Training Courses Offered at Westminster City Council

Free professional training opportunity for licensed premises in Westminster

We are pleased to offer licensed premises in Westminster free professional training to tackle irresponsible drinking.

We are currently offering two separate half day courses to achieve the BIIAB Level 1 Award in Responsible Alcohol Retailing (ARAR):

22nd February 2013 – 9.00am-1.00pm

13th March 2013 – 12 noon- 4.00pm

Both courses will be delivered at City Hall, 64 Victoria Street, London, SW1E 6QP.

The BIIAB Level 1 Award in Responsible Alcohol Retailing (ARAR) demonstrates a commitment to responsible alcohol retailing and enables candidates to:

Understand the main points of licensing law

Recognise the responsibilities associated with the retail sale of alcohol Understand the duties concerning under-age sales and serving persons who are drunk

Support the designated premises supervisor to retail alcohol responsibly

Licensing Sub-Committee Reports

Licensing Sub-Committee – Tuesday 15 January 2013 Dirty Martini, 10C Hanover Square, W1 (West End Ward / not in stress area) – The premises operates as a cocktail wine bar. This was an application to extend the proposed hours for late night refreshment at the premises from Monday to Thursday from 00:30 to 01:00 and Friday to Saturday from 00:30 to 02:00 and also to extend the proposed hours for the sale of alcohol for consumption on the premises on Monday to Thursday from 23:30 to 01:00 and on Friday to Saturday from 00:00 to 02:00. The Sub-Committee in granting the application took into account that the venue was not in one of the Council’s designated stress areas and the application was therefore to be considered on its merits. The Applicant had made a commitment during the hearing to remove the sale of alcohol for consumption off the premises from the licence and reduce the hours already permitted on the existing licence for recorded music. The Applicant had agreed conditions with the Police and Environmental Health, including that 2 SIA licensed door supervisors would be employed after midnight. The Police had subsequently withdrawn their representation. Environmental Health confirmed that the premises had traded without any complaints being received, including when temporary event notices had permitted the venue to operate until 03:00 hours. The Plumbers Arms Public House, 14 Lower Belgrave Street, SW1 (Knightsbridge And Belgravia Ward / not in stress area) – Application for a review of the premises licence submitted by a local resident on the grounds of the prevention of public nuisance. The local resident’s particular concern was noise from patrons drinking outside the pub and the lack of management of the outside area in the mainly residential location. Members of the Sub-Committee heard that this was at its worst on Thursday and Friday evenings and during the summer. 8 conditions were proposed by the Applicant, including that a SIA licensed door supervisor was employed particularly on Thursday and Friday evenings and that the outside of the premises was managed so as to ensure that the pavement was not blocked and there was no public nuisance to residents. There were representations in support of the review, including Environmental Health who informed Members that undertakings by a previous Designated Premises Supervisor at the premises to manage the outside area had not been kept to. The Licence Holder’s Representative stated that he was not making the case that the review was not merited but that the situation was not as bad as it had been presented. The Licence Holder was content to accept 5 of the 8 conditions proposed by the Applicant but requested that a dedicated member of staff was permitted to monitor the outside area rather than a SIA door supervisor and that there was no set time when patrons were not permitted to drink outside. The Sub-Committee decided that public nuisance had been created outside the pub and that a SIA licensed door supervisor would be employed after 17:00 hours on Thursday and Friday evenings. Drinking outside the pub would not be permitted after 21:00 hours. Hi Sushi, Basement And Ground Floor, 40 Frith Street, W1 (West End Ward / West End Stress Area) – Granted under Delegated Authority prior to the hearing. Covent Garden News, 31 Henrietta Street, WC2 (St James’s Ward / West End Stress Area) – The premises operates as a newsagent/confectionary/tobacconist shop and an off-licence. This was an application for a review of the premises licence submitted by Premises Management – The Licensing Authority on the grounds of the Prevention of Crime and Disorder and The Protection of Children from Harm. The Sub-Committee noted that there had been instances of the premises selling alcohol to drunks and suspected drunks, including a subsequent prosecution. There had

also been one instance of alcohol being sold to 2 test purchasers under the age of 18. Conditions were proposed by the Applicant, including the requirement for CCTV, that a personal licence holder would be on the premises at all times during the hours when alcohol was permitted to be sold, that there would be no super-strength beer, lager or cider sold and that cans or bottles of alcohol would only be sold in packs of four or more. The review application was supported by the Police. The Sub-Committee viewed the matter extremely seriously and decided to attach the vast majority of the conditions proposed by the Applicant and suspend the premises licence for three months. The suspension would give the Licence Holders the time to amend their operating practices, get the necessary training for staff serving customers and have a different clientele.

Licensing Sub-Committee – Thursday 17th January 2013 Sainsbury’s, Basement and Ground Floor, 1 Berners Street, W1 - Application granted under delegated powers prior to the hearing. The Gallery Soho, 121-125 Charing Cross Road, WC2 - Application granted under delegated powers prior to the hearing. Chaijunt, 24 Brewer Street, W1 - Application granted under delegated powers prior to the hearing. Review of the premises licence for Arabesque, Ground Floor and Basement, 12 New Quebec Street, W1 – The Sub-Committee considered an application by Premises Management - Licensing for review of the premises licence for Arabesque, Ground Floor and Basement 12 New Quebec Street, London. The review of the premises license was sought on the grounds of prevention of crime and disorder and public safety. (i) The licensee had repeatedly allowed smoking in premises that were substantially enclosed,

and therefore in breach of the Health Act 2006.

(ii) Customers had been found smoking inside the premises on the ground floor and outside under the canopy (in an area more than 50% enclosed) on seven occasions between 29 May 2010 and 30 August 2012.

(iii) The previous licence holder had been cautioned for an offence under Section 8(4) of the Health Act 2006 on 23 August 2010 and four members of staff had been successfully prosecuted for similar offences between May and August 2012.

Representation had been received from a local resident supporting the application on the ground of public nuisance stating that customers had remained on the premises on numerous occasions in the last two years beyond the permitted licensable hours smoking water pipes. Members of the Sub-Committee resolved not to take any further action at this stage. This was on the grounds that

(1) Arabesque had been a family business for 12 years, and was now managed by a new

licence holder who had sought to reassure Members that the previous breaches of licensing objectives would not reoccur. It was noted that there had been a number of visits by Inspectors since August 2012, and no breaches of the Health Act 2006 had been observed.

(2) Evidence received in future of customers making noise and found smoking inside the premises and outside under the canopy (in an area more than 50% enclosed) in breach of the Health Act 2006 will give rise to a further review and possible revocation of the granted licence.

(3) Further instances of breaches of licensing objectives will invoke a Court Injunction that has previously been prepared but is currently held in abeyance.

Members of the Sub-Committee also commented on the level of costs that had been incurred by both the licence holder and the local authority in addressing the breaches in licensing objectives.

The changes concern the levelling of the trading area for improved disabled access, the creation of a deli/coffee area with internal partition wall to front part of the premises and a new internal door next to the bar area for staff access only. The new door provides staff access to storage and an office. Current access is gained by leaving the premises and entering through an external door next door. The door will not to be used by patrons. The door is internal and opens onto a corridor leading to storage and office. The new door provides an improvement for current staff working practices. There are no additional areas identified for licensable activities and it has no impact on access and egress for patrons. For ease we also enclose a current plans and pre-application report from the District Surveyor. Given the very technical nature of the proposed changes it was helpful for us to seek formal assistance from the District Surveyor. This event is an afternoon workshop which is a ticketed event for members of the public, maximum of 30 attendees plus 2 staff (including myself). The workshop is about perfume and will include discussion and experience of various fragrances presented by the applicant Elizabeth Ostrom). It is a seated event with attendees at tables. As part of the event, I would want to serve guests a complimentary glass of wine; as this would included in the ticket price, I am therefore applying for this temporary event license. No alcohol will be for sale or served beyond that included in the ticket price. The event does not include any entertainment such as live music or a PA system. The duration of the event is three hours in the afternoon. The venue, Les Senteurs, have offered for me to run this event in their downstairs room and the shop owner has agreed to the serving of alcohol at the premises at this event.
