Application u/s 22C (1) of Legal Services Authority Act.
RESPECTFULLY SHOWETH: -
1. That the applicant is a __________________. The husband of the
applicant died in _______. The copy of the death certificate is
annexed as Annexure A-1
2. That the applicant is living at the abovementioned jhuggi since
1994 till Oct’2014 its demolition by the Chandigarh Administration.
3. That the applicant was issued voter ID card on the above
mentioned address. Copy of voter ID card is annexed as Annexure
A-2.
4. That the applicant was also Adhhar UID No. on the above mentioned
address. Copy of voter ID card is annexed as Annexure A-3.
5. That the applicant voted in the election and her name figured in the
voter list for the year 2004, 2005, and 2013 wherein her address was
same as mentioned in the head note of this application. Copy of all the
voter list are annexed as Annexure A-4 to A-6.
6. That it is also pertinent to mention that in 2013 the applicant
have some dispute with her neighbour and she has made a
complaint regarding this mentioning the same address. Copy of
this complaint is annexed as Annexure A-7
7. That all the above mentioned documents and facts show that
the applicant along with her family had been living at the above
mentioned address.
8. That the respondent notified a Scheme in the year 2006 titled
as “ The Chandigarh Small Flats Scheme 2006” for the
rehabilitation of the jhuggi dwellers as amended on 09-11-2009.
According to the scheme of 2006 and as per amendment, criteria
of eligibility ia as follows :-
D. Eligibility and mode of Allotment
6. (a) With respect to every block of a Notified Colony
selected for clearance, allotment of a flat shall be made as
under :-
(i) All person whose name appear in the biometric survey
and voter list as on Ist January, 2006 shall be eligible for
allotment of a flat on license basis. The name of the person
should also appear in the latest voter list of the year in which
allotment is ti be made.
(Provided that any person whose name appeared in bio-
metric survey but does not appear in the voter list as on Ist
January 2006 shall be eligible for the allotment of flat under
the scheme if his name appears in the voter list as on Ist
January 2004, Ist January 2005, Ist January 2007, and Ist
January 2008.
(ii) A person who owns more than one habitation in any of the
Notified colonies in his own name or in the name of any
dependent member of his family shall be entitled to the
allotment of only one flat under this scheme.
(iii) A family unit shall be entitled to one flat, provided it fulfil
all the conditions under this scheme.
(iv) Persons who had applied of plinth sites under the
Licensing of Tenements and Sites and Services in Chandigarh
Scheme, 1979 and are found eligible but allotments could not
be made due to misplacement of files in the Estste Office shall
also be eligible for the allotment under this scheme. They can
apply within a period of 30 days of the publication of the
notice which shall be published in such manner as the
competent authority may prescribe.

9. That the applicant is eligible for the allotment of flat under the
abovementioned scheme as
(i) Her name exists in the Bio-metric survey of 2006 conducted
by the administration and is part of the office record.
(ii) Her name figures in the Voter list as on 1st January 2006.
(iii) Her name also figures in the voter list as on 1st January 2004,
1st January 2007 nad 1st January 2008.
(iv) Her name also appears in the voter list as on 1st January 2013.
10. That the applicant obtained an Application Form No. 14674
issued by the Chandigarh Housing Board in compliance to the
latest notification dated 06.11.2006 as amended vide
notification dated 02.11.2009, and distributed through the
field staff of Estste Office along with official Chandigarh
Housing Board to all the jhuggi dwellers of notified colonies,
whose name figured in the Bio-metric survey and residing the
said colony.
11. That the applicant received a ___________________________ vide
dated 25.10.2013 through which her claim for allotment of flat
was rejected on following grounds :-
12. That the applicant make requests to the Respondents vide
letter dated ________________________. Copies of these letters are
annexed as Annexure A-8 & A-9.
13. That the Respondent did not consider her claim despite the
fact that the applicant had been living at the said place since
_______.
14. That the applicant is a poor widow with four minor children
and left homeless after demolition of _________________.
15. That the applicant is runnig pillar to post to get the flat
despite of her genuine claim.
It is therefore, respectfully prayed that the Respondent be
directed to consider my name for rehabilitation and allotment
of falt under “The Chandigarh Small Flats Scheme 2006” in
lieu of my Jhuggi No. _______________________. Chandigarh.
