APPROVE MINUTES Mrs. Quinlisk requested a motion to approve the Minutes from the Regular Meeting, August 16, 2016. Mr. Schramm MOVED TO APPROVE THE MINUTES FROM THE REGULAR MEETING, AUGUST 16, 2016. Mr. Farrell seconded. The motion passed. PAY BILLS Mrs. Quinlisk made a motion to pay bills. Mr. Schramm MOVED TO PAY BILLS AS PRESENTED. Mr. Farrell seconded. The motion passed. Mrs. Quinlisk presented the Fund Status and the Appropriation Status through September 1, 2016. The Township is a pass through to pay the electric bill and does not receive extra revenue by providing this service. Comments Neutral to Proposal: No comments. Mr. Schramm MOVED TO CLOSE THE PUBLIC HEARING ON THE STREET LIGHTING REQUEST FOR THE TRAILS AND THE GROVES OF ASPEN SUBDIVISION FOR (39) LIGHTS. Mr. Farrell seconded. The motion passed. PUBLIC COMMENTS David Brown, Butler County Auditor’s Office, provided and update from the Auditor’s office. He stated the auditor’s office will again be able to return excess fees to local entities. He also stated that the County’s CAFR and PAFR Financial statements are available online.

Ms. McKinney requested a Resolution that the Liberty Township Board of Trustees hereby authorizes the Township Administrator to execute the attached agreement with DeSmet Consulting for Economic Development Consulting Services for an amount not to exceed $6,600.00 from account #1000-110-360-0007. Mr. Behrman requested a Resolution to declare that the owners’ maintenance of 4652 Aspen Drive, Parcel ID # D2020 108.000 016, has been neglected and constitutes a public nuisance per Section 505.87 of the Ohio Revised Code. The Liberty Township Board of Trustees orders the owners to abate the nuisance within seven (7) days; and if such nuisance is not abated within seven (7) days, the Liberty Township Board of Trustees authorizes staff to abate the nuisance and / or contract the abatement and assess the cost to the property tax duplicate. RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that
WHEREAS, the Aspen Trails Homeowners Association has requested that the Liberty Township Board of Trustees establish and facilitate a lighting district for The Groves of Aspen Trails and Aspen Trails Subdivision;
WHEREAS, the Groves of Aspen Trails and Aspen Trails Lighting District will be comprised of 39 lights covering 198 parcels;
WHEREAS, the Liberty Township Board of Trustees will activate the lighting district on January 1, 2017;
WHEREAS, the Liberty Township Board of Trustees will make all lighting district payments commencing January 1, 2017; and
THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees hereby authorizes the creation of The Groves of Aspen Trails and Aspen Trails Lighting District with assessments starting in the 2017 calendar year.

SUMMARY Liberty Township is experiencing strong growth. In addition to the development of Liberty Center, a premier shopping, entertainment and dining destination, the township has attracted significant investments from Cincinnati Children’s, TriHealth and Christ Hospital. To build on this success and attract additional investments from BioHealth organizations, however, the township has identified the need for a strategic road map. This proposal outlines the framework that is necessary to effectively guide the development of the strategic road map as well as its various components. It is based on a proven model that DeSmet Consulting has used to help other economic development organizations as well as businesses successfully chart the course for their futures and achieve their growth objectives. Thank you for the opportunity to prepare this proposal. DeSmet Consulting is excited about the possibility of being a part of Liberty Township’s ongoing success.
PROPOSAL In order to develop the strategy road map, a two-phased approach is recommended. The first phase will consist of pre-work by DeSmet Consulting which will be followed by two facilitated strategic road map sessions with key stakeholders of Liberty Township. I. Pre-Work During the first phase of the consulting engagement, DeSmet Consulting will work with Liberty Township to collect existing competitive information and will conduct additional research. This includes researching and analyzing the value propositions of Liberty Township’s key competitors. This information will be summarized and presented during the strategy road map sessions. In addition, a workbook will be provided to attendees of the strategy road map sessions in advance so they will be prepared to share additional competitive intelligence during the sessions. II. Strategy Roadmap Sessions It is estimated that two six-hour sessions will be needed to complete the strategy road map and its components, a sample of which is on the following page. It is recommended that up to 10 stakeholders attend the sessions. DeSmet Consulting will facilitate each session to help guide the attendees through various exercises that will led to the creation of the strategy road map and Liberty Township’s value proposition. DeSmet Consulting will also prepare handouts for each session. The following topics will be discussed during the sessions:

RESOLUTION TO LEVY SPECIAL ASSESSMENTS TO PAY FOR SUBDIVISION STREET LIGHTING IN LIBERTY TOWNSHIP
RESOLVED by the Board of Trustees of Liberty Township, Butler County,
Ohio, that WHEREAS, the Liberty Township Board of Trustees has the authority to
assess the expense of maintaining the street lights in two equal annual installments in the same manner and times as the taxes are paid and collected in accordance with O.R.C. § 515.08;
WHEREAS, the Liberty Township Board of Trustees will assess property
owners one hundred percent (100%) for the expense incurred in the maintenance of the street lights, not in excess of the special benefits resulting thereto from such lighting, in accordance with O.R.C. § 515.08;
WHEREAS, the boundaries of the said unincorporated districts and said
assessments shall be certified to the Butler County Auditor by certifying a copy of this resolution, in which the Auditor shall annually place upon the tax duplicate for collection in equal annual installments of said assessments for that year pursuant to O.R.C. § 515.11; and
WHEREAS, the assessments, when collected, shall go into the treasury of
the township and used by the Board of Trustees, thereof, only for the said purpose in which they are levied pursuant to O.R.C. § 515.11;

PROPERTIES FOR NUISANCE ABATEMENTS
RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that
WHEREAS, the Liberty Township Board of Trustees has the authority to
assess the expense of the abatement, control, or removal of vegetation and debris pursuant to O.R.C. § 505.87;
WHEREAS, the Liberty Township Board of Trustees will assess property
owners one hundred percent (100%) for the expense incurred in the abatement, control or removal of vegetation and debris in accordance with O.R.C. § 505.87;
WHEREAS, Rick Plummer, Liberty Township Services Director and Bryan
Behrmann, Liberty Township Zoning Director, assert that the maintenance on the properties have been completed; and
WHEREAS, the Liberty Township Board of Trustees has decided that if the
assessed amount is less than $ 300.00 it will be collected in a single (1) year, if the assessed amount is between $ 300.00 and $ 900.00 it will be distributed evenly in three (3) years, and if the assessed amount is over $ 900.00 it will be distributed evenly in five (5) years;
THEREFORE BE IT RESOLVED that the Liberty Township Board of

MEETING SCHEDULE AND MOVE THE MEETINGS TO THE 3RD MONDAY OF EACH MONTH AND MODIFY THE SUBMITTAL DEADLINES ACCORDINGLY
RESOLVED by the Board of Trustees of Liberty Township, Butler County,
Ohio, that
WHEREAS, on December 29, 2015, the Board of Trustees established the 2016 Zoning Commission Meeting Schedule and Submittal Deadlines with Trustee Resolution 2015-205;
WHEREAS, the Zoning Commission currently conducts their meetings on
the 1st Monday of each month and the Butler County Planning Commission currently conducts their meetings on the 2nd Tuesday of each month;
WHEREAS, upon evaluating the zone change process, it was discovered
that by moving the Zoning Commission meetings to the 3rd Monday of each month it would significantly reduce the amount of time that is necessary to navigate through the required process due to the timing with the Butler County Planning Commission meeting;
WHEREAS, Bryan Behrmann, Director of Planning & Zoning, requests
approval to amend the established 2016 Meeting Schedule to move the Zoning Commission meetings to the 3rd Monday of each month and amend the submittal deadlines accordingly;
THEREFORE BE IT RESOLVED that the Liberty Township Board of Trustees hereby approves the amended 2016 Zoning Commission meeting schedule, as attached.

A RESOLUTION IMPOSING A MORATORIUM OF ONE YEAR ON THE CULTIVATION, PROCESSING, AND RETAIL SALE OF MEDICAL
MARIJUANA WITHIN LIBERTY TOWNSHIP
WHEREAS, Ohio House Bill 523 passed both houses of the Ohio state
legislature, was signed into law by Governor John Kasich, and becomes effective September 8, 2016; and;
WHEREAS, new Chapter 3796 of the Ohio Revised Code establishes a medical
marijuana control program within the department of commerce and the state board of pharmacy, which shall provide for the licensure of medical marijuana cultivators and processors, the licensure of laboratories that test medical marijuana, and the licensure of retail dispensaries and the registration of patients and their caregivers; and
WHEREAS, for the purposes of this Resolution, the definitions of “cultivators,” "processors," and "retail dispensaries" are given the same definitions as those found in House Bill 523 and Chapter 3796 of the Ohio Revised Code, which Chapter is effective September 8, 2016; and
WHEREAS, Section 3796.03 of the Ohio Revised Code instructs the department of commerce to adopt rules establishing standards and procedures for the medical marijuana control program within one year after the effective date of that Section; and
WHEREAS, Section 3796.29 of the Ohio Revised Code authorizes a township board of trustees to adopt a resolution limiting the number of, or entirely prohibiting, cultivators, processors, or retail dispensaries licensed under Ohio Revised Code Chapter 3796 within the unincorporated territory of the township; and
WHEREAS, the Liberty Township Board of Trustees seeks time to study whether to limit or entirely prohibit the cultivation, processing and/or retail dispensing of medical marijuana; or, alternatively, to develop and implement regulations regarding the possible location and operation of medical marijuana-related businesses within Liberty Township, including medical marijuana-related cultivators, processors, and retail dispensaries; and
WHEREAS, Township staff require additional time to review and make recommendations on zoning, prohibition and/or limitations of medical marijuana so that any necessary regulations conform to goals of the Liberty Township Board of Trustees and help ensure the public peace, health, safety, and welfare of its citizens; and

WHEREAS, a moratorium of one (1) year on the authorization or establishment of any medical marijuana-related businesses in Liberty Township will allow the Board of Trustees and Township staff time to accomplish the Township’s goals and help ensure the public peace, health, safety, and welfare of its citizens.
NOW THEREFORE, BE IT RESOLVED, by the Board of Trustees of Liberty Township, Butler County, State of Ohio: SECTION 1. That pursuant to its powers under House Bill 532, Ohio Revised Code Section 3796.29, and Ohio Revised Code Chapter 504, the Liberty Township Board of Trustees hereby establishes a moratorium of one (1) year with respect to the authorization or establishment of any medical marijuana-related businesses within Liberty Township, including but not limited to medical marijuana-related cultivators, processors, or retail dispensaries.
SECTION 2. For the duration of this moratorium, Township staff are prohibited
from issuing or processing any permits or approvals for any medical marijuana-related businesses such as medical marijuana-related cultivators, processors, or retail dispensaries within Liberty Township.
SECTION 3. The Board of Trustees directs the Township staff and the Law
Director to investigate and review the implementation of House Bill 532 and Chapter 3796 of the Ohio Revised; Township staff will then make a recommendation to the Board of Trustees with respect to regulations regarding the cultivation, processing, and retail dispensing of medical marijuana.
SECTION 4. It is found and determined that all formal actions of the Board of Trustees concerning and relating to the passage of this Resolution were taken in an open meeting of this Board and that all deliberations of this Board of Trustees and of any of its committees that resulted in formal action were in meetings open to the public in compliance with all legal requirements, including 121.22 of the Ohio Revised Code.
SECTION 5. That the Board by a majority vote hereby dispenses with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and hereby authorizes the adoption of the Resolution upon its first reading.
SECTION 6. This Resolution shall take effect on the earliest date permitted by law.

RESOLVED by the Board of Township Trustees of Liberty Township, Butler County, Ohio that
WHEREAS, the Liberty Township Board of Trustees is authorized by Section 505.87 of the Ohio Revised Code to provide for the abatement, control or removal of vegetation and debris from land in the Township, if the board determines that the owner’s maintenance of that vegetation, garbage, refuse, or other debris constitutes a nuisance;
WHEREAS, the owners and all lien holders of record of the property located at 4652 ASPEN DRIVE, PARCEL ID # D2020 108.000 016, have been provided advance notice of the involved Board of Trustees’ meeting and that an opportunity to be heard on the matter would be provided at such time; and
WHEREAS, the Board of Trustees has determined that the owners’ maintenance of the property constitutes a nuisance and that the abatement of said nuisance is necessary to further the public health, safety and general welfare;
THEREFORE BE IT RESOLVED, that the Liberty Township Board of Trustees hereby approves this resolution to declare that the owners’ maintenance of 4652 ASPEN DRIVE, PARCEL ID # D2020 108.000 016, has been neglected and constitutes a public nuisance per Section 505.87 of the Ohio Revised Code. The Liberty Township Board of Trustees orders the owners to abate the nuisance within seven (7) days; and if such nuisance is not abated within seven (7) days, the Liberty Township Board of Trustees authorizes staff to abate the nuisance and / or contract the abatement and assess the cost to the property tax duplicate.
