Legislative Wrap Up
2019 Long Session Roy Cooper, Governor

The 2019 Legislative Session, which began on January 9, 2019, finally came to an end 310 days later on
November 15, 2019. Lawmakers remained in session for an unusually long period as a result of a deadlock
on the state budget, disagreement over Medicaid expansion and transformation, and the redrawing of
legislative and congressional district maps, among other issues. This session, 1,733 bills were introduced;
however, only 287 bills were presented to the Governor for his signature.
Below are highlights from this session.

Budget Highlights
Although the House voted to override Governor Cooper’s veto of House Bill 966, 2019 Appropriations
Act, the Senate did not hold a similar vote this session. The General Assembly will reconvene, however,
on Tuesday, January 14, 2020, and many speculate that the Senate will attempt to override the Governor’s
veto at that time. Despite the impasse, a number of mini-budget bills passed this session to address various
agencies’ needs. Those mini-budgets impacting DPS are listed below:
Session Law 2019-242 (House Bill 111), 2019-2021 Base Budgets/Certain Agencies
Enacts a base budget for certain State agencies, departments, and institutions for the 2019-2021
fiscal biennium.
States the appropriations and funding provisions set out in the bill “shall remain in effect until
House Bill 966, 2019 Regular Session, becomes law, at which time that act shall become effective
and shall govern appropriations and expenditures.”
Salary Increases
State Employee Raises – Session Law 2019-209 (House Bill 226)
Retroactively grants 2.5% raises to employees in fiscal year 2019-2020.
Funds an additional 2.5% in fiscal year 2020-2021.
• Part-time employees will receive increases on a prorated basis.
Awards five days of special annual leave.
Adult Correctional Employee Raises – Session Law 2019-208 (House Bill 609)
Provides a 2.5% increase in the 2019-2020 fiscal year for state employees who are based in one or
more State adult correctional facilities, and were employed in a state-funded position on June 30,
2019.
• Raises will be retroactive to the July 1, 2019 effective date.
Provides a 2.5% increase in the 2020-2021 fiscal year for state employees who are based in one or
more State adult correctional facilities, and were employed in a state-funded position on June 30,
2020.
• Part-time employees will receive increases on a prorated basis.
Continues custody-based pay differential.
Provides $15 million recurring for high-need facility salary supplements.
Awards five days of special annual leave.
Alcohol Law Enforcement & State Bureau of Investigation Raises – Session Law 2019-211 (House
Bill 777)
Provides a 2.5% increase in the 2019-2020 fiscal year for state employees who are employed as a
law enforcement officer of the State Bureau of Investigation or Alcohol Law Enforcement, and
were employed in a state-funded position on June 30, 2019.
• Raises will be retroactive to the July 1, 2019 effective date.
Provides a 2.5% increase in the 2020-2021 fiscal year for state employees who are employed as a
law enforcement officer of the State Bureau of Investigation or Alcohol Law Enforcement, and
were employed in a state-funded position on June 30, 2020.
• Part-time employees will receive increases on a prorated basis.
Codifies a six-year step pay plan:
• Increases Entry Level Salary of agents and officers to $45,100 in fiscal year 2019-2020.
• Increases Entry Level Salary of agents and officers to $46,228 in fiscal year 2020-2021.
Sets a stepped progression of 6.5% per year until reaching $65,807.
Awards five days of special annual leave.
State Highway Patrol Raises – Session Law 2019-126 (House Bill 126)
Provides a 2.5% increase in the 2019-2020 fiscal year for state employees who are employed as a
law enforcement officer of the State Highway Patrol, and were employed in a state-funded position
on June 30, 2019.
• Raises will be retroactive to the July 1, 2019 effective date.
Provides a 2.5% increase in the 2020-2021 fiscal year for state employees who are employed as a
law enforcement officer of the State Highway Patrol, and were employed in a state-funded position
on June 30, 2020.
• Part-time employees will receive increases on a prorated basis.
Modifies the beginning step of the existing pay plan:
• Increases Entry Level Salary of officers to $45,100 in fiscal year 2019-2020.
• Increases Entry Level Salary of officers to $46,228 in fiscal year 2020-2021.
Awards five days of special annual leave.
Division Specific Mini Budgets
ADULT CORRECTION
Session Law 2019-223 (Senate Bill 118), Prison Safety/TANF State Health Plan/Clarifications
Appropriates almost $4.5 million for additional stab-resistant vests and exterior carriers, security
netting, handheld metal detectors, key lockboxes, and IT upgrades for prison mandown technology
and cameras.
EMERGENCY MANAGEMENT & OFFICE OF RECOVERY AND RESILIENCY (NCORR)
Session Law 2019-224 (Senate Bill 429), Disaster Recovery - 2019 Budget Provisions
Allocates a total of $112.6 million for recovery needs from Hurricane Florence and other specified
natural disasters. Of that sum, $22 million will be distributed to NCORR as follows:
• $5 million for mitigation buyouts, relocations, buyout assistance to local governments, and
infrastructure repairs in order to serve homeowners and communities that would otherwise
be eligible for federal Community Development Block Grant – Disaster Recovery (CDBG-
DR) funding, but are outside of the federally designated "most impacted, most distressed"
counties.
• $8 million for the State Acquisition and Relocation Fund which provides gap funding to
storm survivors related to buyouts to move families out of floodplains.
• $9 million to assist financially distressed local governments with staff support and to
provide grants and loans to local governments in disaster areas that need immediate cash
flow assistance.
Session Law 2019-250 (House Bill 200), Storm Recovery Act/Var. Budget
Appropriates $70.8 million in nonrecurring funds for the 2019-2020 fiscal year to the Department
of Public Safety to use as a State match for Hurricane Florence federal disaster assistance programs.
LAW ENFORCEMENT
Session Law 2019-222 (House Bill 75), School Safety Funds, Programs, and Reports
Appropriates funding for eight (8) full-time equivalent positions for sworn agents at the State
Bureau of Investigation.
• Effective January 1, 2020, the positions will support the Behavioral Threat Assessment
(BETA) program and work to identify potential threats to schools and houses of worship.
JUVENILE JUSTICE
Session Law 2019-229 (House Bill 1001): Raise the Age Funding
Appropriates $30.9 million for fiscal year 2019-2020, and $43.5 million in fiscal year 2020-2021
to assist with implementation of Raise the Age. The funds will be allocated as follows:
• Appropriates funds to create five (5) staff training positions, two (2) statistician positions,
three (3) information technology positions and two (2) human resources positions.
• Provides funds to create one (1) facility management position and six (6) field support
specialist positions to support operations at the juvenile detention centers, youth
development centers, and other Division of Juvenile Justice facilities throughout the State.
• Funds 15 transportation positions, effective October 1, 2019, and purchase 29 vans.
• Directs funds to increase bed capacity at juvenile detention centers and support operations
at juvenile detention centers across the State, including those owned and operated by the
State and those owned and operated on a contract basis by certain counties.
• Appropriates funds to create 38 positions at, and cover certain operating expenses for, the
C.A. Dillon Youth Development Center in the Town of Butner.
• Provides funds to create four (4) new school counselor positions that will provide reentry
and placement services, career planning, vocational training, and other services for
juveniles who are preparing to exit secure custody, effective October 1, 2019.
• Directs funds to (i) provide additional funding for contracts for Level II community-based
and residential programs for juveniles who have been adjudicated delinquent and (ii)
create, one contract management position, effective October 1, 2019.
• Creates five (5) positions in the Community Programs section to provide administrative
support and technical assistance and to monitor programmatic quality and fiscal
accountability for Juvenile Crime Prevention Council programs, effective November 1,
2019.
• Directs additional funding to be allocated to the county-level Juvenile Crime Prevention
Councils.
• Appropriates funds to create (and phase in over the 2019-2020 fiscal year) 97 Juvenile
Court Counselor positions that will act as the primary point of contact for juveniles and
their families as the juveniles move through the juvenile justice system, beginning
November 1, 2019.
• Provides annualized recurring funding for the 65 full-time equivalent (FTE) positions in
the Court Services section of the Division of Juvenile Justice authorized in the Committee
Report described in Section 39.2 of S.L. 2018-5.
Enacted Legislation Related to DPS
ALCOHOLIC BEVERAGE CONTROL
Session Law 2019-49 (Senate Bill 11), ABC Regulation & Reform
Requires second or third violations of the ABC laws not involving acts of violence, a controlled
substance, or prostitution to occur within three years in order to result in the imposition of fines.
Increases the maximum fines for violations of the ABC laws involving acts of violence, a controlled
substance, or prostitution occurring upon the premises, and for these types of violations, authorizes
the ABC Commission (Commission) to impose conditions on the operating hours of a business.
Increases from $5,000 to $10,000 the maximum amount the Commission can accept in compromise
in lieu of a permit revocation for certain violations.
Repeals the Commission's authority to issue a permit to a person at least 19 years old who is a
manager of a business, thereby requiring all persons to be at least 21 years old to obtain an ABC
permit.
Allows permittees to seek review of Commission permit decisions before an administrative law
judge.
Modifies the Commission's authority to summarily suspend or revoke a permit upon receiving
certain information regarding an undercover investigation.
Changes the definition of a "private club" to include only establishments that are 501(c) businesses
and that have been in operation for at least 12 months before applying for an ABC permit.
Creates a new definition of "private bar" and exempt them from regulation as a food and lodging
establishment in the same way that "private clubs" are exempt from such regulation.
Provides that permits issued to "private clubs," as defined before this act becomes law, would be
grandfathered and eligible for renewal as a private bar or a private club, as applicable under the
new definitions of those terms.
Session Law 2019-182 (Senate Bill 290), ABC Regulatory Reform
Makes various changes to the alcohol statutes, including provisions allowing distilleries the same
serving privileges as wineries and craft breweries, while also reducing regulation on out-of-state
sales.
Session Law 2019-52 (House Bill 389), ABC/Univ. Athletic Facility
Authorizes public colleges and universities to allow alcohol sales at stadiums, athletic facilities,
and arenas located on school property.
ALCOHOL LAW ENFORCEMENT
Session Law 2019-203 (House Bill 99), Transfer ALE/Move Boxing Advisory Commission
Re-establishes ALE as a division within DPS. However, the Boxing Advisory Commission was
transferred to the Department of Commerce.
ADULT CORRECTION
Session Law 2019-236 (Senate Bill 579), Prison Reform Act of 2019
Directs the Program Evaluation Division (PED) to study alternative organizational and
management structures for the Division of Adult Correction and Juvenile Justice.
• PED shall submit its findings to the legislature no later than November 1, 2020.
Session Law 2019-135 (House Bill 106), Inmate Health Care & 340B
Requires the Department of Public Safety to do the following:
• Develop a plan to increase the use of the Central Prison Healthcare Complex and submit
the plan to the legislature by December 1, 2019.
• Submit various reports.
• Work with the Department of Health and Human Services (DHHS) to ensure social
workers receive Medicaid eligibility determination training regularly and qualify for and
receive federal reimbursement for performing administrative activities related to Medicaid
edibility for inmates.
• Issue two RFPs for developing an electronic inventory system for medical supplies, as
prescribed in the law.
• Study and develop initiatives pertaining to the salaries of all in-prison health services
employees.
• Perform a feasibility study and establish a telemedicine pilot program to provide physical
health services to inmates.
• Partner with DHHS to access Federal 340B Program pricing for medications.
• Plan and issue Requests for Proposals to partner with other entities to access 340B pricing.
• Develop a Memorandum of Agreement with the University of North Carolina Healthcare
Services to allow DPS to realize 340B savings.
Session Law 2019-171 (House Bill 108), PED/Safekeeper Health Care Cost Recov. Pract.
Modifies the data collection and cost recovery practices for health care services provided to inmates
who are transferred from a local jail to the State prison system pursuant to a safekeeping order.
Session Law 2019-134 (House Bill 138), Damage Jail & Prison Fire Sprinkler/Penalty
Effective December 1, 2019, increases the punishment for willfully interfering with, damaging,
defacing, molesting, or injuring any part or portion of a fire-alarm, fire detection, smoke-detection,
or fire-extinguishing system in a prison or local confinement facility to a Class H felony.
EMERGENCY MANAGEMENT
Session Law 2019-187 (Senate Bill 498), Facilitate Response to Disasters
Provides tax and regulatory relief for nonresident businesses and nonresident employees that
perform disaster-related work during a disaster response period at the request of a public utility or
a public communications provider,
Allows the Secretary of Revenue to issue a temporary license to an importer, exporter, distributor,
or transporter of motor fuel in response to a disaster declaration.
Session Law 2019-200 (House Bill 217), DIT Changes. -AB
Enables the State Chief Information Officer to make various changes related to government
information technology support systems, for cybersecurity purposes.
Establishes the 911 Board within the Department of Information Technology (DIT) and requires
the board to prepare a State plan, administer the 911 Fund, implement Next Generation 911 system
capability enhancements, and distribute revenue in the 911 Fund to Commercial Mobile Radio
Service providers and Public Safety Answering Points.
Session Law 2019-89 (House Bill 917), Emergency Declaration/Clarify Rd. Closure
Explicitly provides that a local declaration of emergency includes the authority to close roads and
public vehicular areas to the public within the emergency area during the emergency.
JUVENILE JUSTICE
Session Law 2019-186 (Senate Bill 413), Raise the Age Modifications
Modifies various juvenile delinquency and juvenile justice statutes to facilitate implementation of
Raise the Age legislation.
Session Law 2019-41 (House Bill 617), Allow Repeat Referral to Teen Court
Enables a juvenile to be referred to a teen court program more than once by removing the
prohibition on referring a juvenile to a teen court program if the juvenile has been referred to a teen
court program previously.
NATIONAL GUARD
Session Law 2019-161 (Senate Bill 420), NC Servicemembers Civil Relief Act
Creates the North Carolina Servicemembers Civil Relief Act, which provides protections for
servicemembers during certain civil proceedings and transactions while engaged in military service
and, in some instances, the servicemember’s dependents.
Clarifies the right of a servicemember to take leave without pay from the member’s civilian
employment when called into service of the State by the Governor.
Specifies that military servicemembers may terminate a rental agreement when there has been a
change in station orders, or upon release or discharge from active duty service.
PRIVATE PROTECTIVE SERVICES
Session Law 2019-32 (Senate Bill 381), Reconstitute/Clarify Boards and Commissions
Reconstitutes several boards and commissions that were held to have unconstitutionally appointed
membership.
Makes various corrections and other clarifying changes.
STATE HIGHWAY PATROL
Session Law 2019-228 (House Bill 283), Conner’s Law
Increases the penalty from a Class E felony to a Class D felony for assaulting a law enforcement
officer, probation officer, or parole officer with a firearm.
Increases the penalty from a Class H felony to a Class G felony for assaulting emergency personnel
and causing serious bodily injury or using a deadly weapon.
Increases the penalty from a Class F felony to a Class E felony for assaulting emergency personnel
and using a firearm.
Provides an additional $100,000 death benefit for public safety employees who are murdered in the
line of duty, effective retroactively to qualifying deaths occurring on or after July 1, 2016.
Session Law 2019-196 (Senate Bill 321), Federal Motor Carrier Safety/PRISM
Makes various changes to the motor vehicle laws of this State to incorporate requirements of the
Federal Motor Carrier Safety Administration’s Performance and Registration Information Systems
Management Program.
Session Law 2019-90 (House Bill 747), NC Missing Person Information Sharing
Requires law enforcement agencies to enter information from a missing person report or about
unidentified persons into the National Missing and Unidentified Persons System (NamUS) after 30
days have passed and the person has not been found or identified.
Session Law 2019-157 (Senate Bill 29), Move Over Law/Increase Penalties/Amber Lights
Increases the penalty for those who cause serious injury or death for violating the State’s Move
Over Law.
Makes it unlawful for any vehicle to use a flashing or strobing amber-colored light unless one of
the specified conditions apply.
o Effective December 1, 2019, and applies to offenses committed on or after that date.
LAW ENFORCEMENT
Session Law 2019-48 (Senate Bill 148), Public Records/Release of LEO Recordings
Expands the purposes that law enforcement may release and disclose a recording to include suspect
identification or apprehension, and to locate missing or abducted persons.
Session Law 2019-109 (Senate Bill 191), Out-of-State Law Enforcement/2020 Rep. Convtn.
Authorizes a police department in a city with a population exceeding 500,000 to contract with an
out-of-state law enforcement agency for the use of officers and equipment for a designated period.
Session Law 2019-116 (House Bill 224), Assault w/ Firearm on LEO/Increase Punishment
Makes it a Class D felony to commit an assault with a firearm on a law enforcement officer,
probation officer, parole officer, and an employee of a detention facility.
VICTIM SERVICES
Session Law 2019-216 (Senate Bill 682), Implement Crime Victim Rights Amendment
Implements the constitutional amendment to provide better protections and safeguards to victims
of crime and acts of delinquency.
Session Law 2019-221 (House Bill 29), Standing Up for Rape Victims Act of 2019
Appropriates $6 million over two years to test the backlog of untested sexual assault kits in North
Carolina.
Establishes a process for properly and efficiently testing the kits.
Proposed DPS-Related Legislation – Eligible for 2020 Short Session
House Bill 641, Modifications to Various DPS Provisions
Would do all of the following:
• Clarify that a member of the North Carolina National Guard is not required to use accrued
vacation or other leave from the member's civilian employment for a period of active
service.
• Authorize certain employees of the Department of Public Safety (DPS) to perform
construction, maintenance, or repair work on State property without needing a license
under Chapter 87 of the General Statutes.
• Expand the arrest authority of probation officers.
• Require parole revocation orders to be entered into North Carolina Statewide Warrant
Repository (NCAWARE) database.
• Require an active prison sentence for prisoners who knowingly and willfully expose their
genitalia to prison employees or for those who possess tools to affect an escape or aid in
an assault and require such sentences to run consecutively from any sentences being served.
• Limit the value of an inmate's personal property to two hundred fifty dollars ($250).
• Require inmates to exhaust their administrative remedies under DPS's Administrative
Remedy Procedure (ARP) prior to taking claims for personal injury to the Industrial
Commission.
• Tax court costs to indigent inmates who file frivolous lawsuits.
• Authorize the Secretary of DPS to settle inmate claims of twenty-five thousand dollars
($25,000) or less without approval of the Industrial Commission.
• Require gross negligence by certain employees DPS before DPS is liable in tort for
damages.
• Implement the federal Performance and Registration Information Systems Management
(PRISM) program in this State.
• Make certain communications by emergency personnel privileged communications.
• Establish a Green Alert System for missing persons with posttraumatic stress disorder
(PTSD).
House Bill 630, Protective Services/Alarm Systems Law Changes
Would make various changes to the Private Protective Services Act and the Alarm Systems
Licensing Act.
The bill would also create certain fees.
House Bill 702, Modify Juvenile Crime Prevention Councils
Would modify the law related to Juvenile Crime Prevention Councils (JCPCs), as recommended
by the Juvenile Jurisdiction Advisory Committee (JJAC) as part of implementing Raise the Age
legislation.
