For Allen Hernandez, the new field general of a

feisty and influential environmental group, it’s

personal.

Hernandez was afflicted with pollution-induced

asthma as a child growing up in Fontana. Three

decades later, his 6-year-old niece, Alani, has

asthma.

And, so, as Hernandez, 37, takes over as executive

director of the Jurupa Valley-based Center for

Community Action and Environmental Justice, he

is working to improve Alani’s life — and the lives of

millions of other residents of the Inland Empire.

Hernandez, the former statewide organizing

manager for the Sierra Club, started March 1 in his

new capacity.

“This is an opportunity of a

lifetime,” Hernandez said.

“Penny Newman is a legend.”

He was referring to the face of

the organization and its first

executive director. Newman

said she founded the group 40

years ago. And she stepped

down last month to launch a

campaign for a seat on the

Riverside County Board of

Supervisors.

Leaving sad

Newman is confident Hernandez will be an

effective leader.

“He understands what the history and mission of

the organization is,” Newman said. “I am leaving

sad, but very much happy that it is in his hands. I

don’t think there is another person I would feel as

comfortable with.”

Since 1978, the center has worked with

communities in Riverside and San Bernardino

counties to advocate for healthy and safe

environments. The group has helped contain

impacts from warehouses, reduce truck traffic

pollution and keep toxic chemicals away

from schools and homes.

The group has pushed city councils and county

supervisors, lobbied state and regional

regulators and tangled with developers. Among

other battles, it was party to a lawsuit challenging

the 40.6 million-square-foot World Logistics

Center warehouse complex in Moreno Valley by

Highland Fairview.

Iddo Benzeevi, president and chief executive

officer for Highland Fairview, signaled a

willingness to engage with the group’s leader.

“We congratulate Mr. Hernandez on his new

appointment and look forward to meeting him and

collaborating on important issues in our

communities,” Benzeevi said in an email .

Lytle Creek

Hernandez said he intends to continue the

tenacious, activist tradition of the Center for

Community Action and Environmental Justice.

Tenacity runs in his blood.

He was born in Los Angeles to parents who

immigrated from Guatemala. In the 1970s, his

mother and father organized a meatpacking union

in the Central American nation at a time when that

was inherently risky.

“They would tell me stories

about when their coworkers

would just disappear,” he said.

“And everybody knew that they

had been taken out.”

When Hernandez was 2 years

old, the family moved to

Fontana. Between 5 and 12, he

said he suffered repeated

asthma attacks.

“My parents used to drive up to

Lytle Creek so I could get some fresh air,” he said.

“We would sit out there in the middle of the

mountains, and I would start breathing better

again.”

Hernandez recalled one terrifying occasion when

he was rushed to the hospital because he could

hardly breathe and, upon arriving, was given six

shots in the back.

“I was always in and out of the emergency room,”

he said.

‘Tattooed on my arm’

Now he worries about his niece, Alani Hernandez.

He speaks of her as a father would talk about his

daughter.

“I don’t have any kids, so Alani is like my world.

The day she was born I got her name tattooed on

my arm,” Allen Hernandez said, rolling up the

right sleeve of the navy blue shirt he wore during a

recent interview.

“My niece is surrounded by all the new

warehouses,” he said. “So it is extremely personal

to me.”

It’s not that he hates warehouses. Hernandez said

they don’t create pollution by themselves. But they

do generate truck traffic that creates air pollution

in a region that can ill afford more smog.

Consequently, the group will push to set limits and

separate truck traffic from residential areas, he

said.

Hernandez said the ultimate solution is to convert

to trucks that run on electricity.

“We’ve got to wean ourselves away from the fossil

fuels,” he said.

Hernandez made clear his No. 1 priority will be

clearing the air. That, he said, must include both

local and regional strategies.

Jurupa Valley truck route

On the local level, the group will continue to

scrutinize developments as they come up, he said.

At the moment, the group is lobbying Jurupa

Valley to designate a truck route through the city.

Graciela Larios, community organizer for the

center, said the group wants trucks barred from

Etiwanda Avenue in a roughly half-mile stretch

between the 60 Freeway and Hopkins Street. The

goal is to protect a neighborhood of 101 homes off

Etiwanda, north of the freeway.

Larios said the group recommends trucks be

diverted north around the area via Milliken

Avenue, and east along Philadelphia Avenue.

Jurupa Valley Councilman

Verne Lauritzen said the city is

conducting a truck route study

to explore potential remedies.

“There likely will be some truck

restrictions in some

areas,” Lauritzen said.

But Lauritzen cautioned

that shutting a portion of

Etiwanda is a politically

delicate proposition, given that the busy road

parallel to I-15 is used by trucks in neighboring

cities, too.

“Sometimes you have to think a little bit

regional,” Lauritzen said. “We are not just an

island.”

Hernandez thinks regionally when it comes to

overall air quality.

And he intends to regularly prod the South Coast

Air Quality Management District, which regulates

stationary sources of pollution in Los Angeles,

Orange, Riverside and San Bernardino counties,

and the California Air Resources Board, which

regulates cars and trucks.

‘Like mutant sludge’

Hernandez is quick to acknowledge skies around

the Inland Empire are cleaner than they were in,

say, the 1960s.

“They used to be like mutant sludge,” he said. “But

is it good enough? The answer is, ‘No.’ We can do

better.”

On the plus side, Hernandez said, many state and

local leaders are committed to improving the air

more.

“They still need nudging along,” he said. “And

those who don’t think we need to go any farther

need a little more than a nudge.”

Despite the improvement, Southern California has

some of the nation’s worst pollution and is far from

attaining federal air quality standards.

Hernandez refuses to be pessimistic, though, about

one day reaching that elusive milestone.

“We’ll get it done,” he said. “As to when, I don’t

know. My main concern right now is, I want to get

there in time for my little niece.”

climbing in the Cleveland National Forest was

She was Joy Welling, 33, from Montclair, the

Orange County coroner’s office said.

The Orange County Fire Authority was called at

12:30 p.m. Saturday to a waterfall near the Blue

Jay campground, which is just outside Caspers

Wilderness Park, OCFA Capt. Paul Holaday told

City News Service.

OCFA Helicopter Two picked up technical rescue

personnel and their gear and dropped them at the

top of the waterfall, where a man who was

climbing with the woman was unhurt, Holaday

said.

The rescuers assigned to the helicopter were

lowered down to where the woman had died and

carefully recovered her body, he said. It was taken

to Caspers Park, where the coroner was standing

by.

The chopper then went back for the man, Holaday

said. The mission was completed about 4:30 p.m.

The two climbers were very experienced, he said.

The was the fifth waterfall from which they had

repelled in the isolated part of Orange County.

The Orange County Sheriff’s Department was

investigating the fall, Holaday said.

The incident happened off Ortega Highway, which

links Lake Elsinore in Riverside County with San

Juan Capistrano in Orange County.

They do it in San Francisco. They do it in Florida, Nebraska and Tennessee. Theyelect their public defenders. Why not in Los Angeles County?

In calmer times, this question might be of interest mostly to academics. It has takenon new urgency now, however, as L.A. County deputy public defenders rebelagainst the appointment of their interim leader, Nicole Davis Tinkham, because ofher lack of experience in criminal law. They plan to protest outside downtown'sClara Shortridge Foltz courthouse on Monday, the 54th anniversary of thelandmark U.S. Supreme Court decision in Gideon vs. Wainwright, which recognizedthat the 6th Amendment right to counsel — regardless of the defendant's ability topay — applies in any criminal case, whether state or federal, felony ormisdemeanor.

Deputy public defenders take their role as guardians of the 6th Amendmentseriously. What they lack in pay and resources compared to private-sector lawyersthey make up for in a sense of mission to serve the indigent and to push backagainst a culture of over-criminalization, excessive punishment and raciallyselective prosecution.

The Board of Supervisors already had been through several interim departmentleaders when it picked Tinkham in January to serve for six months while itcontinued to search for a permanent public defender. The appointment has beentaken by many in the criminal defense world as an attack on the independence of

the Public Defender's Office and a disruption in the careful constitutional balanceof power in the criminal justice system.

But there's a certain structural imbalance already, isn't there? The other players areelected, and because of that, they enjoy a measure of independence in carrying outtheir duties as they see fit. We elect the district attorney, who prosecutes criminalcases. We elect the sheriff, who polices much of the county and locks up accusedand convicted criminals. We even elect the judges. But the public defender is anappointee. How come? Why is San Francisco the only county in California to elect apublic defender?

Maybe the best answer is that it's San Francisco. Small, compact and notoriouslyliberal, it's a city in which voters are at least as vested in who represents criminaldefendants as who prosecutes them.

L.A. is liberal too, of course, but not as consistently so. We have been the birthplaceof many tough-on-crime measures. Like other counties, we elect our districtattorney to represent us in court and to protect us from lawbreakers. If we pick alousy lawyer, we suffer the consequences, at least in theory. Guilty people areacquitted, or perhaps charges are never brought. Crime proliferates. If need be, wemake a change, ousting the D.A. at election time and picking a replacement.

Public defenders are different. They don't represent The People. They are lawyers ina more traditional sense, representing individuals accused of crimes. They areemployed by us, but they don't work for us. They work for the people who ourlawyer, the district attorney, is trying to convict.

If L.A. were going through one of its fear-of-crime waves, voters who want to crackdown on crime might, if they elected the public defender, find themselves in theperverse position of choosing the least effective defense lawyer for indigent peopleaccused of crimes.

The Board of Supervisors has to deal with a different set of tensions. Its goal is notnecessarily the most acquittals or convictions, but rather an office that representsits clients in a way that at least meets constitutional standards. Its job in one senseis to butt out and let the lawyers do their work as they see fit, while standing readyto butt in when things aren't working and changes are in order. By butting in with

city, first started to feel the pinch of rising

retirement costs for city workers, it took several

steps to limit the fiscal pain.

As recommended by the League of Cities and other

authorities, Santa Cruz issued a bond to pay down

its rising pension liabilities, set aside funds to

cover increasing demands from the California

Public Employees Retirement System, shifted

some employees into lower-benefit pension plans

and made sure that its workers paid significant

portions of pension costs.

Nevertheless, the impact on the small city’s budget

continued to grow, leading City Manager Martin

Bernal to tell the city council in his 2016 budget

message that “our biggest challenge is the

skyrocketing increases in health and retirement

costs. These costs have gone from 28 percent of

general fund salary in 2004 to 43 percent of salary

in 2015, to an anticipated 58 percent of salary in

2020.”

With operating costs, particularly for pensions,

continuing to outpace revenues, even during a

generally upbeat economy, city officials projected

budget deficits growing to more than $20 million a

year by 2021.

Santa Cruz is not alone. Throughout California,

city governments are facing budget shortfalls as

CalPERS cranks up mandatory contributions in a

somewhat desperate effort to make the gigantic

trust fund healthy enough to cover pension

promises to millions of state and local government

workers.

It has only about 70 percent of the money it says is

needed to cover pension obligations – and that

assumes that its investments will return profits

that many experts believe are unrealistic. CalPERS

lost about $100 billion during the Great Recession

a decade ago and has not fully recovered, while

payouts to retirees grow due to demographic

factors.

City officials have repeatedly appeared before the

CalPERS board to seek relief, contending that

some cities will be driven to insolvency. But for the

most part, CalPERS officials have taken the

attitude that making the fund actuarially healthy is

their highest priority.

In February, the Santa Cruz City Council

unanimously declared a fiscal emergency,

preparatory to placing a quarter-cent sales tax

increase on the June ballot.

Santa Cruz isn’t alone on that approach either.

Throughout California, cities have taken, or are

planning, sales tax increases.

However, cities rarely cite pension costs as the

specific reason for the tax increases, because doing

so might generate more opposition. Typically, they

just say the money is needed for “police and fire

services,” which is a half-truth since police and fire

pensions are the biggest drivers of rising

retirement costs.

Also, a general sales tax increase ballot measure

requires only a simple majority vote, while one

dedicated to a specific purpose, such as pension

costs, would require a two-thirds vote.

our community values its municipal services and

we do want to be able to fulfill those expectations,”

Santa Cruz Councilwoman Cynthia Mathews said

as the state of fiscal emergency was declared.

Whether those expectations can, in fact, be fulfilled

is questionable even if Santa Cruz’s voters endorse

the sales tax hike.

The $3 million a year it would generate is just a

fraction of the extra $9-11 million that the city

calculates it’s paying to cover CalPERS shortfalls

and even a smaller slice of the $20 million annual

deficit city officials are projecting.

California’s municipal finance crisis is likely to get

worse before it gets better – if it ever does.

Several mayors from across the country — including LosAngeles, Phoenix and Mesa — have joined a coalition to findsolutions to the lack of affordable housing in their cities.

Fourteen mayors and CEOs have joined the Mayors & CEOs for U.S. Housing

Investment coalition. Part of their goal is to form public-private partnerships to

ensure the federal government continues to fund federal housing and homeless

assistance.

In Arizona, more than 40,000 people are homeless, according to the 2016

Arizona Department of Economic Security report on homelessness.

From 2015 to 2017, Maricopa County saw a 59 percent increase in the number

of people living unsheltered, according to the city of Phoenix . That accounts for

70 percent of the state's homeless population, according to Phoenix Rescue

Mission.

The scarcity of affordable housing, Phoenix Mayor Greg Stanton said in a

statement, "can put a local economy at a competitive disadvantage as many

employers have reported that a lack of affordable housing makes it more difficult

to recruit and retain employees."

The average rent for an apartment in Phoenix is $935, a 5 percent increase

compared with last year, according to RentCafe .

Rising housing costs and the shutdown of an overflow shelter for men have

contributed to an increase in the number of people living on the streets in

Maricopa County, experts told Cronkite News .

There aren't enough beds in the remaining shelters. For example, the 470 beds

at Central Arizona Shelter Services in downtown Phoenix are filled most nights

of the year, Mary Glennon, a program manager at CASS, told Cronkite News

earlier this year.

In California, housing prices have skyrocketed. The average rent for an

apartment in LA is $2,220, according to the RentCafe website. That has led to

sharp increase in homelessness.

The Rev. Andy Bales of Union Rescue Mission in LA said he's frustrated that

local authorities have done so little to deal with affordable housing and

homelessness. The mission is the oldest and largest private homeless shelter in

the country.

"Skid row is the worst man-made disaster in the U.S., and it's going to take a lot

of work to turn it around," Bales said, referring to a dilapidated 54-block area of

downtown Los Angeles.

Many cities across the U.S. struggle with housing and homelessness, he said,

and will require "every kind of approach, including the mayors' coalition."

He also said there is a huge need for an investment in more affordable housing,

such as micro units and tiny homes.

"We've got to not only get people off the streets . but we also have to create

innovative affordable smaller units that people with low income can actually

afford to live in," Bales said.

Oakland Mayor Libby Schaaf also joined the coalition. Her city has created a

temporary housing complex using Tuff Shed shelters.

"We actually got the business community to help us purchase Tuff Sheds," she

said. "Now, these are not intended to keep permanent residents. These are an

improvement over tents, but we were able to get people into safety, security and

services."

The sheds fill a lot owned by the Pacific Gas and Electric Co. Those staying in

the sheds can stay up to six months as they try to get back on their feet, officials

said.

The coalition wants to create three public-private partnership programs and

opposes federal funding cuts to housing programs such as the U.S. Department

of Housing and Urban Development.

Despite another hot and dry year with less than four inches of rain in the Los Angeles area, we are back to our water-wastingways. Two years ago, Californians were using 24% less water compared with 2013. This year, we're hardly conserving at all —just 1%.

Clearly, our earlier successes were more behavioral than structural. If lawn removal and new efficient fixtures and applianceshad saved all that water, we wouldn't be seeing this momentous backslide. Meanwhile, our sources of imported water — fromthe Delta, the Colorado River, and the Los Angeles aqueduct — have all been revealed as vulnerable to politics, drought,climate change and crumbling concrete in recent years.

Los Angeles sorely needs to transform its water infrastructure. In a proactive move, Mayor Eric Garcetti and the city of LosAngeles this month released the Resilient Los Angeles plan, which outlines 96 steps to strengthen the city. Among thesmartest moves: reduce our reliance on imported water from the current 85% to less than 50% by 2035.

Right now, if an earthquake severed our connection to the L.A. Aqueduct, the State Water Project or the Colorado RiverAqueduct, we would quickly be in dire straits. With a local supply portfolio — balanced between recycled water, capturedstormwater, and groundwater — the city will survive catastrophes. Pumping less water from faraway sources hasenvironmental benefits too. Moving water across the state uses huge amounts of energy. Leaving more water in the Delta,Owens Valley and the Colorado River watershed would reduce ecological impacts and the carbon footprint of our watersupplies.

The bigger question is could Los Angeles become entirely water self-sufficient by 2050? Even as we face climate change andpopulation growth? The answer is yes, but it will require a modern, integrated approach to water management.

Currently, only 1% to 2% of the city's water supply comes from recycled water, but that could supply roughly 40%. All thewastewater going to the Terminal Island Treatment Plant gets recycled, but that's not the case at the Tillman, Glendale orHyperion treatment plants. Those three dump treated wastewater into the L.A. River and Santa Monica Bay.

If all the treatment plants were upgraded, their recycled water could be injected or filtered into our local groundwater basins.This highly treated wastewater could be pumped directly to the Los Angeles Department of Water and Power's drinking waterfiltration plant for distribution to customers — providing the state establishes regulations for direct potable reuse — within adecade.

Stormwater is another local source we haven't adequately tapped. Based on a DWP study, urban runoff can provide anadditional 58,000 acre-feet of water, or about 11% of current annual use. But the potential is there for much more: In anaverage rainfall year, 270,000 acre-feet per year of stormwater ends up flowing down the L.A. River into the ocean. Fundingfor green stormwater infrastructure could come from the L.A. County Safe Clean Water Measure, which is expected to be onthe ballot this November.

The final piece of the puzzle is our local groundwater basins. If Los Angeles can improve rainwater absorption with greenstreets and alleys, infiltration basins, biofilters and other nature-based solutions, local aquifers can provide approximately114,000 acre-feet per year. An essential first step is already underway: the remediation of the San Fernando Valley aquifer.Our primary local aquifer, it became so contaminated with industrial chemicals that it's a Superfund site. But the city, withsupport from the state, has begun a $600-million project to clean it up. By cleaning the groundwater, DWP could provideresidents and businesses with up to 20% of local water supply.

If we tally all those sources — recycled wastewater, captured stormwater and new groundwater — Los Angeles has about372,000 acre-feet of local water that it could bring online by 2050. That's still not quite enough for a population likely to be4.5 million.

The mayor's plan uses a consumption rate goal of 98 gallons per capita per day. To achieve complete water self-sufficiency,Angelenos would need to decrease consumption to approximately 75 gallons per capita per day. Numerous Australian,Southeast Asian and Western European cities have managed that. For Los Angeles to join them, all properties within the citywill need to replace turf with native, climate-appropriate landscapes. Residents will need to use water-efficient washingmachines and dishwashers. Commercial properties will need to install water-efficient cooling technologies. Also, DWPcustomers should get individual smart meters that provide real-time consumption information.

Going local on water won't be easy and it won't be cheap. But it can be done. The city managed similar transformation oncebefore when — in the span of a decade — it rebuilt the Hyperion Treatment Plant, replaced miles of old sewer lines andstopped dumping sewage sludge to clean up Santa Monica Bay. If that history can repeat itself, the benefits for Angelenos anddistant ecosystems are enormous.

The movement went statewide with Senate Bill 54, an initiative by lawmakers to protect immigrants without legal residencyby restricting local law enforcement's cooperation with federal immigration authorities.

Now, one Southern California city may want out.

On Monday, the Los Alamitos City Council is set to consider an ordinance that exempts the small Orange County municipalityfrom the state's sanctuary law, which took effect in January.

A city agenda report argues that the state law is at odds with the U.S. Constitution and "infringes on the rights of the citizens"of Los Alamitos.

"In view of this contradiction, it is impossible to comply with both the Constitution of the United States and the Constitutionof the State of California," the report said. "In this situation, my belief is that the Constitution of the United States hasprecedence over the Constitution of the State of California."

The report indicated the initiative came from Mayor Pro Tem Warren Kusumoto.

The state's sanctuary law has drawn sharp criticism from federal officials, including Atty. Gen. Jeff Sessions, who ischallenging it in court. Earlier this month, the Justice Department filed a lawsuit against California over three laws, includingSB 54.

The law prohibits state and local police agencies from notifying federal officials in many cases when immigrants potentiallysubject to deportation are about to be released from custody.

Administration officials argued that the state measures not only hinder their ability to carry out federal law, but also putimmigration agents and communities at risk.

The other laws administration officials seek to challenge make it a crime for business owners to voluntarily help federalagents find and detain undocumented workers, and create a state inspection program for federal immigration detentioncenters.

Trump, who made his first visit to the state as president last week, has frequently criticized California for fighting hisimmigration platform and moves to increase deportations.

Few ballot measures have ever been more resoundingly embraced by Californians than Proposition 2, the 2014 constitutionalamendment championed by Gov. Jerry Brown requiring that more state tax money be put aside for rough economic times.

But there's some surprising analysis now being shared inside the state Capitol: The proposition that won 69% of the votecould have the surprising effect of limiting how much cash gets stockpiled for easing the budget cutbacks inevitable in thenext recession.

In short, it's about trust. If only voters believed the California Legislature would do the right thing, they would givelawmakers more flexibility in governing the state and would impose fewer rules through the ballot box.

Proposition 2 was just such a rule, a governing "two-fer" that increased the size of the state budget's rainy-day reserve fundwhile also creating a new mandate for paying off government debt. "Proposition 2 sets aside money to prepare us foreconomic storms," Brown said in a TV ad during the 2014 campaign.

It also sets a firm cap on how much cash can be held in reserve — no more than 10% of California's general fund taxcollections. At that point, Proposition 2 sends earmarked cash not to a savings account but to infrastructure projects. Thatspending certainly has benefits, but it's the kind of mandate that hinders flexibility in responding to the specifics of a crisis.

And this spring, those rules matter. Brown has proposed using $3.5 billion in surplus tax revenue to top off the rainy-dayreserve fund ahead of schedule. If lawmakers sign off on his plan, the mandatory infrastructure payments will begin next yearand would probably continue into the foreseeable future, even if the economy slows and budget deficits return.

A report almost two weeks ago by the nonpartisan Legislative Analyst's Office predicted Brown's eagerness to overpay intothe rainy-day fund could trigger almost $2.9 billion of infrastructure spending over the first three years. In previous crisistimes, that's the kind of money that would go toward shielding services such as child care or higher education.

The growing fear in Sacramento of an economic downturn in the near future makes this a discussion worth having. Given thefine print of Proposition 2, there's only one shot at deciding what to do with the $3.5 billion in extra tax revenues.

The analysts' report suggests that the Legislature consider rejecting Brown's proposal, and instead place the surplus cash in adifferent, more flexible reserve account while making only the required payment to the Proposition 2 fund. That way, thethinking goes, lawmakers could possibly end up with $1 billion more in emergency cash in the event of a budget deficit.

None of the existing options would fully fill the hole that even a modest recession would create. "That said," write theanalysts, "these reserves would still buy the Legislature considerable time as it made other choices to confront such abudgetary challenge."

To do this, though, legislative leaders will have to confront Brown and challenge his reputation for being the most frugal,prudent Democrat in Sacramento. They've privately grumbled in recent years about how little credit has been given to theLegislature. Objecting to the governor's plan for this year's cash surplus could provide lawmakers the chance to prove thathe's not the only politician who's eager to plan for the worst.
