Summary of Opinion: The parties’ discovery appeal presented the recurring conflictbetween liberal allowance of broad discovery in civil litigation and the proscription againstoverly expansive “fishing expeditions” into matters of questionable relevance. Informationis discoverable if it appears reasonably calculated to lead to the discovery of admissibleevidence, and evidence of prior accidents or medical complaints are admissible only if theearlier injuries are properly connected to the complaints at issue. Therefore, the defensewas permitted to subpoena only those medical records and insurance files relating to priorinjuries which bear connective relevance to the injuries in dispute in this case. Moreover,since the plaintiff merely averred generally that he suffered physical and mental andsuffering as a result of his physical injuries, but did not claim to have suffered any discretemental injury, severe emotional trauma requiring treatment, or other comparablepsychiatric/ psychological condition, he did not waive the psychiatrist/ psychologist-patientprivilege and the defense request for pre-accident treatment records on plaintiff’spsychiatrist was denied.

Summary of Opinion: The discovery appeal in this psychiatric malpractice action raisedan issue of first impression: whether a Sentinel Event Report that is forwarded by ahospital to the accreditation organization, the Joint Commission, is privileged andprotected from discovery by Section 4 of the Peer Review Protection Act (PRPA), Section311 (a) of the Medical Care Availability and Reduction of Error (MCARE) Act, or Section299b-22 of the Federal Patient Safety and Quality Improvement Act of 2005 (PSQIA)?Although the Joint Commission’s report that it provided to the hospital following the JointCommission’s receipt and review of the hospital Sentinel Event Report was protected fromdiscovery since the hospital did not establish that it was prepared or reviewed by thehospital’s peer review committee. Nor was the Sentinel Event Report shielded fromdiscovery under the MCARE Act inasmuch as the report was not developed by the hospitalfor the purpose of complying with the MCARE Act’s patient safety reporting requirement.Additionally, since the Sentinel Event Report was not prepared by the hospital for reportingto or by a federally-recognized patient safety organization, it did not constitute protected“patient safety work product” under the PSQIA. Thus, the patient’s estate was entitled todiscovery of the Sentinel Event Report.

Summary of Opinion:

Plaintiff in this auto case filed a motion in limine to preclude evidence of her pre-screenurine test that was performed almost one year after the accident and which was positivefor marijuana and opiates. Defendant argued that the positive drug screen was admissibleto impeach plaintiff’s “credibility involving her denial of marijuana use.” However, it is wellsettled that a witness may not be impeached on “collateral” matters and that generalquestioning concerning drug use does not bear witness’s veracity. Moreover, a matter isdeeded “collateral” if it is not admissible at trial for a purpose independent of the profferedcontradiction, and defendant did not identify an independent basis for introducing evidenceof plaintiff’s post-accident use of marijuana. Therefore, plaintiff’s motion in limine wasgranted.

Summary of Opinion: Defendant, who was sentenced for indecent assault of a 12 yearold girl in 2004 and required to register and report as a sexual offender for ten years underthe existing version of Megan’s Law, challenged the retroactive application of the SexualOffender Registration and Notification Act (SORNA) which became effective on 12/20/12and imposed a lifetime registration obligation upon defendant. Defendant argued thatSORNA violated the ex post facto clauses of the U.S. and Pennsylvania Constitutionswhich prohibit the retroactive application of a law that imposes greater punishment thanthe law annexed to the crime when it was committed. Although the ex post facto clausesprohibit laws inflicting greater punishment then the law that was in effect when the crimewas committed, they do not bar the retroactive application of non-punitive regulatoryscheme, and the legislatures subjective purpose in enacting SORNA was to create a civilregulatory scheme, rather than a criminal penalty. Furthermore, based upon the relevantfactors articulated in Kennedy v. Mendoza-Martinez, 372 U.S. 144 (1963), SORNA wasfound not to be so punitive in its purpose or effect as to negate the General Assembly’sstated intent to deem it civil. Hence, since defendant did not establish the SORNA’sretroactive application violated the federal or state ex post facto clauses, his petition toreassess or reclassify his registration period was denied.
