Present were: Mayor Arterburn and Council Members: Gallaway, Gaston, Utley and Nienhueser. Others pres-ent: City Manager Sadler, City Attorney Leef and City Clerk Anthony. Notice of the meeting was given in advance thereof by publi-cation in The Sidney Sun Telegraph, the designated method for giving notice, a copy of the proof of pub-lication being attached to these minutes. Advance notice of the meeting was also given to the members of the City Council and a copy of their acknowledg-ment of receipt of notice is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the notice to the City Council. All proceedings shown hereafter were taken while the convened meeting was open to the attendance of the public.

Mayor Arterburn informed the public of the location of the posted Open Meetings Act.

Gallaway moved, Nienhueser seconded “That the minutes of the January 10, 2017 meeting be approved as printed.” Roll call vote: Yeas: All council members present.

During Comments by the Public: Patricia Finney presented concerns about snow removal in the Historic Downtown as well as public restrooms for that area also. Ice accumula-tion behind her business in the alley was also a concern.

Andrew Sherman, Library Director, present-ed the Annual Report for the Sidney Public Library. Gaston moved, Nienhueser seconded “That the Annual Report for the Library be

accepted.” Roll call vote: Yeas: All council members present.

Discussion was held on the proposed changes to the City Code which would allow for liquor consump-tion on City-owned prop-erty as well as update it to the State Statutes. Addition of an appeal process was requested by majority of the Council. ORDINANCE NO. 1784 entitled “AN ORDINANCE TO AMEND CHAPTER 612 ALCOHOLIC BEVERAGES SECTIONS 612.01 THROUGH 612.99 OF THE SIDNEY MUNICIPAL CODE IN ITS ENTIRETY ; TO REPEAL SUCH SECTIONS AS HERETOFORE EXISTING, AND TO PROVIDE FOR THE EFFECTIVE DATE OF THIS ORDINANCE” was read by title for the second time. There being no motion to waive the third reading, the Ordinance will be on the 2/14/17 agenda.

City Manager’s Report: The second round of bonds was sold last week at a lower interest rate than last time. He is advertising for Economic Development Director again. Interviews for a Golf Director will begin on Monday, the 30th. FYI – Knox boxes will be installed on many of the municipal buildings.

Council Comments: Mayor Arterburn: Thanked Sherm for the excellent report on the activities of the Sidney Public Library. He also read a thank you note from the Chamber of Commerce which expressed their gratitude for Keven Kubo’s building services at their building. Other Council Member’s Comments: Roger thanked the staff for installation of the additional outlet on the Council bench in order to facilitate the computers used for the agenda pack-ets. All were interested in when Charter will be pro-viding the promised servic-es. The deadline for that is January 25, 2017 and if no action has been taken, the City Manager will promptly contact Charter.

The Mayor recessed the meeting for a short break before the Work Session and then opened it again in open session for the Work Session as follows: 1. Street; new streets, maintenance of older streets, possible truck routes, enforcing exist-ing laws regarding where large vehicles can park. 2. Possible schedules for mowing city owned proper-ties. 3. Utility Rates and possible re-structuring. More work sessions will be held in the near future.

CALL TO ORDER: President Jed Benish called the meeting to order at 6:30 p.m. Members pres-ent: Jed Benish, Kevin Henke, Cary Linton, and Rob Rushman. Members absent: Colleen Cruise and Jennifer Powell. Also pres-ent were Superintendent Greg Brenner, Principal Lance Howitt and Recording Secretary Janella Kruse. In addition, there were four visitors. Moved by Mr. Rushman, seconded by Mr. Linton to approve the agenda as amended. Motion approved 4-0. Communications were read from Ann Hurt and Cindy Reilly. The 5th grade class also submitted indi-vidual letters of apprecia-tion. BUSINESS MEETING: Moved by Mr. Rushman, seconded by Mr. Linton to approve the minutes of the Board’s regular meeting for January 9, 2017. Motion approved 4-0. Moved by Mr. Linton, seconded by Mr. Benish to approve General Fund bills and financial reports as pre-sented. Motion approved 4-0. Moved by Mr. Henke, seconded by Mr. Rushman to approve bills and finan-cial reports from the remaining funds as pre-sented. Motion approved 4-0. ACTION ITEMS: Moved by Mr. Linton, sec-onded by Mr. Henke to grant Special Recognition to the 5th grade students and teachers for an out-standing job with their Wax Museum projects; to the Cheyenne County Spelling Bee placers, Ethan Eckhardt (3rd) and Hannah Vath (6th); to Sierra Nickel for being selected to the Chadron State High Plains Band/Choir; to the recipients of the Nebraska Chiropractic Physicians Association Academic All-State Fall Awards (One-Acts: Josh Kruse, Paige Ernest; Football: Kenny Ernest, Morley Haley; Volleyball: Hope Dykman, Taylor Berner); to the HS Boys’ Basketball team for being MAC Tournament Champions; to the HS Girls, JH Girls, and JH Boys’ basketball teams for being MAC Tournament Runner Ups; and to Ted Watchorn for donating a framed copy of the Constitution. Motion approved 4-0. Moved by Mr. Benish, sec-onded by Mr. Linton to accept, with regret, a res-ignation letter from Mrs. Shirley Melton (1st Grade Teacher). Motion approved 4-0. Moved by Mr. Benish, seconded by Mr. Henke to approve Cary Linton as a Leyton Public School Foundation Board member. Motion approved 4-0. DISCUSION ITEMS (WITH POSSIBLE ACTION): Mr. Linton presented the Building & Grounds report and will have more details at the Board Retreat. Discussed the need for a new route bus. The Transportation commit-tee will gather informa-tion for the Board Retreat. President Benish will call Board members to sched-ule the date for the retreat.

REPORTS: Mr. Howitt reported on attendance at the parent-teacher conferences; basketball sub-districts; the 6th, 7th, & 8th grade sci-ence fair (February 15th); winter break (February 17th); state cheer and dance (February 17th & 18th); teacher in-service (February 20th); MAC Speech & JH Quiz Bowl (February 22nd); National FFA week (February 19th-26th); 5th grade Mardi Gras parade (February 28th); and UNK Job Fair (March 14th). Mr. Brenner reported that the technol-ogy committee will meet in March and that we are close to 1:1. He also reported on the hazard mitigation plan and the need to work with local fire departments in the future to look at mass evacuation plans. EXECUTIVE SESSION: Entered into executive session with general con-sent at 7:32 p.m. to pro-tect the reputation of the Superintendent. Returned to General Session at 9:30 p.m. by general consent. TIME AND DATE OF NEXT REGULAR MEETING: The next regular meeting of the Leyton Board of Education will be Monday, March 13, 2017 at 6:30 p.m. The meeting will be held in the district’s adminis-trative offices at Leyton High School in Dalton.
