liable to adhere to the Act. That's even true

where the land owner is a CHS in case of Re

Development.

10. The Promoter must share quarterly progress

report of the project, receipt of pending

approvals and other such declarations which

are related to project delivery on a regular

basis.

11. Sale or allotment of Open Parking Areas by the

Promoter is not permissible. However, the

Covered Parking and Garage as de�ined is

permitted to be sold

12. P ro m o te r s h a l l exe c u te a re g i s te re d

conveyance deed in favour of the allottee

within three months from date of issue of

occupancy certi�icate or �ifty one per cent of

the total number of Purchasers, in such a

building or a wing, has paid the ful l

consideration to the promoter, whichever is

earlier.

13. The �ile size limit is 1MB per �ile and only PDF

�iles can be uploaded on the application. The

14. If your project has no encumbrances, then you

can upload a self-certi�ication stating that your

project has no encumbrances.

15. MOFA has not been repealed, however, in case

of inconsistent provisions; the provisions of

the Central Act (RERA) shall prevail.

BENEFITS OF AGENTS:-

As per the government rules, only registered agents

are legally allowed to function in the real estate

business. Also, the RERA makes it mandatory for a

developer to make a declaration about the real

estate agents, architects, structural engineers and

similar parties to the appellate Tribunal of the

RERA.

PENALTY AND COMPLAINT

1. The penalties are quite high.

CIRCULAR - REGARDING COGNIZABLE OFFENCE IN BUILDING CONSTRUCTION

Sub:- Regarding Cognizable Offence in Building Construction

CIRCULAR

Government of Maharashtra has enacted the Maharashtra Ownership Flats Act, 1963 (MOFA) and

Maharashtra Regional and Town Planning Act, 1966 to regulate the promotion of the construction of the

sale and management and the transfer of �lats on ownership basis and to effectively prevent the Sunday

abuses and malpractices which were on the increase. Please perusal the same.

Section 3 of the MOFA Act : Is about builder failureto give possession of �lat on agreed date, not

acquired Occupation Certi�icate, not displaying plans approved by the

Municipal Corporation.

Section 4 of the MOFA Act : Is about Builder who has not executed agreement according to

Registration Law even after taking less than 20% amount of the �lat price.

Section 5 of the MOFA Act : Not to keep the advance amount taken from the �lat purchasers in the bank

by Opening Separate Account for it.

Section 7 of the MOFA Act : Construction is not made according to approved Plans. Constructed more

�loors than approved plan.

Section 10 of the MOFA Act : Builder did not submit an application for Registration of Co-operative

Housing Society within 4 months.

Section 11 of the MOFA Act : Within 4 months of the Society Registration, Conveyance is not made of

the entire Land & Buildings on it.

For all these offences,, the aforesaid act has made the provision of 3 years, 5 years and 1 year

imprisonment. As provided in the Act the Police have Authority to �ile the FIR. Cheating by doing illegal

construction, not doing the Registration as Co-operative Housing Societies, not executing the Conveyance

Deed, Breaching Trust of the Consumers, violations of Maharashtra Regional Town Planning Act, all these

are the cognizable offences.

All the sections of RERA , 2016 has commenced

from 1st May 2017. Section 3 provides a period of 3

months for the promoter to register on going

projects. Accordingly, the provisions related to

registration(section 3) till revocation and

obligations of Authority on revocation or lapse

(section 8) may be compiled till 31st July 2017.

All other sections are applicant from 1st May 2017.

FUNCTIONS AND DUTIES OF PROMOTER is as

building, as the case may be, as an advance payment

or an application fee, from a person without �irst

entering into a written agreement for sale with

The agreement referred to in sub-section ( 1 ) shall be in such form as may be prescribed and specify the particulars of development of the project including the construction of building and apartments, along with speci�ications and external development works, the dates and the manner by which payments towards the cost of the apartment, plot, or building, as the case may be, are to be made by the allottees and the likely date on which the possession of the apartment, plot, or building is to be handed over and such other particulars, as may be prescribed.

Since OC has not come, it is considered as" on going projects "and hence the promoter is required to register thus project under RERA.

Every person whom the promoter allots the �lat in exchange of old �lat or on account of sale of free area both are considered as Allottees under RERA.

Allottees is de�ined under section 2 (d) as under

: ‘'allottee'' in relation to a real estate project,

means the person to whom aplot, apartment or

buildings, as the case may be, has been allotted, sold

or otherwise transferred by the promoter, and

includes the person who subsequently acquires the

said allotment through sale, transfer or otherwise,

Real Estate projects include redevelopment of

housing society building in which some �lats are

made available for sale. Therefore, in the given case,

if the original member has transferred or sold the

allotted �lats on resale to another person during

under construction , such new purchaser is deemed

to be Allottees. Thus the promoter is liable for all

the obligations of promoter to new Allottees also.

Thus new purchaser is fully protected under RERA.

sale , in such situation brokers need to be registered

with RERA and listed with particular project as
