Kleinhans, my Husband; a Father; a Friend; a Colleague; a Conserva-

tionist; a Mentor; and most of all his faith, his Christian belief, have

immensely influenced and is still influencing my life as well as so many

other lives, even still today and tomorrow!

The definition of honour is: high respect as well as having a great rep-

utation.

in all of his dealings with others.

Theo’s characteristic of sacrificing his time and energy for others was

Theo’s life would seem too short to many, but those

who were touched by him understood that the

quality of existence far exceeds the quantity

of time in which one lives. His touch and gently

smile with bright blue eyes, brought so much joy to

all.

The Gentle Giant, gave us and is still giving us all

such courage and hope and still reminds us of the

preciousness of life.

He loved to research every aspect of life, his Klein-

hans Genealogy and “White Tribe” which he started

some 30 years ago, was his lifetime ambition to com-

plete, which he duly completed 3 month prior to his

passing. He could spend hours in front of the com-

puter to research and collate his findings, the end

result, magnificent products of his dreams, determi-

nation and authenticity.

He enjoyed reading stories and every night, for

many years, he would spend a few hours complet-

ing VOLUMES of crosswords…….always search-

ing to enrich his already incredible vocabulary and

the commands of the Afrikaans and English lan-

guages.

Theo will always be remembered, we will reminisce

and great treasures will be brought to mind. If

you remember people or events from the past, you

still have an idea of them in your mind and you are

able to think about them. What does remember

mean? To keep (someone) in mind as worthy of con-

sideration or recognition of his many years of dedi-

cated past services.

No man is an island

When we achieve, we usually do so because others

have helped, therefore the gift or acknowledgement

you give in return, is for what was given to you.

With regard to be above, every one of us have had

first-hand experience of the following attributes dur-

ing a meeting or encounter with Theo, I can honestly

also add the following about Dr Theo Ernst Klein-

hans….

• Passion for his work, which became his hobby!

• Passionate about fauna and flora!

• Problem solver!

• Dedicated!

• Communication skills!

• Work ethics, which will always guide us!

• His knowledge and engineering skills made so many projects come together!

• He always found a way to get it done – and done well!

• It's really admirable how he always could see projects through from conception to completion!

• He spoke up in meetings and provided unique perspective!

• Nature conservationist!

Our Theo will always be with us. He is the whisper of the leaves as we walk through the bush or sit at an open bush-fire drinking POLISIEKOFFIE, he is the substance that creates pleasure where ever he goes. Our Theo lives inside our laughter, he's crystallized in every tear drop. He’s the place you came from, your first home and nothing on earth can separate you from US, your loved ones. Not even time, not even space... not even death! Our Theo … is a living presence!!

and no one will know as I pour the drinks that the towel on the bar was yours -

a lasting reminder that you were here - and, as I smile and wipe the spilled ice

Die horlosie stap ongesteurd voort, terwyl ons aardse bewoning al korter word. Ernstig bedink jy jou laaste termyn hier op aarde. Jy maak ‘n opname van waartoe jy nog instaat is, watter leemtes nog gevul moet word en stel prioriteite. Hierdie proses verloop ietwat as volg … Eendag baie lank gelede, is my oupa oorlede. . . . maar dit was maar goed en reg, want hy was al oud! Jare daarna is my pa oorlede . . . maar op 'n manier was dit ook maar goed en reg, want hy was ook al oud. Nou besef ek dat van ons vriende en familie ook nie meer met ons is nie en raak verstom daaroor … want hulle was dan nog so jonk! Stadig maar seker begin die werklikheid van nou … vandag, soos yskoue water in jou wese intrek. Beide my oupas en my pa is jonger oorlede as wat ek nou oud is. My ma en beide oumas het wel diep in die 90’s getrek,

maar dit was ietwat verwagt. Nou vra ek … waarnatoe is ek op pad? Sommige van ons is al selfs die Bybelse tyd verby van ‘three score and ten’. Nou besef ek dat ek die oudste lewende naamgenoot in ons familie is, en dat ek nou die verantwoordelikheid van gesinspatriarg moet dra en voorbeeldig moet vertoon en lewe. Ek bepeins dit alles rustig, en vreemde emosies neem van my besit. Ek wil huil oor die jare wat verby is … maar ek wil ook nog jubel oor die tye wat nog kan kom. My raad vandag aan al my vriende en familielede is … tel elke dag julle manna op ... drink elke dag van die water wat Hy vir jou uit die rots uit gee … leef dankbaar voluit … en volhoudend … huil kortstondig oor die hartsere in jou lewe ... doen dan opgewonde met ywer die dinge wat die Here nog wil hê wat jy moet doen. Treur oor hulle wat weg is … maar doen meer moeite, met hulle wat nog hier met ons is. Hou op om geld na te jaag … Hou op versamel … My oom Abe het altyd gepraat van doodswaens wat nie sleepwaens saamtrerk nie! Gaan dien die Here en geniet jou laaste paar jare saam met jou geliefdes! Kan jy onthou wat die digter sê - "Wat ek is, is net ge-nade! en wat ek het, is net geleen!" Ons almal se toekomspaaie loop nou vorentoe maar hopelik terselfdertyd Boëntoe. Seën en voorspoed vir jul elkeen se uitsonderlike reis in die jaar 2020. Ek wil afsluit deur te sê: "Leef tot Eer van die HERE, ger-eed om Hom te ontmoet . . .want wanneer dit is . . . weet net Onse Hemelse Vader alleen!". Mag jou 2020 jaar verloop volgens jou en ons Hemelse Vader se wil.

There appears to be a substantial element of con-

fusion regarding “Goods Hoists” and “Access

Goods Only Lifts”. Taking into account that 2020

is the critical year, we shall attempt to shed some

clarity on the background to the current scenario.

REGULATORY REQUIREMENTS FOR

‘GOODS HOISTS’

• Prior to December 2010, ‘Goods Hoists’

were regulated under the Occupational

Health and Safety Act No.85 of 1993

(OHSAct) Driven Machinery Regulations

- Section 17 (DMR-17) ...

• Prior to this, ’Goods Hoists’ were regu-

lated under The Machinery and Occupa-

tional Safety Act of 1983 (MOSAct) -

Regulation C45 ...

• Prior to this, ’Goods Hoists’ were regu-

lated under the Factories, Machinery &

Building Works Act of 1942 - Reg. C45.

• Under the amended OHSAct LEPC (Lift, Esca-

lator and Passenger Conveyer) regulations ef-

fective December 2010, ‘Goods Hoists’ be-

came classed as “Access Goods Only Lifts”

under a new standard SANS 1545-5.

This means that the approximate 20

000 ‘Goods Hoists’ installed in South

Africa between 1942 and 2010, are at

varying levels of compliance to the lat-

est 2010 regulatory standard.

Accordingly, new areas regarding ...

registration with the Dept. of Labour

24-monthly compliance inspections

Six-monthly rope inspections

monthly service visits

maintaining of records

appointment of a competent service provider,

etc ...

to name but a few ... became mandatory

requirements after September 2010.

• All Access Goods Only Lifts installed after Sep-

tember 2010, should comply with SANS 1545-5

as the design standard.

• Regretfully, an anomaly existed up until Sep-

tember 2015 due to Part 17 still being present

in the Driven Machinery Regulations. The

Industry took this to imply two parallel stand-

ards, which it most certainly was not meant to

be, but was an escape route for them.

• This grey area only existed between September

2010 and September 2015, whereby units

could still legally be installed under DMR 17,

due to ... DMR 17 only being repealed by

DoL in September 2015.

• In June 2015, a government directive was is-

sued to the effect that all “Goods Hoists” in-

stalled under DMR 17, shall be upgraded to

comply to SANS 1545-5 within five years of

the date of the publication (June 2015). However, Section 24 of the new Driven Machin-

ery Regulations states that … these new reg-

ulations shall commence on 30th Sep-

tember 2015.

• The Dept. of Labour, after recognising that it

would not be possible for every “Goods Hoist”

to be upgraded to SANS 1545-5 due to existing

hoist-ways etc., engaged stakeholders to devel-

op a set of minimum criteria for … existing

hoists (installed under DMR 17 prior to Sep-

tember 2015) to comply with … The “Code of

Practice for Existing Goods Hoists” was

compiled with the intention of improving the safety

on units that would not be able to comply fully

with SANS 1545-5. One must also take into ac-

count that DMR 17 only listed 10 requirements.

• The “Code of Practice for Existing Goods

Hoists” was issued by Chief Inspector Mr Tibor

Szana as a directive on 3rd February 2017

(Government Notice No.40594 - Gazette R94).

At a separate Stakeholder’s Forum with the

Regulator in Pretoria, it was confirmed

that ...

• The due date for compliance for ALL

‘Goods Hoists’ to comply with the ‘Code

of Practice for Existing Goods Hoists’ is

… 30th September 2020.

• The due date for compliance to SANS

1545-5 for all Access Goods Only Lifts

installed after 30 September 2015 is …

30th September 2020.

• All units registered and installed after December 2010 using SANS 1545-5 as the design stand-ard (in the application for registration), must comply to SANS 1545-5 from the time of instal-lation. This is a simple matter as the application to register detailed SANS 1545-5 in the first in-stance.

Bonnie has been inundated with calls

over the past few weeks, mostly to in-

quire WHERE , WHEN and WHAT the

regulations are that require these old

hoist units to be made compliant!

Furthermore, they mostly request (free)

copies of the various communications!

Hopefully, the above explanation clears

the confusion regarding target dates.

WHERE ARE WE NOW?

While most owners choose to be intentionally igno-

rant of the mandatory requirements, there have been

attempts by a few service providers to convey the

correct information. Notably, there has also been

communication via social media from one consulting

entity. On the flipside, there are a multitude of manu-

facturers and service providers that are absolutely

clueless with respect to regulatory and design stand-

ards matters. The irony off course, is that collectively,

we all work in an intensely regulated sector.

Sadly … “To date, nobody can claim know-ledge of an accurate number of affected units ... as there simply is NO available data-base. An estimate of 20 000 units however, regularly does the rounds."

Come 30th September 2020 … ?

Will service providers stop maintaining

non-compliant units?

CONDITIONS FOR USE OF ACCREDITATION SYMBOLS and REFERENCE TO ACCREDITATION (Part I)

Accreditation provides formal recognition that Approved Inspection Authorities (AIAs) for the inspection of Lifts, Escalators and Passenger Conveyors (LEPCs) meet certain standards of quality, performance, technical expertise, and competence.

Once accredited, an AIA is encouraged to use the SANAS accreditation symbol and/or appropriate words ref-erencing its accreditation on its reports and certificates and can also use it in its advertising / publicity material and stationery, in accordance with the rules as prescribed by SANAS (please look out for Part II of this arti-cle). The use of the accreditation symbols or material implying accreditation should enhance the reputation and value of accreditation for all stakeholders. In this two-part article, we will review the conditions for LEPC AIAs to use the SANAS accreditation symbols;

or reference to SANAS accreditation.

General Format and Display of Accreditation Symbols or Reference to SANAS Accreditation

The SANAS CORPORATE LOGO, as displayed below, is for the exclusive use of SANAS and may NOT

be used by any other organisation (including AIAs).

The SANAS accreditation symbols, are designed for each specific field of accreditation. Please refer to the symbol

for LEPC AIAs, displayed below:

• The accreditation symbol or reference to accreditation shall not be used by applicants for accreditation and may only be used once accreditation has been granted.

The accreditation symbol shall be used by an accredited LEPC AIA only under the name or the registered trade name of the legal entity in which it holds accreditation;

The accreditation symbol shall not be used by a LEPC AIA’s external service providers or clients that are not accredited by SANAS;

• Only Technical signatories who have been confirmed as competent by SANAS are authorized to sign re-ports or certificates bearing the SANAS accreditation symbol or referring to SANAS accreditation. (Refer to SANAS R 03 “Nominated Representative and Tech-nical Signatories: Responsibilities, Qualifications and Approval”).

The accreditation symbol shall be displayed only in the appropriate format, proportion, col-our and wording as detailed in Appendix 1 of SANAS document R04.

• An accredited LEPC AIA shall only display the SANAS accreditation number or reference to SANAS accredi-tation with the relevant SANAS accreditation symbol on reports, certificates or documents containing re-sults covered by the scope of accreditation, in addition to all other requirements detailed in SANAS document R04.

Where it is not practicable to display the relevant accreditation symbol, the LEPC AIA is entitled to, without variation, use the relevant phrase with the accreditation number as per below: “A SANAS Accredited Inspection Body, No. LIFT .....” The SANAS accreditation symbol can only be used in combination with the accredited LEPC AIA’s logo, mark and/or name, and without being more prominent than that of the LEPC AIA.

• Use of logos, marks, or names of other organisations on the same document shall not be used in combina-tion with the SANAS accreditation symbol or in any other way which might imply that SANAS has

accredited those organisations.

A SANAS accredited LEPC AIA shall not include anything in a report / certificate or in any other attachment or material that implies or may lead a user of the results or any interested party to believe that a conformity assessment activity is covered by the scope of accreditation when it is not.

• The SANAS accreditation symbol or accreditation claim shall not be:

placed on any product or item (or part of it) which has been subjected to conformity assessment by a

conformity assessment body (except on inspection labels).

used to imply or create the impression that SANAS approves or certifies their product, process, service, management system or person; or

used in any manner which gives the impression that SANAS accepts responsibility for conformity assessment results, or any opinions or interpre-tations derived from those results or approves a calibrated, inspected certified or tested item or product, or reference material.

The LEPC AIA shall not make any misleading or unauthorized statement regarding its accredita-tion. An accredited LEPC AIA shall, upon suspen-sion, withdrawal, or expiry of accreditation, immediately discontinue the use of the SANAS accreditation symbol and cease to make any reference to accreditation status in reports, certificates, labels, promotional material, letterheads, websites, or any other item. (Refer to SANAS R51 Suspensions, Reductions, Withdrawals and Re-instatement of Accredited or GLP/GCP Compliant Organisations”).

The same shall apply to partial suspension, or reduction of accreditation, where only part of the scope is suspended or withdrawn, in which case the LEPC AIA shall immediately discontinue the use of the SANAS accreditation symbol and cease to make any reference to accreditation status (for the scope affected by the suspension or withdrawal) in reports, certificates, labels, promotional material, letterheads, websites, or any other item.
