MEETING MINUTES Thursday, December 17, 2015

Members Present: Karol (KZ) Bolton, Lenawee County Commission; Keith Dersham, City of Adri-an; Carrie Dillon, Education; and James Tipton, Blissfield Twp.

Members Absent: Rebecca Liedel, Madison Charter Twp.; Ralph Tillotson, Lenawee County Commission; and Jerry Wilson, Rollin Twp.

Others Present: Grant Bauman, Staff/Recording Secretary

Item 1 Call to order — The meeting was called to order at 6:30 p.m. by Chairperson Tipton.

Item 2 Public comment — None.

Item 3 Approval of Agenda — Staff submitted the meeting agenda for approval.

A motion was made by Commissioner Dillon, and seconded by Commissioner Bolton, to ap-prove the agenda as presented. The motion passed unanimously.

Item 4 Approval of Minutes — Staff submitted the October 15, 2015, meeting minutes for approv-al. The November 19, 2015, meeting was cancelled due to the lack of a quorum.

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to approve the October 15, 2015, meeting minutes as presented. The motion passed unanimous-ly.

Item 5 Request(s) for Review, Comment, and Recommendation

a. Consideration of Township Zoning Amendment(s) — No zoning ordinance amendments were submitted to the Commission for its review and recommendation.

b. Consideration of PA 116 Farmland Agreement(s) — Nine PA 116 applications were submitted to the Commission for its review and recommendation.

(1) #15-18 | Franklin Twp. — Commissioners reviewed a proposed agreement for a prop-erty located in Section 20 (T5S,R3E) of the Township (please see the staff report).

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend disapproval of the application for a lack of adequate information. The mo-tion passed unanimously.

(2) #15-19 | Adrian Twp. — Commissioners reviewed a proposed agreement for a proper-ty located in Section 5 (T6S,R4E) of the Township (please see the staff report).

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend disapproval of the application for a lack of adequate information. The mo-tion passed unanimously.

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend disapproval of the application for a lack of adequate information. The mo-tion passed unanimously.

(4) #15-21 | Palmyra Twp. — Commissioners reviewed a proposed agreement for a prop-erty located in Section 31 (T7S,R4E) of the Township (please see the staff report).

A motion was made by Commissioner Bolton, and seconded by Commissioner Dersham, to recommend approval of the application. The motion passed unanimously.

(5) #15-22 | Raisin Twp. — Commissioners reviewed a proposed agreement for a property located in Section 14 (T6S,R4E) of the Township (please see the staff report).

A motion was made by Commissioner Bolton, and seconded by Commissioner Dersham, to recommend approval of the application if the residence and dooryard are removed. The motion passed unanimously.

(6) #15-23 | Franklin Twp. — Commissioners reviewed a proposed agreement for a prop-erty located in Section 32 (T5S,R3E) of the Township (please see the staff report).

A motion was made by Commissioner Bolton, and seconded by Commissioner Dersham, to recommend approval of the application if the information regarding the leasing of mineral rights is answered. The motion passed unanimously.

(7) #15-24 | Franklin Twp. — Commissioners reviewed a proposed agreement for a prop-erty located in Section 20 (T5S,R3E) of the Township (please see the staff report).

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend disapproval of the application for a lack of adequate information. The mo-tion passed unanimously.

(8) #15-25 | Cambridge Twp. — Commissioners reviewed a proposed agreement for a property located in Section 21 (T5S,R2E) of the Township (please see the staff report).

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend approval of the application if the requested information regarding the number of acres under cultivation or engaged in other uses is provided. The motion passed unanimously.

(9) #15-26 | Palmyra Twp. — Commissioners reviewed a proposed agreement for a prop-erty located in Section 13 (T7S,R4E) of the Township (please see the staff report).

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend approval of the application if the farmstead is removed and the number of acres is adjusted accordingly. The motion passed unanimously.

c. Consideration of Master Plan(s) — One master plan amendment was submitted to the Commission for its review and recommendation.

The City of Adrian proposes an addendum to its City of Adrian 2006 Comprehensive Plan. None of the proposed changes to the future land use map should impact adjacent communities nor are they inconsistent with the countywide future land use map. Therefore, staff advised the

LCPC to state that, in its opinion, the 2015 Addendum to the City of Adrian 2006 Comprehen-sive Plan is consistent with:

The master plans of adjacent municipalities and

The Lenawee County Comprehensive Land Use Plan

A motion was made by Commissioner Dersham, and seconded by Commissioner Bolton, to recommend approval of the 2015 Addendum as recommended by staff. The motion passed unanimously.

Item 6 Other Business

a. Unfinished Business — None.

b. New Business

(1) 2016 Meeting and Submittal Deadline Schedules — Staff provided the proposed schedule of meetings for 2016 as well as a deadline schedule for submitting requests for consideration at a particular meeting.

A motion was made by Commissioner Bolton, and seconded by Commissioner Dersham, to approve the meeting and submittal deadline schedules as presented. The motion passed unanimously.

(2) Reappointment of Commissioner Bolton — Commissioner Bolton’s current term on the LCPC expires at the end of 2015. The Board of Commissioners has asked for input from the County’s various commissions, boards, and committees regarding appointments.

A motion was made by Commissioner Dillon, and seconded by Commissioner Dersham, to recommend approval of the reappointment of Commissioner Bolton to the LCPC. The mo-tion passed unanimously.

Item 7 Public Comment

Commissioner Bolton asked when work on the master plan will resume. Staff indicated that work should resume of the master plan as soon as the draft of the County’s solid waste master plan is completed.

Item 8 Commissioner Comment — None.

Item 9 Adjournment. Chairperson Tipton adjourned the meeting at 7:10 pm.

Petition Description: Proposed text amendments regarding eating and drinking establishments to the Rollin Township Zoning Ordinance

Summary

The Township’s Planning Commission wishes to amend the Rollin Township Zoning Ordinance by adding the following use to the listings of ‘permitted uses after special approval’ in the ‘Local Commercial Dis-trict (C-1)’ [Sec.13.02.4] and ‘Commercial Recreation District (CR)’ [Sec.16.02.10]:

Eating and drinking establishments when food or beverage is consumed within a com-pletely enclosed building. Outdoor dining is permitted when attached to and a part of the indoor establishment. Establishments with a character of a drive-in or open front store are prohibited.

A similar use is included in the listing of ‘permitted principal uses’ in the C-1 District:

Eating and drinking establishments when food or beverage is consumed within a com-pletely enclosed building. Establishments with a character of a drive-in or open front store are prohibited.

The difference is that ‘outdoor dining is permitted when attached to and a part of the indoor establish-ment’ is not included the listing ‘permitted principal uses’. No similar use is included in the listing of ‘permitted principal uses’ in the CR District.

‘Fast food establishments’ are included in the listing of ‘permitted principal uses’ in the ‘General Commercial Dis-trict (C-2)’ [Sec. 14.01.7] and by reference in the listing of ‘permitted principal uses’ in the ‘Highway Service Commer-cial District (C-3) [Sec.15.01.1]. Therefore, the exclusion of ‘establishments with a character of a drive-in or open front store’ from the C-1 and CR Districts does not exclude them from the Township.

Based upon the above analysis, staff advises the Lenawee County Planning Commission to recommend APPROVAL of the proposed additions of Sec. 13.02.4 and Sec.16.02.10 to the Rollin Township Board.
