Dear colleagues, dear friends,

The UIA invites you on a wonderful, journey next year: we

will be heading to Macau and you will not want to miss this

congress which promises to be exceptional in many ways.

Our congress will be taking place in China for the very first

time! This is not a bit surprising since we all know that the

world’s centre of gravity is slowly shifting to Asia in the 21st century.

Macau, administered by Portugal for over 400 years, reverted to being part of China on

December 20, 1999, but the Portuguese influence has remained.

Both Cantonese and Portuguese are thus spoken there, and the legal and judicial system

based on the Portuguese model falls within the civil or continental law system.

The Macau peninsula, a territory made up of two islands, gathers a population of over

half a million inhabitants, with a higher density than those of Monaco and Singapore.

The economy is based on textiles, the production of fireworks, toys and electronics;

however Macau has become the main global centre of the gaming industry, on the same

level as Las Vegas since 2005, thanks to the gambling sector and tourism.

Around 30 million tourists choose Macau as a travel destination. You will belong to those

coming to discover the unique character of Macau, combining Chinese and Portuguese

cultures, such as the A-Ma temple, the Macau Tower, the Nobre de Carvalho bridge and

numerous historical sites registered as Unesco World Heritage Sites since 2005.

You will also discover a friendly and welcoming population: Chinese, Portuguese and

those combining both ancestries whom we call the Macanese people.

But above all you will come to meet UIA colleagues, regular congress participants or

newcomers, and to work on the topic: “Corruption and the lawyer”.

Each UIA congress is a key event; in a rapidly changing world the Macau congress

promises to be a major meeting to exchange ideas on the state of the world and our

profession, to meet old friends and make new ones, and to leave with wonderful

memories.

In addition, late October is the best season of the year and you will be able to organize

a trip to Hong Kong or mainland China before or after the congress.

Along with the UIA team, I look forward to welcoming you all, enthusiastic and

numerous, in Macau in October 2013.

Dear colleagues, dear friends,

For the first time in its history the UIA is organizing

its annual congress in China. This represents not

only a shift in geographical longitude, but also

recognition of the importance of the East and the

Far East in today’s world.

Since December 20, 1999, Macau has been a Special Administrative Region of

the People’s Republic of China with a high degree of autonomy, which

translates into Macau's enjoying its own executive, legislative and judicial

powers, its own customs, government departments under its own Executive

and its own currency – the Pataca (MOP) – while its defense and foreign affairs

are handled by the Central Government.

Macau is located within the Pearl River Delta, 60 km from Hong Kong and 110 km

from Guangzhou. The industrial importance of Guangdong, together with the

large waterborne traffic served by the harbors of Macau and Hong Kong, makes

this one of the most dynamic commercial zones in the world.

With the liberalization of the gaming industry since 2002, Macau enjoys

unprecedented economic development. Gaming, together with tourism, leisure

and services, are the economic activities which contribute the most to its

economy. Thanks to this dynamic, Macau currently has practically no

unemployment (2% in September 2012), nor any big social gap between rich

and poor. The GDP per inhabitant is around USD 66,000.

Member of the UIA since 1996, the Macau Lawyers Association (AAM),

Professional Public Association by the 1991 law, regulates discipline and the

profession. Although Macau is a Special Administrative Region, its lawyers’

organizations are totally independent.

The congress in Macau is thus a unique opportunity to meet with lawyers from

all over the Far East.

LEGAL PROJECTS

The UIA commissions and working groups examine a host of legal fields falling under Business Law, General Practice and Human Rights .Each commission looks at developments in its discipline and determines in which way they affect or are affected by other legal sectors . Consequently, all the UIA commissions collaborate with each other and offer together several international training seminars every year .

At its annual congress, the UIA commissions hold their working sessions . They produce high quality reports which are placed at the disposal of all the association’s members and congress delegates .

Since 2011, the UIA offers advanced training courses in various areas of the law or on the new professional techniques . These training courses, provided by senior experts, enable lawyers wanting to improve their skills to acquire the essential tools to do so . The 2013 programme includes: International Arbitration, Mediation, Management of Law Firms, Human Rights, etc .

PROTECTION OF LAWYERS AND HUMAN RIGHTS

Wherever in the world the right to defence may be threatened, the UIA gets mobilised so as to provide assistance to lawyers who are unable to practice their profession freely .

En 2012, in particular, it followed cases in Colombia, Democratic Republic of Congo, Iran, Saudi Arabia, Turkey, etc .

It has enjoyed a special consultative status vis-à-vis the European Council and since 1971 vis-à-vis the United Nations .

Finally, the UIA attends the sessions of the Assembly of States Parties to the International Criminal Court and is a member of the International criminal Bar's Executive Council .

BRINGING TOGETHER THE WORLD'S LAWYERS

For over 85 years, the Union Internationale des Avocats (UIA - International Association of Lawyers) has been defending the legal profession and stimulating international contacts, cooperation and exchange of knowledge among lawyers, while respecting their cultural and professional diversity .

An association open to all law professionals, the UIA is the only international association of lawyers to:◗ Promote the fundamental principles of the legal profession and the development of legal sciences in all legal fields at the international level .◗ Contribute to the professional growth of its members through the exchange of information in forums established by its commissions and working groups .◗ Intervene frequently all over the world in favour of lawyers who have either been imprisoned or are being persecuted for practising their profession .

Today, the UIA brings together several thousand members and hundreds of bars, federations and associations spread out in over 110 countries .

◗ ENTRY FORMALITIESAll visitors to Macau must hold a passport valid for at least 6 months after arrival date and a valid travel document .

Generally, passport holders from the countries listed below are exempt from visa requirement for Macau with a certain length of stay:

Passport holders from other countries are allowed to obtain a visa at the immigration counter upon arrival .

Only Bangladeshi, Nepalese, Nigerian, Pakistani, Sri Lankan and Vietnamese nationals are required to obtain a visa prior to their arrival in Macau .

We still recommend that you contact the embassy or consulate of the People’s Republic of China of your country of residenceor with the immigration services of the Public Security Bureau of Macau

(http://www.fsm.gov.mo/psp/eng), for the latest information on entry formalities.

Important information for all participants from countries exempt from visa requirement for Macau who wish to book pre or post-congress activities in China: We highly recommend those travelling to continental China via Hong Kong or Macau to obtain a visa at the embassy or consulate of the People’s Republic of China of your country of residence .

Congress participants who need a visa and wish to attend the general excursion to Hong Kong should ask for a multiple entry visa .

◗ HEALTHIn general, no special immunizations or medications are necessary for travel to Macau . It is however recommended to update your DT Polio and check your vaccines against hepatitis A and B and typhoid fever .

◗ AIR TRANSPORTThere are several airlines serving the destination with connecting flights . You can avail yourself of preferential airfares by making your reservations directly on the Internet as early as possible .

For long distance flights to and from America and Europe, visitors can also fly to Hong Kong International Airport that is only 50 minutes away by ferry .

◗ ARRIvALThe Macau International Airport (MFM) is located on the eastern tip of the island of Taipa, 6 km from the city centre .

Passengers can transit into or out of Macau via Hong Kong International Airport (HKIA) without the need to go through Hong Kong customs and immigration formalities and also without carrying their luggage to the ferry terminal . There are two ferry companies that operate to Macau: Turbojet (Macau Terminal) and CotaiJet (Taipa Ferry Terminal) . The trip to Macau from Hong Kong International Airport is approximately 45 minutes .

The helicopter is the fastest means of transport from Hong Kong to Macau .

◗ TRANSFERS FROM THE AIRPORTThe UIA will not provide any shuttle service from the airport .

A large fleet of free shuttles connects frequently several hotels mainly located both at Cotai, Taipa and old Macau Peninsula with the airport and Macau Ferry terminals and borders .

Taxi fares are fixed rates and subject to the destination . The cost of the journey from the Macau International Airport to the congress hotel is of approximately MOP 30 and lasts ca . 5 minutes . The cost of the journey from the ferry terminals to the congress hotel is of approximately MOP 30-60 and lasts ca . 10-15 minutes .

◗ CURRENCYThe Pataca (MOP) is the official currency . The Hong Kong Dollar (HKD) also circulates in Macau .As of 02/04/13: MOP 10 = EUR 0 .975345 and MOP 10 = HKD 9 .70874 .

◗ BANK / FOREIGN ExCHANGEAutomatic teller machines (ATM) are available throughout the city . Almost all credit cards are accepted . Travellers’ cheques are accepted in most of the places (hotels, restaurants, shops, etc .) .Banks are generally open from Monday to Friday from 9 .00 am until 5 .00 pm, and on Saturday from 9 .00 am to 12 .00 pm .

◗ LANGUAGESMandarin and Portuguese are the two official languages . However, Cantonese is the most widely spoken . English is widely used in trade and tourism .

◗ POWER SUPPLYThe electric current supplied is 220V/50Hz . It is recommended to take an international adapter along with you (English model) .

◗ SHOPS OPENING HOURSStores in Macau usually open from 10 .00 am to 7 .00 pm . At the weekend, they generally open slightly earlier . ◗ JACQUES LEROY INTERNATIONAL PRIZESince it believes that law students can also help in promoting human rights in the business world, the UIA is organising the Jacques Leroy international prize to reward a law student of less than 30 years for his / her legal work .

It will reward a dissertation (plea, study, commentary of a practical case) dealing with the following theme: “Fair Trade: how can we establish rules that are specific and realistic?”, submitted to the UIA before June 30, 2013.

The Jacques Leroy international prize will be granted for the fourth time during the opening ceremony . The winner of the prize will be granted free participation to the congress .

◗ MONIQUE RAYNAUD-CONTAMINE AWARDIn 1999, the Union Internationale des Avocats established the Monique Raynaud-Contamine Award in memory of and as a tribute to Mrs . Monique Raynaud-Contamine, former UIA Director of Legal Publications, and former President of the Banking Law Commission . Monique Raynaud-Contamine was a vitally important UIA member for several years .The Monique Raynaud-Contamine Award was established in homage to her work and her personality and is granted to the authors of the two best legal reports drafted for the UIA annual congresses . One of the two awards will be conferred on a young lawyer .

The Monique Raynaud-Contamine Award will be granted during the closing ceremony . It will be granted to the best report received in electronic format by the UIA latest by September 15, 2013.

Corruption and the lawyer

Ever since the OECD Convention was signed in 1997, the fight against international corruption has been a major issue for the international community, like the fight against money laundering beginning in the 1990s. As a result, a convention against corruption was signed by the United Nations in 2004 (the Merida convention), and since 2010 the fight against corruption has been a G20 priority.The United States are at the forefront of this movement, and have developed a myriad of techniques (from self-reporting to whistle-blowing) that lead to extraordinary sanctions against corporations and their managers and employees.The new presidency of the People’s Republic of China has made fighting against corruption one of the major points of its political agenda.The whole world is mobilised on this subject, especially in Asia, which requires corporations to implement costly compliance programmes. Some countries impose such measures by law. Victims of corruption also seek compensation in courts: countries (Taiwan, Nigeria, Tunisia, and Trinidad and Tobago), losing bidders, associations of victims ("ill-gotten gains" case). Arbitration also regularly confronts these issues (arbitrability, public policy statutes, friendly arbitration). Lawyers stand at the crossroads of this worldwide movement, sometimes as counselors, and unfortunately also as the targets of investigations. The fight against corruption is an inevitable topic for lawyers. 1 - The international environment 2 - What is happening in Asia? Cloud computing: benefits and dangers. Are the fundamental values of the profession under threat?

The legal profession is currently facing new challenges.First, the profession, which has become globalised, open and modern, is permanently in competition with other professionals. Can it avoid using new technologies?

Secondly, authorising or prohibiting the use of technologies such as cloud computing in the legal profession is not possible without in-depth analysis of the benefits and dangers.

Can this use be controlled? If so, under which conditions and how?

How can Bar Associations, after adopting all appropriate security measures, ensure that lawyers comply with all their professional and regulatory obligations, in particular attorney-client privilege and client data protection?

These issues will be the focus when Bar Association Chairs, Law Society and Professional Association Presidents meet for discussion at the International Bar Leaders Senate meeting in Macau.

◗ Cross-border debt recovery: How to secure freezing orders, the attachment of bank accounts and other protective measuresThe economic downturn has increased the occurrence of insolvency by companies and the need of creditors to pursue their claims to collect debts. When parties involved are based in different countries, it is essential to avail from measures efficiently enabling creditors to freeze the debtor’s assets located abroad.This session will discuss worldwide attachment measures, including freezing orders available in various jurisdictions, as well as the recent European Commission’s proposal of a regulation

on creating a European Account Preservation Order. Are these measures protective enough for creditors? Are they easily enforceable in a legal system different from the one where they have been issued?

◗ Open public procurement markets: The interplay betweenpublic procurement tools and competition law against corruption and for more transparency

◗ Arbitration in AsiaThe session will focus on arbitration in Asia, with four panels featuring arbitral institutions and leading experts in the field of arbitration in this region.The first panel will be devoted to institutional arbitration in Asia, examining the practice and rules of four institutions. Topics to be covered will include joinder of parties, consolidation of proceedings, emergency arbitrators and interim measures, expedited proceedings, case management, confidentiality, scrutiny of award and costs. Panel two will look at arbitration in China, examining proceedings in China from several different angles, covering both the legal framework and difficulties that arise in practice.

Panel three will examine issues arising in connection with the enforcement of arbitral awards in Asia.Panel four will focus on current issues in investment arbitration in Asia.

◗ From Beijing, Vancouver and London to Sochi 2014 and Rio 2016The Olympic Games are the most important sport event in the world. Besides the huge logistical needs, their organisation requires legal consideration at all times, in view of the number of issues and disputes that may arise.

This session will address certain legal aspects surrounding the Olympic Games, such as the choice of the host city, the infrastructures (project finance), issues of sponsoring and TV rights, as well as the disputes brought before the ad hoc Division of the Court of Arbitration for Sport.

◗ Made in Asia: How to deal with manufacturing agreements in Asia Over the last 20-plus years, the Asian market has become one of the most crucial levers for global growth. Western investors seek to develop long-lasting relationships with Asian partners to capitalise on the attractive Asian cost-structure, while concurrently protecting their know-how and intellectual property, among other rights.In negotiating such manufacturing agreements, however, there are two sides of a mirror. These sides are the result not only of

different economic interests but also of different cultural approaches when doing business. This session will bring together Asian and Western legal practitioners to jointly discuss the key issues which concern Western and Asian clients alike when dealing with the drafting and negotiation of manufacturing agreements. Topics include choice of law, terms of trade, confidentiality, prevention of “back-dooring” and other circumvention, and possible controlling rights over the manufacturing party.

◗ Ethics in real estateThe purpose of this session is to appraise whether the acceleration of the resort to ethics in real estate is a symptom of the defeat of real estate law. In a second stage, we will consider if the ethical behaviour of the players in the real estate market influences right to ownership or right to use. Deciphering the different systems of ownership: usufruct, bare ownership, time sharing, joint ownership, co-ownership. Seeing the different leasehold systems in action: dwelling lease, commercial lease, administrative emphyteutic lease, ground lease.

Inaugurated in December 2001, the Macau Sky Tower is 338 m high. It features a 360° viewing deck where you can enjoy the most beautiful view of Macau. You may access this deck if you wish.The tower is not only used for observation and entertainment, but also for radio diffusion and telecommunications.

◗ Departure with your guide from the congress hotel at 7.30 am. Customs and immigrationformalities at Taipa Ferry Terminal and transfer by ferry to Hong Kong. After a 50-minute crossing, and going through customs and immigration formalities upon arrival, you will visit the Central district, and you will discover the architecture of Hong Kong during a Feng Shui Tour. You will then go to Aberdeen, a port city where fishermen’s families live in house boats. Dim Sum lunch on board the floating restaurant “Jumbo Kingdom”. In the afternoon, you will experience a moment of quiet by visiting the Chi Lin wood convent, with lotus ponds and golden statues, and the Nan Lian garden. End of the excursion by 6.30 pm. After the excursion, you may choose between staying in Hong Kong, going to the Ferry Terminal to return to Macau, or to the Hong Kong airport to take your return flight. ◗ Transfer from the congress hotel to the A-Ma Temple, dedicated to the goddess protector ofthe sailors. A true emblem of Macau, this temple is still open and visitors can discover the various rituals associated with the prayer to the local deities.

Then, you will move on the Ruins of St. Paul's Cathedral in the heart of the old town.It is a magnificent stone sculptured facade of St. Paul, which together with the main staircase, constitutes all that remains of the first Jesuit church and university in China.

Visit of The Mount Fortress, built by the Jesuits as headquarters and as an effective defense against the Dutch attack. Later, it became the residence of the governor, and nowadays it holds the Macau Museum.

You will then move on to the Senado Square, where the marble pavements are an exact replica of those in Lisbon. Having admired these monuments, you can enjoy some free time to go shopping and walk around.

Then continue to the Our Lady of Carmel church, situated in height and walk in the Carmel Garden.

Visit of the Buddhist Monastery Po Tai Un, a pilgrimage place known for its magnificent prayer room and a very popular vegetarian restaurant.

Finally, you will visit Coloane, a small former fishing village and com-mercial harbor with the surrounding Chinese islands.

Walk through the narrow streets of the village and soak up the atmosphere of traditional Macau.

Return by bus to the hotel.

Xian, the historic city of the Yellow River basin, is one of oldest capitals of China, the starting point of the Silk Road. During almost 1,062 years, eleven dynasties succeeded and left their mark on historic sites, tombs or monuments, kiosks or terraces.

Your guide will take you to a typical restaurant, where you will savour a Chinese fondue for lunch.

In the afternoon, you will go for a tour in the old town and the Hui Muslim district. In this commercial area, the signs are written in Chinese and Arabic. You will also have a chance to visit the Great Mosque, a Chinese mosque with no minaret, with a set of classic wooden pavilions distributed around a garden. Then, you will walk around a Chinese medicinal plant market, and your guide will explain why medicinal plants and herbs are so important in the Chinese culture. Finally, you will stroll along Shu Yuan Men, a street with old classical architecture, called "the Street of Art", and you will discover traditional Chinese calligraphy and painting with brush and Chinese ink.

Cancellation of registration for the congress / Gala dinner / General excursion

All cancellations will be subject to a 20 % deduction for processing fees and will have to be sent in writing, to be received by the Union Internationale des Avocats (UIA - International Association of Lawyers) no later than September 30, 2013. No refund will be made for cancellations received after this date.In order to avoid any reimbursement problems, we earnestly advise all those who need a visa to proceed with their registration as soon as possible. All reimbursements will be made after the congress.

Participants who have paid the total registration fee amount and are unable to attend the congress personally may send a colleague as a substitute after informing the UIA. A € 50 processing fee will be charged.

The UIA and DESTINATION PLUS reserve the right to cancel or postpone the congress to a later date, change the congress venue and/or programme, make any corrections or modifications in the information published in the congress programme and cancel any invitation to participate in the congress, at any time and at their entire discretion, without having to provide any reasons for the same. Neither the UIA, DESTINATION PLUS, nor any of its managers, employees, agents, members or representatives shall be held responsible for any loss or damage, of any nature, suffered (directly or indirectly) by a congress delegate, accompanying person or a third party following any cancellations, changes, postponements or modifications.Neither the UIA, nor any of its managers, employees, agents, members or representatives shall be held responsible for any loss or damage, of any nature whatever, suffered (directly or indirectly) by a congress delegate or accompanying person, except in case of death or personal injury due to gross negligence by the UIA.The contractual relations between the UIA and each participant (congress delegate or accompanying person) in relation to the congress are subject to French law and jurisdiction, to the exclusion of any other law. Paris is the city of jurisdiction. As far as accommodation for the congress and the tours proposed by DESTINATION PLUS before and during the congress are concerned, the contractual relationship will be established directly between DESTINATION PLUS and each participant. This relationship is subject to French law, to the exclusion of all others. Paris is the city of jurisdiction.

Formalities

It is the responsibility of congress participants to ensure compliance with police, customs and health formalities for their journey. Congress participants unable to take part in the congress because of their inability to take a flight or any other means of transportation due to being unable to provide the documents required (passport, visa, vaccination certificate, etc.) cannot claim any reimbursement.

Force majeure

“Force majeure” means any event external to the parties, of both an unforeseeable and insurmountable nature that prevents either the client or the participants, or the agency or service providers involved in organising the congress, from executing all or part of the obligations provided for in the present agreement. By express agreement, such will be the case in the event of a strike affecting the means of transport, hotel staff, air traffic controllers, an insurrection, a riot or any prohibition whatever decreed by Governmental or public authorities. It is expressly agreed that for the parties, a case of force majeure would suspend the execution of their reciprocal obligations. At the same time, each of the parties shall be responsible for all the expenses incumbent upon them, resulting from the case of force majeure.

Health

The organisers decline any responsibility in case of any health problems existing prior to the congress that may lead to complications or be aggravated during the entire period of the stay: pregnancy, cardio-vascular problems, any allergies, special diets, any disorders under treatment and not yet consolidated on the day the congress starts, psychic, mental or depressive illness, etc. (Non exhaustive list).
