Supports city efforts to conserve, protect, improve, andexpand Washington's urban forest in order to reduce stormwater pollution in Puget Sound, flooding, energyconsumption and greenhouse gases emission, air pollution,and storm impacts to utility infrastructure.

Provides for development of uniform criteria for astatewide community and urban forest inventory andassessment.

Limits grants or other forms of financial aid to citiesand towns that are in compliance with this act.

Requires the department to develop an evergreen citiesrecognition program whereby the department, thegovernor, and a statewide council representing urban andcommunity forestry programs authorized under RCW76.15.020 establish criteria for official state recognition anddesignation of evergreen cities.

Creates a grant program and a competitive awardprogram to provide financial assistance to cities, towns, andcounties for the development, adoption, andimplementation of evergreen cities management plans orordinances.

Requires certain cities, towns, and counties, to adopt anevergreen cities forest management plan and relatedordinances.

Authorizes the attorney general or any resident of acity, town, or county to appeal to the appropriate growthmanagement hearings board issues of local governmentcompliance or noncompliance with evergreen citiesmanagement plan or ordinance adoptions.

Authorizes local governments to accept voluntarydonations.X

Declares the tax imposed and collected under chapters82.08 and 82.12 RCW, less any credits allowed underchapter 82.14 RCW, on initial construction for a highwayof statewide significance to be constructed by atransportation benefit district in a county that bordersanother state and has a population of more than fourhundred thousand, must be transferred to the highwayproject to defray the costs or pay debt service on thatproject. In the case of a toll project, this transfer or creditmust be used to lower the overall cost of the project andthereby the corresponding tolls.X

This authority is subject to theappropriate sovereign tribal nation submitting to the officeof financial management proof of public liability andproperty damage insurance for vehicles operated by thepeace officers, police professional liability insurance, andtraining requirements for each tribal police officer.
