My journey as your 2011 HBAL President has been very rewarding. I send my sincerest thank you to each member for this great opportunity. I enjoyed all the kind words and comments from the members I worked with this past year.

In January, I will be passing the gavel to Dan Klein, Sr. I look forward to working under his leadership during 2012. His knowledge and background will be a great benefit for our Association. I have said this more than once,

but our Association is a powerful group of professionals and we are looked up to around our community. We need to continue to be the Association that takes charge and helps to build Lincoln in a positive pro-job and housing area. The key is to continue to bring jobs to Lincoln, then second, housing is most important.

I hope everyone has their goals and plans established for 2012. Please allow time to be an active member of HBAL as the rewards are immeasurable.

I truly enjoyed representing you in 2011. I will never forget the honor you have given me. May you each be blessed with a successful 2012.

In December 2010, Congress extended the so-called Bush-era tax cuts by passing the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010. However, for investors, the legislation may represent not a pardon but a stay of execution. While it’s true that federal tax rates on income, qualifying dividends, and capital gains have been extended through the end of the 2012 tax year, many of the issues that influenced the debate over tax rate extensions will continue to be the subject of heated discussion. As a result, investors have been granted a reprieve while Congress wrestles with those issues. That’s time you can use to think about how best to position your portfolio.The can won’t stay kicked down the road foreverWhy should you look at the time between now and 2013 as an opportunity? Be-cause the U.S. budget deficit is at levels that both political parties recognize can’t be sustained long-term. In 2010, a presidential budget commission recommended addressing the problem through a combination of spending cuts and tax increases. Though the proposals didn’t get enough support to be submitted to Congress, the deficit problem hasn’t gone away. Even if Congress can agree on budget cuts, the possibility of higher taxes in the future can’t be ruled out.There are several categories of investors who should be paying particular atten-tion to the planning process in the coming years. They include people with invest-ments that have appreciated substantially in value; people who rely on dividends and bonds to provide them with ordinary living expenses; and people who are considering investing in the newly issued stock of a small business.Capital gains and dividendsThe tax cut extensions gave investors who have large unrealized capital gains some breathing room. Rather than a top tax rate of 20%, long-term capital gains will gener-ally continue to be subject to a maximum rate of 15%, and the rate for investors in the lowest two tax brackets will remain at zero. If you own investments that have appreci-ated substantially in value and that now represent a bigger portion of your portfolio than you’d like, you have another chance to examine whether it makes sense to unwind those investments before the end of 2012. Taxes obviously are only one factor in mak-ing such a decision, of course. However, if you’ve been considering selling an asset anyway, you’ve got some time to plan and gradually implement a strategy for doing so.Two points worth remembering: first, unless further action is taken, the top long-term capital gains rate will increase to 20% after 2012 (a top rate of 10% will apply to investors in the 15% tax bracket); and second, even at the increased level, the rates on those gains would still be relatively low. As recently as 1986, under President Ronald Reagan, the Tax Reform Act of 1986 provided for capital gains to be taxed at the same rates as ordinary income, with a top rate of 28%. To paraphrase Mark Twain, no one is safe when Congress is in session, and there’s no guarantee that the top capital gains rate after 2012 might not be increased beyond the scheduled 20% maximum.Qualified dividends will continue to be taxed through 2012 at the long-term capital gains rates rather than as ordinary income, as they were before 2003 and are scheduled to be again beginning in 2013. The higher your tax bracket and the more reliant you are on dividends for your income, the more you should be aware of the potential impact if that income were subject to higher taxes. Again, many factors will affect your decision about the role of dividends in your portfolio, including the potential for higher interest rates in the future. However, doing some “what-if” analysis might be useful.Taxable vs. tax-free bondsTaxable bonds typically pay higher interest rates than municipal bonds. However, if you’re in a relatively high tax bracket or expect to be in one in the future, munis can potentially offer a better after-tax return. They may be worth a second look between now and 2013, when--separate from any potential increase in federal income tax rates--the unearned income of people making $200,000 a year ($250,000 for couples filing a joint return) is scheduled to be subject to a new 3.8% Medicare contribution tax. Absent further legislative changes, that could make munis even more attractive for affluent investors.However, as with any investment decision, there are many factors to consider. Local and state governments have come under severe financial constraints in recent years, and though the default rate on muni bonds has historically been low, default by individual governmental bodies is always possible. Also, the legislation that extended the tax cuts did not authorize continued issuance of Build America Bonds (BABs) beyond 2010. During the almost two years BABs were authorized, many lo-cal and state governments used them to tap the taxable bond market; that temporarily reduced the issuance of new tax-free munis. However, since BABs can no longer be issued without further authorization from Congress, the supply of new munis may increase, which could affect prices. Finally, interest rates have been at historic lows since the end of 2008; since bond prices move in the opposite direction from their yields, rising interest rates would not be good news for bond prices.Tax traps with munis: Only the interest paid by muni bonds is tax free; you could owe taxes on any increase in a bond’s value when sold. Also, not all munis are tax exempt; the primary example is so-called private-purpose bonds, whose interest is taxable at the federal level unless specifically exempted. And even if it is specifi-cally exempted from regular federal income tax, interest on private-purpose bonds may be included when calculating alternative minimum tax (AMT). Finally, hold-ing tax-exempt securities in a tax-deferred account could mean you’re accepting a lower return but getting no additional tax advantage.Tax break for qualifying small business stockTo help small businesses raise capital, the Internal Revenue Code offers a tax break for investments in businesses that meet certain qualifications. The Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 extended the exclusion of 100% of any capital gains on the sale of qualified small

business stock. The 100% exclusion now applies to qualifying stock issued after September 27, 2010 and before January 1, 2012.The 100% exclusion is higher than that previously available. Prior to the 2010 legisla-tion, the exclusion amount for a qualifying small business investment was generally 50% of the capital gains on stock issued between August 10, 1993, and February 17, 2009, or 75% for stock issued after February 17, 2009, and before September 28, 2010.If you’re interested in making an investment that qualifies for the exclusion, you should be aware of some of the restrictions that govern it:• You must hold the stock for more than five years.• The business must satisfy certain active business requirements.• The gross assets of the business may not exceed $50 million before or immedi-

ately after issuance of the company’s stock.• The stock must be acquired at original issue rather than purchased through the

secondary market. (Exceptions apply, including those relating to qualifying stock acquired through inheritance or as a gift.)

• A qualified investor must be a noncorporate investor (though passthrough enti-ties such as S corporations and partnerships may qualify).

• You may not sell the stock short during the required five-year holding period and still receive the exclusion.

There are limits on the total amount of gain that is eligible for the exclusion. There also may be special considerations if you roll over the gain from the sale of your stock to another qualified small business stock, or if you receive qualified stock as part of your deferred compensation plan. Consult a financial professional about your specific situation.2013 and beyondThe nation’s financial pressures will almost certainly mean continued adjustments to the tax code as 2013 approaches. Though there are no guarantees about what will happen when the new provisions expire, investors generally have another chance to fine-tune their planning efforts while taxes remain historically low. Improving Housing Markets

Lincoln is Among Twenty Metros to Join List of Improving Housing Markets Index in December

The number of improving housing markets continued to expand for a fourth consecutive month in December, rising from 30 to 41 on the latest National Association of Home Builders/First American Improving Markets Index (IMI), released today.

The December list featured 20 new additions, including several major markets such as Washington, D.C.; San Jose, Calif.; and Toledo, Ohio. Meanwhile, nine smaller markets dropped off the list, primarily due to softer house prices.

The index identifies metropolitan areas that have shown improvement from their respective troughs in housing permits, employment and house prices for at least six consecutive months.

New entrants to the list in December include the following:

Ann Arbor, MIAthens, GABoulder, COBurlington, VTCanton, OHCharleston, WVDanville, VAFort Wayne, INGrand Forks, NDJackson, MS

Kingsport, TNLaredo, TXLincoln, NEMuncie, INMuskegon, MISan Jose, CAScranton, PAToledo, OHWashington, DCWinchester, VA

The nine markets that dropped off the IMI in December include Alexandria, La.; Fairbanks, Alaska; Hinesville, Ga.; Houma, La.; Jonesboro, Ark.; Lima, Ohio; Pine Bluff, Ark.; Sumter, S.C. and Waco, Tex. All but two of these metros fell from the list due to softening house prices. The exceptions to the rule were Jonesboro and Waco, where declines were registered in employment and single-family housing permits, respectively.

The IMI is designed to track housing markets throughout the country that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top improving Metropolitan Statistical Areas. The three indicators that are analyzed are employment growth from the Bureau of Labor Statistics, house price appreciation from Freddie Mac, and single-family housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metro area must see improvement in all three areas for at least six months following their respective troughs before being included on the improving markets list.

Eye of the EconomyMultifamily a Bright Spot in a Housing Market

Showing Little Luster The economic and housing news of the past few weeks suggests a continuation of the flat recovery.

The Federal Reserve’s Beige Book showed the nation’s economic activity growing at only a “slow to moderate” pace. While manufacturing activity expanded and consumer sales climbed modestly in most of the Fed’s bank districts, residential real estate remained weak, weighed down mostly by sluggish single-family housing construction.

In keeping with the moderate pace of employment growth seen during much of 2011, 120,000 jobs were added in November, again below the level needed to accommodate an expanding labor force. More than half of November’s decline in the unemployment rate to 8.6% was due to a decrease in the labor participation rate, suggesting that the rate of unemployment will shift upward again in the next few months as discouraged workers return to the job market.

Despite efforts to pay down debt and build up savings, households continued to see their balance sheets deteriorate in the third quarter, with stock market declines wiping out $2.7 trillion of their financial assets. As a result, overall household net worth declined 5%.

While consumers in recent months have indicated that they view their current and future financial situations more favorably, the two main consumer confidence indexes remain at low levels, in line with those seen at the end of the recession.

Although home building — particularly single-family — remains slow, the NAHB/First American Improving Market Index continued to expand in December with the addition of 11 metro areas, raising the number of improving markets to 40. Largely absent from the index so far are major metropolitan markets that dominate the housing statistics.

Pointing to a bright spot in the broader U.S. housing market, the Fed’s Beige Book noted improvements in multifamily construction in New York, Philadelphia, Cleveland, Chicago and Minneapolis.

Meanwhile, reflecting consistent improvement in multifamily housing starts this year, NAHB’s Multifamily Production Index for

the third quarter registered its fifth consecutive increase, reaching its highest reading since the fourth quarter of 2005.

While market absorptions drifted down over the first half of 2011, vacancy rates have steadily declined, which is a hopeful sign for future expansion in the multifamily market.

Credit conditions continue to restrain the housing recovery, with a recent survey showing that a majority of NAHB members saw the shortage of acquisition, development and construction credit (AD&C) worsen in the third quarter.

Builders are also struggling against a flawed appraisal process. In a recent survey, one in three builders reported losing signed sales contracts in the previous six months from appraisal values coming in below the contract sales price.

Flawed appraisals are also choking off AD&C credit, with falling appraised values for land and subdivisions under development leading some financial institutions to stop lending to developers and builders, to demand additional equity and even to call in performing loans.

electrical. Volunteers are also finishing up the exterior. If you are interested in assisting in this project, please
