1.0 INTRODUCTION
1.1 PreambleThisHeritageAnalyishasbeenpreparedtoguidetheheritageaspectsoftheDraftStLeonardsandCrowsNest2036Plan(Draft2036Plan)beingdevelopedbyNSWDepartmentofPlanningandEnvironment(DPE).ThePrecincttraversesthethreeLocalGovernmentAreas(LGA)ofNorthSydney,WilloughbyandLaneCove.PartofthefollowingsuburbsarelocatedwithinthePrecinct:
• CrowsNest;• Wollstonecraft;• StLeonards;• Naremburn;• Artarmon;and• Greenwich.
TheDraft2036Planwillincludethevision,objectivesandguidingprinciplesforfutureplanningofthePrecinctandwilloutlinefuturelanduses,builtformproposals,growthprojectionsandtheinfrastructurerequiredtosupportpopulationandemploymentgrowth.ItisinformedbythefindingsoftheStage1andStage2technicalstudiesincludingUrbanDesign,PublicDomain,SocialInfrastructureandOpenSpace,Transport,Heritage,EconomicFeasibilityandUtilitiesandServicing.TofacilitateurbandesignandplanningassociatedwiththePrecinct,aheritageanalysisisrequiredtosupportandinformdetailedprecinctplanningtounderstandwherespecificheritageconsiderationsarerequired.Inaddition,thereareanumberoflocalheritageitemslistedoneachoftheCouncilLocalEnvironmentalPlans(LEPs)andseveralstateheritageitems.FiveheritageconservationareasoflocalsignificancealsoexistinthePrecinct,oneinWilloughbyLGAandfourinNorthSydneyLGA,asfollows:

2.0 HISTORICALDEVELOPMENT
2.1 OriginalOccupationWhileanAboriginalhistoryhasnotbeenprovidedfor,itisacknowledgedthatthenorthernshoresofSydneyHarbourwereinhabitedbyanumberofAboriginalgroupsatthetimeofthearrivaloftheFirstFleetin1788.TheCammeraigalandtheWallumedegal,partofthelargerKu-ring-gaispeakinggroup,whooccupiedanareafromNorthHeadinlandtotheHawkesburyRiverandnorthtoLakeMacquarie,arerecognisedastheoriginaloccupantsofthepresent-dayNorthSydneyMunicipality.
2.2 NorthSydneyBefore1850ThetownshipofSydneywasestablishedonthesouthernsideofSydneyHarbourinJanuary1788.AlllandwasdeclaredtobeCrownLand.InhisAnAccountoftheEnglishColonyinNewSouthWales,publishedattheendoftheeighteenthcentury,DavidCollinsreferstotheNorthShoreofSydneyHarbour,adesignationthatremainstothisday.From16January1793,successivecolonialgovernorsgrantedlandoutsidethetownshipboundariesinordertofurtherthepurposesofsettlement.ThenorthernshoresofSydneyHarbourwerelocatedwelloutsidethefirsttownshipboundaries.Beyondusefortimbergettingandthecollectionofshellsforlime,theNorthShorewaslargelyignoredbythefirstEuropeansettlersuntilaseriesofsmalllandgrantsweremadeinthemid-1790s.Mostofthesegrantswerenottakenup,butweretradedorabandonedforbetterlandelsewhere.Furtherlandgrantsweremadeafter1800.Whetheroccupiedornot,mostofthelandwithinthepresent-dayNorthSydneyLGAhadbeengrantedbytheendofthe1830s.AmongthosetoacquirelandontheNorthShorebefore1830wereRobertRyan(1800),AlfredThrupp(1814),WilliamBlue(1817),JamesRobertson(1825)andthepartnershipofEdwardWollstonecraftandAlexanderBerry(1821)(Figure12).

AlexanderBerry(1781-1873)arrivedinSydneyinJanuary1808withtheintentofsellingsuppliestoaseverelyunderprovisionedNewSouthWales.WithmuchdifficultyinsellinghissuppliesinSydney,AlexanderthentradedintimbersfromFijithatheon-soldinLima.BeforereturningtoEnglandhemetEdwardWollstonecraftinCadiz,Spainwhomhelaterenteredintoapartnershipwithinhistradingventures.BothpartnerssailedtoSydneyin1819toestablishtheirbusiness.1EdwardWollstonecraftandAlexanderBerryoperatedasgeneralmerchants,exportingtimber,wool,sealskinsandotherproductsandimportingawiderangeofcommodities.DuringBerry’sabsenceinEnglandEdwardWollstonecraftwasgivenagrantof524acresbyGovernorMacquarieonthenorthsideofSydneyHarbour.TheNorthShoregrantwasoneofseveralmadetoeitherofthepartners,withthelargestandmostimportantbeingthevastCoolangattaEstateontheShoalhavenRiver.In1821Wollstonecrafterectedasmallcottageonthehighestpointofhisgrant,whichwasthenusedbythepartnerswheninSydney.ThiscottagewascalledCrow’sNest,forthevantagepointitprovided.2BerryandWollstonecraftwerehithardbythecurrencyreformsofGovernorBrisbaneof1822andduringthe1830s,thepartnershipwasofteninaperilousfinancialposition.Toraisecapital,thepartnersbeganexportingtimberfromtheShoalhavenand,forabriefperiod,fromtheNorthShore.EdwardWollstonecraftdiedatCrowsNestinDecember,1832,aged49.AlexanderBerrybecameownerofthe524acregrantandamalgamatedthelandwithhisown20-acreand60acregrants.BerryhadreceivednumerousapplicationsrequestingthesaleoflandontheEstateduringthe1840s.UnderthetermsofWollstonecraft’swill,however,Berrywasnotpermittedtoselllandontheestatetoraisecapital.Thelegaltitletotheestatewasnotresolveduntil1853.ThiscameatatimewhenthefirstsignsofgreaterdevelopmentontheNorthShorewasapparent.TheTownshipofStLeonardswaslaidoutin1836onCrownlandtothenorthofHulkBay,laterLavenderBay.By1838,thebasicroadstructureofthetownshipwaslaidoutinatraditional10-chaingrid,withBerry,Mount,BlueandLavenderStreetsrunningeast-westandMillerandWalkerStreetsrunningnorth-south.StLeonardscontinuedtogrow;by1851itsupportedapopulationof737people.3Outsideofthetownship,apatternofharboursidevillaestatesdevelopedassubstantialresidenceswereconstructedatNeutralBay,Kirribilli,MilsonsPointandLavenderBaytotakeadvantageofthespectacularharbourviews.Amongtheresidentswereprominentmerchantsorcolonialadministrators.Alongsidethesevillaswasapatternofmoremodestdwellingsoccupiedbypeopleabletoobtainlocalorindependentemployment.InSeptember1854,asecondtownshipforthenorthernshoresofSydneyHarbourwasproclaimedanditwaspredictedthat:‘…ItisnoLittleSydneybutaNorthSydney,arivaltothesoutherncityintendedtobeadepotfortheproduceoftherichtractsoflandtobeopenedupbetweenitandtheunexplorednorthoftheCountyofCumberland.’4ArealestateadvertisementfromMarch1855claimedthat:1Perry,T.M.,'Berry,Alexander(1781-1873)',AustralianDictionaryofBiography,2006.OnlineEdition,ANU2Brodsky,Isadore,NorthSydney1788-1962,NSW,MunicipalCouncilofNorthSydney,1963,p.26.3Bridges,Barry,TheCrowsNestEstate,1821-1873,p.20.Unpublisheddocumentdated1996.NorthSydneyHeritageCollection,StantonLibrary.4IllustratedSydneyNews2September,1854.

‘…notowninNewSouthWaleshadprogressedsorapidlyasSt.Leonards…(itis)…studdedwithfirstclassmansions,shops,familyhouses,cottagesandfarmsinalldirections.’5BerryprogressivelysubdividedandsoldtheCrowsNestestateoverthefollowingdecades.WhenBerrymadeanapplicationtobringtheremainderoftheCrowsNestEstateundertheprovisionsoftheRealPropertyActinJanuary1872,itwasvaluedat£30,000.Theestatewasdescribedintermsof‘BlocksAtoL’.Theblocksvariedconsiderablyinsize,rangingfromassmallasoneroodtooverthreehundredacres.FollowingAlexander’sdeathin1873,hisbrother,DavidBerrybecametheowneroftheCrowsNestEstate.DavidBerryresidedatCoolangattaandshowedlittleinterestintheestate.ThesaleoflandontheCrowsNestEstatethatfollowedoccurredatthebeginningofaperiodofgrowthandexpansion.Theperiodfrom1860to1890wasoneofgeneraleconomicandurbanexpansionacrossSydney.Between1881and1895thepopulationoftheNorthShoregrewfrom7,000peopleto25,000people,anincreasebroughtaboutbythenumeroussubdivisionsthatoccurredduringtheseyearsandbyimprovedtransportationandservices.ThedevelopmentofNorthSydneyreceivedasignificantboostwhentheNorthShoreRailwayline,betweenHornsbyandStLeonards,openedinJanuary1890.ThelinewasextendedtoMilsonsPointin1893.Sydneywasdividedintomunicipalitiesduringthisera.TheareanowtheMunicipalityofNorthSydneywasinitiallydividedintotwo,andlaterthree,separatecouncilareas.ThefirsttobeestablishedwastheBoroughofEastStLeonards,declaredin1860;itwouldnotbeuntil1868,however,thatthefirstCouncilwaselected.TheBoroughofStLeonardswasdeclaredin1867.Fouryearslater,however,itsplit,creatingtheBoroughofVictoria.ThethreeboroughswouldeventuallycombinetocreatetheMunicipalityofNorthSydneyin1890.

Highdensitycommercial,mixeduseandresidentialtobeconcentratedinlandextendingfromTheForumalongPacificHighwaytowardstheproposedCrowsNestMetroStation.Theproposedheightofthedevelopmentwilltaperdownwardtowardsthe‘FiveWays’intersection.
AnumberofthedevelopmentoptionsareproposedtointerfacedirectlywithadjoiningHCAsandheritageitems.
CrowsNestVillage:
CrowsNestVillageisproposedtoberetainedinitscurrentformtoprotectthefinegrainscaleoftheresidentialandretailarea,however,thereisproposedtobeincreaseddensitybehindtheexistingtwo-storeyshops.
Containsanumberofheritageitemsconsideredsignificanttothesurroundingarea.
Residential(NaremburnandCrowsNest):
NaremburnandCrowsNestareasareproposedtoberetainedforlowerdensityresidentialdevelopment.
InterfaceswithheritageitemsbetweenhighdensitydevelopmentintheStLeonardsCentreandCrowsNestMetroStationcharacterarea.
PacificHighwayCorridor:
ThePacificHighwayCorridorisproposedtobeanactivated,highdensitymixedusecorridorwithakeyfocusonemployment.
Heritageitemsclusteredaroundthe‘FiveWays’intersectionareproposedtoberetained.
Residential(Wollstonecraft):
Wollstonecraftisproposedtoberetainedasmediumtohighdensityresidentialsetwithinalandscapedsetting.
Achangeinsettingtotheheritageitems.
Residential(StLeonardsSouth):
StLeonardsSouthisproposedtobeahigherdensityresidentialarea.IncreaseddensitieswillbefocusedinthoseareasclosesttoStLeonardsStation.
Thereareproposedinterfaceswithheritageitemsandthehigherdensityresidentialdevelopment.

GoreHillOval&Cemetery:
TheGoreHillOvalisproposedtoberetainedforrecreationalusestosupportresidentsandworkersinthePrecinct.CouncilhasplanstoimprovetherecreationalfacilitiesofGoreHillOval.PedestrianimprovementstotheGoreHillCemeteryincludingpaths,furnitureandlightingarealsoproposed.
TheproposedfacilitiesrequiredtomeettheneedsoftheincreasedpopulationsurroundingtheopenspaceoftheGoreHillOvalmayimpactonthesignificanceoftheGoreHillMemorialCemetery.TheimpactsoftheproposedpedestrianimprovementswillhavetobecarefullydesignedtomitigateimpactontheGoreHillCemetery(listedontheStateHeritageRegister).
HealthandEducation:
TheHealthandEducationcharacterareaisproposedtoberetainedforusesassociatedwithhealthandeducationindustriesbuildingonthevisionfora‘healthandeducationsuperprecinct’.AMasterPlanforthisareaiscurrentlybeingdeveloped.
HeritageitemswithintheRNSHsiteareproposedtoberetainedandincorporatedintoanynewdevelopment
ArtarmonEmploymentArea:
Thisareaisproposedtobeprotectedforemploymentandurbanservices.Itwillevolveintoakeyhighdensityemploymentandtechareafosteringcomplementaryusesadjoininglightindustry.
HeritageitemswithintheArtarmonEmploymentAreaareproposedtoberetainedandincorporatedintoanynewdevelopment.

4.1 GuidingPrinciples:Thefollowingguidingprinciplesprovideanoverviewofmitigationmeasuresthatcanbetakentoreducetheimpactoffuturedevelopmentwithin,adjacentorinthevicinitytoheritageitemorheritageconservationarea.
1. HeritageitemsandconservationareasshouldbemaintainedandconservedsotheycandemonstratetheheritagenarrativeoftheAreainviewoftheconsiderablechangetheAreaisundergoing.
2. NewdevelopmentmayrendersomecurrentDevelopmentControlsuntenable.Wherethisoccurs,newdevelopmentshouldtakeacautionaryapproachtoconservationofheritageitemsandofthecharacterofConservationAreas.
3. TheinterfacebetweenareasofhighdensityandthosemaintainedasConservationAreaswithafarlowerdensityshouldbecarefullyconsidered.Mitigationmeasuressuchasplantingoftreesshouldbeundertakenonthelandproposedforhigherdensity,notonthelandmaintaininglowerdensity.
4. Whereaheritageitemexistsinanareaofincreaseddensity,surroundingbuildingenvelopesshouldusedevicessuchaspodiumsandfinedetailingtocomplimentthescaleoftheItemandsurrounditwithelementsofappropriatescale.
5. HeritageitemsshouldbeabletorealisetheirlimiteddevelopmentpotentialthroughanabilitytosellheritagefloorspacebasedontheCityofSydneySystemanddulymodifiedtoaccountfromexperiencegainedfromrunningthatscheme.
4.2 Heightofbuildings
ThePrecinctischangingrapidlytoincludehighdensityresidentialandcommercialupliftintheStLeonardsCommercialCore.ResponseAbuildingofgreatermassingandscalewillhaveanimpactuponthesmalleradjacentheritageitems.Inprovidingcontrolsthatencourageincreaseddensityanduplift,theDepartmenthassoughttheadviceofWeirPhillipsHeritagetorecommendcontrolsthatwillenablefuturedevelopmentandmitigatetheimpactonheritageitemsandconservationareasthatareadjacentorinthevicinitytoareasofproposeduplift.
Controllingtheminimumlotsize(1500m2)ofabuildingover25storeysallowsforapodiumwithinasetbacktobeincorporatedintothedesign.Themitigatingimpacts,whicharediscussedindetailbelow,essentiallygivearelatablescaletothesurroundingsmallerscaleheritagebuildingsandpedestrians.Thedisadvantagesofincorporatingabovepodiumsetbacksresultinalossoffloorplateand

4.3 TransitionstoHeritageConservationArea
Inthefuture,largerscalebuildingsmaybeproposedinproximitytolowscaleHeritageConservationAreas.ResponseDensityshouldgenerallyreducefurtherfrompublictransporthubsandadjacenttoopenspacesorsignificantsites,tocreateatransitionofheightandscaleandminimisevisualimpact.WhereaproposedtallbuildingisdirectlyadjacenttoaHeritageConservationArea,itisdesirabletocreateatransitionbetweenthebuildingandadjacentHeritageConservationAreas.Thisisnormallyachievedbythecreationofapodiumtothetallerbuilding,theheightofwhichreflectstheheightofbulkandproportionsoftheadjacentitem.Althoughtherearenosetrulestopodiumheightinthecontextofmanyheritageitems,itgenerallyliesinthe2-3storeyheightrange,allowingforatransitionbycreatingalowerstreetwall,therebydrawingattentionawayfromthebuildingmassabove.Theincorporationofapodiumreducesthevisualimpactofthetower,whichremainsconstantregardlessofitsheight.

Forexample,thediagrambelowinFigure14illustrateshowthecreationofapodiumcreatesaheighttransitionbetweenthelowerscaleheritageconservationareasandthepodiumwhichmitigatestheimpactoftheheightofthetowers.

Inalargerstreetscapecontextofpodiums,itisimportanttoretainaconsistentstreetwallheightinareaswhichadjoinheritageconservationareas.Thisallowsforvisualconsistencyandlimitsthesenseofenclosureofthesurroundingstreetscape.WhileanumberofstreetwallheightsarespecifiedwithinthePrecinct,generallytheheightanddetaileddesignofastreetwallshouldrespondtothebuiltformcharacteroftheareawhichcanincludeheritagefabric.Traditionally,inmoreestablishedurbancentres,thestreetwallheightisoftendefinedbynarrowfrontedVictorianorFederationeraterraceswithparapetheightsofapproximately10m.DuetothedifferentdevelopmentphasesofthePrecinctthereisnohomogenousbuildingtypologytoderiveaconsistentstreetwallheightfrom.Typically,streetwallheightsrangefromthe2-3storeysallowinga3-4storeypodiumtofitcomfortablyintothestreetscape.Podiumsshouldalsobearticulatedtorespondtoadjacentheritageitems.WithinthePrecinctthereareanumberoflargerbuildings,suchasbanksandhotelswhichdefinethestreetcorners.Newdevelopmentwithinthevicinityofthesebuildingsmayderiveitsstreetwallheightfromthesebuildings.Thiscanallowforgreaterstreetwallheightsandcreatesanopportunitytodevelopamoredistinctiveidentitythroughstrongerspatialdefinitionwhilestillrespectingtheestablishedheightoftheheritageitems.Figure15belowshowshowacontinuousstreetwallheightcanbedeveloped.

4.4 RespondtoFineGrain
SubstantialupliftrequireslargerbuildingsthatdonotrepresentthehumanscaleandthereforeitisimportanttoretainthefinergrainaspectofthePrecinctwherepossible.ResponseAtgroundlevelwheretherewillbehighlevelsofpedestriantraffic,itisimportanttopreservethefinegrainofsmallertenancies.Thisisparticularlyimportantwitholderbuildings(e.g.theCrowsNestRetailGroup)whichprovidemuchoftheexistingcharactertothePrecinct.Thiscanhelpfosterlocaldistinctiveness;encouragedesigninnovationandfurtherarchitecturalvernacular.Asdescribedabove,podiumswhichrespondtotheexistingstreetheight,helptomitigatetheimpactofhigherbuildingmass

behindthepodiumbyprovidingahumanscaletothedevelopment.Inthecasewherethereisanexistingbuildingthatistoberetained,thefinerstreetlevelgraincanbepreservedbysettingthedevelopmentbehindtheexistingformofthefinergrainbuildings.ThisisparticularlyimportantalongWilloughbyRoad,wherea‘village-like’collectionofeateriesandsmallcommercialtenancieshavecreatedanattractivetowncentreforthePrecinct.SeeFigure16aboveforanexampleofthedevelopmenttypethatmayoccurablockawayfromWilloughbyRoadtoensurethatthecharacterofthevillageisretained.Figure17demonstrateshowthefinegrainofthestreetcanbepreservedwhilstfacilitatinghigherdensitydevelopmenttowardtherearofthesite.

Forexample,adevelopmentmaybesetbackbehindaparapetandpreservethetwofrontroomsofanexistingVictorianErashopfront.Thiswaytheoriginalpatternofretaildevelopmentaswellasthemostsignificantelementsofthesiteremainintactandabletobeunderstoodwhilststillfacilitatingahigherdensitydevelopment.Anyconstructionontopoftheshopsshouldbesubjecttosetbackprovisionsthatmaintaintheconsistencyofthestreetscapeestablishedbythem.Theseprovisionsrequirecarefulconsiderationsoasnottodestroytheremnanttwoblocksoflow-riseshop/residences,particularlyastheyaresetbetweenthePacificHighwayandNicholsonPlace.Thisdoesnotleaveagreatdealofdepthoncesetbackistakenintoconsideration.
4.5 VisualImpact
AnyupliftandnewdevelopmentwillhaveavisualimpactontheheritageitemsandheritageconservationareasinthevicinityofthePrecinct.Theheight,bulkandscaleoflargescalebuildingsisoftendifficulttomitigatethroughdesignalone.ResponseUtilisingtreeplantinghelpstomitigatethescaleofchangeandalsotopartiallyscreenadjacentlarge-scaledevelopment.Whilethistypeofmitigationisnotpossibleinallareasoftransitionothermitigationmeasurescanbeundertaken.

4.6 Overshadowing
Preservingthesolaramenityofheritageitemsandheritageconservationareasisanessentialcomponentinminimisingtheimpactofthenewlargerscaledevelopment.ResponseBuiltformcontrolshaveconsideredovershadowingofcriticalopenspacesandsurroundinglowdensityresidentialareas,ensuringfuturebuildingenvelopesdonotcreateadditionalimpactonHeritageConservationAreasbetweenthetimesof9:00am–3:00pm.ItiscriticalthattheamenityofdwellingslocatedwithinHeritageConservationAreasandheritagelistedbuildingsisprotected.Ifamenityissubstantiallyreducedthedesirabilityofpropertieswillbeerodedandthusthelongtermprotectionofthesignificantitemsandareasmaybethreatened.

Thepreservationofexistingviewcorridorswasalsohighlightedasakeycomponenttobeimplemented.AnumberofkeyviewcorridorswereidentifiedduringpreliminarystudiesinStage1.Someoftheviewcorridorsidentifiedinclude:
• TheaxialviewcorridorsonstreetssuchasAlexanderStreetandWilloughbyRoad.
• ThecurvedPacificHighwayviewcorridor.• Themultipleviewcorridorsextendingfromthe‘FiveWays’Intersection.• Viewsfromexistinghousingtotherearoftowersandpodiums–avoiding
expansiveareasofblankfacadesetc.onthe4thelevation• ViewstowardsStLeonardsandCrowsNestfromfurtherafarsuchasthe
SydneyCBD.ResponseFourtoeightstoreystreetwallsareproposedalongPacificHighwaybetweentheproposedCrowsNestMetroandStLeonardsStation.Whiletwo–fourstoreystreetwallsareproposedalongtransitionedgesandlowscaleactivityareassuchasChandosStreetandWilloughbyRoad.Thisistoensurefuturedevelopmentrespondstothefinegrainformoftheexistingstreetscape,whilealsobeingabletosupportcommercialandretailactivitiesthatpromotethecharacterofthearea.Thestreetwallheightsrespondtotheformandfunctionoftheareasandensurefuturedevelopmentisabletosupplyfuturecommercialfloorspace.TheheritageitemsareconcentratedinanareaalongthePacificHighwaybetweenShirleyRoadandHumeStreet.TheyareboundedtotherearbyNicholsonLane.Inallthereare19individualheritageitemsalongthisstretchofroad.Theyarepredominantlytwostoreyshop/residencesoflocalheritagesignificance.Specialcareshouldbetakentoensurethatthestreetwallheightbetweenthesebuildingsismaintainedatthetypicalheightoftheirparapetsandthattherhythmofnarrowfrontedindividualbuildingsismaintainedinnewdevelopment.AnydevelopmentonthenorthwestcornerofHumeStreetandPacificHighwayshouldformatransitionfromthetwostoreyheightoftheheritageitemsoppositetofullsitedevelopmentfurtheralongPacificHighway.Inmostsituations,thefrontelevationoftheseheritageitemsisthepartwiththe

Higherdensitydevelopmentcanimpactuponthesmallscalepedestrianexperienceatstreetlevel,particularlywherethereisaninterfacewithHeritageConservationAreas.ResponseSmallscaleurbandesignresponsescanincreasetheamenityoftheprecinctattheinterfacebetweenHCAs.Thiscanhelpmitigatetheimpactatstreetlevelofthehigherdensitydevelopmentandeasethetransitionbetweenthezones.Theseinclude:
• Developmentshouldallowforcontributionstobemadetofacilitatetherelocationofelectricitypolesunderground.

TheDraft2036PlanhasconsideredtheheritageconstraintsandopportunitiesinthePrecinct.ThePlanhasidentifiedthestatutorylistingsapplicabletothesiteacrossthethreeLGAs.AttheperipheriesofthePrecinctareanumberofHeritageConservationAreas.ThePlanhasconsideredtheimpactthatasignificantupliftwillhaveontheselowscale,predominatelyresidentialareasandhasdevelopedmitigationmeasures,throughdesignandplanningtoreducetheimpact.Considerationsinclude:
