Adjustments to charge
The levied charge will automatically increase by the lesser of the following:
(a) The difference between the levied charge and the maximum adopted charge the local government could have levied for the development when the charge is paid; and
(b) The increase worked out using the PPI, adjusted according to the 3-yearly PPI average, for the period starting on the day the levied charge is levied and ending on the day the charge is paid.
‘3-yearly PPI average’ and ‘PPI’ have the meanings given in the Planning Act 2016. As the charge amount stated above is current at the date the notice was generated, the total charges due at the date of payment may be greater.
Offsets and/or Refunds

DECISION NOTICE DECISION TO GIVE AN INFRASTRUCTURE CHARGES NOTICE
Pursuant to section 119 of the Planning Act 2016, on the insert date, the City decided to give this infrastructure charges notice. The date the development application was approved is set out on the first page of the decision notice approving the development application. Appeal rights
You have appeal rights in relation to this notice. An appeal may be made against an infrastructure charges notice on 1 or more of the following grounds:
(a) the notice involved an error relating to:
(i) the application of the relevant adopted charge; or
Examples of errors in applying an adopted charge:
• the incorrect application of gross floor area for a non-residential development
• applying an incorrect ‘use category’, under a regulation, to the development
(ii) the working out of extra demand, for section 120 of the Planning Act 2016; or
(iii) an offset or refund; or
(b) there was no decision about an offset or refund; or
(c) if the infrastructure charges notice states a refund will be given – the timing for giving the refund; or
(d) for an appeal to the Planning and Environment Court – the amount of the charge is so unreasonable that no reasonable relevant local government could have imposed the amount.
To remove any doubt, the Planning Act 2016 declares that an appeal against an infrastructure charges notice must not be about:
(a) the adopted charge itself; or
(b) for a decision about an offset or refund:
(i) the establishment cost of trunk infrastructure identified in a local government infrastructure plan; or
(ii) the cost of infrastructure decided using the method included in the local government’s charges resolution.
An appeal must be started within 20 business days after the infrastructure charges notice is given to you.
An appeal may be made to the Planning and Environment Court or to a development tribunal.
An appeal is started by lodging a notice of appeal with the registrar of the Planning and Environment Court or a development tribunal, as applicable. The notice of appeal must be in the approved form, succinctly state the grounds of the appeal and be accompanied by the required

1. The setback area (Area required approx. 40m²) shown on Transport Plan Sketch prepared by Queensland Government dated 25/05/2017, reference 11B/TP170008 and revision A must be kept free of any permanent buildings, structures and improvements (including car parks, swimming pools and advertising signs) above and below the ground at all times.

2. a) Carry out the development generally in accordance with the report Acoustic Report, prepared by Acousticworks dated 10 August 13 September 2017, and reference 2017094 Revision R01CD. In particular –
i. Construct a 2.3 metre noise barrier in the location shown on Figure 10 of the Acoustic Report, prepared by Acousticworks dated 10 August 13 September 2017, and given reference 2017094 Revision R01CD.

The balance of these mapping anomalies will be considered in March 2018. 3 PURPOSE OF REPORT The purpose of this report is for Council to consider a series of updates to the building height and residential density overlay maps to rectify 246 major building height and residential density anomalies across the city (excluding the Light Rail Stage 3 corridor and the Spit).
4 PREVIOUS RESOLUTIONS On 30 May 2017, Council resolved (G17.0530.018, Committee Recommendation CP17.0524.006):
… 2 That Council proposes to commence a major amendment (Major update 2) to the
City Plan in accordance with section 117(1) of the Sustainable Planning Act 2009 and Statutory Guideline 01/16 ‘Making and amending local planning instruments’.
3 That the scope list for Major update 2 outlined in Attachment 1 be endorsed. …. 6 That further reports detailing the City Plan updates for each scope item be brought back for consideration by the City Planning Committee.
On 25 July 2017, Council resolved (G17.0725.016, Committee Recommendation CP17.0719.003): …
3 That the document titled ‘Building Height Study – An Approach to City Image – Volume 2 – Building Height Strategy and City Plan Recommendations – dated 5 July 2017’ inform amendments to the policy direction for building height in the City Plan as part of Major Update 2 and any other consequential amendments as required, with the exception of principle 5 which will be considered at a later time.
4 That the Mayoral Technical Advisory Committee be engaged in relation to the URBIS Report and proposed amendments to the building height in the City
Plan as part of Major Update 2 and any other consequential amendments as required.
5 That a further report detailing the City Plan amendments related to the recommendations set out in ‘Building Height Study – An Approach to City
Image – Volume 2 – Building Height Strategy and City Plan recommendations – dated 5 July 2017’ be brought back for further consideration by the City Planning Committee. … On 17 October 2017, Council resolved to implement a staged approach to the development of the policy direction for building height. 5 DISCUSSION 5.1 Background Council has undertaken a Building Height Study, which has resulted in the development of an updated citywide policy direction on building height to support the future City image and shape. Through the preparation of this study, it became evident that a more rationalised approach for determining building height, which is based on city shape values and citywide principles that seek to balance the city’s natural landscape values with on-going infrastructure investments and built form, is required.

It is anticipated that this second phase of the review will be presented at a future City Planning Committee in March 2018. 5.3 Alignment methodology 5.3.1 Identification of major anomalies The founding proposition for this alignment exercise, is that the existing zone is the point of truth of the policy position for building height and residential density. Consequently, a major anomaly is considered to be where a designated building height or density on the overlay map/s does not align with the intent of the zone code. The envisaged building heights and residential densities for the zones create a baseline, with an anomaly identified by being either above or below the identified baseline. The methodology used to identify major anomalies is diagrammatically presented in Figure 1. In order to identify major anomalies in the current City Plan mapping, the following steps were undertaken:
Step 1: Review current zone provisions (purpose, overall outcomes, performance outcomes and acceptable outcomes. Step 2: Develop a set of criteria based on direction from the zone code. The full set of criteria is listed in Attachment B. Step 3: Review current building height and residential density designations on the Building height and Residential density overlay maps by applying the criteria. Step 4: Identify the number and location of building height or density anomalies. Step 5: Recommend actions to address anomalies having regard to the intent of the underlying zones.

11.0 City Plan scheduleThe City has committed to an ongoing program of updates to our City Plan.
Major updates are planned to occur on a six-month basis. Minor and administrative updates will occur as needed.
Since commencement of the City Plan, on 2 February 2016, four updates have been adopted.
Seven other updates have been initiated, with four of those open for public consultation between 4 October and 15 November 2017. The timeline below also shows three potential future updates, consistent with the endorsed rolling update program, but which have not been formally initiated.

The ‘urban ground’ refers to the first three or four floors of a building that creates the human scale experience of the city. Podiums are just one building base that contribute to the ‘urban ground’ of a city.

Good design outcomes are usually not contentious or political but desirable policy.
1. City Plan changes
• Strengthening and/or adding design detail and outcomes into all levels of City Plan
2. Improve clarity of the Light Rail Overlay Code
• Podiums are the preferred built form typology in the Urban Renewal Light Rail Overlay in the core and frame area. This covers a large part of the City.
• Clarity around the importance of context is required and its interrelationship with the role and nature of the urban ground.
3. Guidelines
• Design guidelines defining preferred design principles
• Guidelines are not statutory but when endorsed by council can provide a strong direction as to the intent for the city.
